Actually Mac has gained nearly 10% market share in two years. That's lost customers for Microsoft since I doubt many migrated from Linux. No one is predicting Microsoft will go away in our lifetimes but their monopoly seems to be breaking and they brought it on by shooting themselves in the foot while Apple continues to come out with new OSs and products that get people excited. ME was a near death experience but they were lucky because there was no threatening replacement so they had time to recover. Leopard is an attractive replacement to most people and they get extra functionality out of their iPhones. You can knock iPhones but everyone I know wants one if they don't already have one and most of the people they know feel the same. They have the real potential to eventually out sell iPods when you look at the SDK and games. There's an ocean of software apps being written already. Vista does suck. When a few of us made ME references we got shouted down but there's been a quiet acceptance that it's ME part deux and everyone is pinning their hopes on Windows 7 which is still vaporware. Most say they'll fix everything in Win 7 and the sun will shine brightly again. But what if they don't? We aren't talking a cosmetic fix many of the problems are structural and were caused by serious short sightedness. Mac has a nimble stable OS that can be stripped down to fit into an iPhone. Vista would have trouble running on a 5 year old desktop no matter how much you stripped it and OSX is running on a souped up PDA. There's huge difference between the OSs and unless Microsoft bites the bullet like Apple did and reworks the OS from the ground up they are likely to be replaced as the number one OS. A lot of foreign countries are already embracing Linux and the US market is warming to Mac. They got caught with their pants down because they got fat and lazy. They didn't see any competition so they we're trying. Mac was the tortise to their hare. They kept boasting about their dominance while Apple was quietly delivering superior products. They still haven't come up with a set top hit device but neither has anyone else. TiVo still rules that market. For computers, personal music players, smart phones and music delivery system they are beating everyone. That's four giant markets that any company with be thrilled to dominate just one. Yes they don't dominate the smart phone market but remember the iPhone isn't even a year old. It already dominates wireless data traffic. Why? Because people actually use their iPhones for internet surfing. I canceled the data service with my old phone because it was useless. IPhones are a joy to use.

  11. Same BS argument on Universal Attacks First Sale Doctrine · · Score: -1, Troll

My Troll a day to keep mod points away. This is that same bullshit argument that seems to keep coming up. It okay for some one to make a buck off music and movies so long as they didn't have a financial interest in creating the work in the first place. It's cool for some one to sell it on Ebay but the record company is evil for selling music and not giving it away. The whole point is promotional copies have been around from day one and the same rules have always applied and that includes posters. Technically you aren't supposed to sell them in spite a thriving industry selling old movie posters. The industry has looked the other way but music sales have dropped like a rock so probably a lawyer told them you better get this under control. The point is they may now start to require agreements with radio stations and such before they will give away promotional copies. Everyone benefited because they got their music out there and the radio stations kept costs down since they saved tens of thousands on buying CDs and replacing them. Yes I know technically, blah blah. Why is the guy selling a CD he boosted for free the good guy and the music company that was providing it the bad guy? What will be the result no matter what happens in court is the process will change and it will hurt everyone. The guy was being a dick selling a freebie copy that the record company was nice enough to provide. Would everyone be happier if there were no promotional copies? The record companies have always looked the other way when DJs handed them out to friends when they were supposed to be used in on air promotions and for air play but a lot of the tolerance may be drying up. They feel they are fighting for survival. Yes I know good riddance. All the garage bands will happily provide for all your music needs. Well here's food for thought, if you can get all your music from garage bands then why do you care what the music companies do? I know the fantasy is you'll eventually get slick studio music from top artists for free and the record companies will one day cave in and give away all the music no matter what it costs to produce. Time to wake up it's an industry and without profits they will do something else for a living.

I'm amazed the government has turned their back on them since they are functioning as a bank but are unregulated. They scare me and I've canceled my account several times but certain things require them already. I largely let the account stand inactive. If we loose other options with Ebay I'll probably drop them myself. The whole thing is so dodgy I haven't hardly bought anything on Ebay in years. 19. Where he went wrong on Imperial Storm Troopers Skirmish in Latest IP Battle · · Score: 1

It sounds like Lucasfilm may have screwed up and not gotten a contract. That said where the guy screwed up was using original molds. They are technically the property of Lucasfilm since they paid for them. He may have been in his rights reproducing the design but not using the molds. I used to know John Stears back in the early 80s. He told about Lucas getting him to sign over the rights to R2D2 and the land speeder for the promise of more work. Rights up until then had no value so he opted for the additional work. Well Lucas never hired him again and he figured by that time he had lost 8 mill in licensing fees. Lucas had all the key people sign over all rights after the film was finished. I doubt Lucas can claim that there was prior art since most of the "production" art was actually done after the film was finished so the design probably was his. In truth he should have himself sued decades ago for a cut of the rights but he was a nice guy and didn't. Ironically he probably was within his rights doing that but striking new casts from the old molds he didn't have the right to do. What the court should do is fine him for the amount of props sold and give that money to Lucasfilm but then award him the rights to the design and make Lucas pay him the lost royalties which would amount to 1000X what the suits brought.

Personally I run Open Office and don't use VS 2008. I found it really annoying that Microsoft refused to port X10 to XP since it was the only feature in Vista I was interested in. It was an obvious attempt to force gamers to make the switch but it largely fell on it's face and most of the game companies have been hesitant to use X10 since there is no backwards compatibility with XP. X10 could have been a feather in Microsoft's cap but instead it's failed to become the new standard as it should have been. It isn't the users fault that Vista was a flop. If they put a new splash screen and added X10 to XP they probably could call it Windows 7 and people would be happy. I'd like to see both 64bit and 32 bit support like Leopard has but I'd be happy if they just added X10 and got rid of the annoying reminders and just released an XP upgrade for Windows 7.
