I understood there was some precedent for throwing out illegal votes in those case. Here's a page I found describing that point of view, I haven't read it yet myself.

Re:Death of Taxes
By the way, so you know - the US constituition does *NOT* mandate that you have to pay a tax on your income.

Re:Taxes suck, but why not?
You don't have to pay income taxes in the US. The US constituition has a law which mandates that *corporate* income is taxable - not personal income.

IRS needs a court order for any action against you
Now why did the media not make that a top story? Did you hear about this?
If the IRS needs to go to a court and have a hearing before issuing a levy or seizing any property, then you get notice of that hearing and can ask them where the hell they get the jurisdiction and then they have to prove jurisdiction.
They never had jurisdiction in the States, and they can't tax the people directly, it's been a big bluff all this time.
Search around the net, read and get informed, then you need to understand how much the media is under government control.

Groups like this....http://www.givemeliberty.org is currently working on our tax problems..sure some, probably all of you think that taxes are normal and this group is a bunch of whack-o's, BUT, be they correct or not, they are standing up for what they believe in. We need to shoot down all these freedom destroying laws that are being passed.
It is a crying shame that the bulk of the American people are letting their freedoms, their liberties be eroded by the federal government. National ID Card? No Thank You...
They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety.

They have no teeth! They never have a court order!
Jan 2005 - "IRS Summonses apply no force to taxpayers, and no consequences can befall a taxpayer who refuses or ignores, or otherwise does not comply with an IRS summons until that summons is backed by a federal court order."
Second Circuit Court of Appeals Schulz v IRS (Case No. 04-0196).
Can they get a court order? That's the point, they have no authority to do anything to you, and have no jursidiction so that is the first thing people will bring up and the case is thrown out!
The problem has been that they didn't give you your day in court so you could ask any simple questions before taking your house!
Read the site and learn! -
The tax system is FAKE! 2nd circuit court 2005
http://givemeliberty.org/
Second Circuit Court of Appeals January 2005 ruling in Schulz v IRS (Case No. 04-0196).
The recipient of an IRS administrative summons "cannot be held in contempt, arrested, detained, or otherwise punished for refusing to comply with the original IRS summons, no matter the taxpayer's reasons or lack of reasons for so refusing."
In Schulz, the Court also held that "IRS Summonses apply no force to taxpayers, and no consequences can befall a taxpayer who refuses or ignores, or otherwise does not comply with an IRS summons until that summons is backed by a federal court order."
Why is this important? If you don't know that, you need to go get a clue. Basicly, they can't do anything to you till a court orders it, and in a real court (this is not "tax court") you can ask for their delegation of authority that they never have, let me spell it out, they have no authority or jurisdiction in the several states, go get a clue.
Are you stupid enough to keep on paying them? -
The US Code is Open SourceIf you take the time to muddle through Title 26, you'll likely come to the conclusion thousands of other people have:
The US Federal Income tax, as currently codifed
Doesn't make the natural person liable for the tax.
Would be unconstitutional if it did.
Is illegally enforced.
And many of those people, won't pay it. So my conclusion is you really don't need any income tax software. I don't.
A good place to start reading about the truth of the Federal Income Tax is GiveMeLiberty.org
They have active lawsuits that are making progress. Last month the Second Circuit Court ruled:
"IRS Summonses apply no force to taxpayers, and no consequences can befall a taxpayer who refuses or ignores, or otherwise does not comply with an IRS summons until that summons is backed by a federal court order."
The IRS response in their appeal:
"the Court's opinion threatens to seriously impede the effective administration and enforcement of the nation's tax laws."
Boo-Hoo.
You'd think federal court ruling that essentially strips the IRS of 90% of their scare tactic enforcement power would be news worthy, but don't hold your breathe for the CNN report.
And to the normal "You're going to sing-sing for this" replies:
Just because people suffer at the hands of judges does not mean they aren't RIGHT! It's called TYRANNY you spineless morons!
It's a lot easier to jeer someone for taking action against a dangerous government, then for YOU to enter harms way and stand up for yourself.

Re:Slightly OT: RIAA & MPAA Law Suits
I am still looking into this Article I/III issue, but to response to my "other wacky Consitutional options saying income tax is illegal"
(Note: I don't say it is illegal, just not needed to be paid by regular folk. There are people who need to payit but not 98% of Americans)
I will refer you to (BOTH of these are Surpeme Court decisions.):
FRANK R. BRUSHABER, Appt., v,UNION PACIFIC RAILROAD COMPANY. (Too long and nothing worth quoting out of context)
Or STANTON v. BALTIC MINING CO, 240 U.S.103(1916)
I quote (emphasis mine):
"But, aside from the obvious error of the proposition, intrinsically considered, it manifestly disregards the fact that by the previous ruling it was settled that the provisions of the 16th Amendment conferred no new power of taxation, but simply prohibited the previous complete and plenary power of income taxation possessed by Congress from the beginning from being taken out of the category of indirect taxation to which it inherently belonged, and being placed [240 U.S. 103, 113] in the category of direct taxation subject to apportionment by a consideration of the sources from which the income was derived,-that is, by testing the tax not by what it was, a tax on income, but by a mistaken theory deduced from the origin or source of the income taxed."
For more info see:
This PDF will lay it out better than I can.
Thank you for listening! I hope you continue to investigate with an open mind. I think you'll be surprised. I started on this because I tried to disprove someone as you are doing now. -

Re:Er...
Isn't giving the government your encryption keys like testifying against yourself? And isn't that not required by the fifth amendment?
If you are a tax cheat, isn't giving the government your financial records like testifying against yourself? Not according to the Supreme Court.
<rant>
Well... at least in 1927. In 1894, income taxes were declared unconstitutional. So along came the 16th amendment to change all that.
But... the 16th amendment was never properly ratified.
Apparently, the Constitution has not mattered for a very long time.
While on taxes, I would like to note... the USA is 7.2 trillion dollars in debt. 13% of this years budget is devoted to paying interest on that debt. This year's budget deficit is 300 Billion dollars. The Baby Boomers have the government living beyond its means and expect Generation X to:
- a) pay for it
- b) pay for their retirement
- c) do without the benefit of social security.
Neither candidate in the next election is a fiscal conservative. So we'll have four more years of budget deficits either way. The rigged electronic elections will just be for show. Provisions of the Patriot Act may expire, but Section 213 does not sunset. And just when you thought all the news was bad, the MPAA is teaching our children about copyright, complete with cash and prizes.
</rant>
Um, back to the topic... Yeah, I think the Ronald Reagan defense is your best strategy in that case.

Re:Just grit your teeth and pay it
You just successfully defeated the purpose of what the federal constitution was designed to do. The United States of America was established on the mantra against oppressive taxation. One of the platforms they set up was that there could be no tax on goods shipped from state to state. The intent was
A. To create the ultimate free trade zone. (For a prosperous Nation)
B. To penalize a state from excessively taxing it's people. (Because people would just purchase things out of state.)
As far a use tax goes. They have a separate form in Ohio for Use Tax. It is Clearly labeled on top 'voluntary'.
But the bastards added a line to the income tax return?? YES. Which raises the question, Is this legal?
It depends if the Income tax return is mandatory or voluntary also. If it is voluntary then yes, it would be completely legal.
The question weather the state income tax return is Voluntary depends on weather the state passed a law making the citizens liable (Ohio doesn't use the words liable for income tax but they do for sales tax) although it must also be considered on how they expect you to fill out a Income tax return based on federal returns that no law makes you liable for.
givemeliberty.org addresses the issue in the new article about Irwin Schiff
"Therefore, if the Government will simply produce at my arraignment a Code Section that similarly makes this defendant 'liable' for income taxes in the same clear and unequivocal manner as Code Sections 4401, 5703 and 5005 [that] make persons 'liable' for Federal wagering, tobacco, and alcohol taxes, this defendant will plead guilty at his arraignment and save himself and the government the expense of a trial."
Income taxes are destroying American productivity and Free Trade throws Import taxes (federal governments legitimate taxing power) out the window and moves jobs overseas so you can loose your high paying manufacturing job and get a low paying job at Wal-Mart (now US largest employer).
(To all the gutless Americans out there) Thank you for your participation in the destruction of the American economy.

Re:Yeah, I can see this working. *cough*
the honor system doesn't work
Doesn't it?There are people out there who say that there is no legal requirement to pay income tax to the federal government. I read last night about a guy that used to work for the IRS who resigned after doing his own research and coming to the conclusion that these people actually have a case. He hasn't filed a return since 1999.
How these people propose to fund the building of the roads that they will march on in protest is unclear, but it's an interesting case they put forward from a legal point of view.

Re:We pay interest on all money in circulation.
Ah, but these quotes do not contradict the parent, since they do not outright say that the Federal Reserve is in any way owned by the US Government... which indeed it isn't!
However words "within the government" quoted from the Fed's site are very misleading, since few people suspect that this alludes to the Fed's status as a privately held corporation which is able to wield governmental authority.
Yes the Federal Reserve corporation does derive its authority from the US Congress, which is precisely the illegal part. Congress is not constitutionally permitted to delegate this function.
Why do you think states like Nevada are rebelling against the Federal Reserve, introducing bills to legalize their own state currency?
Check here for a list of serious grievances knowledgeable folks have with the Federal Reserve system.
Actually the "Fed" is indeed a private corporation. Its shareholders are known to be major banks, such as Chase Manhattan, Citicorp, etc.
(And the "federalreserve.gov" should not enjoy a ".gov" top level domain either!)
For more information, see Test Your FED I.Q.
The parent post stating the Fed is a private corporation is 100% factual, and its former +5 mod was indeed appropriate, so mods... please restore the post to visibility.
Lastly, I've taken enough Economics to know that the politically incorrect facts tend not to get any coverage in such classes. -
Re:The only downside of Slashdot
Most of you don't have any reportable "income" in the first place. The fact that you pay taxes is your own damn faults for writing anything other than $0 on a tax return and signing it. The moment you sign it, you just swore that you owe that amount, under penalty of perjury. Take the fifth and don't sign the damn thing. And, "income" in the constitutional sense of the word means corporate income. As individuals, most of you don't have "income" and will never owe "individual income taxes" in your entire life. But you keep paying them, oh well. Send me some too, since you're so willing to just give it away. And before you say "its the law", please be sure to cite the law. givemeliberty.org if you really care to learn more.

Re:Right to privacy
I think the Fourth Amendment is kind of a sibling to the Fifth Amendment. Whereas the Fifth protects us from having to testify against ourselves, the Fourth protects us from having our bodies, homes, things, and records (including electronic?) testify against us, at least without some kind of due process.
Interesting to think how the IRS "persuades" us to give up all our financial information then, in order to pay a "voluntary" tax, isn't it? "'Volunteer' your info, or go to jail." The tax protesters have a point. Otherwise why would the government back out of facing them directly?

Re:And, we have no one to blame but ourselves.
Couldn't have said it better myself. In fact, I've been saying this alot lately.
- just say NO to publicly-funded campaigns
- plausible alternative to finance reform (thread), with further elaboration
- another plausible alternative for limiting government
Of course, the best way to limit government is to de-fund it. Without a ridiculously inflated budget, gov't couldn't afford to trample our lives. Why won't the IRS and DoJ answer a few simple questions?
Only two "major" parties advocate Constitutionally-limited government: the CP and LP. I hope you're voting for them.

SSN is voluntary...but difficult to live without
SSN is not exactly voluntary-- you are supposed to get one if you are a citizen.
Absolutly false. There is NO LAW requiring someone to get a SSN, and many people do no have them based on religous objection. You can read two Social Security Adminstration letters stating this here and here. (PDF's) If you research the law behind the letters you see what they claim about the I.R.C. is misleading. A common practice by the government.
However try to do anything without receiving this mark of the beast. Our lives are a that of second class citizens. I assure you, tell someone up don't have a SSN and you will be delt scowes of hatered and discriminated against extensivly.
National ID is already here in the form of the drivers licence linked to the social security number. With the formal acceptance of it in name by the populus, life in the US for anyone not willing to accept the position of a government slave will be unbearable, and infact, deadly. -
