It's hard for us to understand why this analyst group (a husband/wife team) is respected enough that lots of large companies (he claims Microsoft and most PC manufacturers) pay him, and lots of press quotes him.
Since he has so much industry support despite his really poor writing style I guess these companies must think he knows something.
Beyond his reports, though, it's really hard to find anything in support of SCOs position, though.
So I guess the reall issue is whether or not Enderle is some sort of psychic visionary, or just a well-payed microsoft shill.

Does your life lack a cause?There are people who get up every day, work a 9 to 5 and go home to their families trading their lives for varying degrees of cash. In my view, though clearly not theirs, they are selling their lives very cheaply. These are wage slaves and the difference between people like that and a zombie is generally lost on me. Do you realize that many, I'm not saying all or even most, of the Linux supporters are like this, they have never coded anything in their lives, have never even played a video game, in fact the only reason they are supporting Linux is because it is a cause and their life lacks one. That is an incredibly sad group of folks, and I wonder what their reaction will be when they finally understand they are supporting software and not the second coming.

SCO yes SCO for making a complete idiot of themselves and suing IBM for a product (Linux) that they don't even own. Also for other such hilarious comments as Linux doesn't exsist, Linux is just Unix, and we no longer offer Linux to our customers

SCO's Unix Business could still survive
Looking at SCO's SEC filing you can see that their $7.3 million loss is roughly equal to the " Cost of SCOsource licensing revenue" (i.e. legal fees). Their Unix business itself is still (marginally) profitable. I'm willing to wager that some of their other costs (like marketing) are also related to the ScoSource FUD campaign. Now factor in the cost of lost goodwill and lost sales. If SCO would just quit the ScoSource business and stop alienating potential customers, it would actually make a profit. They are being killed by their own FUD machine.
The ScoSource unit managed to make $678K while costing $7.3M. I wonder how much of that $678,000 was from the IP-in-Linux scam versus licencing actual UNIX technology to third parties.
I think that Darl & company are finally starting to wise up to the fact that they are killing their own company. That is why they are starting to de-emphasize the legal strategy and cut their losses. The whole lawsuit was nothing more than a get-rich-quick crap shoot. Now finally they are realizing (at least I hope they realize) that few people get rich quick and they should instead concentrate on growing their UNIX business to make a (modest) profit. -

Pennies worth
Yes, I would pay for a free software subscription. I even occasionally click on google ads while searching to buy a particular item. But it would be a long time before I spend $299 that I might pay for a complex app that really meets my needs. Yes you can make money from side business if software itself is free, but probably not enough to cover writting software in the first place. Perhaps enough to cover distribution and minor bug fixes.
Of course support can be expensive, but that's only for corporate customers, and even then many free apps can be "supported" by googling for info. What kind of questions about Firefox are worth $100 a pop?
Let's just accept that most free software is written as a hobby, as an academic project or for personal use. Linus didn't set out to make great riches, and as far as I know he didn't. If you are trying to make money off either free or pay software that other people are willing to write and maintain as a hobby, well you should have known better. -
Going back to their roots, too bad they're rotted
IBM has transformed Linux from a bicycle to a Rolls-Royce, making it almost an enterprise-class operating system.
I find it interesting that he's using a metaphor found in SCO's original complaint -- paragraph 84:84. Prior to IBM's involvement, Linux was the software equivalent of a bicycle. UNIX was the software equivalent of a luxury car. To make Linux of necessary quality for use by enterprise customers, it must be re-designed so that Linux also becomes the software equivalent of a luxury car. This re-design is not technologically feasible or even possible at the enterprise level without (1) a high degree of design coordination, (2) access to expensive and sophisticated design and testing equipment; (3) access to UNIX code, methods and concepts; (4) UNIX architectural experience; and (5) a very significant financial investment.
He's also going back to the original portrayal of the case as being about "stolen" code, rather than about contract disputes. Unless he's taking SCO's interpretation of the contract disputes to such an extreme that he would indeed agree and assert that IBM "stole" code from SCO by the act of writing it themselves. -

SCO's prior art
So is SCO going to sue Microsoft for infringing on their claim to sudo
They already have prior art in the form of asroot in SCO OpenServer. For those who aren't familiar with it, asroot allows an adminstrator to authorize certain users to run certain commands, well, 'as root'. Since it requires a 'data store' of which users are authorized to run which commands, there is definitely prior art.Of course, it's quite possible that the prior art involved is that of the programmers working on the original Xenix product for MS.

You're being overly literal minded and arguing semantics. How charmingly sophmoric! Even more charming that your argument is wrong. However, unfamiliarity with the English language might be the least of your problems. Your big problem is that you stated that SCO never claimed to own copyrights to code in the Linux kernel. That has made my job easy; I have only to find a single instance where SCO has made such claims. So far, I've given you three.
My advice: In the future, avoid making hard to defend generalizations, especially when you are basing them on the utterances of a company famous for it's double-talk. Learn to read between the lines and to understand implications. SCO might have thought they were safe making implications, that if they tap danced hard enough they couldn't be pinned down, but their words are coming back to haunt them, and IBM is nailing them down with those very words. This might be too subtle a point for you to catch, however. -

Thats precisely what they've done. Look here in the initial press release. Search for "copyright", and you won't find it. You'll find:
- the owner of the UNIX operating system, announced today that it has filed legal action against IBM (NYSE:IBM) in the State Court of Utah, for misappropriation of trade secrets, tortious interference, unfair competition and breach of contract.
Then head on over here, and you'll find a multi-page document on how great copyright is, and how all these big bad Linux companies hate copyright. Blah, blah, blah.. DMCA is also good.. GPL is unconstitutional.. Blah blah.. FSF undermines copyright and patents.. Blah blah..
Where is the accusation that IBM put code that it owns copyright of into the kernel? Lets look at one of the infamous teleconference calls with McBride:

They talk about copyright all the time, but never say we own the copyrights to JFS, NUMA, RCU, etc and IBM put them in the kernel. They don't say that, because its not true. They would be sued for slander and libel if they said that. -

Don't fall into Microsoft's trap.
It should be painfully obvious by now that Microsoft's current MO (aside from funding the litigious bastards at SCO, and their current astroturf campaign about patents) is to lead everyone in the wrong direction about what "free" means (i.e. gratis instead of libre) and then tear down any claims made by that assumption.
Don't fall into Microsoft's trap. When talking about open source with colleagues, customers, etc. make sure they know about the true benefits. Lower TCO is part of the picture (and it does have a lower TCO when anyone not reciving Bill Buck$ is doing the measurement), but there's also the ability to interchange components at will, and the ability to interchange vendors at will, which gives everyone more leverage with their vendors. With open source, everyone wins except for software companies who have built their businesses around lock-in.
If nothing else, this whole thing should serve as a stellar example of why the phrase "open source" is an order of magnitude more versatile than the ambiguous "free software." There's no confusion as to what it really means. -

What if lots of us bought 1 share of SCOX?So... with the stock now trading at $4, and Sharebuilder.com available to make it super-cheap to buy and hold small numbers of shares ($4 for an "automatic" purchase of any number of shares, but selling is priced more traditionally, around $15 for most people)...
would it be interesting for lots of people with an interest in the SCO v. Linux matter to individually purchase single shares of SCOX?
Market cap is $62M, shares at $4 and change, that's about 15M shares outstanding... per Yahoo, over 75% of the shares are tied up in big holders, so individuals could not attain a controlling interest (http://finance.yahoo.com/q/mh?s=SCOX)
but... being an owner of even one share of stock makes the company accountable to the shareholder, with the attendant expense of keeping track of the shareholder, and responding via shareholder relations to shareholders' inquiries.
Shareholders also have the right to nominate directors at the 2005 annual meeting, and to introduce shareholder resolutions to be considered at the annual meeting. Note that as of the 2004 annual meeting, the next meeting was expected to happen around April 19, 2005, and that such proposals are due WELL in advance (4 months anyway)

No proposals have been submitted by stockholders of the Company for consideration at the Annual Meeting. It is anticipated that the next annual meeting of stockholders will be held on or about April19, 2005. A stockholder may contact the Corporate Secretary of the Company at its headquarters for a copy of the relevant Bylaw provisions regarding the requirements for making stockholder proposals and nominating director candidate

I just whipped out my credit card, and bought 10 SCO IP Licenses. We should all buy our licenses now, and avoid trouble with the BSA later.
By the way, I just got my patent for "electronic communication", and bought the patents for streaming media from Acacia. My fee is $10k per device (device defined as any individual component, including but not limited to telephone, cordless phone, modem, wireless network card, wireless network AP, router, switch, and cable), plus 10% of any company which may derive income from my patents.
