I don't play video games but I wanted to chime in on the television, radio, and internet comment.
Television - I don't have cable nor can I pick up FTA channels because of where I live. The internet can fill this void very easily. I have a subscription to MegaVideo to watch the few shows I enjoy, otherwise I will rent/buy the DVD set when it comes out.
Radio - I have Sirius. All music stations are Ad Free. However I can't seem to get a hold on my addiction to Howard Stern, Bubba The Love Sponge or Jay Thomas.. so I do hear ads on channel 100 & 101. I don't mind because I know the talent needs their breaks to go to the washroom, etc. etc.
Internet - Adblock Plus is my best friend here. Works awesome. I know some people don't use Firefox, but that's not my problem.

Yes, it sounds crude, but Howard Stern taught me how to brush my teeth. Don't brush your teeth - if you brush your gums gently, your teeth will get brushed anyway. Brush the outside (front) and inside (back) of your gums and kiss your cavities goodbye. Flossing is also an important and oft-ignored part of dental health. Yes, it's anecdotal, but suffice it to say that I haven't had any cavities since I started doing this.
As a side note: It really sucks to see an attractive person who obviously doesn't floss because when you get within 3 feet of them, the breath is unbearable. Floss daily and brush your gums. -

that's not how the FCC operates
You are misinterpreting how the FCC polices indecency. It doesn't watch channels. It responds to complaints that provide transcripts of the alledgedly offensive broadcasts. The PTC and other American Moralists have been streaming complaints against Howard Stern for over a decade. That's why he's been getting fined.
The Oprah Winfrey example clearly illustrates the hypocrisy in how the FCC arbitrarily chooses to levy fines. If you're a friend to the mainstream, you're safe. If you're outside the status quo, watch out.

XM vs. Sirius Adverts
IT used to be when you go to Howard's Site you got a nice, big XM ad on the top right. Now when you go there it shows a Sirius advertisement.
I'm just curious why he would make such a change? I hope he hasn't signed anything binding with Sirius that would potentially keep him off XM since they have better channels, better compression, and more listeners. -
Stern the flip--flopperWhat's funny is that this morning (and weeks previous), Stern's website had banner ads plastered ALL over for XM Radio. Now I go look and it's Siris ads.
Methinks XM signing Opie & Anthony pissed Stern off something fierce, and there's no way in hell he's going to admit that publicly. Best way to stick it to XM and ClearChannel (and make a $gazillion) -- join Sirius.

Social Engineering

I think that the people who are going to profit from this the most will be guys like Howard Stern (if he's still on the air). He'll ring up anyone he wants and pretend to be working for some fake government agency while the nimrods on the line will be in fear if they have caller id. Oh the laughs... until the FCC has their way with Stern and shut him down.
How many kids are going to get into serious trouble with this service?
Let's not even start talking about all the wonderful social engineering that can now be performed with this great service. "This is Bill Gates. I forgot my password. Give it to me."
So all ye lawyers, would the owners of Star38.com be in the doghouse for this service when the masses start using it as a launchpad for social engineering? I'm thinking, hell yes (but IANAL). -
look at the bigger picture
Freedom of Speech is not just an issue that affects speakers. It affects listeners. Decency is being used to quiet people in the media who have been critical of the current administration. The definition is intentionally vague such that it can be applied arbitrarily against political enemies.
Think I'm exaggerating? Check out the case where some stations broadcasting Howard Stern were fined by the FCC because he described (without profanity) what a 'Blumpkin' is. Meanwhile, stations broadcasting Oprah Winfrey are not fined when one of her guests defined what 'tossing salad' means.
I do consider the current terorist threat to be serious. Way more deserving of attention than gay marriage, which the republicans in the Senate spent all week trying to ban. But I also think that as a country, we've proven time and time again that our freedoms are more important than human lives. That's why we send soldiers into battles-- for our freedoms.
Movie/radio studios may be fined for not abiding by it but it isn't affecting your level of freedom whatsoever and the role of the gov't is to protect the views of the many over the views of the individual, otherwise there is no reason to be voting on anything if the majority means nothing in this country anymore.
I know this will sound condescending, but please ask your teachers about the validity of what you've said here. The original framers of the Constitution couldn't disagree with you more. Consider this quote from James Madison:
The traditional American philosophy teaches that The Majority must be strictly limited in power, and in the operation of government, for the protection of The Individual's God-given, unalienable rights proclaimed in the Declaration of Independence and, therefore, of the rights of The Minority--of all minorities.
How about this other quote from James Madison:
No majority, however great even all of the people but one Individual--may properly infringe, or possess the power to infringe, the rights of any minority, however small--even a minority of a lone Individual.
Movie studios, by the way, are not at risk of fines from the government. There is no government regulation of content restricting movies, books, newspapers, cable TV, or magazines. Just broadcast radio and television. Somehow, our civilization has survived through the onslaught of bare nipples and four-letter words found in these other media formats. -

Could someone explain to me why Howard Stern can say something, and it's "indecent", but if Oprah uses the same language, in the same setting, in the same way, it's magically *not* indecent?
...yeah, that's what I thought. Somehow the current administration seems to have forgotten about "equal protection under the law". Maybe it was that big Constitution-burning party they had right after stealing office. -
Censorship
Gosh, how do you post to this thread without looking like a troll?
I know the topic of censorship is near and dear to the Slashdot community. I hope people can see that the right wing has a history of using money to censor media outlets in this country. This is a good example of that as is the holy war the FCC has declared on broadcasters.
The liberals in this country want open and free discussion. the conservatives think that they can get away with censoring the liberals by labeling everything opposed to them as indecent.

Now it is all starting to make some sense ...
Many people wondered why Clear Channel was so quick to dump the Stern show in six markets without putting up any kind of a fight.
While at first they presented themselves as being truly ashamed of the "Indecency" over their airwaves, it seems now that they were supporting the FCC in a very public arena so they could work themselves into a position where they can influence FCC policies. It probably doesn't hurt that they are a huge corporate donor to the Bush campaign.
On a recent Stern show episode, Howard suggested holding concerts in major Clear Channel markets to combat their growing power. With this latest news we have all the more reason not to support them and their anti-competitive policies.

I do agree with you that there needs to be a clear and objective standard as to what is indecent. But I can't beleive that describing oral sex, in great detail, to an 8 year old girl can in any sane society be considered anything else than indecent.
The irony is that Oprah recently broadcast a far more explicit description of oral sex than Howard Stern ever has (transcript) and no-one is looking to fine Oprah. While the transcript from Howard's show is filled with euphemisms and code words that would go right over a child's head, the Oprah show spelled it out in plain English.
Which do you think is more damaging to an 8-year-old child?
Howard's show is usually over by 10:30am, probably before most kids' first recess, while Oprah is on after school in many markets. I have a hard time believing that properly supervised kids have either the access or the interest in listening to Stern for it to even be an issue.
In any case, like you, I agree there should be some standards; let's just define them clearly and objectively and apply them equally to everyone. -

Yes it is about to be violated. The FCC is fining the radio stations, and soon the artists themselves for 'indecent' content, but no one has given them the authority to decide what is indecent. There has been no trial to decide what is indecent, and if you poll people, the majority would not think his show is indecent. His free speech is being violated because the government is arbitrarily imposing financial restrictions on the broadcasting stations. Go read about it at his site

Make Howard Stern and other comedy shows PG-13, and don't hold them to the same standards as the Super Bowl halftime show or the Evening News.

Howard Stern's Required Reading
What is so insane is that the rules for profanity are completely inconsistent. Oprah can have a show talking about "tossing salads" which include a detailed description of what that is, but if Howard Stern says it, he will get fined.
This is a problem for several reasons:
1) Our freedom of speech is killed because we can be fined into bankruptcy for talking edgy, so obviously people will be more careful of anything that they say
2) freedom of speech is completely killed because the FCC can decide months later if what you said was profane, so the feedback mechanism is completely messed up.
3) initial rulings on profanity can be "overruled" by the FCC, meaning that political agendas can be enforced through the FCC now

7 192Is that true? If you said "well screw that!" for Windows XP, perhaps you'd be interested in Linux, which can be downloaded freely from the Internet! You can install it on as many computers as you want to; there essentially is no license to violate (there's a license, but it's completely different -- the GPL http://www.fsf.org , which simply says that if you make changes and sell the changes, you have to provide the source code with it). And the complete source code is available, for free!
There's a new company, Lindows.com, http://www.lindows.com which is rewriting Windows from scratch, so they can run Windows games under Linux. Many programs already run under Linux, using an emulator called WINE http://www.winehq.org which can handle 90% of the Windows calls -- and which is constantly being improved, a new version being released every two weeks.
It would help your listeners greatly if you would mention this. The alternative is free, and open -- it comes with the source code, so if there's a bug, or a feature you'd like to see, you (or someone you pay) can easily modify the source. No waiting on hold with Microsoft Tech Support and being ignored because your problem isn't important enough. Any programming shop can fix your problem.
Most Windows programs already run on Linux, and it's only going to improve from here! I have no financial interest in this (I'm retired), I simply want to help your listeners make the better choice. Those with cable modems or DSL can download a CD image in 10-20 minutes, then burn it onto a CD and install it on all their friend's computers, completely legally.
Freedom is killer. That's what this country was based on. Especially in these unstable times, we need to protect freedom. Please help spread the message -- there's a free alternative.

Thing 1PS It would be really cool to have recordings of your shows available on your web site. I'd love to hear the segment where you discussed Windows XP. Please consider it. You could even sell ad space in the recordings, for a separate revenue stream. Sure, some people will FF through them, but most will have it on while doing other things. I can help set this up if you like.
PPS You may also want to let your listeners know about the piece of legislation Senator Hollings is embarrased to discuss, but is promoting because of payments from the entertainment industry. It's called the SSSCA, and will kill the technology industry -- all digital devices will be required to have strong copy protection, which means writing "hello world" will require a Computer Science degree to protect the output. It also means the death of the open source industry, which is what created Linux. It's a response to the Napster-like ability of all media to be digitally transmitted, at no cost, with perfect copies. It's a new world; just as we lost the buggy whip industry when automobiles came around, we will lose the "media conglomerates" -- but they'll try to stop progress by buying legislation, and that hurts everybody. Imagine if you couldn't make mix tapes. That's their future. Again, choose freedom. Thanks.
