I am so sick of people accociating having source code avaliable the same thing as free.
I personaly feel that no software should be considered copyrighted unless it is sold with its source code.
Just because the source code is open doesn't mean they can't charge for the product, sure, the linux/gnu comunity don't do it now, but they should. If I buy MS office, there should be a cd or two with source code. I shouldn't be able to get redhat for free, but if I pay for it, I should get the source code.
I don't care for free, paying other people to do things that I don't want to do, or that I can't do, is how society works. What I want, is the source code avaible to prevent abuse such as what we have seen from many vendors besides just microsoft. Also, I like the ability to control things that are mine. Weither its to tweak it, fix it, or even break it.
You know, you may actualy have the court throw it out as a law suit on the basis that they are claiming your breaking a law, not just a contract, and this should be a criminal case. Thats much easier to defend, as they need evidence. Also takes a whole let resources, but IANAL.
What scary is this type of stuff already happens, and is being pushed more. It is not very far from what you joke about now. But that is exacly what they want.
a few years ago with the last company I worked for. I had a friend who quit and got a better job elsewhere. However, he was asked if he could do after hours work and he would be paid, well he loved this since he gets to play arround with another network and not have to get things working.
Well, what happened is, he never charged, the local admins (me included) was canned. All because of this guy (well the economy being a big part)
What sucks is I told this guy what would happen, and well, 2 people ended up canned over it, and they have a network that doesn't work. (most the sun systems are in storage)
actualy, I would say using 3.0 insted of 2.6 would be for corperate reasons. Look how MS has used the big jumps in version numbering (no.1 or.001 patching). And look to see how much money corperate america spends on them.
Also, Sun did this, they went from 2.6 to 2.7 and called it 7, and now 8, etc.
Personaly, what I'd like to see is 1.2.11 (Version.Features.BugFixes) Meaning its version 1 with 2 updates for featers and 11 fixes of bugs. Adding to the Version number would usualy be when breaking previous protocalls/apis/etc or a complete rewrite.
When you say you can't argue the "hammer analogy " with the fact it its flawed. It is actually the copyright laws that are flawed.
Copyrights and other IP laws was used to give ideas and so forth a substance so to speek. However it lacks any sort of balance.
For example, corporations have benefits and costs. Some of the benefits include (but not limited too): Owners are protected, and can lose only what they put in. But Tax twice, yes, I know stock options negate this to some extent.
See, what happens, is that the corporation is considered an individual, and actually has some rights so to speak that come with it. Such as ownership. And is considered an individual entity.
The same thing needs to be done with "IP". It needs to be treated as a physical object in good and bad ways.
Good way: You can make money off it and people can not copy it. Bad way: it is now theirs, and they can do what ever they like with it. Also, the makers are subject laws that are used in all manufactured laws. If it doesn't work as advertised, breaks and takes things down with it, costs lives, etc.

By preventing MS from getting more, SUN is staying alive. MS has been for years trying to take over SUN (Server) market. Look what happened to Novel. (well novel had 2 problems, 1 being tcp/ip and the other being MS) But MS has a monopoly (desktop, etc) and is pushing it into the server. SUN is trying to make it so they are needed as servers, not ms as everything. MS brakes openGL, java, html, javascript, everything they touch. They don't touch things they don't plan on taking over and turning it into another monopoly, or to streathen a monopoly.
What SUN should be doing, is working closely with a few linux distros, to get it to work great as a client to its servers. And to get it to run java perfectly, and fast. SUN doesn't need to sell Linux to beat back MS, but they think they can make money using linux, when all they need to do is make it stronger as a client.
That was one of the big reasons for me to use kde, everything else about kde alreaedy sucks. intergreated web browser, bah! Bloated and slow, bah! Intergreated.net framework, double bah!

Actualy, your wrong, a goverment can exist without taxation. Many churchs exist souly on volentary contributions, and some churchs do not pay clergy. This could be extended into goverment.
How effective that would be is another issue. But I think a fact most can aggree on, is that taxes can be cut 1/2 (or more) and still have a very effective government, and would be better.

Basicaly shows us, that most the stuff we do, is perfectly leagle, RIAA/MPAA and friends are looking to grab more momey. They don't want you to back up anything, because they can make money selling it again. They don't want your friends to watch your copy, they don't want you to watch it more than once w/o paying more either. They also don't want to have to produce anything, and just tax us.
Hrmm, I think someone who uses MS sql thinks themselves to know what is being talked about. Most real DB's bypass the OS/File system and write directly to the disk.
This is done mostly for reliability, sicne the OS will cache things and tell the application that it is written before its actualy commited to the drive.

my understanding has been, they only need to make the source code disks availiable to those who bought the product.
Well, aol behind the sceens is anti-ms, and pretty linux friendly, I would say they just might release a linux version of aol.
And that might also be the worst virus to hit linux ever too.
