However, even cursory examination of the Reuter photos show obvious Cut&Paste manipulation.

The points you raise are valid in general, but for this discussion, it only looks like you're trying to dilute the issue down.

Adjustment Layers allow you to specify a type of manipulation (like Contrast, or Gamma Curves, or Hue, etc), the manipulation value, the overall opacity, and specify a Mask to go with the adjustment. Layers under this adjustment layer retain their original values, but look modified as seen thru the adjustment layer. Adjustment layers change the way layers underneath look, without changing the layers themselves. Since they aren't directly coupled to the layer, you're free to move the adjustment layer up or down the layer stack. That's different than just twiddling the layer directly.

Shouldn't the dirty tricks that spyware software uses to infiltrate computers, should that be a violation of the DMCA?

According to chillingeffects.org (http://www.chillingeffects.org/anticircumvention/ faq.cgi), this is the definition of circumvention:
    ----
    Question: What does circumvention mean?

Answer: Circumvention, according to Section 1201(a)(3)(A), means "to descramble a scrambled work, to decrypt an encrypted work, or otherwise to avoid, bypass, remove, deactivate, or impair a technological measure, without the authority of the copyright owner." While the full scope of activities and practices that would fall under this definition has not yet been examined by the courts, any act of undoing a "lock" or "block" in a digital system may well be considered circumvention.
    ----

So, if unauthorized spyware happens to "avoid, bypass, remove, deactivate, or impair" all the technological measures I can in place to stop spyware from modifying my copywritten material on my computer (such as my registry, perhaps?), can I seek damages against spyware companies? And would 3rd party companies that bundle spyware be also guilty of "manufacture, import, offer to the public, provide, or otherwise traffic" as well?

Do you mean kinesthesia, the sense that detects bodily position, weight, or movement of the muscles, tendons, and joints? Most people's sense of kinestheia for their limbs is linked with visual feedback, like hand-eye coordination. If you're outdorrs, and asked to point at something, you're getting real-time visual feedback on whether your limb is pointing accurately at what you intended to point at.
