Should Comcast Be Investigated For Antitrust Violations? (theverge.com)
The American Cable Association (ACA), an industry group that represents over 700 small and medium-sized cable operators, wants antitrust regulators to investigate whether Comcast-NBCUniversal is abusing its power to hurt smaller television and internet service providers. The group has "asked U.S. Assistant Attorney General Makan Delrahim to 'immediately' open an investigation into Comcast's practices," reports The Verge. Comcast is denying the claims, and while the Justice Department hasn't publicly responded, that may change soon. President Donald Trump tweeted about the ACA's claims earlier this afternoon. From the report: The ACA claims Comcast has a uniquely powerful hold on the U.S. cable industry because it controls a large chunk of "must have" programming like NBC's regional sports channels. The group argues that the Comcast "has shown a willingness to harm rivals" in the past, even while bound by a 2011 consent decree that expired earlier this year. The letter is dated November 6th but was published today, after Fox Business Networks reported on its existence last week.
Contra Trump's description, the letter doesn't seem to describe "routine" violations of antitrust law. It's primarily arguing that there's a huge risk of Comcast abusing its market position, while explaining just how much damage could result if Comcast did so. The ACA has put forward more concrete claims in the past, though -- like a 2017 complaint that Comcast was forcing smaller cable providers to bundle unwanted NBC-owned channels into TV packages, driving up their costs. The ACA's letter also raises concerns involving Hulu, suggesting that Comcast could effectively hold the service hostage. "We have heard from ACA members that they fear that ComcastNBCU may restrict, if it is not already restricting, their ability to access Hulu and make it available to their customers as an alternative to their cable offerings," reads the letter. -
Mattel's New Baby Monitor Uses AI To Soothe Babies and Lawmakers Aren't Happy About It (washingtonpost.com)
Mattel has a new kid-focused smart hub called Aristotle, which can switch on a night light if it hears a baby crying to soothe the child (Warning: source may be paywalled; alternative source). The device is also designed to keep changing its activities, even to the point where it can help a preteen with homework, learning about the child along the way. Given the privacy concerns, lawmakers are worried that the always-on device could build an "in-depth profile of children and their family." Jezebel reports: The $299 Aristotle is similar in spirit to the Amazon Echo, only the scope of its features is much broader -- and scarier. Last week, Senator Ed Markey and Representative Joe Barton sent a letter to Mattel CEO Margaret Giorgiadis about their issues with the tablet, which tracks things like kids' eating and sleeping habits when they're young, and adapts to answering their questions about long division and sex or whatever as they grow up. According to nabi, the Mattel brand that developed the device, the Aristotle is meant to "provide parents with a platform that simplifies parenting, while helping them nurture, teach, and protect their young ones." Not everyone is on board. But Markey and Barton aren't the only ones squicked by Aristotle's capabilities. Buzzfeed reports that privacy experts, parents and child psychologists are also concerned that the device "encourages babies to form bonds with inanimate objects and use information it collects for targeted advertising," so much so that a petition has been launched to prevent it from going to market. -
Walmart Wants To Deliver Groceries Straight To Your Fridge (consumerist.com)
New submitter Rick Schumann writes: Walmart has a new marketing idea: "Going to the store? No one has time for that anymore," Walmart says. They want to partner with a company called August Home, who makes smart locks, so a delivery service can literally deliver groceries right into your refrigerator -- while you watch remotely on your phone. Great, time-saving idea, or super-creepy invasion of your privacy? You decide. Here's how the company says it would work:
1. Place an order on Walmart.com for groceries or other goods.
2. A driver for Deliv -- a same-day delivery service -- retrieves items when the order is ready, and brings them to the customer's home.
3. If no one answers, the delivery person can use a one-time passcode that's been pre-authorized by the customer to open the home's smart lock.
4. The customer receives a smartphone notification when the delivery is occurring, and can choose to watch it all play out in real-time on home security cameras through a dedicated app.
5. Delivery person leaves packages in the foyer, then brings the groceries to the kitchen, unloads them into the fridge, and leaves.
6. Customer receives notification that the door has locked behind them. -
Online Critics Decry Even More Wells Fargo Fraud Scandals (boingboing.net)
On Saturday author/blogger Cory Doctorow launched a new barrage of criticism towards Wells Fargo: It's been a whole day since we learned about another example of systematic, widespread fraud by America's largest bank Wells Fargo (ripping off small merchants with credit card fees), so it's definitely time to learn about another one: scamming mortgage borrowers out of $43/month for an unrequested and pointless "home warranty service" from American Home Shield, a billion-dollar scam-factory that considers you a customer if you throw away its junk-mail instead of ticking the "no" box and sending it back.
$43/month gets you pretty much nothing: people who tried to actually use their AHS insurance found it impossible to get them to actually do anything in exchange for this money. Here's a quick Wells Fargo fraud scorecard: stealing thousand of cars with fraudulent repos; defrauding mortgage borrowers; blackballing whistelblowers; creating 2,000,000+ fraudulent accounts, and stealing millions with fraudulent fees and penalties.

United Airlines Claims TSA Banned Comic Books In Checked Luggage For Comic-Con, TSA Denies It (boardingarea.com)
schwit1 shares a report: San Diego Comic-Con has become so much more than just a comic book convention. But comic books remain the heart and soul of Comic-Con. In addition to attendees being there to buy comic books, vendors flock to Comic-Con to sell their comic books as well. That's why participants in Comic-Con were shocked to find a notice waiting for them at the San Diego airport after Comic-Con: "COMIC-CON ATTENDEES: REMOVE ALL BOOKS FROM CHECKED BAGS." On Twitter, United Airlines confirmed the ban: "The restriction on checking comic books applies to all airlines operating out of San Diego this weekend and is set by the TSA. ^MD" Consumerist reached out to TSA and were told by a spokeswoman that the warnings about not allowing comic books -- or any kind of book -- in checked bags were simply not true. There is "no restriction on anything related to putting comics or any type of books" in baggage, and TSA never put out any guidance to that effect, she said. "In fact, they are allowed in both checked and carry-on baggage," the spokeswoman told Consumerist, adding that there were no delays in the processing of checked bags out of San Diego yesterday. -
Home Improvement Chains Accused of False Advertising Over Lumber Dimensions (consumerist.com)
per unit analyzer writes: According to Consumerist, an attorney has filed a class-action lawsuit charging Home Depot (PDF) and Menards (PDF) with deceptive advertising practices by selling "lumber products that were falsely advertised and labeled as having product dimensions that were not the actual dimensions of the products sold." Now granted, this may be news to the novice DIYer, but overall most folks who are purchasing lumber at home improvement stores know that the so-called trade sizes don't match the actual dimensions of the lumber. Do retailers need to educate naive consumers about every aspect of the items they sell? (Especially industry quirks such as this...) Furthermore, as the article notes, it's hard to see how the plaintiffs have been damaged when these building materials are compatible with the construction of the purchaser's existing buildings. i.e., An "actual" 2x4 would not fit in a wall previously built with standard 2x4s -- selling the something as advertised would actually cause the purchaser more trouble in many cases. -

Google Following Your Offline Credit Card Spending To Tell Advertisers If Their Ads Work (consumerist.com)
One of the new tools Google has announced for its advertisers today promises to tie your offline credit card data together with all your online viewing to tell advertisers exactly what's working as they try to target you and your wallet. Consumerist reports: That return, for decades, was hard to measure in all but the most vaguely correlative of ways. Did people buy your product after seeing your TV ad? After seeing your billboard? On a whim after seeing neither? Who knows! But in the age of highly targeted, algorithmic advertising, the landscape is completely different. The apps on your phone know what you looked at and when, and can tie that in to what you see on other devices you're also logged into their services on (like your work computer). Meanwhile, you're leaving tracks out in the physical world -- not only the location history of your phone, but also the trail of payments you leave behind you if you pay with a credit card, debit card, or app (as millions of us do). Google also introduced some offline measurements to its online tool suite back in 2014, when it started using phone location data to try to match store visit location data to digital ad views. But a store doesn't make any money when you simply walk into it; you need to buy something. So Google's tracking that very granularly now, too. "In the coming months, we'll be rolling out store sales measurement at the device and campaign levels. This will allow you to measure in-store revenue in addition to the store visits delivered by your Search and Shopping ads," Google explains to advertisers. That's very literally a collection of spending data matched to the people who spent it, matched in turn to people who saw ads. -

Amazon has transformed businesses including retailing, filmmaking and data storage. But no one anticipated the bananas. It started with a brainstorm from founder and CEO Jeff Bezos that Amazon should offer everyone near its headquarters -- not just employees -- healthy, eco-friendly snacks as a public service. After considering oranges, Amazon picked bananas, and opened its first Community Banana Stand in late 2015. However, not everyone is pleased with the ecommerce giant's effort. From a report: Although there is no money in Amazon's community banana stands -- where the company has been offering free fruit to both workers and locals in Seattle since 2015 -- the tech giant's largesse is changing the banana landscape for some nearby businesses. [...] Thus far, the company says it's handed out more than 1.7 million free banana, reports The Wall Street Journal. But while many folks are fans of the free bananas, others say it's changing banana consumption in the community: Some workers say it's harder to find bananas at local grocery stores, while nearby eateries have also stopped selling as many banana as they used to. -
FCC Suspends Net Neutrality Comments, As Chairman Pai Mocks 'Mean Tweets' (gizmodo.com)
An anonymous reader writes:Thursday the FCC stopped accepting comments as part of long-standing rules "to provide FCC decision-makers with a period of repose during which they can reflect on the upcoming items" before their May 18th meeting. Techdirt wondered if this time to reflect would mean less lobbying from FCC Chairman Ajit Pai, but on Friday Pai recorded a Jimmy Kimmel-style video mocking mean tweets, with responses Gizmodo called "appalling" and implying "that anyone who opposes his cash grab for corporations is a moron."
Meanwhile, Wednesday The Consumerist reported the FCC's sole Democrat "is deploying some scorched-earth Microsoft Word table-making to use FCC Chair Ajit Pai's own words against him." (In 2014 Pai wrote "A dispute this fundamental is not for us five, unelected individuals to decide... We should also engage computer scientists, technologists, and other technical experts to tell us how they see the Internet's infrastructure and consumers' online experience evolving.") But Pai seemed to be mostly sticking to friendlier audiences, appearing with conservative podcasters from the Taxpayer Protection Alliance, the AEI think tank and The Daily Beast.
The Verge reports the flood of fake comments opposing Net Neutrality may have used names and addresses from a breach of 1.4 billion personal information records from marketing company River City Media. Reached on Facebook Messenger, one woman whose named was used "said she hadn't submitted any comments, didn't live at that address anymore and didn't even know what net neutrality is, let alone oppose it."
Techdirt adds "If you do still feel the need to comment, the EFF is doing what the FCC itself should do and has set up its own page at DearFCC.org to hold any comments." -
Cable Lobby Survey Backfires; Most Americans Support Net Neutrality (consumerist.com)
New submitter Rick Schumann writes from a report via Consumerist: The NCTA hired polling firm Morning Consult to survey people about their attitudes toward net neutrality. In the results and a blog post about the survey, the organization crows that clearly, everyone thinks regulation is bad. Here's the "TL;DR" version: The NCTA claims Americans want "light touch" regulation of the "internet," but did not ask about regulation of internet service providers. The survey claims most voters believe regulation will harm innovation and investment, but their own numbers show that just as many people believe it won't. Most people don't believe the internet should be regulated like a "public utility," which is good because that's not what net neutrality does. When people were asked their feelings about what neutrality actually does, they overwhelmingly support it. -
Why You Should Care About the Supreme Court Case On Toner Cartridges (consumerist.com)
rmdingler quotes a report from Consumerist: A corporate squabble over printer toner cartridges doesn't sound particularly glamorous, and the phrase "patent exhaustion" is probably already causing your eyes to glaze over. However, these otherwise boring topics are the crux of a Supreme Court case that will answer a question with far-reaching impact for all consumers: Can a company that sold you something use its patent on that product to control how you choose to use after you buy it? The case in question is Impression Products, Inc v Lexmark International, Inc, came before the nation's highest court on Tuesday. Here's the background: Lexmark makes printers. Printers need toner in order to print, and Lexmark also happens to sell toner. Then there's Impression Products, a third-party company makes and refills toner cartridges for use in printers, including Lexmark's. Lexmark, however, doesn't want that; if you use third-party toner cartridges, that's money that Lexmark doesn't make. So it sued, which brings us to the legal chain that ended up at the Supreme Court. In an effort to keep others from getting a piece of that sweet toner revenue, Lexmark turned to its patents: The company began selling printer cartridges with a notice on the package forbidding reuse or transfer to third parties. Then, when a third-party -- like Impression -- came around reselling or recycling the cartridges, Lexmark could accuse them of patent infringement. So far the courts have sided with Lexmark, ruling that Impression was using Lexmark's patented technology in an unauthorized way. The Supreme Court is Impression's last avenue of appeal. The question before the Supreme Court isn't one of "can Lexmark patent this?" Because Lexmark can, and has. The question is, rather: Can patent exhaustion still be a thing, or does the original manufacturer get to keep having the final say in what you and others can do with the product? Kate Cox notes via Consumerist that the Supreme Court ruling is still likely months away. However, she has provided a link to the transcript of this week's oral arguments (PDF) in her report and has dissected it to see which way the justices are leaning on the issue. -
US Lawmakers Propose Minimum Seat Sizes For Airlines (consumerist.com)
The size of each passenger's seat on an airplane -- as well as the distance between rows of seats -- should be standardized, according to legislation proposed by two American lawmakers. Slashdot reader AmiMoJo quotes Consumerist: The text of the bill does not specify any dimensions for seat widths or legroom. Rather, if the legislation is passed, the particulars would be left up to the FAA to sort out... Though seat size may vary from airline to airline, Cohen notes that the average distance between rows of seats has dropped from 35 inches before airline deregulation in the 1970s, to around 31 inches today. Your backside is getting the squeeze, as well, as the average width of an airline seat has also shrunk from 18 inches to about 16.5 inches. -
Southwest Airlines Is Doing Away With Pneumatic Tubes, Paper Tickets (consumerist.com)
As part of Southwest's biggest tech upgrade in its 45 years of existence, the company will doing away with several of its antiquated practices, including paper tickets and the use of pneumatic tubes to send messages at airports. Consumerist reports: The airline says the goal of these upgrades is to keep planes moving in and out of airports as quickly as possible. "We're looking for minutes," Chief Operating Officer Mike Van de Ven told Bloomberg. "How do I save a minute here, a minute there? In 2017, we are more deliberate in our continuous improvement efforts." The new reservation system will allow Southwest to accept foreign money -- something its rivals can already do -- bounce back faster from storms, and have more control over price changes and schedules. Ramp workers will be getting tablets with real-time information to speed up airplanes' "turn time" -- how quickly they can deboard and reboard passengers and take off again. Tarmac staffers also won't be using pneumatic tubes anymore to send notes via canister about lost luggage and other communications to the cargo workers in charge of calculating jet weight and balance. Digital transmissions will replace that system, as well as printouts for workers who transport bags to and fro. Customers will be seeing changes as well, as the new reservation system means Southwest can ditch paper tickets altogether and stick with electronic tickets only. -
DirecTV Admits Screwing Up Regional Sports Fees, Starts Issuing Credits (arstechnica.com)
An anonymous reader quotes a report from Ars Technica: AT&T this week acknowledged that DirecTV has been charging the wrong regional sports fees to some customers and is now issuing bill credits to those who paid more because of the mistake. "We have identified a small percentage of customers who are receiving some inaccurate bills for regional sports network fees," an AT&T spokesperson told Ars yesterday. "We are working as quickly as possible to notify those customers and issue credits. We apologize for the error." AT&T bought DirecTV, the nation's largest satellite TV provider with about 21 million customers, in 2015. The mistake affects bills going back to late January. Customers will not have to do anything to get the credit, as it will be issued automatically. The billing problem came to light last week when Consumerist published a report detailing how the regional sports network fees vary by ZIP code in ways that simply didn't make sense. It wouldn't be surprising to see different fees in different metro areas and states, since different local sports networks and teams are broadcast in different areas. But there were numerous cases in which people in adjacent ZIP codes were charged very different amounts to watch the same exact networks and teams. Some customers were charged no sports fee, while others were charged amounts of $2.47, $5.83, or $7.29 a month. -
Netflix Will Now Let Android Users Download Content Onto SD Storage (consumerist.com)
An anonymous reader quotes a report from Consumerist: Now that Netflix has finally opened the doors to offline viewing, subscribers have the ability to download content and watch it later. That's all well and good if you've got plenty of space on your device, but not so useful if you don't. Android users will have some breathing room now, however, as Netflix's most recent app update lets users set their download location to either internal storage or an SD card. As The Verge notes, offline content has a time limit, so it's not like you can download all the movies and TV shows your heart desires and leave them there forever. The feature doesn't support any Android devices that have a microSD slot, either. -
Office Depot Allegedly Diagnosing Computers With Nonexistent Viruses To Meet Sales Goals (consumerist.com)
An anonymous reader quotes a report from Consumerist: A new report claims that some Office Depot employees are falsely claiming computers are infected with viruses in order to meet sales goals. According to KIRO-TV in Seattle, employees of the office supply retailer allege that pressure to sell protection plans and other services has led store staffers to misdiagnose computers with viruses. To investigate the claims, the station took six computers to various Office Depot stores in Washington and Oregon for PC Health Checks. There technicians determined that four out of the six computers showed symptoms of malware. To fix the issues, the employees attempted to sell services costing up to $200. The only problem? The computers were out of the box new. A second test by a unaffiliated computer security firm found no symptoms of malware and no needs for repair. The employee tells KIRO that workers selling the services are just following corporate mandates. To make matters worse, he says, the company posts sales goals and current employee sales in the break room for all to see. This, he claims, creates more aggressive associates to push harder when selling the protection plans for nonexistent programs. -
Samsung Patent Describes Holographic TV Technology (consumerist.com)
Patently Mobile is reporting about a new patent application filed by Samsung that lays out new holographic TV technology. Slashdot reader Rick Schumann writes via Consumerist: Holographic displays as described by Samsung would be able to make the depth the brain perceives consistent with the focus of the eyes. Lasers would be used to project holograms that float in front of the screen, which of course sounds a heck of a lot like a mini Princess Leia telling Obi-Wan Kenobi he's her only hope. The display apparatus could also include an eye tracking unit that would locate an observer's pupils and adjust how far it has to project the holographic image for optimum viewing.Worth noting: This is just a patent application; no indication of even a working prototype.

Uber, Lyft, Zipcar Offer Free Or Discounted Rides To Polls On Election Day (consumerist.com)
An anonymous reader quotes a report from Consumerist: Lyft, Uber, Zipcar, and Maven have unveiled a variety of discounts and promotions aimed at enabling voters to get to the polls on Tuesday. The ride-hailing service [Uber] has teamed up with Google to create an in-app feature that aims to assist voters in locating their poling place and then getting there. "Given the important decision people around the country will make on November 8th, we wanted to make getting to and from your polling place easier than ever," the company notes in a blog post on the feature. Uber will be promoting the offer throughout Election Day with reminder alerts to users. Select Lyft users will receive 45% off their Election Day trip to the polls, The Verge reports, noting that getting back from your polling place will cost full price. The company said it would send emails Sunday night to customers in eligible areas, including Atlanta, Baltimore, Boston, Charlotte, NC, Chicago, Dallas, Denver, Detroit, Miami, Minneapolis-St. Paul, New Orleans, Nashville, New York City and New Jersey, Orange County, CA, Philadelphia, Portland, OR, Phoenix, Raleigh, NC, San Diego, and Washington, D.C. If you're determined to drive yourself to the polls, but don't have a car, Zipcar is offering members an alternative: a free rental. The service will make more than 7,000 cars available for free between 6 p.m. and 10 p.m. Tuesday. During that time, members of the service can reserve a free car through the company's app or website. Maven -- the ride-sharing business from General Motors -- will offer riders $5 off all day, a spokesperson tells The Detroit Free press. -
Feds Charge 61 People In Indian-Based IRS Phone Scam Case (consumerist.com)
BUL2294 writes: Following the arrests earlier this month in India of call center employees posing as IRS or immigration agents, USA Today and Consumerist are reporting that the U.S. Department of Justice has charged 61 people in the U.S. and India of facilitating the scam, bilking millions from Americans thinking they were facing immediate arrest and prosecution. "According to the indictment (PDF) -- which covers 20 individuals in the U.S. and 32 people and five call centers in India -- since about 2012 the defendants used information obtained from data brokers and other sources to call potential victims impersonating officers from the IRS or U.S. Citizenship and Immigration Services," reports Consumerist. The report adds: "To give the calls an air of authenticity, the organization was able to 'spoof' phone numbers, making the calls appear to have really come from a federal agency. The callers would then allegedly threaten potential victims with arrest, imprisonment, fines, or deportation if they did not pay supposed taxes or penalties to the government. In instances when the victims agreed to pay, the DOJ claims that the call centers would instruct them to go to banks or ATMs to withdraw money, use the funds to purchase prepaid stored value cards from retail stores, and then provide the unique serial number to the caller. At this point, the operations U.S.-based counterparts would use the serial numbers to transfer the funds to prepaid reloadable cards. The cards would then be used to purchase money orders that were transferred into U.S. bank accounts of individuals or businesses. To make matters worse, the indictment claims that the prepaid debit cards were often registered using personal information of thousands of identity theft victims, and the wire transfers were directed by the organizations using fake names and fraudulent identifications. The operation would then use 'hawalas' -- a system in which money is transferred internationally outside of the formal banking system -- to direct the pilfered funds to accounts belonging to U.S.-based individuals. -
ISP To FCC: Using The Internet Is Like Eating Oreos (consumerist.com)
New submitter Rick Schumann shares with us a report highlighting an analogy presented by an ISP that relates Double Stuf Oreos to the internet. Specifically, that Double Stuf Oreos cost more than regular Oreos, and therefore you should pay more for internet: The Consumerist reports: "Ars Technica first spotted the crumbly filing, from small (and much-loathed) provider Mediacom. Mediacom's comment is in response to the same proceeding that Netflix commented on earlier this month. However, while Netflix actually addressed data and the ways in which their customers use it, Mediacom went for the more metaphor-driven approach. The letter literally starts out under the header, 'You Have to Pay Extra For Double-Stuffed,' and posits that you, the consumer, are out for a walk with $2 in your pocket when you suddenly develop a ferocious craving for Oreo cookies." Of course their analogy is highly questionable, since transmitting data over a network doesn't actually consume anything, now does it? You eat the cookie, the cookie is gone, but you transmit data over a network, the network is still there and can transmit data endlessly. Mediacom's assertion that the Internet is like a cookie you eat, is like saying copying a file on your computer somehow diminishes or degrades the original file, which of course is ridiculous. -
Appeals Court Decision Kills North Carolina Town's Gigabit Internet (hothardware.com)
MojoKid writes: In early August, the 6th Circuit U.S. Court of Appeals ruled the FCC had no authority to prevent states from imposing restrictions on municipal internet. This was a result of the FCC stepping in last year in an effort to "remove barriers to broadband investment and competition." However, the courts sided with the states, which said that the FCC's order impeded on state rights. In the end, this ruling clearly favored firmly entrenched big brand operators like Time Warner Cable, Comcast, and ATT, which lobbied hard to keep competition at bay. The federal ruling specifically barred municipal internet providers from offering service outside of their city limits, denying them from providing service to under-served communities. The fallout from the federal court's rejection of the FCC order to extend a lifeline to municipal internet providers has claimed another victim. The small community of Pinetops, North Carolina -- population 1,300 -- will soon have its gigabit internet connection shut off. Pinetops has been the recipient of Greenlight internet service, which is provided by the neighboring town of Wilson. The town of Wilson has been providing electric power to Pinetops for the past 40 years, and had already deployed fiber through the town in order to bolster its smart grid initiative. What's infuriating to the Wilson City Council and to the Pinetop residents that will lose their high-speed service is that the connections are already in place. There's no logical reason why they should be cut off, but state laws and the lobbyists supporting those laws have deemed what Greenlight is doing illegal. Comcast Excited To Have Lost 4,000 TV Subscribers This Spring (consumerist.com)
An anonymous reader writes from a report via The Consumerist: Comcast has released their second quarter results and they are happy to announce that they lost 4,000 TV subscribers in the last three months. Why are they so happy to announce such a loss? Because, compared to the same time last year where they lost 69,000 TV subscribers, the loss this year is much better for them. Comcast said in a statement to investors that "video customers net losses improved to 4,000, the best second quarter result in over 10 years." That Consumerist reports: "That means that for the most than a decade, the best Comcast can do in April to June of every year is to lose only 4,000 TV subscribers. At this time last year, Comcast reported 22.3 million TV subscribers, and at the same time this year, they report roughly 22.3 million TV subscribers. The major driver of increased subscriptions comes, as you'd guess, from broadband. Comcast reports an increase of 220,000 broadband customers in the second quarter which, in the overall growth of the company, entirely offsets a lost of 4,000 TV viewers." -
Amazon Patents Way To Turn Lampposts, Church Steeples Into Drone Perches (consumerist.com)
An anonymous reader writes from a report via The Consumerist: Amazon has received a patent that shows what drones may be doing when they're not flying throughout the sky delivering packages: sitting on lampposts and church steeples. "Amazon was recently awarded a patent for docking and recharging stations that would be built on tall, existing structures like lampposts, cell towers, or church steeples," reports The Consumerist. "Once the drone is done making a delivery, it would be able to land on the station, recharge and refuel, as well as pick up additional packages." A "central control system" would then be able to control each docking station and connect the docked drone(s) with a local or regional packaged handling center or central facility. Based on weather or package data, the drones may be commanded accordingly. The patent says the system will not only provide directions based to the drone, but will have the ability to redirect the unmanned aerial vehicle based on the most favorable conditions, such as a route with less wind. The patent describes a system in which the drone delivers a package to the platform that then moves the item via a "vacuum tube, dumbwaiter, elevator, or conveyor to the ground level." From there, the package could be transferred to an Amazon Locker or a local delivery person. The docking stations could also act as cell towers that "provide local free or fee-based Wi-Fi services. This can enable cities to provide free Wi-Fi in public parks, buildings, and other public areas without bearing the burden of installing some, or all, of the necessary infrastructure." -
Study: 78% of Resold Drives Still Contain Readable Personal or Business Data (consumerist.com)
itwbennett writes: Blancco Technology Group, which specializes in data erasure, bought 200 secondhand PC storage drives (PDF) from eBay and Craigslist to see if they could recover any of the old data saved inside. Their findings: 78 percent of the drives contained residual data that could be recovered, 67 percent still held personal files, such as photos with location indicators, resumes and financial data, and 11 percent of the drives also contained company data, such as emails, spreadsheets and customer information. Only 10 percent had all the data securely wiped, Blancco said. The Consumerist points out that Blancco makes their money from promising secure data erasure, so the company has a "strong and vested interest in these results." As for why so many of the drives contain unwanted information, the report says it has to do with the difference between "deleting" data and "erasing" data. Your files aren't actually deleted when you drag them to the Trash or Recycle Bin, or by using the delete key -- shocking, I know. You can format a drive to erase the data, but you have to be careful of the format commands being used. A quick format, which was used on 40% of the drives in the sample, still leaves some residual data on the drive for someone to possibly access. A full format, which was used on 14% of the drives, will do a better job in removing unwanted files, but it too may still miss some crucial information. The solution Blancco recommends: buy a tool to perform complete data erasure. -
Comcast Admits It Incorrectly Debited $1,775 From Account, Tells Customer To Sort It Out With Bank (consumerist.com)
An anonymous reader writes from a report via The Consumerist: Consumerist reader Robert is fighting with Comcast over a $1,775 early termination fee that should not have been assessed after he tried to cancel his business-tier service with the company. Comcast itself has even admitted that the money should not have been debited from Robert's bank account, but now says it's his responsibility to sort the mess out with his bank. The Consumerist reports: "In an effort to save money in 2014, Robert called to have their service level downgraded to a more affordable rate. Shortly thereafter, correctly believing that he was out of contract, he cancelled his Comcast service. That should have been the end of the story, but only weeks after closing the Comcast account, the boys from Kabletown decided that Robert was not out of contract, debiting $1,775.44 from the checking account tied to the Comcast service. Skip forward to Jan. 2015 -- two months after being told he'd get made whole; still no check. Robert says that when he called Comcast, 'the rep actually laughed when I told her I didn't get a check yet. She said it would take three months.'" Two calls later, one in June 2015 and one in Jan. 2016, Robert still didn't receive the check even after being reassured it was coming. More recently, he received an email from someone at Comcast "Executive Customer Relations," saying: "I understand you're claiming that someone advised you Comcast would send a refund check for the last payment that was debited but this is generally not the way we handle these situations. [...] For your situation, you would have to dispute the payment with your bank." Good news: The Consumerist reached out to Comcast HQ and a Comcast rep wrote back. "More information just came in," reads the email, which explains that an ETF credit was applied to his account in Dec. 2014, but "through some error the refund check never generated." Comcast is reportedly sending the check for real this time. -
Like Comcast, Google Fiber Now Forces Customers Into Arbitration (arstechnica.com)
An anonymous reader writes: In Google Fiber's updated terms, the company now says they "require the use of binding arbitration to resolve disputes rather than jury trials or class actions." Ars Technica reports: "While the clause allows cases in small claims court, it otherwise forces customers to waive the right to bring legal actions against the ISP. Arbitration must be sought on an individual basis, as the clause also prevents class arbitration. The previous terms of service did not have the binding arbitration clause, though they did limit Google Fiber's liability to the amount customers pay to use the services." The good news: customers can opt out of the change. The bad news: they have 30 days. "According to the terms, the new agreement kicks in within 30 days of accepting the new language. Customers can, however, during that time period use this online form (you must be logged in to your Fiber account to access it) to opt out of this change and future changes to the arbitration agreement," writes The Consumerist. Ars Technica reports that Google told them customers have 60 days to opt out. "An e-mail sent to customers on June 14 says the new terms of service will apply unless they call to cancel service within 30 days. If customers do nothing, they will have "accepted" the terms at that 30-day mark. After that, customers who remain with Google Fiber have another 30 days to opt out of the new terms using the online form," writes Ars. -
Frontier Has No Plans For Data Caps As They're Not Necessary, Says CEO (consumerist.com)

"The nice part of technology and what has happened is that transport costs continue to decline," he explained. "We have not really started or have any intent about initiatives on usage based pricing," said McCarthy. "We want to make sure our products meet the needs of customers for what they want to do and it does not inhibit them or force them to make decisions on how they want to use the product." He did note that data caps could someday come into play: "There may be a time when usage-based pricing is the right solution for the market, but I really don't see that as a path the market is taking at this point in time." The gist of what McCarthy is saying as noted via Ars Technica is that data caps are a business decision, not a network necessity. -
White House Declines To Support Bill That Would Let Judges Order Tech Companies To Break Encryption (reuters.com)
kheldan quotes a report from Consumerist: Senators Richard Burr and Dianne Feinstein are expected to introduce a bill regarding phone encryption as soon as this week, according to Reuters. The draft text will give judges authority to order tech companies to help law enforcement when asked to -- basically, it would be a newer piece of law to fall back on than the All Writs Act of 1789, which is the one that usually sees use for this sort of thing. However, sources tell Reuters that the bill "does not spell out what companies might have to do or the circumstances under which they could be ordered to help," and therefore really doesn't necessarily change the underlying discussions at play, both in the tech world and in government. Nor does the bill specify penalties for failing to comply. The FBI recently briefed Senators Richard Burr and Dianne Feinstein on the methods used to unlock the San Bernardino terrorist's iPhone 5c. According to Reuters, the White House is declining to offer public support for draft legislation Burr and Feinstein are currently working on because the administration is "deeply divided on the issue." The White House has reviewed the text and offered feedback, but it is expected to provide minimal public input, if any, sources familiar with the discussions said. -

The first patent is for a "Re-Configurable Passenger Bench Seat," which allows seat belts and arm rests to be moved to accommodate different size passengers (e.g. two large adults, or two small adults and two small children in a row). The second patent places a storage box under each seat, which is accessed by raising the seat cushion. Of course, this means there wouldn't be room for your feet under the seat in front of you. -

Retailers seem to want it both ways: They want shoppers to spend money long before these key shopping events, and yet they also want shoppers to turn out in full force to make purchases over the epic Black Friday weekend. When they use the "Cheap Stuff!" card day after day and week after week, the deals on any single day stop seeming special. Add to that the trend of manufacturers creating stripped-down versions of their electronics to sell on Black Friday, and consumers have less reason than ever to flood retail stores.
The true story behind Black Friday is not as sunny as retailers might have you believe. Back in the 1950s, police in the city of Philadelphia used the term to describe the chaos that ensued on the day after Thanksgiving, when hordes of suburban shoppers and tourists flooded into the city in advance of the big Army-Navy football game held on that Saturday every year. Shoplifters would also take advantage of the bedlam in stores to make off with merchandise, adding to the law enforcement headache. Sometime in the late 1980s, however, retailers found a way to reinvent Black Friday and turn it into something that reflected positively, rather than negatively, on them and their customers. The result was the "red to black" concept of the holiday mentioned earlier, and the notion that the day after Thanksgiving marked the occasion when America's stores finally turned a profit. -

According to the article: "Though the Federal Food, Drug, and Cosmetic Act (FD&C Act) gives the FDA the authority to require mandatory labeling of foods if there is a material difference between a GE product and its conventional counterpart, the agency says it is not requiring labeling of these GE fish 'Because the data and information evaluated show that AquAdvantage Salmon is not materially different from other Atlantic salmon.' In this case, the GE salmon use an rDNA construct composed of the growth hormone gene from Chinook salmon under the control of a promoter from another type of fish called an 'ocean pout.' According to the FDA, this tweak to the DNA allows the salmon to grow to market size faster than non-GE farm-raised salmon." -
Senators Attempting To Remove Robocall Loophole

Now, several senators want to remove it with Senator Ed Markey's "Help Americans Never Get Unwanted Phone calls" (HANGUP) Act. Meanwhile, according to an article at Consumerist, "the Federal Communications Commission has nine months to craft rules dictating the conditions under which the government would be allowed to make these robocalls", so perhaps this loophole will meet its end before that time. -
FCC Fines Another Large Firm For Blocking WiFi

This time, M.C. Dean, who provided the Baltimore Convention Center's in-house WiFi service, were caught by the FCC sending deauthentication frames to prevent hotspot users maintaining a connection. The complainant alleged that M.C. Dean's actions were identical to those that had earned Marriott a $600,000 fine only weeks earlier. -
DRM Circumvention Now Lawful For More Devices
BUL2294 writes: The U.S. Library of Congress' Copyright Office has published their newest rules regarding DRM circumvention. Much to the chagrin of car makers and agricultural vehicle manufacturers, DRM circumvention, with the exception of telmatics ("black box") and entertainment systems, and anything that would run afoul of DOT or EPA regulations, is now allowed for "diagnosis, repair or lawful modification of a vehicle function." In addition, jailbreaking is now extended to tablets, wearables, and smart TVs, but not to single-purpose devices like e-readers. An exemption has been carved out for security researchers to hack cars, voting machines, and medical devices — as long as that device is not being used for its purpose and is in an isolated environment. Finally, owners of abandoned video games that require server authentication (where such authentication is no longer available) may also circumvent DRM. DRM circumvention is NOT allowed for jailbreaking gaming systems and e-readers, and does not allow for "format-shifting" (e.g. moving e-books from one platform to another).

From the article: Among the issues concerned consumers can complain about, the form now contains "open internet/net neutrality," right there alphabetically between "interference" and "privacy." So what, specifically, qualifies as a net neutrality violation you can complain about? The FCC has guidance for that, too. In general, paraphrased, it's a problem if there's:
Blocking: ISPs may not block access to any lawful content, apps, services, or devices.
Throttling: ISPs may not slow down or degrade lawful internet traffic from any content, apps, sites, services, or devices.
Paid prioritization: ISPs may not enter into agreements to prioritize and benefit some lawful internet traffic over the rest of it on their networks. -
What To Say When the Police Tell You To Stop Filming Them
HughPickens.com writes: Robinson Meyer writes in The Atlantic that first of all, police shouldn't ask. "As a basic principle, we can't tell you to stop recording," says Delroy Burton, a 21-year veteran of DC's police force. "If you're standing across the street videotaping, and I'm in a public place, carrying out my public functions, [then] I'm subject to recording, and there's nothing legally the police officer can do to stop you from recording." What you don't have a right to do is interfere with an officer's work. ""Police officers may legitimately order citizens to cease activities that are truly interfering with legitimate law enforcement operations," according to Jay Stanley who wrote the ACLU's "Know Your Rights" guide for photographers, which lays out in plain language the legal protections that are assured people filming in public. Police officers may not confiscate or demand to view your digital photographs or video without a warrant and police may not delete your photographs or video under any circumstances.
What if an officer says you are interfering with legitimate law enforcement operations and you disagree with the officer? "If it were me, and an officer came up and said, 'You need to turn that camera off, sir,' I would strive to calmly and politely yet firmly remind the officer of my rights while continuing to record the interaction, and not turn the camera off," says Stanley. The ACLU guide also supplies the one question those stopped for taking photos or video may ask an officer: "The right question to ask is, 'am I free to go?' If the officer says no, then you are being detained, something that under the law an officer cannot do without reasonable suspicion that you have or are about to commit a crime or are in the process of doing so. Until you ask to leave, your being stopped is considered voluntary under the law and is legal." -
Supreme Court To Consider Data Aggregation Suit Against Spokeo
BUL2294 writes: Consumerist and Associated Press are reporting that the Supreme Court has taken up the case of Spokeo, Inc. v. Robins — a case where Spokeo, as a data aggregator, faces legal liability and Fair Credit Reporting Act violations for providing information on Thomas Robins, an individual who has not suffered "a specific harm" directly attributable to the inaccurate data Spokeo collected on him.
From SCOTUSblog: "Robins, who filed a class-action lawsuit, claimed that Spokeo had provided flawed information about him, including that he had more education than he actually did, that he is married although he remains single, and that he was financially better off than he actually was. He said he was unemployed and looking for work, and contended that the inaccurate information would make it more difficult for him to get a job and to get credit and insurance." So, while not suffering a specific harm, the potential for harm based on inaccurate data exists. Companies such as Facebook and Google are closely watching this case, given the potential of billions of dollars of liability for selling inaccurate information on their customers and other people. -

The whole process took months and involved false assurances and bureaucratic convolutions. The national broadband map database frequently cited by Comcast as proof of sufficient competition lists 10 options at his location, including a gigabit municipal fiber network, but he cannot subscribe to it due to Washington state direct sale restrictions. -
Comcast's Incompetence, Lack of Broadband May Force Developer To Sell Home
BUL2294 writes Consumerist has an article about a homeowner in Kitsap County, Washington who is unable to get broadband service. Due to inaccurate broadband availability websites, Comcast's corporate incompetence, CenturyLink's refusal to add new customers in his area, and Washington state's restrictions on municipal broadband, the owner may be left with no option but to sell his house 2 months after he bought it, since he works from home as a software developer. To add insult to injury, BroadbandMaps.gov says he has 10 broadband options in his zip code, some of which are not applicable to his address, have exorbitant costs (e.g. wireless), or are for municipal providers that are prevented from doing business with him by state law. Yet, Comcast insists in filings that "the broadband marketplace is more competitive than ever." As someone who had Comcast call to cancel on the day of my closing (two days before my scheduled install) because they didn't offer service to my house after all, I can sympathize. -
House Republicans Roll Out Legislation To Overturn New Net Neutrality Rules
An anonymous reader writes: U.S. Representative Marsha Blackburn (R-TN) and 31 Republican co-sponsors have submitted the Internet Freedom Act (PDF) for consideration in the House. The bill would roll back the recent net neutrality rules made by the FCC. The bill says the rules "shall have no force or effect, and the Commission may not reissue such rule in substantially the same form, or issue a new rule that is substantially the same as such rule, unless the reissued or new rule is specifically authorized by a law enacted after the date of the enactment of this Act." Blackburn claims the FCC's rules will "stifle innovation" and "restrict freedom." The article points out that Blackburn's campaign and leadership PAC has received substantial donations. from Comcast, AT&T, and Verizon. -

If they take the free data option, that goes to 3GB for the same price. Or they can elect to stick with the 2GB and their data bill drops to $40/month.
