If it is a civilian database then well, it's still not 'nice', as being a passenger on a plane isn't nearly the same thing as being a registered owner of a firearm (if you get me), but it's not as bad as being classed with criminals.

I wonder if developers jumping ship was part of Microsoft's reason for wanting the deal. more disenfranchisement means less open source competition (you could say they'll move to greener pastures but some could just leave).

The intellimouse is my mouse of choice in all situations, and I'm on my second one in about 4 years.
However I haven't noticed any stuttering issues and I have never installed any drivers for it. No locking up either.
Personally I wish I could find a black one to match the rest of my desk, haven't seen any, but on the back of one of a Microsoft keyboard box I saw it there, in front of the black keyboard, taunting me... damn thing. The buttons being on opposite sides are much better for gaming in my opinion though, you won't ever mistakingly hit the wrong button because your thumb slips.
I'll give you the quick hand-wavy answer, which is that modded consoles can run hacks to disrupt the games of other legitimate users on Live.
