More correctly any contractual conditions beyond the point of sale, the full initiation of a contract, need to take into account the cost to the purchaser making that purchase.
Example buying an operating system at a brick and mortar store; Travel to store Time spent waiting and making purchase Loss of income of monies spent Return home Install software time and capital cost of equipment used Read agreement, disagree, time lost (lawyers charge for reading contracts, hence customers are entitled to the same consideration) Un-install software time lost Return trip to store Time spend gaining refund
Next up of course is who should pay for the cost of researching alternate software, as the software originally purchased was falsely sold under conditions of contract that differed from the information supplied.
Let's be honest any court that let's those issues slide is criminally corrupt and operates upon the basis of extreme bias against the citizen in gross favour of corporation's fraudulent profits. Don't think so, now consider those costs when multiplied by hundreds of thousands. Basically courts corruptly facilitating corporate profits based upon the use of contractual deceit and lies. Hundreds of millions of dollars in bias against consumer in favour of corrupt corporations and the deceitful politicians those profits fund.
Class actions still provide the most important thing. A real penalty for lying, cheating, stealling and murderous corporations. Not the joke criminal one, where the actual perpetrators get off scot free and the penalty for the corporation is significantly less than the profits made. A real fiscal penalty greater than the profits made. All that needs to happen now, is that the class action be extended to target the actual corporate executives who made and implemented the decisions, they also need to be driven into the poor house at least to make up for them not being in prison where they belong.
The only reason class actions fail, is because actual real criminal penalties should have been applied that exceeded the profits made and those penalties should have extended to prison sentences for deceitful fraudulent and often lethal practices.
More importantly consider the migration was, a warm period, a major ice age, another warm period and another major ice age ago. Consider the changes in environment with multiple sea levels changes around the 500 foot range. Changes in land scape, repeated truly significant cultural and societal changing events, routinely generating a break down of human society.
Erm, innocent until 'proven' guilty in a court of law. I know it's that whole US confusion with torture, where you are punishing someone for being a suspect, without proving anything or having substantiated any evidence in a court of law. All done so badly that they have to rely on kangaroo courts 'er' military tribunals to, get a guilty plea 'er' get false confession, under threat of indefinite imprisonment and torture 'er' enhanced interrogation versus a fixed term and the preferred punishment of the US homosexual rape (US law is becoming so confusing, good thing if your rich your always innocent unless of course you steal from other rich people, that helps simplify the US legal system).
So US trial of poor people, by corporate media for attacking corporations, I sure that's going to be fair and law 'enforcement' (again read delusions of grandeur and no real understanding of the law) preening with corporate media 'er' press announcements.
There is a way to trap drivers into speeding. Target locations where there is a high probability of drivers missing the change of speed sign ie two lane road and only one sign on one side of the road, driver passing another vehicle which obscures visibility of the sign or change of speed on a downhill stretch which requires active deceleration to comply.
What this is all about is of course, computers will do my job for me, I will still take the credit and get paid for doing nothing (if it really worked, of course they would fire them and just use computers). Automated speed cameras do not assist police officers they replace police officers.
Lets add the word 'corrupted' to that "Law Enforcement". Conspiracy charges are typically what is used when there is no real evidence that an individual has actually committed a crime but instead they are going for sounds like, looks like they might have charges. Also police, only police the laws, they absolutely do not enforce the laws (this is the delusion of ignorant crew cut jock thugs in uniform) the courts enforce the laws.
A lot of countries reject conspiracy laws because inevitable 'Law Enforcement' (again read power mad douches in uniform) types routinely conspire to twist evidence and testimony under threat of punishment, to create cases to suit promotions, rather than any real evidence.
Seriously, I mean really seriously, look at the people they have arrested and the pseudo charges used. This is what they call a 'NATIONAL SECURITY THREAT', it hard to tell whether to call it FBI ego bloating or just grovelling to corporate profits and power. Yeah, let's all panic because a few individuals used DDOs to temporarily disrupt access to an internet bill board, let's all pretend that a temporary IP address (used to monitor a minor billing account) is all the evidence you need and of course that testimony under threat of decades of imprisoment means anything (this from a country that legalised physical torture or at least pretended to and, where psychological torture is to be expected and even sickly enough demanded).
Infinite contracts are a delusion of lawyers relying on legal bluff. Contracts are never one sided and both, repeat 'BOTH" parties must continue to fulfil the conditions of contract, for the contract to continue. Technically your private information is not a one shot deal as it continues for as long as you live. Corporations as always simply choose to interpret the law as it suits their greed until to forced to do otherwise and pay the consequences.
The problem is tech branding is running into ODM take over. Those companies actually making product starting to sell direct and cur out the empty branding companies. The inevitable death of of shoring guaranteed.
So what can HP do now, attempt to get back into actual manufacturing rather than contracting and advertising, merge with an ODM seeking expansion, a stock shuffle. The CEO needed for that is basically a do nothing and cash your check type and let the banking and investment corporations handle the deal.
A face and reputation to sell the deal to the investment public. Meg Witless is now a major loser after blowing millions of dollars (way out spending her opponent with one of the most absurd election campaigns) on an ego driven political campaign and that taint is going to last for ever, not the face you want to drive 'new and exciting' business prospects.
The real question is whose asset is your information. Consider that your information is on loan, subject to conditions of contract being fulfilled, at any time you are entitled to recall your private data and in turn the company is no longer required to provide you will value based upon the loan of that data.
The company has gone bankrupt and as such is no longer able to fulfil the conditions of contract the were the basis of the loan of your private data, failure to adhere to the conditions of contract means your private data must be returned to you ie. deleted.
You private data can not be transferred upon bankruptcy under new conditions, because the bankrupt company now owes you a debt, your privacy because it no longer can provide contracted services.
M$'s big problem with MSN is 'Ballmer' and MSN being run by bean counters and marketdroids rather that creative people and programmers.
MSN was out there long before Google, there was no uphill battle, MSN had the lead by years, in fact it was a Google up hill battle. Except it wasn't all that uphill, thanks to the likes of Ballmer choking the chicken. Squeezing down to hard and stop any chance of the money coming by driving off the end users with over the top add placement.
The screwed up there search enginer by filling so full of crap pay to place, that if you were smart you didn't bother with page 1 of search results but clicked straight to page 3 or more. The portal became a dead space of full page adds that wouldn't leave and it was easy to go to another portal that put up with getting passed that full page add. All interactivity was forced to be their add choked annoying way or you went else where, which is of course what everyone did.
So MSN is being choked to death, MSN search is a joke being named changed again and again. They have completed abandoned any kind of MSN branding recognition for feeding Ballmer's ego and' getting those executive bonuses.
Yes they did they stopped new money coming and, just like all ponzi schemes without new money coming in to hide the money that has disappeared, well come on it's not like it wasn't expected. Most of the poker companies rely on computer generated players and stacked decks to clean out the suckers, perhaps these guys are just crappy programmers and just went straight for the cash by emptying out the accounts directly.
I bet all those people who got ripped off also complain about paying taxes. When the government does it you lose some but they set up rules and regulations to protect the rest of your money, when private enterprise does it you lose the lot and they try to get rid of all the rules and regulations so that they can get away with it.
Wouldn't politicians killing other politicians be even better, less pollution and your not feeding the ravenous beast, "The Global Military Industrial Complex" (apparently they are now colluding together upon a multinational basis to keep mass murdering high profit wars going). All you need is a bunch of clubs and some campaign contributions and let them go at it and, the winner is, the general public.
Those chicken hawk politicians that want war, let them fight it themselves.
The implication is when your product and your profit mark up are no longer competitive, companies often seek other legal manipulations, political corruption and, deceitful mass media to keep other products out and of course to continue to artificially inflate their profit margins.
So the big question is who will be the winner in the consumer eyes, who will be seen as the manipulative, conniving, greedy, anti-customer, corporation holding the end user hostage to the greed of corporate executives out of control.
Even if they break even, Apple loses badly, as the fashion conscious technology unconscious product any tarnishing of their marketing image will cost them hugely.
Now for a touch of reality, http://en.wikipedia.org/wiki/1948_Palestinian_exodus. Based upon the endless lies of Jewish Palestinians and a horde of European migrants, the expulsion of the majority of the population and denial of return and, the blatant theft of land, friendliness is highly unlikely.
Consider the same in your country, if the majority were, killed, expelled and imprisoned and via biased religious apartheid based immigration turned into a minority. Whilst this has happened before to the shame of several major countries, what happens in our life times is our shared responsibility and shame.
It is clear from the the outset, that one side wanted and worked towards religious apartheid, not just targeted at Muslims, but as demonstrated by the fundamentalists who actually spit on Christians against all others.
Upon this basis that country based around the theft of land, the removal and expulsion of the original inhabitants and the continual denial of truth should be specifically excluded from all international organisation and trade. There is no place in this modern world for a pariah nuclear armed state.
C'mon seriously, wouldn't you want episode 1, 2 and 3 completely redone. He could tweak the originals sufficiently to pretend they are about a completely different non-star wars galaxy and then produce three completely brand new versions (allowing some one else to write and direct).
Now with regards to this thread the quality of the movie is meanignless, what really counts is Canada has a loser pays system for civil suits. The loser pays court costs and the winners legal costs.
When playing games of mass civil suits, you need just one winner and everyone else cites that case and all of a sudden they have lost thousands of case and face counter suit for harassment and psychological harm.
This has always been the reason why they haven't played civil suit games in countries with tighter tort laws, they could lose millions of dollars, a real game of Russian legal roulette except the defendant only pull the trigger once but they have to pull it thousands of times, which pretty much guarantees it will end up going off in their faces.
Now for the actual reason they want to use those organised crime Rico Racketeering Influenced and Corrupt Organizations Act, rather than the lie put forward by those two "seeming' dipshits Associate Deputy Attorney General James Baker and Secret Service Deputy Special Agent in Charge Pablo Martinez, it's because they can ramp up the "conspiracy" chargers when no actual crime is committed and the evidence is all circumstantial.
Basically about kangaroo courts targeting people who can not afford a proper legal defence and where judges and juries will fall under the bullshit baffles brains, of tons of techno-speak evidence without any real substance.
This is the government version of the blackmail recruiting drive, where cowards turn states evidence under threats of extended prison sentences for any kind of criminal fantasy they or the fed handlers can dream up, into targeting anyone they want to.
Sick stuff, some cop shoots and kills an unarmed person and, it's a slap on the wrist versus some script kiddy participates in a DDOS protest and it's life in prison and you have two government dipshits stand up and try the lickspittle mass media shuffle to make it sound all proper and acceptable.
That's why night time and infrared work so well. If you can remain focused on a particular area and use computers to track the movement of heat sources over time and their clustering points and compare them with daytime appearance and use of a particular site. Of course this rely on the magic box only strategy as what looks like a group of suspected maybe terrorists clustering at a suburban house prior to a raid, can actually be a wedding party, with typical US military homicidal results.
What we really want is the high altitude semi rigid dirigible shots for intelligence gathering and suspect analysis, for the extra sharp images. Privacy, meh, it will only be a few more years of, "ramp up the domestic terrorist threat" and there will be a 24/7 camera over watch of your backyard http://www.restmycase.com/.
More importantly on the computer geek side, focus on the TSA agents lawyers letter, oh my, that website is just so bad in terms of suitability for purpose. It screams narcissist ambulance chaser http://www.restmycase.com/ but, hey just in case, that is only my opinion;D.
Reminds me of all those lame layers who will traipse their clients through the courts for years knowing full well they are going to lose but, that is also only just a opinion;D.
Either way in marketing terms Apple, the marketing engine is making itself look ugly, cheap and tacky. This kind of legal battle always cheapens a company image and for Apple that is a disaster and the longer it goes on the worse it is. The other companies aren't affected by it is much because of course they market themselves in a different fashion and not as a fashion concious, technology unconscious, digital accessory range.
So Apple is now looking to face the counter threat to what it was doing. Apple was not after money, it never believed it would win, it was aiming to keep other products off the market for as long as possible by creating a very long court battle, one they intended to run for years, all based upon legal bullshit. Now of course these counter suits will simply be used to gain legal relief from Apple's injunctions against trade, so years in court for an empty stale mate.
You fail to consider that neither I nor the majority of politicians children go strutting about on the world stage like and bunch of doofuses pretending their someone special because of it. In fact a lot of politicians descendant's try to hide their shame and embarrassment takes a special kind of genetics to be proud of what other people would be ashamed of, it's generally called narcissism or psychopathy. Surely you can grasp the difference.
The number one anomaly for a tank in the field, being clean. So keep your tank parked in a shed and, only drive it on the bitumen. Of course you can just target any strange bushes with exhaust giving off large amounts of heat. It would seem that reflective camouflage netting to extend and break up the outline would largely do the same thing, clean or dirty and of course much cheaper. There's nothing like the greed of an out of control military industrial complex to find the most expensive and profitable ways of doing things.
When it comes to stuck in the mud unable to change, the monarchy in the UK is a prime example of it. Keep in mind monarchy was basically a system of government based upon torturing to death anyone who disagreed or even might possibly disagree. Basically a system of government based upon homicidal psychopaths and their loyal psychopathic minions. That's the heritage of monarchy and one can see it today in various autocratic states when power is handed down within a family and opponents are executed in the most horrific fashion imaginable ie. Libya, Syria, North Korea etc. etc.
Really honestly any sane person should be ashamed and embarrassed to be part of a royal (descendent of homicidal maniac) family but no they strut about like insane clowns with delusions of grandeur, now that is really embarrassingly backward, much like continuing the closed source proprietary software route. No control, forced upgrades, wasted dollars auditing proprietary code (paying for the privileged debugging), data purposely degraded by upgrade incompatibilities and an endless stream of marketing lies that you as the consumer pay for.
Don't discount Russian and Japanese, they are still pretty worth while and Russian is definitely becoming more a global economic player. Spanish of course gives access to opportunities in South America, which is stabilising as US involvement (keeping South America unstable, weak and exploitable) is being pushed out.
Languages do seem a good bet with the internet driving multi-lingual capabilities.
