    When the legislation doesn't give you a clear answer in a legal dispute, the courts must decide the outcome, using principles of law, international agreements and more.

    When a similar dispute comes to the courts, it is important that the it is treated equally, so precedent is applied.

    Another reason for why precedents are important in civil law systems, is that it is a principle of the rule of law that rules be foreseeable. If courst would not follow their precedents, people would not be able to plan their actions according to a clear rule, as they can with precedents.

    I fount a "Proposal for a DIRECTIVE OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on measures and procedures to ensure the enforcement of intellectual property rights", I don't think it has been approved yet, but it gives companies in the member states these kind of enforcement rights.

    I hope this will not be made into a directive, it goes against so many individual rights.

    This defense definetly applies when you're using an app that requires IE, but if you're just locked down in the sense that you can't install Firefox, then I recommend that you use portable firefox [mozdev.org] .. It's meant for portable usb drives and such, but you can download it to your "personal folder" or what not, to use within the company's network.

    I use it at my school, with great success. No installation required.


    The mods didn't seem to fond of it then ;)

    We have something in Scandinavia (in Iceland at least) called dolus mixtus cum culpa, that is, when your intent is on doing something unlawful, but the results are more serious than you expected (like death resulting from a heist), it is treated the same as if he intended on killing the guy all along.

    It's the same here in Iceland, our government is slowly changing our free4all higher-education schoolsystem to an only-if-you-got-loads-of-money-will-you-get-a-good -education type system, a la america.
