If I were to end up on the list I'd damn sure let everyone know and I'd fight it with everything I have.
Remember don't fund an entity that will only sue you into financial ruin. We can hurt them where it hurts them most...in the wallet. This is the only way to make a statement. Once these lawsuits start then the shit is really going to hit the fan and the backlash will be severe.
Think of it this way...what's more important violent crime or copyright violations? Well the RIAA is sending out so many subpoenas without judicial oversight I might add that court systems are having to redistribute their workers to cover the overwhelming workload. That means less work on violent, horrible crimes and more work on copyright infractions? This is beyond ridiculous!

Cafe Press first CD available for purchase is by MeepMeep. I can tell from experience that the tracks were made with MTV Music Generator. So it may not be for a serious musician, but it's out there and people are publishing with it.

been doing this for the last year...We're doing our CDs via SwiftCD, our T-shirts and other merchandise via Cafepress. We may add a vendor or two later.
MP3 sound samples (full songs) you can download off our site.
All we did was upload (we snailmailed the CD for replication) our info, all we have to do with fulfillment is wait for them to send the checks. They handle the credit card stuff and create the goods on demand. The prices are a bit high, but creating stuff on a one-off basis is expensive even with everything basically automated.

Daddy, where does the merchandise come from?
Fatchuck's 100% offer is a nice marketing gimmick, but it conveniently neglects to tell artists that they have to have the stuff first beforethey can sell it. If a musician pays out for 100 pro-grade CDs and 100 decent T-shirts, signs up on Fatchuck's for $60, and only sells a handful of each in 12 months, the artist is still out for the cost of making the CDs and T-shirts. It's one thing if it's a touring band that can sell their stuff at gigs, too, but if they can do that, why pay the extra $40/year?
I dare say that CafePress.comand its high base prices are still a better option for a lot of artists that can't afford to pay up front for the goods, although Mixonic tends to offer better rates for CDs. Why there aren't more inexpensive CD creation services like those two really baffles me. (And yes, I know about MP3.com and Ampcast, but CafePress and Mixonic don't ask for $100/year to sign up and don't fill your CD with ads like MP3.com does.)

If you're running it as a hobby, don't expect to earn anything serious. Trust me, I know.

Sure, you can set up advertising, banners, pop-ups, merchandise, blah-di-blah-di-blah, but unless you're prepared to put in a lot of time, you simply won't get much out of it.
In order to make a significant amount from web advertising, you will need to keep a careful eye on which ads are earning and which aren't. You'll need to constantly add new ads, and purge the ones that aren't working. You'll need to keep in touch with the latest trends - what are people clicking on, and why, and change your adverts to follow the trends.
Put simply, if it's a hobby, you're not likely to have time to put in the effort required to make money from it.
Putting up a simple banner ad might get you a small amount of income - it depends on just how popular your site actually is ("moderately popular" is not a well defined amount), and also whether you're willing to sell your soul and advertise gambing sites and dodgy credit cards (these two categories will earn you about ten times anything else, but I still refuse to advertise them).
The other idea that might work for you (depending on what your site actually has on it) is merchandising. If your site is suitable for merchandising, may I humbly recommend you visit CafePress, and start selling mugs and t-shirts with your logo. I have actually managed to make a bit of money from this, where advertising failed dismally. (also not much, but again I'm not putting in any real time to actively market them) -
CafepressAs long as we're on the topic, I suppose I should mention that Print On Demand megacenter CafePress has gotten in on the music publishing game. They also do data CDs. Sort of like MP3.com does, only without any self-promotion that I've noticed, since they're not actually a music site. That should help at least a few artists that want to "self"-publish.
They also do data CDs, and they're planning on doing POD publications (books) in the future. Cool. They're the ones that used to make Megatokyo T-shirts before Thinkgeek took over.

I really wanted to put this picture on a shirt.. but that would have broken CafePress's rules on several counts.
BTW: It's a fucking shirt. I could easily fill ten or twenty pages with why you should "resist Redmond", but that wouldn't be too effective on a shirt. Can you picture it: "Hey! Is your shirt printed in microfilm!? I can't read it!"

I don't think anyone expects them to embrace the GNU/Linux community on the Xbox issue. What is WRONG is that they are using lawyers as their minions. If it were a technically sound product, they wouldn't CARE about modders because they would know that it wouldn't affect their sales at all.
Let's look at this - a lot of people say "Why would I want to run GNU/Linux on an Xbox?" There is no secret reason, it is just because you can. That is what hacking is all about. Nobody can honestly tell me that the market for mod chips is big enough to make a dent in future sales. It is a niche community, and a small one. Microsoft shouldn't give a rat's ass about it. But they do, because it is something they don't control. This isn't about playing pirated games, or running another OS on the Xbox, it is about control. Microsoft wants to Own It All . Period. And they are using "the law" to assist them. Something is weird here, because as a lot of people have pointed out, they probably woulnd't buy an Xbox just to run GNU/Linux - so why does Microsoft care if they do it?
Yes, you can play pirated games on a modded Xbox. but there are perfectly legal reasons for wanting a modded box. This has been proven that it is possible, and that there is interest in it. I can't imagine that even pirated games would make a dent in legitimate sales. Modding an Xbox is not wrong, and if it is illegal it shouldn't be. What the hell has happened to common sense? This is just another example of Microsoft "not getting it". They are not a software, or a technology company. They have firmly moved into the ranks of a control business. The RIAA and the MPAA have welcomed them in with open arms.

There's all kinds of fun things to discover about this case. For example, the NY Better Business Bureau gave PetsWarehouse its worst possible rating for its business practices. Mr. Novak claims that the BBB is *actually* talking about the retail store, not the website, and as a result, he's threatened to actually SUE the Better Business Bureau.
Mr. Novak is on very shaky legal ground. He's been reprimanded by judges (since he's filed three seperate lawsuits and several ammendments, there are a lot of judges involved) for not having a clue what he's doing. He told a magazine that he considers suing people to be "his hobby", and a profitable one, because he lives right down the street from the courthouse and most people can't afford to travel to his venue to fight the lawsuits. When Slashdot first covered the lawsuit in April, someone posted a comment sayign that they new Mr. Novak, and he told the poster that he has a lawyer in the family who gives him advice on filing baseless lawsuits for extra income.
Also, one of Mr. Novak's big claims in this lawsuit is "trademark infringement" (since we ALL know that saying "I don't like XYZ" is a violation of XYZ's trademark, right??), however, there's some question of whether he owns the trademark at all. He used Pets Warehouse as a "common law" trademark (IANAL, but I think that means he never actually filed the trademark, he just started using it and that entitles him to some legal protection), however, when he filed bankruptcy in the 90's, he didn't list any intellectual property that he wanted to keep on his bankruptcy application, thus it's entirely likely that he lost any trademark he might have had on the name during the bankruptcy.
He also refuses to actually serve papers against any of the defendents who live in California, because California has a strong SLAPP law that would bite him in the ass he if tried to actually bring any California residents into the lawsuit.
I'm not the only one who thinks all this is very, very crazy. -

If you set the prices to the minumum they really aren't that bad. Plus your friends can buy your shirts as well.

From what (little) I know about Falun Gong, hacking a satellite doesn't sound like something they'd do, since it's much more likely to be illegal than a sit-down type protest, and MUCH more likely to bring the jackboots down on them.
I'm inclined to think it was some other band of kiddiez that just wanted a good cover for their actions, like the "Hacked By Chinese" incidents from last year.

People will say that spam is the same as junk snail mail, but it's not. "Legitimate" junk snail mailers will happily bear the cost of sending their messages, knowing that they are advertising a legitimate product or service. Spammers push that expense off on the people receiving their message.
To further the theft of services concept, an overwhelming majority of spam is sent through open or unsecured mail relays. This means that people who have no legal right to use those services are using them, much like someone who splices into an apartments building's cable tv system to get free cable. And as I always point out in my spam complaints, there's always this little gem:

While I don't exactly approve of this "buy software and then kill the Windows branch" stragety, it's interesting to see it happening. As a shareholder, I'm curious to see if all these purchases are truly being made to improve Apple software, or just to limit Windows users access to such software.

Now true, this might be a good way to get rid of some of your junk sale books, but it seems some folks are having better ideas :)

Same thing here. The last movie I saw was Ocean's 11, and the sound kept cutting out during the big finale. We (myself, my wife, and the rest of the people at that screening) got free tickets, and with any luck, the wife and I will be able to cash them in this weekend when the grandparents come down to see the grandkids

The problem is that broke their own rules when going from os9 to osX. Finder commands which have been constant since System 7 changed for no good reason: want to create a new folder? Command-N doesn't do it anymore, that opens a new Finder window - Shift-Command-N is your new keyboard shortcut now. The "stop light" of window control buttons violate their old user interface guidelines on multiple levels. And they even moved the location of "Empty Trash" on the menu bar, so people that went to the menu bar instead of using a keyboard shortcut have to undo all those years of muscle memory training of just going to the last menu item on the right and dragging down...
Yes, it's whining, to a certain degree. I did the same thing when Apple went from System 6 to System 7 and changed how you handled control panels and extensions, and when they went to the "Platinum" puffy Windows-y interface in OS 8.
The changes from 6 to 7 were good for the system, "Platinum" didn't do much for me (I still prefer the clean black-and-white interface of System 7), and osX is a whole new ball game. It's starting to grow on me, and I'm finally learning to go to the Dock instead of the Finder to empty the trash. I'm actually starting to enjoy the Dock now - it's a nice retractable place to put a lot of icons I used to leave lying around on my desktop. I guess change can be good after all :)

But I really don't get this whole "blog" thing. When did it become so popular, and why? Yeah yeah, there's the whole "freedom" and "empowerment" lines, but I still don't get the attraction of putting what seems to me to be a diary online for the world to see. Can anyone else provide me with a clue about this phenomenon?
I guess the web pages I put up when my wife was pregnant with our first child was a sort of blog - I should get around to re-posting that somwehere, actually... but as a geek with a wife, two kids, and a mortgage, I don't seem to have the lifestyle that would make good blog material anymore.

You are correct. Mac OS X is built around Darwin, which is partly based on FreeBSD. See http://developer.apple.com/darwin/ for more details. Darwin is also available for x86-compatible computers, so it's not a Mac-only thing.
