GameFly Scores In Longstanding DVD Mailing Complaint
An anonymous reader writes "GamePolitics reports that the Postal Regulatory Commission has ordered [PDF] the U.S. Postal Service to equalize the rates paid by mailers who send round trip DVDs, and concluding (sort of) a dispute that has been underway for more than four years. The new postage rates take effect on September 30th. Some mailers, prominantly Netflix, send their round-trip movie DVDs as 'letters,' but GameFly's gaming disks are sent in slightly bigger envelopes as 'flats' to avoid breakage, and so GameFly has paid a much higher postage rate. GameFly argued that this was unfair discriminatory treatment because USPS was providing special hand-sorting treatment for Netflix disks without charging Netflix for the extra handling. But now there's a new twist: the Postal Service wants to reclassify DVD mailing [PDF] as a competitive product, where the prices would not be limited by the rate of inflation, because it says that mailed DVDs compete with the internet, streaming services, and kiosks such as Redbox. The regulatory agency is accepting responses [PDF] from interested persons until September 11th to the Postal Service's latest comments on its request [PDF]." -

GameSpy's New Owners Begin Disabling Multiplayer Without Warning
New submitter OldTimeRadio writes "Over the last month, both game publishers and gaming communities alike were surprised to find their GameSpy multiplayer support suddenly disabled by GLU Mobile, who purchased GameSpy from IGN this August. Many games, including Neverwinter Nights 1 & 2, Microsoft Flight Simulator X, Swat 4, Sniper Elite, Hidden and Dangerous 2, Wings of War, Star Wars: Battlefront are no longer able to find (and in some cases even host) multiplayer games. While games like Neverwinter Nights are still able to directly connect to servers if players know the IP address, less-fortunate gamers expressed outrage on GLU Mobile's 'Powered by GameSpy' Facebook page. In an open letter to their Sniper Elite gaming community today, UK game developer Rebellion explained it was helpless to change the situation: 'A few weeks ago, the online multiplayer servers for Sniper Elite were suddenly switched off by Glu, the third-party service we had been paying to maintain them. This decision by Glu was not taken in consultation with us and was beyond our control. We have been talking to them since to try and get the servers turned back on. We have been informed that in order to do so would cost us tens of thousands of pounds a year — far in excess of how much we were paying previously. We also do not have the option to take the multiplayer to a different provider. Because the game relies on Glu and Gamespy's middleware, the entire multiplayer aspect of the game would have to be redeveloped by us, again, at the cost of many tens of thousands of pounds."" -

Valve's Newell: One-Price-For-Everyone Business Model 'Broken'
Fysx writes with recent comments from Valve co-founder Gabe Newell about how he thinks the traditional video game business model is flawed: "The industry has this broken model, which is one price for everyone. That’s actually a bug, and it’s something that we want to solve through our philosophy of how we create entertainment products. What you really want to do is create the optimal pricing service for each customer and see what’s best for them. We need to give customers, all of them, a robust set of options regarding how they pay for their content. An example is – and this is something as an industry we should be doing better – is charging customers based on how much fun they are to play with. Some people, when they join a server, a ton of people will run with them. Other people, when they join a server, will cause others to leave. We should have a way of capturing that. We should have a way of rewarding the people who are good for our community." -
Sony Online Entertainment Services Follow PSN Down
nam37 writes "Sony Online Entertainment's various services seem to be down and a message on the official site does not give much information on the particulars. According to a short post on the site, the services were taken down after an investigation revealed a deeper 'intrusion' than expected at first. This is the first we have heard that Sony's MMORPG arm had some sort of security breach. This could be part of Sony's plans to beef up security for the PlayStation Network, but this message seems to indicate that something more serious going on." -
FTC To Examine Microtransactions In Free-To-Play Games and Apps
A post at GamePolitics points out that the Federal Trade Commission will be looking into free-to-play mobile games that rely on internal microtransactions as a business model. Many such games are marketed for children, and there have been a spate of cases where kids racked up huge bills without their parents' knowledge or explicit consent. "The in-app purchases have also catapulted children's games such as Smurfs' Village and Tap Zoo, by San Francisco-based Pocket Gems, into the ranks of the highest-grossing apps on iPods, iPhones and iPads. But the practice is troubling parents and public interest groups, who say $99 for a wagon of Smurfberries or $19 for a bucket of snowflakes doesn't have any business in a children's game. Though a password is needed to make a purchase, critics say that the safeguards aren't strong enough and that there are loopholes. 'Parents need to know that the promotion of games and the delivery mechanism for them are deceptively cheap,' said Jim Styer, president of Common Sense Media, a public advocacy group for online content for children. 'But basically people are trying to make money off these apps, which is a huge problem, and only going to get bigger because mobile apps are the new platform for kids.'" -
UK Courts Rule Nintendo DS R4 Cards Illegal
CheShACat writes "A UK high court ruled today that R4 cards for the Nintendo DS are illegal, finding two vendors guilty of selling 'game copiers.' The ruling by Justice Floyd is quoted as saying, 'The economic effect on Nintendo of the trade in these devices is substantial as each accused device can store and play copies of many Nintendo DS games [...] The mere fact that the device can be used for a non-infringing purpose is not a defence.' No word in the article as to what law in particular they were found to have broken, nor of the penalty the vendors are facing, but this looks like bad news for all kinds of hardware mod, on any platform, that would enable homebrew users to bypass vendor locks." Nintendo won a related lawsuit in the Netherlands recently, in addition to the one in Australia earlier this year. -

Civilization V To Use Steamworks
sopssa writes "2K Games today announced that Civilization V will be using Steamworks for online matchmaking, automated updates, downloadable content and DRM for the game. Steam's Civ V store page is also available now, revealing some new information about the game. There will be an 'In-Game Community Hub' for online matchmaking, communication, and for sharing scenarios between players. While including Steamworks might put some people off, it might also indicate better online gameplay than in the previous Civilization games, where it was almost impossible to have a good game without playing with just friends." -
South Korea Announces Daily MMO Blackouts For Youths

While it targets most popular MMORPGs, some popular games like Lineage were left off the list." -
Examining Virtual Crimes
GamePolitics has an article about a research paper issued by the AU government's Institute of Criminology titled "Crime Risks of Three-Dimensional Virtual Environments." The paper discusses the legal questions raised by game worlds and avatars, ranging from regulation of in-game currency to a report of virtual rape. "A person controlling an avatar that is unexpectedly raped or assaulted might experience the physical reaction of 'freezing,' or the associated shock, distrust and loss of confidence in using [3D virtual environments]. While civil redress for psychological harm is conceivable, the 'disembodied' character of such an incident would invariably bar liability for any crime against the person. However, Australian federal criminal law imposes a maximum penalty of three years imprisonment for using an internet carriage service to 'menace, harass or cause offence' to another user. Further, US and Australian laws ban simulated or actual depictions of child abuse and pornography. Therefore, any representations of child avatars involved in virtual sexual activity, torture or physical abuse are prohibited, regardless of whether the real-world user is an adult or child." -
Game Developers Note Net Neutrality Concerns To FCC
eldavojohn writes "A list of notes from game developers (PDF) was sent in a letter to the FCC which represented a net neutrality discussion between the developers and FCC representatives. Game Politics sums it up nicely, but the surprise is that developers are concerned with latency, not bandwidth, unlike the members of many other net neutrality discussions. One concern is that each and every game developer will need to negotiate with each and every ISP to ensure their traffic achieves acceptable levels of latency for users. 'Mr. Dyl of Turbine stated that ISPs sometimes block traffic from online gaming providers, for reasons that are not clear, but they do not necessarily continue those blocks if they are contacted. He recalled Turbine having to call ISPs that had detected the high UDP traffic from Turbine, and had apparently decided to block the traffic and wait to see who complained.' It seems a lot of the net neutrality discussions have only worried about one part of the problem — Netflix, YouTube and P2P — while an equally important source of concern went unnoticed: latency in online games." -
ASCAP Seeks Licensing Fees For Guitar Hero Arcade
Self Bias Resistor writes "According to a post on the Arcade-Museum forums, ASCAP is demanding an annual $800 licensing fee from at least one operator of a Guitar Hero Arcade machine, citing ASCAP licensing regulations regarding jukeboxes. An ASCAP representative allegedly told the operator that she viewed the Guitar Hero machine as a jukebox of sorts. The operator told ASCAP to contact Raw Thrills, the company that sells the arcade units. The case is ongoing and GamePolitics is currently seeking clarification of the story from ASCAP." -
FTC Says Virtual Worlds Bad For Minors

The report makes five recommendations to keep little Johnny away from the harms of Barrens chat: Use more effective age-screening mechanisms to prevent children from registering in adult virtual worlds; Use or enhance age-segregation techniques to make sure that people interact only with others in their age group; Re-examine language filters to ensure that they detect and eliminate messages that violate rules of behavior in virtual worlds; Provide more guidance to community enforcers in virtual worlds so they are better able to review and rate virtual world content, report potential underage users, and report any users who appear to be violating rules of behavior; and Employ a staff of specially trained moderators who are equipped to take swift action against rule violations." -

Russia Recalls Modern Warfare 2

Seems the Russian government was none too happy about the portrayal of Russia in the game and decided to yank it from stores. Infinity Ward has responded with a patch that removes the 'No Russian' mission (the content in question) from the storyline. Before you overly criticize the Russian government, there may be some truth to the claim that the game's story line overly demonizes Russians as just terrorists as the Russian site GotPS3.ru alleges. Is cultural sensitivity becoming an overly played card in the gaming world? Not too long ago, Wolfenstein was recalled in Germany for containing Nazi symbols." -
FCC Mulling More Control For Electronic Media
A recent Notice of Inquiry from the FCC is looking for opinions on how the "evolving electronic media landscape" affects kids, and whether the FCC itself should have more regulatory control over such media. "FCC Chairman Julius Genachowski included a statement with the NOI in which he noted that 'twenty years ago, parents worried about one or two TV sets in the house,' while today, media choices are far more widespread for children, including videogames, which 'have become a prevalent entertainment source in millions of homes and a daily reality for millions of kids.'" -
Leaked Modern Warfare 2 Footage Causes Outrage

Probably just advertising at work, but the footage is indeed controversial — the question remains whether or not it is out of context." -
BringIt.com Allows Players to Bet On Console Game Matches
eldavojohn writes to tell us of a new service, "BringIt.com," that allows gamers to put their money where their mouth is with respect to their console gaming skill. "BringIt supports the PlayStation 2, the PS3, the Xbox 360 and the Wii. Players challenge each other on the site, but play on their consoles. BringIt holds players' entry fees until the game is finished. After the game is done, it verifies the results and credits the winner, minus the service fee. To attract players of a broad range of skill sets, BringIt has separate tournaments meant for novice players and expert gamers. Levin compared it to the handicap system in golf or the weight-class system in wrestling. -

Shortly thereafter, State Senator Leland Yee petitioned the US Supreme Court to review the case. Now, along with California's Psychiatric and Psychological Associations, Yee has filed an amicus curiae brief with Court that elaborates on the reasoning behind the law. Within the brief (PDF) are some interesting quotes: "Parents can read a book, watch a movie or listen to a CD to discern if it is appropriate for their child. These violent video games, on the other hand, can contain up to 800 hours of footage with the most atrocious content often reserved for the highest levels and can be accessed only by advanced players after hours upon hours of progressive mastery. ... Notably, extended play has been observed to depress activity in the frontal cortex of the brain which controls executive thought and function, produces intentionality and the ability to plan sequences of action, and is the seat of self-reflection, discipline and self-control." The video game industry has filed its own amicus brief to dispute Yee's claims. -

Senator Applauds Pirate Bay Trial, Chides Canada
eldavojohn writes "Republican Senator Orrin Hatch spoke Tuesday at the World Copyright Summit in Washington DC and hailed the Pirate Bay guilty verdict as an important victory. He expressed severe disappointment in Canada for showing up on our watch list for piracy next to China and Russia. Senator Hatch also said, 'In fact, one study reports that each year, copyright piracy from motion pictures, sound recordings, business and entertainment software, and video games costs the US economy $58 billion in total output, costs American workers 373,375 jobs and $16.3 billion in earnings, and costs federal, state, and local governments $2.6 billion in tax revenue. During this time of economic turmoil, we must ensure that all copyrighted works, both here and abroad, are protected from online theft and traditional physical piracy. After all, US copyright-based industries continue to be one of America's largest and fastest-growing economic sectors.' GamePolitics notes that for his 2006 campaign, Hatch was rented for $7,000 by the RIAA and also got on his knees for $12,640 from the MPAA." -
German Interior Ministers Seek Ban On Violent Games
GamePolitics reports that "Germany's 16 Interior Ministers have banded together to ask the Bundestag (Germany's equivalent of Parliament) to ban the production and distribution of violent video games. Moreover, the ministers hope to see this accomplished before Germany's new elections take place on September 27th." Violent games became a national issue in Germany earlier this year after Far Cry 2 was scapegoated for a shooting. Germany-based game developer Crytek could be forced to move or outsource if the ban goes through. Spiegel Online has the original story (Google translation). -
Learning From EA's Annual Report

It also shows that 'game content legislation and its potential effect on sales' concerns EA, as does the potential for a 'Hot Coffee incident.' More evidence that while it's good to be the big dog, it comes with a lot of responsibility and worrying." -

New York. Applying strict scrutiny, we hold that the Act violates rights protected by the First Amendment." Well, that didn't satisfy a PhD child psychologist turned Democratic California State Senator named Leland Yee who states in his press release that "California's violent video game law properly seeks to protect children from the harmful effects of excessively violent, interactive video games. I am hopeful that the Supreme Court — which has never heard a case dealing with violent video games — will accept our appeal and assist parents in keeping these harmful video games out of the hands of children. I believe the high court will uphold this law as Constitutional. In fact in Roper v. Simmons, the court agreed we need to treat children differently in the eyes of the law due to brain development." Wal-Mart Enters the Used Game Fray
eldavojohn writes "It's a simple model — you buy used games for a third of the price of a new one from patrons. Then you turn around and sell the game for two-thirds the normal price to other patrons that have not yet enjoyed the title. Such has been the model for stores like GameStop. The great part about that business is a recession can sometimes help their market, as gamers look to save a few bucks any way possible. Well, today Wal-Mart launched kiosks in 77 of its stores that vend used video games. Looking like a RedBox DVD kiosk, these automated machines are full of bugs, but spell trouble for businesses like GameStop. This should also pique the interest of used-game opponents and provide a bigger target for them to go after if they get the politicians on their side." -
NY Bill Proposes Fat Tax On Games, DVDs, Junk Food

The logic from its author: 'Almost all experts agree that the primary reasons [for the obesity epidemic] are increased consumption of larger quantities of high calorie foods, snacks and sugar sweetened beverages... and lack of physical activity as vigorous play is replaced by sedentary activities such as watching more television, movies and videos and playing video games. This bill would raise revenues from modest surcharges on the very food products and sedentary activities that are linked to the lifestyle changes involved in the explosion of childhood obesity in the last 20-30 years.' In addition to that, realistic use of narcotics has entered mainstream games. While gamers (of adult age) have by and large won the right to this entertainment, a large amount of games have arisen lately that challenge a different aspect of video games — inappropriate or sensitive topics. We've covered it before on Columbine to Fallujah, but I noticed through GamePolitics recently a large trend in severely controversial video games. Where do you stand on these titles?" Read on for the rest of eldavojohn's thoughts.First I'd like to discuss the basic complaints many people have over these video games. The phrase "too soon" gets thrown around a lot. But what are the specific complaints about these controversial games? I've tried to divide them up from most serious to not-so-serious attributes (which a controversial game may have one or more of, and which is by no means a comprehensive list):
- Human life was lost.
- People who survived the situation or are survivors of victims of the situation still remember it, as it happened less than one generation ago.
- It spins the situation too much as novelty or entertainment and thus disrespects those involved and/or detracts from the gravity of the situation.
- It deals with a very real life issue that some people aren't comfortable discussing, such as: race, religion, sexual orientation, slavery, politics, the law, prostitution, drug use, etc.
- Stuck in a think-of-the-children mentality, the "M" or even "AO" rating does not deter groups and people like Jack Thompson from arguing that it is not appropriate material for minors and therefore should not be distributed. Popularity of a title and great game mechanics may exacerbate this.
I'm going to start with an easy game to discuss: RapeLay — an obscure title by a Japanese publisher that focuses on forced sex situations. There is something special about sexual crimes that make them even worse than murder in the United States. I don't know why, but Hot Coffee in GTA3 drew far more criticism than the normal killing rampage in that game and games before it. This same phenomena occurs at parties where they play games that a murderer is at the party. Yet, if a rapist was at the party, people would probably be mortified. While the sentencing isn't as harsh, sex offenders are registered and tracked for the rest of their lives while murderers can be released or paroled under good behavior. I see RapeLay as nothing more than a game concentrating on a particular crime — a less serious crime than many I commit in some of the games I play. I've no desire to play it, but people who derive entertainment from that have a right to it. RapeLay is merely another adult game like Dangerous Toys for the Dreamcast.
Nothing could be more recent than making a simulation game where you're a Somali pirate invading other ships. You have an impoverished community with people starving to death and people being taken captive. A player is most likely deriving entertainment from horrible situations on other continents today. This isn't Disney making three Pirates of the Caribbean movies based loosely on a very real and life-threatening situation four hundred years ago. This is completely a function of when it happened. On the other hand, piracy on the water has been a classic platform for games, and if the game is historically accurate, how much different is this than an in depth news article? Keep in mind that this is the same game company that partnered with the History channel to bring you WWII and Vietnam games in the past. I think it is very much arguable that games based on war can be informative if done correctly.
A quick note on a more wide spread release for the Playstation 2 is a game that some Hindu groups say is offensive to their religion. Along the same lines, several online games have depicted Mohammad which is a no-no in Islam causing unrest. These situations are offensive to a small part of the population and — unless done in very disrespectful ways — aren't going to gather much more controversy. They're no Muslim Massacre: The Game of Modern Religious Genocide, but they are reportedly offensive to some groups of people. On the other end are religious games that gain controversy by targeting non-members of that faith. Left Behind: Eternal Forces was controversial because of violence against non-Christian characters in the video game. Video games like Ethnic Cleansing express extreme prejudice and hate towards a particular ethnicity or nationality. Murder and violence are still murder and violence whether you are religiously motivated, racially motivated or have no clear motivation (like GTA). It is difficult to argue that these games should be outlawed while claiming that it's our right to enjoy games like GTA. Is it because these games are used for propaganda or recruitment tools and mainstream games are not? Is it because of a controversial message in the game? If so, I would like to know why this is any more dangerous than murder in video games.
None of these games faced the wide distribution that Six Days in Fallujah was looking at. And that game is now canceled, the deciding factor most likely being that it was a big name publisher with wide distribution channels. Not that the content was any more or less controversial than some of the games Kuma has made about Vietnam and WWII, but it would have had a wider release and been about a present day war that is still in progress. Books written about the Iraq war have to be careful; news about the Iraq war has to be sensitive to families. Games — a form of non-necessary entertainment — have to be even more careful if they want to enjoy popularity and avoid criticism. As a society, we are just not ready to accept games as a dignified medium. Other mediums faced this same barrier and overcame it, and it's good to have these games testing the waters.
In the United States, it's easy to claim freedom-of-speech this and freedom-of-speech that, but the lawsuits will flow from interest groups with money — no rating system will satisfy them. Letting the popularity (or lack thereof) of a title speak for its quality and message is not enough for some people. The general populace do not yet accept games as an art form like books and movies. Entertainment and even edutainment are not seen as appropriate ways to portray current events, and they may not be for a long time.
Where do you stand on controversial video games? Should publishers and developers be able to release whatever they want? Super Columbine RPG? RapeLay? Six Days in Fallujah? Are they protected by free speech? Will games forever be entertainment and therefore never be able to cover current topics? How would you effectively regulate content if I should be able to play a game like GTA but not Six Days in Fallujah? Do these titles hurt the social standing of gamers and gaming as a medium?

GamePolitics was on hand to cover the protest, and took video of the arrests. A local news station also reported on the rally, and the Peace Action Network released a statement saying, "In its desperate approach to meet recruiting numbers, the military is teaching the wrong values to teenagers. Sugarcoating combat experience with virtual war is a dishonor to those with real war experience." -

Konami Cuts and Runs From Iraq War Game
Less than a month after the announcement of Six Days in Fallujah , a video game based upon a real-life battle between US Marines and Iraqi insurgents in 2004, Konami has decided that it is too controversial, and abandoned plans to publish the game. The developer, Atomic Games, has not commented on Konami's decision other than to say an announcement will be made soon. Konami told a Japanese newspaper, "After seeing the reaction to the video game in the United States and hearing opinions sent through phone calls and e-mail, we decided several days ago not to sell it." While the game did receive a great deal of criticism, others were optimistic, including several outspoken veterans of the Iraq war. One of the major complaints was that in researching the battle, Atomic Games reportedly interviewed several insurgents. This prompted speculation that the insurgents were compensated for their help, though Atomic later denied that was the case. Konami's decision also may have been influenced by the fact that they seemed to represent it as entertainment, whereas Atomic's president, Peter Tamte, was more hesitant to describe it as "fun." He said, "The words I would use to describe the game — first of all, it's compelling. And another word I use — insight." -
Study Claims 8.5% of Young Gamers "Pathologically Addicted"
schnucki brings word of new research which claims roughly one in twelve American children between the ages of eight and 18 are "pathologically addicted" to video games. The study, conducted by Douglas Gentile, director of the National Institute on Media and the Family at Iowa State University, says that "pathological status was a significant predictor of poorer school performance even after controlling for sex, age, and weekly amount of video-game play." However, Professor Cheryl Olson, who has conducted her own research into video game use, questioned Gentile's methodology, saying, "The author is repurposing questions used to assess problem gambling in adults; however, lying to your spouse about blowing the rent money on gambling is a very different matter from fibbing to your mom about whether you played video games instead of starting your homework." -
Supreme Court Declines Jack Thompson Appeal

They wouldn't even give him the time to review his appeal, so it appears his disbarment for life stands. Florida had declined to file a response to Thompson's appeal, and it turns out they didn't need to. Sad day for Jack Thompson, but a great day for gamers everywhere." You might recall Utah being Jack's last hope and hold-out after being disbarred in Florida and more or less made a mockery everywhere else. Well, from Utah's Senate Site, we get the picture of what Jack is up to now: spamming his last friends on the planet. The Salt Lake Tribune is reporting on Senate President Michael Waddoups' statements: 'I asked you before to remove me from your mailing list. I supported your bill but because of the harassment will not again. If I am not removed, I will turn you over to the AG for legal action.' The Salt Lake Tribune reports that Waddoups confirmed on Tuesday that he would attempt to pursue legal action under the federal CAN-SPAM Act of 2003 against Jack Thompson." -

Not long ago we discussed news that the Utah Senate and House had both passed legislation worked on by Jack Thompson that would add restrictions on how game advertising interacted with the rating system. The bill itself was poorly amended, and many questioned whether it would have the effect its sponsors desired. GamePolitics asked a First Amendment rights expert for his opinion on the matter, and the National Coalition Against Censorship spoke out against the bill, urging Governor Jon Huntsman to strike it down. Fortunately, it appears he took their advice (or that of many lobbying retailers), as the bill has now been vetoed. Huntsman said, "The industries most affected by this new requirement indicated that rather than risk being held liable under this bill, they would likely choose to no longer issue age-appropriate labels on goods and services." -
