SCO isn't thinking!
You need to read the stuff that Novell just put out , they have their correspondance with SCO which is very illuminating.
Go to Groklaw and read the Asset purchase agreement yourself. You can see first hand, just how full of shit SCO is, and exactly what rights they have.
Novell never sold any patents to SCO, that is blatantly written in the asset purchase agreement. SCO probably has few if any copyrights to Unix, the document describes copyright transfer conditions, which SCO has not met. SCO and Novell have actually registered many of the same copyrights to the same Unix products (I have no idea who really owns them but both companies can't claim exclusive ownership of the same copyright). It seems what they really bought was the right to use and sell Unix, not own it free and clear. People are stupid, that is the one thing I have learned from all of this. It makes me wonder how many bogus lawsuits have been settled over similar bogus crap in the corporate world. It also makes me wonder just how smart these hotshot lawyers are. This whole episode shows me just how empowering a distributed network of people can be, like the open source community. -
Twist to the storyThere is an interesting twist to the story if you read the Spat between Novell and SCO posted yesterday.
If you look a the letter on 6/24 from Novell to SCO (partly quoted below) they disputes SCO legal rights to enter into a new agreement with Microsoft.
As voiced yesterday a lawsuit by Novell against SCO is almost certain. They are currently trying to Audit SCO's records in an effort to bring their ducks in row, and presto. Once the suit over Copyright et al is filed SCO effort to get more money will be impossible. On an aside head over to Groklaw and read about SCO's effort o hire a sales manager for their non-existant IP in Linux.

It has come to our attention that SCO may have violated these provisions. In particular, SCO reported in a recent securities filing that SCO has established a program to review existing licenses, and enter into new licenses, relating to UNIX and that this effort "resulted in the execution of two license agreements" during the quarter ended April 30, 2003. The securities filing states:
The first of these licenses was with a long-time licensee of the UNIX source code which is a major participant in the UNIX industry and was a "clean-up" license to cover items that were outside the scope of the initial license. The second license was to Microsoft Corporation ("Microsoft"), and covers Microsoft's UNIX compatibility products, subject to certain specified limitations. These license agreements will be typical of those we expect to enter into with developers, manufacturers, and distributors of operating systems in that they are non-exclusive, perpetual, royalty-free, paid up licenses to utilize the UNIX source code, including the right to sublicense that code.

Increase the burden on SCO
A side letter clarifying the parties' understanding of the Software Agreement, also dated February 1, 1985, states (in paragraph A.2) that:
Regarding Section 2.01, we [AT&T] agree that modifications and derivative works prepared by or for you [IBM] are owned by you. However, ownership of any portion or portions of SOFTWARE PRODUCTS included in any such modification or derivative work remains with us.
The agreements between AT&T and IBM, as amended, including the side letter (the "Agreements"), thus provide for a straightforward allocation of rights: (1) AT&T retained ownership of its code from the Software Products ("AT&T Code"), and the Agreements' restrictions on confidentiality and use apply to the AT&T Code, whether in its original form or as incorporated in a modification or derivative work, but (2) IBM retained ownership of its own code, and the Agreements' restrictions on confidentiality and use do not apply to that code so long as it does not embody any AT&T Code.
I found that quite interesting, mainly that this appears to directly contradict SCO's claim that they own all AIX code as it is derived from "their IP"

Interesting that the music industry is mentioned.In the letter titled: "Letter to Linux Customers" and SCO's lawsuit against IBM" from SCO to Novell (and other Linux customers), Daryll says:
"Similar to analogous efforts underway in the music industry, we are prepared to take all actions necessary to stop the ongoing voilation of our intellectual property or other rights."
And in response to the specific piece Jack Messman says in his response:
"In your letter, you analogize SCO's campaign against the Linux community to that of the record industry against major corporations whose servers contained downloaded music files. There are crucial differences between the two campaigns. The record industry has provided specific information to back up its allegation, while SCO steadfastly refuses to do so. In its allegation letter, the record industry provides evidence of allegedly infringing activity that is specific to the targeted company. This offers the company real notice of the activity, sufficient information to evaluate the allegation, and an opportunity to stop the activity if it determines the allegation is true. If SCO wants to compare its actions to that of the record industry, it should follow the example set by that industry and present specific evidence of the alleged infringement."
At the very least, read this entire response from Novell to SCO regarding it's letter to Linux customers. Jack has pretty much voiced *all* the concerns that the Slashdot community has come up with in a direct letter to Daryll.

I'll tell you, though, selling Microsoft projects is MUCH easier than selling Linux projects. The average non-technical business person has some exposure to MS and Windows. "Linux.. isn't that software that was written by a bunch of non-professional hobbists and Chinese Hackers in their spare time, and there's no support for it? What if something goes wrong? We're trying to run a mission critical application here, not some hobby system!"
And you pointed out that Linux is supported by such fly-by-night operations as IBM, Novell, Hewlett-Packard, and RedHat, right?
If you're not attempting to address such factually-inaccurate opinions, then you're not doing your job. That is, if you're serious about offering Linux projects as an option...

Novell recommends that you take the courses that prepare you for the Linux Professional Institute Certification (LPIC) level 1 to obtain the baseline knowledge that will best ready you for the course on Novell Services.
Yes they do, the FAQ simply is stating that they recommend you take a course to pass your LPI Requirement before taking the CLE. I've been to the Novell/IBM Linux Seminar and they specifically said that they DO require the LPI Level 1 to be eligable for the CLE. If you had read more then the FAQ you would have known this.
Huh? This story *is* about the Novell Certified Linux Engineer course and certification. I think you're the confused one. It clearly states in the FAQ on the Novell website that LPI certification and classes are not required for the class or the test, but they are recommended.
I am not confused, the LPI is most definitely required for the CLE test, but not for the class (though it is recommended). It clearly states this in the link I have posted above, and Novell's staff will verify this if you inquire for additional verification.
You should check your facts before you call someone "wrong on so many levels." Again, my point is that Novell is calling someone a "Certified Linux Engineer" when all they are really testing the person on is their ability to install Novell's Linux-based products on Linux. It's kind of like Oracle teaching someone to install Oracle on Windows 2003 and calling the certification the "Oracle Certified Windows 2003 Engineer".
First off, you don't eat your feedback. Secondly, I am not wrong as I've attested to, and finally it is not synonymous with your analogy because the LPI is supposed to guarantee a base proficiency that they are adding to. If that isn't the case it's a failure on the part of the LPI and not Novell. I'd like to close by saying I'm sorry if you took offense, but I do think the Slashdot readers deserve factual information, and I tried to make the point that you had been confused between the test and the study course. -

It appears the poster has confused this with the Novell Certified Linux Engineer study course, and his general impression is that he has some kind of anger at the lack of developement behind Novell's certification proposal.

I was one of the first 200 people(got a nice leather jacket as a gift) to receive Novell's CDE Certification. There were 2 written tests along with a 2 hour practicum in which you remote into a 5 server-farm setup at Novell and fix a lot of broken shit(probably left over by an MCNE). These lab tests definitely seperate the men from the boys. I had NDS experience since it came out with Novell v4 and I can tell you no matter how many books you read on NDS if you did not have experience there is no way you could have passed. The servers and NDS are messed up in such a way that fixing one problem may make you unable to fix the remaining--so you really had to know what was going on, and which problem to tackle first.

The Novell Practicum test for the Novell Certified Linux Engineer (Novell CLE) will require you to prove your Novell Nterprise Linux Services knowledge in a "real life" setting. Your knowledge of both Linux and Novell Nterprise Linux Services will be tested.
The practicum is basically a remote connection to a live server bank with Linux installed. Using the remote access session, you will be given a scenario with tasks to complete. These tasks will include configuring Novell Services on Linux, performing basic Linux tasks, and may even get into some troubleshooting.
You will need to perform these tasks just as you would in a real environment. You will be evaluated automatically on each of the servers and will you receive a pass or fail exam result. The length of the exam is estimated to be about two hours.
There is no "written" test anticipated at this time.
For once, there is nothing written, and you actually have to demonstrate proficiency! No more "wannabes" (*cough*MCSE*cough*) merley memorising and getting the Certification. -

Sounds like iFolder to me.
iFolder, for those that don't know, is Novell's distributed folder. Work done on any computer is synchronized with a server and automatically distributed and backed up to all other clients authenticated as the same user and running the iFolder client. A simple concept that proves decidedly valuable.
I attended a conference, today actually, about Novell's jump into Linux and iFolder was stressed again and again as an excellent cross platform synergy device. I was thinking through the whole conference that couldn't you just do this with CVS, but then I realized iFolder's true advantage.
iFolder lets you authenticate against a netware tree, access with far less hoops to hop through, and provides easier administration (through iManager or ConsoleOne).
Just something I thought you should checkout if CVS doesn't quite fill your needs.
