Actually, there IS land ownership on the moon. For a small admistrative fee, you can claim moon property from the Lunar Embassy, a very small international organization who put in a land claim for the whole of the moon decades ago, and have been managing the official deed records for moon property ever since. Individuals can purchase land from various lunar real-estate resellers in their own countries - usually for less than $20 an acre.

It still remains to be seen if deeds to land on the moon will be honored by individual world governments, though. There's never been any legal challenge to one.

Yes, but those treaties do not prevent individuals claiming the moon. So this guy claimed it. I just checked the Lunar Embassy website, and it mentions a bunch of accolades he's got from the National Republican Congressional Committee, but that is not his reasoning why he owns it.

I still think it's not the greatest purchase in the world, it's not like you can nip over there for a weekend to enjoy your patch.

Well the guy states in his faq 1(which is a little hard to find) that according to a law setup in the UN 1967 Outer Space Treaty that no government body can own extraterrestrial property, but gave no indication about individuals. So I dunno how it would fare in court one way or another.. but I have a feeling we might find out if a lunar base comes to pass.

This is going to be interesting to see how the man that "laid claim" to the moon is going to handle people that he's sold property to. I wonder how he will respond to the government building a base on "his" territory.. Hmmm wonder if this will turn into a court battle?

According to them, they got "two former US presidents" among their clients, so, it's possible the ranks of the stupid includes a judge, and that's all you need to create a precedent in some countries...

Outer space, including the moon and other celestial bodies, is not subject to national appropriation by claim of sovereignty, by means of use or occupation, or by any other means.

I think this was an incredibly shortsighted viewpoint on the part of the U.S. government back in 1967 (when the treaty was signed and ratified by the U.S. Senate), but at the time most of Congress felt that we would never get even to the moon, much less be able to build any resonable space colonies, the Apollo program not withstanding.

Private ownership of extraterrestial bodies is not expressly forbidden, but the mechanism for being able to grant that ownership and the legal machinery to even file for ownership is simply not in place. There are a few people who are still trying, even without formal sanction.

Personally, I think both are total scam artists along the lines of people buying stars to name after friends and relatives. Still, this is more or less harmless fun regardless of these so-called land claims. If the USA doesn't have soverign claim to the moon, there is no way that the Lunar Embassy could possibly have legal claim through the land office of the U.S. government at San Francisco (the Lunar Embassy's claim to fame in this case).

What is going to have to happen is some legal machinery to decide what laws apply to events that happen on these planetary bodies. For example, if you kill somebody on the moon, can you be convicted in the U.S. court system? Don't be too hasty here, because remember, soverign authority doesn't apply anymore.

What about copyright laws? Do they apply in space as well? (Recording contracts are now starting to cover extraterrestial distribution rights due to a recording company executive worried about who owned distribution rights to music the Astronauts in the Apollo program were playing.)

So far these issues haven't been dealt with because for now all places except for the Apollo missions have been built on the Earth, and soverignty claims can be resolved. If you kill somebody on the ISS, it would matter what module you killed them in, then it would be either Russian, U.S.A., or E.U. courts that would be authorized to prosecute based on what module the crime happened in. That would still be a big mess, legally speaking (not to mention the physical mess on the ISS itself).

I'm using murder here because that is a crime that would not be lightly brushed under the table if it were to happen in space. Lesser crimes like tax evasion (like what happened during the flight of Apollo XIII when John Swigert forgot to file his income taxes before he left) would probabally wait or could be sorted out without a big international incident.

I think this also solves rather nicely who or what would be able to enforce land rights on a place like the moon. If they can lock you up in jail and confiscate your personal property, they can also grant you real estate rights.

I would personally hate giving this power to the U.N., but at least that is an international organization that could in theory be able to establish these property rights. Just imagine though that the U.N. would also be able to pass civil laws for ordinary people and levy taxes. That's why I wouldn't want them trying to decide what would happen on the future homestead for my grandkids.

The only real legitimate route at this point is going to be the creation of a wholly new soverign entity that has no relationship to any of the signatory members of the Moon Treaty.

That's 4 years from first stepping out into space to landing and stepping out onto the moon. The current plan is not to step on the moon within 4 years

you must remember that some of the R&D work is already done.

Not really. R&D work done 40 years ago is worthless today. You can't build things (Saturn V, LEM, what have you) the same way since the suppliers for even the most basic parts (back then) are long gone. Easier to redesign from scratch than to try to reenact history. But we all know how fast, cheap, and effective NASA has become in the spacecraft design department, right? Not.

Why hasn't the Lunar Embassy been contacted about this?

From what I learned, there is a large body of national and international law about space that rests on this treaty and a few others (space liability, rescue and return, etc.) and throwing this one out is unlikely. But, these treaties do have a fundamental problem in not providing any mechanism for private property rights in space, nor particularly envisioning any sort of settlement process. There are a large number of ideas for how to fix this - Alan Wasser's proposals mentioned in the article are one of them. There's also Declan O'Donnell's United Societies in Space that advocates extending common law rules to outer space, and of course there's the Lunar Embassy that's taking advantage of the current ambiguities to sell property on the Moon and other bodies.

What's needed is a push from the US State Department to get these things resolved - there are apparently individuals there who would know what to do to get a new treaty worked out or current treaties amended, but there's been absolutely no support from higher up for it. Write your congressmen or directly to the State Dept. to express your views if you feel a legal property regime for outer space is important!

A declaration of ownership was filed with the United Nations as well as the US and Russian governments 20 years ago by Mr. Dennis M. Hope of the Lunar Embassy, to ensure that a legal basis for the ownership of the properties sold here can be claimed. On that wonderful day in 1980, the Lunar Embassy was born.

If this sounds like a joke to you, please read on, because this is no joke. The sale of lunar property has been ongoing for 20 years by the Lunar Embassy, which are THE ONLY COMPANY in the world to posess a legal basis and copyright for the sale of lunar, and other extraterrestrial property within the confines of our solar system. In 1996, we opened our first web site, the MoonShop, which was the first Internet website ever, to be selling properties on any extraterrestrial body.

Within 9 months of opening the MoonShop, the Lunar Embassy was showered with Internet awards and an overwhelming press attention worldwide, which is continuing today. At the time of writing, the Lunar Embassy has appeared on TV in over 180 countries worldwide on approximately 80 different TV channels, including CNN International, RTL, NBC and Australia Channel 9 to name only four. There have been literally hundreds of press articles and radio shows covering the Lunar Embassy and its offers, which are literally, out of this world. Hope of the Lunar Embassy, to ensure that a legal basis for the ownership of the properties sold here can be claimed. On that wonderful day in 1980, the Lunar Embassy was born.

The sale of lunar property has been ongoing for 20 years by the Lunar Embassy, which are THE ONLY COMPANY in the world to posess a legal basis and copyright for the sale of lunar, and other extraterrestrial property within the confines of our solar system. In 1996, we opened our first web site, the MoonShop, which was the first Internet website ever, to be selling properties on any extraterrestrial body.

Within 9 months of opening the MoonShop, the Lunar Embassy was showered with Internet awards and an overwhelming press attention worldwide, which is continuing today. At the time of writing, the Lunar Embassy has appeared on TV in over 180 countries worldwide on approximately 80 different TV channels, including CNN International, RTL, NBC and Australia Channel 9 to name only four. There have been literally hundreds of press articles and radio shows covering the Lunar Embassy and its offers, which are literally, out of this world. There are now three other Internet pages that try to sell properties on two extraterrestrial bodies in the solar system, to which the Lunar Embassy hold the claim, and on top of that, all are more expensive than us, in every respect. Unfortunately, they are doing this in a highly irresponsible manner, to the disadvantage of any unsuspecting customer. One even calls themselves "consulate"to copy the Lunar Embassy. You have been luckier. You found us first. You will not get a fake Rolex for twice the price. You will get the real thing, at the correct lower price.

WE THE LUNAR EMBASSY are the only recognized world authority for the sale of lunar and other planetary real estate (including Mars) in the known solar system. Please be advised that any others are copy cat companies without authority, soliciting your money for unauthorized products.
