ESRB Changes Oblivion's Rating to 'Mature'

kukyfrope writes "Perhaps reacting based on the debacle that was the 'Hot Coffee' scandal, the ESRB today changed the rating on The Elder Scrolls IV: Oblivion from Teen to Mature. From the article: 'The content causing the ESRB to change the rating involves more detailed depictions of blood and gore than were considered in the original rating, as well as the presence of a locked-out art file or 'skin' that, if accessed through a third party modification to the PC version of the game, allows the user to play with topless versions of female characters,' said the ESRB in a release."

      Yeah, I tried it a while back... so there's some pixelated tits, but they do absolutely nothing. There's no way to use them in any erotic context. It was about as arousing as an article about breast cancer with illustrations. With the game mostly in 1st person or from behind in 3rd person, you barely see them. If this is "Mature", then the nude skins + kissing in the Sims should make it rated XXX.

      Yes right here. I'm using it right now and I just find it makes the game more realistic. When I remove someones shirt they should not have some stupid leather bra under as I believe in the past no one ever used bras. Anyways, enjoy.

      Yes, but we all know by now that American priorities are to hide things that half the population have while showing all sorts of gruesome violence and gore to desensitize us. I've used the mod, the only time you see anything is when in the menu screen where you select your armor. It's definately about realism, not being erotic.

      I just wish the game natively supported wearing/unwearing multiple kinds/styles of underwear. In a game where you can do everything you can't do something as simple as taking off your underwear.
      This also applies to the male game characters, they should be able to buy different kinds of underwear, or go comepletely savage, just like a primitive club and free ballin'.

      Most of the world finds the US attitude to nudity as amusing.
      That whole Janet Jackson thing was the biggest beatup in history.
      Where i live (Australia) if you want to see a boob (breast) you just go to the nearest beach and see the real thing.
      The idea of downloading and applying a patch to a game just to cop an eyefull of animated tit is a joke, even the kids around here aren't that desperate.

      Actually, Lara Croft's boobs in the original Tomb Raider consisted of four polygons: two triangles and two rectangles. That's only a decade ago.

      Now boobs consist of tens of thousands of polygons, and the physics engine makes them jiggle realistically! Think of what this does for gameplay!

      In all seriousness, I think that Oblivion should have been rated mature in the first place, but this is for bogus reasons. If it's not in the vanilla unmodded game why the fuck are they rating for it? ESRB, do you have an answer for me? It's also interesting to note that the ESRB usually overrates games, i.e. Halo and Halo 2 getting M ratings. All of the blood there is blue or fluorescent orange, and there's less than Oblivion.

      I think I'm going to start taping 'The View', ripping it, making some modifications to the hosts' clothing and then make the copies available on the internet. Barbara Walters is almost scary enough to for the show to need a mature rating as it is.

      You could technically mod nudity into any PC game, yes, but, in this case, the original topless female mesh was already present in the game as distributed, it was simply not usable until a mod enabled it (by pulling the resource out of an archive and placing it into a separate file, overriding the normal female upper body mesh).

      The simple fact of the matter is that there were nude patches created for Morrowind as well as for Oblivion, in similar timescales, with similar detail levels relative to the rest of each game. In both cases, the required step to add nudity was the same (download and install unsupported third-party modification), and the outcome was the same (nude females appear in game). The only difference is the source of the data used by the third-party modders.

      So why was the rating changed for Oblivion, but not for Morrowind?

      The source of the data is the critical point. While the ESRB can't base their ratings on third-party content, they have every right to rate the content that actually ships on the disc. So, for a slightly more off-the-wall example, if a T-rated game shipped with a password-protected archive of Playboy photo shoots on the disc - completely unaccessible from, and unrelated to, the game itself - the ESRB would still jack the rating up because the material is being shipped.

      I personally don't think bare breasts are that big of a deal (though they can be a lot of fun in RL), but the ESRB isn't there to either protect me (age 34) or to represent me (childless). They exist to keep f***ing legislatures out of the gaming business, and they've succeeded to a large extent. Since they know that politicians and many parents would care a lot about bare breasts, they've got to rate games accordingly.

      In other words, I think some people here need to learn to love the ESRB...and the bomb...

      Why should I care whether it's the legislature or the ESRB that are stopping people from seeing breasts? It's all the same to me. Am I supposed to feel "freer" if people are acting in fear of what the legislature might do instead of waiting for them to do it?

      Though, technically, one could use a texture for say an elbow or a knee as a breast. The texture came from the game --> M or AO rating. Probably only a matter of time until someone starts using it to sabotage the competition's game sales this way.

      The ESRB doesn't stop anyone (over 18) from seeing anything they want to in a videogame. It also doesn't prevent a developer from putting anything they want to in a videogame. If you're looking for people to blame, look no further than the store from which you buy your games. Virtually all stores have a firm policy of selling no "AO" content and some won't even sell "M" rated games. If developers/publishers knew that they could have shelf space for games with more "adult" themes, they wouldn't care a bit about the ESRB rating. As it is, though, if they push the envelope too far then their product goes nowhere.

      Personally I don't really see what the big deal with toplessness and/or nudity is. It's a nudity is a perfectly nature aspect of human life. Now, going around and hacking people and seeing peoples heads impaled on sticks, isn't.

      I'm pretty shocked to hear the Oblivion was rated Teen (13+) before, and now that there is a way to show breasts it all the sudden becomes Mature (17+)? After playing Oblivion for a while and especially going into some of the Oblivion gates I have no idea why this was rated for 13+ in the first place?

      Is it better that people see rotting corpses with their ribs hanging out, go around smashing people with a giant hammer and so forth, or that they, god forbid, see a pair of breasts. People need to realize witnessing violence and committing it in a game is more for mature people than seeing nudity.

      You can see the PR wordsmith at work here. By saying that they took into consideration the violence AND toplessness, they are satisfying both the people who want it banned because of the boobies incident and people who don't want it banned solely based on the boobies incident.

      In either case, the gamemaker could have left some content off the disc, even if it were "locked out."

      I was thinking the same thing. It's absolutely ridiculous to change the game rating because some player decides to make a modification that contains "mature" content. Why should the game maker have to suffer because someone writes an unsupported mod? (See GTA: San Andreas). Should game companies be forced to now prevent users from modifying the game to protect themselves from rating changes, etc..

      I wonder if Oblivion will lose sales due to this (stores that don't stock Mature games, does Walmart still do this?). Or maybe Oblivion will gain sales from the all the free publicity of the ratings being changed. I think there's already enough hype and buzz behind it (the original game), sales will probably just increase.

      I'm seeing the possibility of these kind of rating complaints escalating as technology moves forward and games become realistic. Will game developers in the post-next-gen era be continually forced to make underwear part of character meshes? How about when we start seeing realistic flowing clothing on 3d models; will they always be barbie dolls? In my opinion, anyone smart enough to install the mod for the game surely also has the skills needed to access pornography on the net. I'm seriously against the flawed justification for this rating change.

      It's just a fundamental flaw with the ESRB system, the board relies on the publisher to compose a video of the worst scenes in the game. This relies on the judgement of the publisher (and the lack of unforeseen situations). A much better method would be to require the ESRB to play through a game and unlock everything (if unlocking takes a lot of time the testee should provide a savegame or password that unlocks everything) before giving out a rating. The german USK requires a complete playthrough with the help of walkthroughs that include every secret room or easteregg and possibly cheats (if anything is left out the rating is void). Since they still manage to rate over 4000 games each year that can't be too demanding. The ESRB really needs to be less lazy.

      I agree completely with this statement, although I disagree with your conclusion. As I understand it, the ESRB exists to warn consumers of potentially offensive material and allow them to make a more informed purchase. This rating is based on the content of said purchase. I assert that this content includes multimedia assets and game code/instructions. I do not believe you can separate the two and rate the game based on one or the other, but instead must judge the product as a whole, as it is available to the end consumer.

      Through modification of the code, nudity is available. This is a modification of the content, and must be downloaded after market, or explicitly written by the user. I don't believe the ESRB has the right to change the rating of a product based on what people in the market can do after the product's release, but should stick to rating what the product actual does do. Otherwise, they are no longer of use to anyone.

      The only way I can see a justification for the action they have taken (and this is a slim chance) is if they are including the construction kit in the rating evaluation. Because with that, any user can modify the game's content, using software (more content) that shipped with the product. But this still would not justify the rating change on the xbox 360 version. I see no reason for that change other than fear of Hilary Clinton and her political agenda. I don't own Oblivion, so I am not aware if the construction set is a separate download or not on the PC version.

    If i make a mod for Oblivion allowing the player to engage in sexual intercourse would that mean the ESRB would have to rank Oblivion AO?

    Basing the rating of a game upon the available third party content seems very stupid to me. I'm sure i'm in the majority of slashdotter who think that changing the rating of a game because of mods is stupid.

    this does not bode well for the future of video game ratings.

      The "art file or 'skin'" was already present in the game, locked out or otherwise.

      The third party tool gave you access to what was already there... exactly like GTA & their hot coffee disaster.

      What the ESRB is trying to tell game makers is that they need to stop including postentially sexual content on the game discs, even if it's "locked out".

      What if I create a mod for a different game (A T rated game) that swaps a skin texture from one character (say, a shirtless guy) to another (a female character) and creates the effect of a "topless character"? Should the game then get an M higher rating? It's only using content that was already in there, although not normally accessable to players? "Potentally sexual content" could be nearly anything!

      What if I make a third party mod that "unlocks" the "hidden" nudity that comes when you layer thousands of images on top of each other, and for each pixel position selects 1 of the thousands of images to show though. It'd be simple to take pre-existing algorithms and get xxx pictures outta that.

      Now, my mod is simply taking stuff that's already on the disc and displaying it. It's just doing so in a way that the developers didn't intend. 18+ rating for everything!

      There's got to be a line drawn, and it should be drawn by saying that if you can access the content without the use of third party tools/mods/whatever, then it should count for the rating. If you have to hack the system in order to modify the game in order to gain access to content, then it shouldn't count against the rating. Once you allow content unlocked by a third-party modification to the game to count for ratings purposes, you've started down a slippery slope.

      Theres no chance in hell a skin for a male model would even fit a female model, unless for some strange reason they were modeled the exact same way. And anyone who is familiar at all with the human anatomy will tell you, Men and Women cannot be modeled the same way.

      That being said taking a male skin and applying it to a female model, will probably come out riddled with errors.

      You're setting up a strawman.

      What happened in this case is that they left the digital equivalent of a picture of breasts in the data tree. The offending skin fits on the model, and they damn well should've known better after Hot Coffee.

      The simple solution here is, if you've made a texture of something pornographic, don't leave it in the data tree if you're told by your publisher that they'd like your game to be targetted for an ESRB rating of T. Seriously. This isn't hard, game developers, unless your game is already on the shelves.

      Once again I scratch my head at this notion that human nudity is somehow harmfull. That seeing what we hide underneath our clothing can somehow damage our phsyche. Depictions of sex fall under the same category if you ask me and this thing doesn't even go there. Its a character without clothes being depicted as anantomically correct. What in the seven hells is wrong with that? Rating this mod as mature due to this depiction is about like labeling a science text book as mature because it depicts sexual organs. This is silly. Its also sexist as there is no hue and cry over the fact the male character is depicted anatomically correct when bare chested. So what the hell is the big deal ?

      Ahem, sorry. I just don't get how you can rate a game based on a mod. I don't care if the "Hot Coffee" content was in the GTA data files. You couldn't ever access it without downloading a THIRD-PARTY unlocker. This is no different if the third-party mod had the content itself, and there's no way you can rate a game based on the mods that players create. In all cases, the user is going out and displaying this content through a third-party means, content that would normally never appear in game at all.

      Fuck the ESRB. Fuck them in their pixelated, unlocked assholes.

      That's a lot of work to not do what happened here. The developers went through the trouble to explicitly design titty textures (oh man, I just named my nerd strip club) and put the file on the game disc, but didn't access it.

      What you're doing could be done with anything, anywhere - splice non-offensive content into offensive content. This is offensive content that's ready to go, it's just not easily accessible, and inaccessible within the normal, unmodified game, but it's still there.

      What you're doing is layering sheet music of all of Beethoven's works until you get one that sounds like a woman moaning in orgasm. That doesn't prove that Beethoven wrote music that included orgasm.

      What Bethesda did was include Beethoven's secret symphony that actually includes a woman moaning in orgasm, but you can't read it without unsticking those two wet pages in the middle, which is difficult, unneccesary and which very, very few people would try to attempt - but does prove that, in fact, Beethoven wrote a symphony that requires a woman moaning in sexual ecstacy. True fact.

      That said... all Bethesda has to do is release a mod to unlock all those doggy-style animations that are also built in, and everyone will forget "horse armor." Except the people who use that mod AND the sexin' mod. Which would just be weird.

      If it's not available to someone playing the unmodified game then it's not relevant to the rating of the unmodified game. The fact that objectionable artwork is or isn't hidden on the disk is irrelevant. ERSB's ratings system is supposed to provide ratings for games AS YOU BUY THEM, not as they may become when modified. If ERSB wants to start providing ratings for mods, that's fine, but until then they should limit themselves to the content that is in the game, not what is on the disk.

      What about DVDs with bonus features and deleted scenes that may contain nudity or gore that would have gotten the theatrical release a more severe rating if they had been in the original film? They still rate the DVD release according to the original MPAA rating, and simply include a disclaimer that says something like, "bonus material not rated." If the core game install, without modifications or hacks added does not contain that content or it is not accessible, it should not be held against the game during the rating. Pretty soon we'll have games being delayed for months to remove all the extraneous bits that aren't necessary for the final build, but tend to lead to cool hacks later on. How much additional enjoyment have people gotten from the unused, hidden levels in games like GTA, Vice City, San Andreas, and Liberty City, to name a few? When does it stop?

      Most games that I've messed with use the same character models for male and female (developers are lazy) and just modify the vertexes to differentiate.

      Besides, that was just one example. There is a nearly limitless number of ways you could mess with existing game data that would make it not fit the current ESRB rating. You could even theoretically "clean up" some games by removing blood spatter or swapping a nude texture with a nun habit texture or something. Not that it'd matter to the ESRB of couse.

      In fact there is a strong argument here that their ratings are meaningless because if it rates potental content, then nearly every game should be AO. You never know what those crazy modders could do.

      No, it's more like Beethoven wrote the symphony, then inked over the naughty portion so that no one could see it. Then later, someone comes along, figures out how to remove the ink laid on top, and reveals what was inaccesable until their modification. Beethoven's intended performance would have been without the naughty portions. He'd inked them out after all. The modified performance is what the 3rd party intended, they're the ones that revealed and included what Beethoven had thought about but decided against.

      Anyways... what would your stance be if the developer included only non-naughty pictures, but coded so as to display naughty stuff in-game by using the technique mentioned previously (laying the non-naughty ones and selecting appropriate bits)? I think it's safe to say that you would be calling for it to have a higher rating then.

      But if a 3rd party did it you wouldn't.

      So you obviously believe that the rating should be affected by what the code does, not just what the raw content is. You also believe that a 3rd party modifying what the code does shouldn't affect the rating... unless the modification is only modifying the code to allow content to be accessed that the code didn't allow access to previously? That seems strange to me... and I'm not really understanding why you differentiate that modification from modifying code to create content that the code wasn't creating already.

      Just to reiterate, the nude texture was included into the game because Oblivion's clothing and armor textures/meshes would not always look correct with a bra texture going straight through it. The bra mesh would also cause clipping and it would be rather clunky to retexture it with every armor. Rather than make some convoluted script that checks skin tone and modifies the existing texture, Bethsoft used a much simpler solution.

      I think that the presence of nipples are the foremost concern for those who object to the "nudity" nipples are apparently the most offensive part of the mammary and must therefore never be shown to children of any age. But if we consider the role a nipple might play in the modelling of armor and clothing (although I will admit that I have no experience in this matter and will defer to the knowledge of anyone who does), such as providing a boundary for how far the neck of a peice of attire can go. The nipple play a part in determining where a seam might be placed on a blouse or an indentation on a tight fitting dress.

      Unlike the Hot coffee mod, which was an intentional inclusion of graphic content, Oblivion's mesh and texture were created to make the game run more smoothly and quite possibly as a modder's resource. The "nipple" on the topless mesh is barely distinguishable from the rest of the breast, and Bethsoft goes to great lengths to make it's content appropriate for younger audiences. For example, in Daggerfall (and Arena?) the book series known as "The Real Barenziah" had very graphic sexual content, Which they removed from Morrowind (and Oblivion) and replaced with the phrase "this passage has been removed by order of the church" They also removed all nude daedra or provided more consevative versions of them for Morrowind. I don't think Bethsoft ever intended for the mesh and texture to be used for this purpose, and while Bethesda certainly expected nude content to become available, they should not be obliged to provide such content for ESRB screening purposes.

    There are several comments here wondering what's so different in this case, and rather than spam reply to all I'd just put my thoughts here.

    The difference here is that the 3D model of the nude avatar is actually included on the disc. It's the same crap as Hot Coffee - it was created by the developer and shipped on the disc, but nothing was pointing to it. So a modder can go in and point to it.

    Not saying I agree with this at all, just pointing out that this isn't your typical "nude patch" where someone creates a 3D Model of a nude Lara Croft and replaces the game model with the nude one. The modder would just replace the 3D Model in the game with another 3D Model in the game that just happens to be topless.

      Just goes to show how screwed up the puritanical US view (at least of those in power) on media is. It's ok for a youngster to see graphic violence, but god help 'em if they see tits! (And frankly, those are some of the poorest 3d representations of tits I can recall seeing.)

      Sex and attraction to physical attributes of people is natural (it's part of human survival). At least amongst thinking people, violence is NOT required for human survival. But yet, it's cool to watch someone get their ass kicked, but it's totally unreasonable to depict a naked human form.

      I could rant for hours about this. I think the ratings nazis just need a good fuck, personally. Then maybe they could relax and enjoy natural life. I know I enjoy it :)

      I don't know about that, but the developers have a good idea of what is included in a game. I don't know if it's the devs not saying or the ESRB not asking (or not looking hard enough). I kind of suspect that the rating change has more to do with the 'skin' than the gore. I'll admit though that some areas of Oblivion are on par with the violence depicted in other M games I own, but it's still not the corpses on meat hooks from Quake 4 or large numbers of body parts lying around in D3.

    Why is the ESRB now adjusting a games rating based on post-release modifications? Have you seen what topless Oblivion is like? You have to be pretty desperate to get off on those lumpy misshapen breasts.

    And, since they have started this crusade, why hasn't the Sims 2 been pulled and modded Adults Only yet? That has far more explicit mods and in-your-face sexuality. Hell, the only way to get ahead in that game is to have sex, and that only gets a Teen rating still?

    If the ESRB is going to keep pulling this, all game makers should just slap Adults Only labels on their games and let the parents figure out which ones are safe for their kids, like they are supposed to be doing in the first place.

      The ESRB is officially punishing game companies for what users do to the game. "Hot Coffee" was never normally accessible in GTA; therefore, they can't be rated for it because a user has to specifically unlock it themselves. The same with this, and it's even more silly because the only reason the nude textures are included is because Bethesda needs a nude body texture to display clothes on top of. It was just for their clothing system, for crying out loud, not some malicious erotic intent. I guess if there weren't any nipples, the ESRB wouldn't care?

      In Oblivion there is what they consider, mature nudity. Its the same uproar that you'd except if suzy homemaker found nipples and vaginas on little Sally's babrie.

      They included unused adult material in a game they released.     The surprising thing is how the ratings of both Grand Theft Auto: San Andreas and Oblivion only changed with third party users made patches to enable them.

    In my mind, this is no different from the Bra and Panties Oblivion mod I've seen floating around (which changes the undergarments from boring brown to something lacy) - not Oblivion's fault as it wasn't meant to be seen when they shipped it.

    The violence - OK, I'll deal with that, but notice that the rating change only happened when somebody went "OMG - there are boobies here!", and some religious nutcase went "OMG - can't have boobies there - think of the children!" ([sarcasm]Personally, I know that I've harbored deep hatred of all women since being exposed to breasts directly after my birth and the next year thereafter.     Odds are, we'll see some press releases from "concerned groups/individuals" (we don't need to name them - that would only feed the trolls), I've already got a press release from IEMA about how fast they alerted the retailers so they could change the ratings right in the computer to prevent minors from buying it, and Oblivion sales might actually go up when 13 year olds looking to feel "mature" convince their parents to buy them the game.

      Although I agree with you about the hysteria over sex/nudity being uncalled for, I have to disagree about this being the same as a purely-third-party mod. Hot Coffee supposedly just unlocked content which was included in the game by the publisher, just in a disabled form. The original Oblivion topless mod was taking a topless mesh which Bethesda had included in the game and made it available for play (and, incidentally, first became available before anyone had figured out how to create third-party meshes). The bra/panty mods, in contrast, are new textures created by a third party. There is, IMO, a very big difference between content included in the game by the publisher (even if inaccessible) and content created by a modder.

      I'll mostly agree with you, but in either case, it takes a third party to activate the hidden content.

      All human/orc/cat/lizard models use the same textures, just different geometry. Nipples were included in the textures for the male humans. When they texured the females they added bras to cover up. It's not like they were like "tee tee, I'm putting secret boobies in the game," they just didn't make separate skins for males and females.

      So did you read anything or are you just quoting the article from the quote in the blurb? Oh wait NM this is slashdot, of course you didn't read it. But if you bothered to do even a little research you'd see that this isn't a "locked out file" or anything of the sort. This is an actual texture in the game that is used when the normal "underware" texture would be otherwise showing through the characters clothing. All someone did was the same thing that people have done with the Sim's since it came out (where they remove the fuzzyness on the nudes). The sad thing is a mod similar to this could be done for any game. Just tell the game don't render the normal upper body texture render a different one in it's place. Such as say a leg texture or some other such. By designing the patch carefully I'm sure it could be made to look just as good as the mod for Oblivion.

      First I don't disagree with most of what you said. People that age are what you say they are. And repressive tactics can just as easily backfire as work (or create more serious problems later in life).

      But I would take issue with your premise that there's some high baseline of sexual arousal that isn't going to be impacted by exposure to material like this. And it has to do with the way are bodies our set up, they aren't designed to do all things all the time, rather to take into account the environment and do what's profitable given what's around you along with your current physical state.

      People don't walk around with boners 24/7, nor do they eat, sleep, defecate or any other activity just anywhere or anytime. Visual cues provided in this kind of material trick the body into thinking that a sexually available person is ready and so the body ramps up all the things it needs to do to make it happen.

      Living in modern society places demands on us that to some degree conflict with how we're wired up genetically. So we have to twist things to balance it out and still be able to function well in society.

      My son needs to get out of high school before impregnating someone or getting VD. The tradeoffs are just too high before that to take those risks, after, the tradeoff is reasonable and the risks are ones to be taken.

      Avoiding pron isn't going to make the urges and desires go away, but it will limit their strength and frequency to hopefully managable levels. And just to be clear, this is about truthful labeling so that at least semi-accurate decisions can be made by the people whose responsibility it is to make them, the parents.

      And games still aren't the problem. You see more sexually exciting material walking down your average shopping street than you do by playing any game, including Pornstar 3D.

      Advertisement is using sex much more aggressively than games. They just do it in a way that no tits or pussies are immediately visible. But our brains being what they are, you clearly see in your mind's eye what you just barely can't see with your physical eyes.

      And lines like that are what spark the flame wars you're so worried about. You basically just said that sex is immoral. Nevermind that the rest of the game involved killing, drug running, gang wars and any number of other actions that could be considered immoral or socially deviated. But no, it's the (horror of all horrors) depiction of oral sex that's outright 'immoral' and gets everyone's attention.

      Really, it's getting tiresome. The fact that the term 'puritanical' has become cliched at this point is an indicator that there's a definite schism in society right now.

    It will be interesting to see if Bethesda decides to pull the current version from the shelves and release a toned-down version to match the original rating, or if they're content with the Mature rating.

    It will also be interesting to see how retailers respond; whether they'll pull "mis-rated" copes from the shelves. This isn't like GTA where the game went from M to AO, which most retailers won't carry.

      A few years ago, Dungeon Siege got pulled from store shelves and rerated from Teen to Mature briefly. There was a cheat code in the game that allowed one to increase the amount of "gibs" that came out when an enemy character exploded. After this, the game-makers released a patch that removed this cheat, and also decreased the amount of blood/gore in the game (which was not substantial to begin with), and the game was again released as Teen. So yeah, if Bethesda wants to fight for the Teen rating, it may be a bit of a headache.

    The lack of female gamers is due to a general lack of interest in computer games among females. Some of this might be inherent in their genetic makeup, but most of it is probably due to a general lack of encouragement girls get to pursue computers or other technical things, either as a career or a hobby.

      Seriously, though. How is this any different from a Barbie? Mattel has specifically created the doll so that her clothes can be removed. This facilitates the changing of clothes, so that (unlike a Raggedy Ann) you don't have to buy a different doll to get a different outfit.

      I haven't seen the mod, so I can't really comment on one potential difference... Do the models have nipples? Apparently that's the line-that-cannot-be-crossed in Barbie's world.

      This is not at all similar to Hot Coffee, where the developers included the ability to see sex scenes. This is an art asset issue, not some developer's idea of a saucy easter egg.

      Seems easy with a movie, 'cos all you have to do is sit in front of it for 2 hours and watch - but with a game, you have to play it for god knows how long, be sufficiently good at it to be able to play through everything, and be aware of 3rd-party mods that don't appear until after the game's release.

      Maybe the ratings boards need to be able to demand all the assets from a game, and be able to slap a hefty fine on the developers for failing to disclose information. Maybe, to help with that, they should ask the developers what rating they think it should get, too.

    That's not quite how it works. I haven't played the game, but this is what I've gathered from reading the author of the mod's comments.

    Most games handle clothing by making it directly part of the character model. Oblivion models character bodies and clothing seperately. Although this approach increases the complexity of the graphics, it allows more reuse of art assests. With this approach, you can mix and match body types and clothing without having to redo the artwork for the different combos. This patch simply removes the clothing layer.

    Also, according to the mod author's comments, the topless women don't quite look right. The models were designed to look right wearing clothing, not bare.

    The Oblivion female character is done as a nude model with a seperate bra added when not wearing any other top. This was done because different outfits cover different areas of skin - for instance, the chainmail top has a narrow slit between the breasts which revails a small amount of skin which is covered by the middle of the bra when topless. Plus, doing it that way makes it easier for mods to add things like backless dresses etc that don't go well with the bra.

    The only nude mod I've seen so far simply removes the bra. The underlieing stuff was never really intended as a nude model and looks like a boob-job with tan lines and very strange lighting. Probably a nude mod with original artwork will come soon to fix those issues. I know at least one modder who did nude mods for Morrowind is active in the Oblivion mod community (Maboroshi Daikon) so the talent is definitely available.

    After the hot coffee fiasco, Bethesda really should have had the sense to remove nipples and black out a little of the area around it, just so that they could say that none of the naughty bits in the nude mods were done by Bethesda.

      The parent is correct, the underlying skin of 'female upper body, nude' was only included to allow additional clothing to look correct when it exposed portions of what the bra was covering.

      The nude female skin included in the file isn't even female. The proportions are quite distinctly male as evidenced by the placement of the nipples being way too far appart and thus rendering them on the side of the breasts rather than the front when it is placed over the female upper body mesh in the mod. The mesh file of the supposed nude still distincly shows the folds of the bra (rendered normally as a folded up, dirty off-white cloth going around the upper body) giving the topless characters lumpy shadows where the bra was.

      In other words, this was not a 'hidden' nudity thing. The males can be rendered without shirts and clothing made with exposure of various parts of the upper body. The female was made the same way, and since the nipples would never be shown, it didn't matter that they used the male skin 'skin' for it as well.

    My understanding of it was that they accomplished it by replacing the default female torso texture with some other undressed torso texture that was supposedly hidden. Seeing as how they admit that the nipples don't look quite right, is there any chance that they simply replaced the femal torso textures with the male torso textures? Not too many games have males that wear bras, so it would cause nipples to be displayed. And, if the wrong texture was being applied to the model, that could explain the mishapen nipples that have been mentioned.

    If this is the case, it brings up all sorts of interesting questions about the nature of nudity, since the texture, on one model, is perfectly acceptable but the same texture, on a different model, is obscene.

    The problem that Americans have with nudity is pretty much incomprehensible to Europeans. We laugh when we hear about it, but actually it's pretty sad.

    The greatest nation on Earth is also one of the most primitive and most inhibited cultures in existence. And as it's a core inhibition within the religious fundamentalism of the government, the cultural barbarianism gets institutionalized, and isn't going away.

    Things like this remain around until the current generation of standard bearers die off. The inevitable conclusion is that if you're American but "enlightened" (you know what I mean, and if you don't then don't worry your little head) then you'd better spend part of your year across the pond, even if it's just for the yearly holiday.

    Very sad.

      As far as religious fundamentalism goes, examine the book of Genesis. In the early chapters Adam & Eve started out nude, and would have remained that way had they not taken the steps that compelled them to leave the garden.

      Seriously, though, inhibitions are not always bad. It is certainly unfair to say that inhibitions are a symptom of a barbaric culture. If you really examine your history, you will observe that cultures become more barbaric as they do away with their inhibitions. (Rome, for example.)

      Inhibitions keep us from doing things that would otherwise get us killed, like jumping off of a building without a parachute just because the ride down will be fun. Even if you believe there is no spoon, gravity will get you if you try that little experiment. Besides the health risk of constantly exposing your privates to the elements, vulnerability to disease, etc., there are social ramifications if we normalize and accept public nudity. (That holds true for Europeans, too.) I have lived in Europe (Greece), and while there is certainly more nudity at the beaches (not to mention proudly displayed postcards and magazines), I do not know many Greek women who would be happy to walk down the street au natural.

      The trend is certainly to view the human body as less special, and less private. However, (though it be from my unenlightened, barbaric viewpoint) I think this is not a change for the good. If the media be representative of the entire population, then any attempt at regulating morals is a complete hypocritical joke. Nonetheless, there are some of us who don't want to pass on to future generations that sex should be casual or that self-control is a weakness. For those of us who claim to follow the God of the bible (and the even fewer who act like it), this is a minority stance (especially on any internet forum). I don't expect everyone to adopt it. Still, it is unfair to completely reject an idea just because someone with religious values agrees with it.

    In some parts of the US it's not uncommon for women to nurse their babies in public. There is occationally public outcry about that too. Honestly, it does not harm children to see breasts. babies see breasts several times a day! It probably do more harm to children to criminalize *innocent* partial nudity.

    As for some 14 year old seeing some pixelated topless woman after intentionally hacking a game. I don't really care, and I'm not convinced parents would make a big deal of it. The kind of stuff they show on TV is far worse (perverse) and most parents let thier teenagers watch that too.

    Now game companies should get a clue and quit putting hidden content in these games. And if possible implement some image recognition to "filter" skins/mods that appear nude. The ESRB apparently takes itself very seriously (too seriously), and if you really are interested in being able to sell your games at Wal-Mart to teens without having them to bring an adult along then you really have to play ball with these prudish rating boards.

      That is, no offense, fucking idiotic. I don't want a damn game to actively try and prevent me from slapping a pair of tits in. If some modder wants to make a new mesh with topless women, the game should not try and stop him. I play these games and I am an adult. I can see a pair of breast at this age without humping the screen or having my parents send angry letters to congress. It is one thing to not include content, it is an entirely different thing to actively cripple the game so that if some stupid image recognition software thinks it is seeing breast, it blacks it out.

      Video game developers are not there to baby-proof video games. There isn't a game out there that you couldn't add a pair of breast to. I am sure some modder for Need for Speed with enough knowledge could add a pair of boobs with wheels on them and call it a car.

      It pisses me off that my content needs to be censored because a few prudish parents are too stupid to realize that if their kids are modding games to include breast, you better believe that they are downloading internet porn by the gigabyte. Whatever few pixilated breast they are seeing in video games is pocket change to the crap they can get off the Internet.

      Then you should stick to buying M and AO rated games. Rather than T rated games.

      The point of the comment was to see where the line should be drawn for ESRB's ratings. If third party modifications count then all games are M unless there is some active content restriction going on. (require the content to be signed, actively filter the content, etc).

      I'm sure you, like I, completely ignore the little ESRB logo on games. But from what I can tell there are people who really want to trust in the ratings provided. I think what is up for debate is the level of trust people should put into a rating system on content that people can easily modify.

      I'm of the opinion that the entire internet is rated M. There is no safe website or chatroom to visit. It's really up to each individual to select and filter the content as it comes down the wire, or turn it off it they cannot do it.

      ps - "no offense" then saying "fucking idiotic" is an offense, you realize that I hope. If you really cared you'd just use some tact instead of making some contradictary remark in an attempt to cover your ass.

If that was the case, then the vast majority of the games out there would be M, and developers would stop feeling the need to pander to the ESRB rating system.     So I'm addicted to Oblivion, at least an hour a day of late. It's a great game, and one of the aspects that builds on this is that there is a sense of Accountability in the game. If you outright kill someone, things change. If you steal, people get pissed at you. If you punch someone, they go rounds with you. Isn't it more important when rating a game that it enforces proper consequences upon the player?

    This is in addition to how ridiciulous it is that you can Mod it, therefore it's MA. Guess what, I can render porn in another well known program, called Windows, so I want it rated MA too (MA for what I say when it crashes).

      Accountability? Hogwash. Mind you, I don't think that players would like it if they could not get off with a small fine, so from a gameplaying point-of-view it is probably a good choice.

    A number of years ago, when the company I founded released Daggerfall, (the second chapter of the Elder Scrolls series from which the latest chapter, Oblivion, has recently sprung), we learned that Senator Joseph Lieberman had identified Daggerfall by name--along with games such as Mortal Kombat--in a televised press conference as one of the year's "10 Worst Games". Not worst games to play, mind you, but most socially unredeeming and therefore deserving of censure by "good people".

    I was incensed. Not only because I believed that Lieberman was using his elected office as a platform for his personal (read political) agenda, but because I knew he could not possibly have played Daggerfall to have come out with such an evaluation.

    As anyone who knows both the RPG genre and especially the Elder Scrolls series can tell you, the series stresses the importance of relationships and enforces many social rules. To put it in the same category as Mortal Kombat simply meant that someone, or some group with an agenda, had provided Lieberman his Worst Games list.

    So, I did what any red blooded president of an American gaming company would do -- I sued him. In doing so we discovered the people who had the agenda and supplied the fateful list to Senator Lieberman. It was the National Institute on Media and the Family. So I sued them too.

    Violated by ignorance

    I was not going to let my rights be violated by ignorance. What came to pass is that Lieberman had to resort to using the Justice Department to shield himself from our suit. Nevertheless, the good news is that ever since that time, Senator Lieberman stopped the absurd practice of an uninvestigated Worst 10 games list. So, I would like to think that my decision to put money behind principle had a result that was vindication for my company and a larger victory for the games industry.

    So, when I tell you that I believe we as an industry need to be aware of our perception by the public and government, I tell you with personal investment in protecting your freedom to be creative and not kowtow to everyone with an opinion. -- The Folly of 'Office Massacre'

    Of course, I see here he is knocking Mortal Kombat, which makes me laugh. "We must all hang together or we will surely hang seperately," as Ben Franklin would say. There was nothing wrong with Daggerfall and nothing wrong with Mortal Kombat, and I'm not surprised he's being singled out, again, by the National Institute on Media and the Family. After all, he beat them, so it's payback time, exactly the sort of behaviour I'd expect from a scummy organization like NIMF. (I don't know that it was them, but this reeks of Hidden Agenda.)

    Oh, hey everyone, you can see Kasumi's boobs in the Dreamcast version of Dead or Alive by downloading a modified save file that lets you view the Japanese intro that was left on the disk, somebody call the ESRB, it's still being sold used some places!!! (It's not as thrilling as it sounds, if I were you I'd just watch this (not work safe) instead.)

      This mod puts the the shirtless male torso texture onto a female character. If you squint really hard, and ignore that the shadows are all wrong, you might convince yourself you are looking at some pixelated nudity.

      It's a real a stretch to call this "hidden porn". If that's the case, then any game with a female character model and some other flesh-colored object has "hidden porn". Just mod the game to apply texture A to model B, and...boobies!

    1/ If you mod Oblivion you can unlock nudity skins, so they need to treat Oblivion as if people will do so.
    2/ If I modded my pants I could cut out the crotch so my old feller is hanging out for all to see. Does that mean I should be treated as if I will and locked up for potential indecent exposure?
    3/ And if its possible for me to do this, its also nothing stopping Jack Thompson from doing this.

    Conclusion: If Oblivion is classified as mature for potential modded nudity, Jack Thompson needs to be locked up for indecent exposure. It's amazing how ironic the world is when you use specious logic.

    They have nude models because all the characters in the game are dressed from the nude... you know, like real people. Maybe we should slap an M for mature on everyone's ass in the real world, just so that parents know that underneath all of their clothing they are naked, and nudity is the devils work.

    QFE. I don't know much about computer graphics, but I bet it's really really hard to make them realistic if you don't start with a nude model to wrap your textures around.

    We're setting a stupid precedent here where developers have to now not only worry about the game content, but every portion of the game that players can hack together to make something racy. Are you going to start actually encoding some sort of tamper protection into your game to score below an M?

    I just heard that you re-rated The Elder Scrolls IV: Oblivion based on a third-party content patch that unlocks the base skin used under the clothing models.

    This is absurd.

    I can make a third party patch for anything that will turn any 3D model into a naked chick in The Sims 2, Barbie Horse Adventures, etc. What I or anyone else does to a game that we have purchased should not affect the rating of the unmodified game sold in stores. This is just a cheap ploy to get attention.

      I really think it was just a sense of wanting to "do things properly" on the part of the developer. Bethesda doesn't seem to care much about this sort of thing - Daggerfall had plenty of actual nudity around, not as a sexual thing, just for accurate representation of life. Apparently all it is is they made a texture to go under for the bits that show through clothing, and someone noticed this means if you remove the default unclothed top (bra) you can see that texture. To me this smacks of wanting to be accurate with the model more than anything else.

    When is the nudity rating insanity going to stop? Is nudity really so harmful that we need to take such steps? People see more than this when they get changed every morning. Maybe we should wrap toddlers in head-to-toe body stockings 'till they're 18 so they can't be corrupted by the sinful sight of naked flesh...

    While we're at it, we need to rate breastfeeding as "Adults Only". Babies don't need to suffer such horrific trauma that early in their lives.

    And birth? God knows what an eyeful those poor young newborns are exposed to! Quick, ban birth before more sweet innocent ones are irretrievably corrupted by more horrible, unnatural sights!

    Sarcasm aside, if our teenagers are unable to handle the sight of naked breasts without being reduced to gibbering sub-human criminals then someone other than a game developer has failed them at some point.

    There's a TOPLESS model for the female body included on the disc.

    (I know, because the first mod I made for Oblivion--about 15 minutes after installing it, on release day--was a topless mod that used the model they provided.)

    I don't think the ESRB decision was justified, but to play devil's advocate for a sec... they do ship the Construction Set with the game. Its not as if you have to have a "3rd party hack" to get at this content. You can access it using nothing but what is provided on the Oblivion disc, and fairly easily too.

    On the game box infront of me for a T rated online game, right under the "T: Violence" part it says "Game experience may change durring online play.". How about when a publisher submits its game to the ESRB, one thing they have to tell them is if the game will have any sort of SDK, for creating mods. If so add "This game may be modified to reflect a different rating". Seems like that would be fair enough warning to parents, even though the majority would still ignore it and complain later...

    It is pretty rediculous for a developer/publisher to leave content such as nude skins in the game, to be easily unlocked... Almost as rediculous as changing the rating of a game because of two nipples. The movie Titanic was rated PG-13 for fucks sake... and as I recall that contained nearly full frontal nudity.

    Regardless of how those textures got there, the semantics of it are sorta like this:

    1. There's the game as you bought it, and it doesn't show any nipples.

    2. You download a mod which, regardless of HOW, replaces the bra texture with a skin and nipple texture.

    Exactly what difference does it make where that texture was? If the mod was 100k larger to include its own textures, would that have prohibited anyone from downloading it? Well, no. Would an extra 100k have made the parent pay more attention to what little Billy is playing? Hah.

    Or does anyone imagine that if the game shipped without that texture, someone else wouldn't have painted it? It's been done before for countless games which _didn't_ include nipple textures, and which in fact had the bra as an integral part of the texture. So what? It didn't stop anyone from recolouring that area, or swapping in a naked texture from another game.

    So exactly what conceptual difference does it make? Why is it ok to have a naked mod for The Sims 2 or Morrowind or (don't laugh) SWG, but not in Oblivion? It's still something you have to explicitly search for, download and install, not something you can discover by accident.

    If it was a case of "Oops, I bought this "Test Clothes" from a vendor hidden in a valley, and now my character is naked", _then_ I'd understand it. Well, ok, then it would be something that people (kids or otherwise) could stumble upon in the game as it was shipped. But that wasn't the case.

    So let me tell you what it really is: idiotic hypocrisy. That's all. Bunch of retards trying to look more moralistic and puritan than the Joneses. "*GASP* You mean those nasty game developpers were playing with naked textures? Why, the evil perverts... let's punish them! Let's gather an outraged mob with pitchforks and torches!" That's all there is to it. A bunch of SFVs (Stupid Fashion Victims) and prom queens trying to be fashionably outraged, when they think it's fashionable to be outraged.

    Groupthink is a funny thing. Or as Terry Pratchett once wrote, the IQ of a mob equals that of the most stupid member divided by the number of members. It's funny how whole towns or whole countries can be such a mob. Take a bunch of people who, taken individually, have nothing against X or pro Y, put them in a group where they think it's fashionable to be pro Y and against X, and watch them try to be the ones who scream the loudest against X and pro Y. Just to fit in the perceived group standards.

    In this case, the perceived standard (at least in huge areas of the USA, but not only) is that to be a fashionable pillar of the community you have to be fashionably outraged by nudity, sex, etc. Watch the bunch of hypocrites try to outdo each other in being outraged of it.

    It's freaking sad, that's what it is.

    It's not necessary to paint nipples on the texture of the basemesh since they won't be seen but most game developers are male and a nipple takes seconds.

    That's funny. When *I* talk, I realize there's a difference between teens and little kids.

    Namely, little kids are generally frightened by blood and gore, whereas teens (male ones anyway) generally think it's really cool.

    So, yes, Oblivion is too graphic for little kids, which is why it was rated Teen.

      Linguistic differences aside, from my experience, I see that Teen is what parents think the limit is when it comes to games.

      I don't know a single parent around me that won't let their kid (8-10 years old) play Teen games. Where I live, games that are M are played by teens, and games that are T are played by teens and kids who are younger than that.

    Nipples are good things to have on a mesh. Why? It makes fitting clothing a hell of a lot easier. If you know where the nipples are, when you are working on clothing that goes over the chest you know where to drop cloth. Personally, I am glad that they made real human bodies. I know the human body is evil and all and your eyes burn out of your skull if you see a pair of breast, people need to get the fuck over it. Yes, naked women have breast. The human body is not evil. Being naked is not automatically vulgar.

    My advice is this. If you see a naked person and they are not being lewd, chill out and realize that you too are naked under your clothing. If you see a woman in the park breast feeding her child, don't call your congressmen worked up in hysteria. If you see a woman at the beach without a top on, chill the fuck out because if you are a dude, you probably don't have a top on either. People just need to chill out. Witnessing breast won't cause your head to explode.
