While no one is going to argue the amount of pirated content available on P2P networks, given (a) that many Linux releases use BT as a distribution medium (Fedora, Ubuntu, CentOS, OpenSUSE, etc.) with images up to a DVD-ROM's worth of data (4.5 Gb), (b) the amount of video-based material (movies and television) that is out there, whose files are no doubt larger than audio MP3 rips, is it fair to assume that the music industry's concerns are a relatively small portion of the overall P2P traffic? Going to a popular tracker site such as http://mininova.org/, the largest BT swarms are typically found for the prior night's TV shows. Item 9 (sales decline directly related to pirated content) has been contested for some time; the industry has reduced its number of releases, the majority sellers are now the big-box stores who carry little in the way of back-catalog material in favor of chart-topping new releases, and the rise of sales in DVDs (sell-through DVD prices comparable to new-release CDs appearing as a better value). -

They all got wiped out by a 1986 Supreme Court ruling, which effectively said the usury laws had to be whatever was highest in whatever state the financial company was in. Suddenly, loads of financial companies opened offices in South Dakota- which has no usury law at all. They can now charge whatever the market can bear- some companies now charge up to 520% interest on loans.
That's nothing. You forget that the banks are only required to keep 10% reserve... This means if they had $1,000 dollars to start with they can loan out $10,000 dollars... at 9% interest.

The reality is that with the advent of Bit Torrent and swarming technology in general we're all rapidly becoming "bandwidth hogs" whether we're downloading licensed material or not. I know that, for my part, I have personally created a few (usually involving the installation of a good BT client and mentioning a few good sites.) ISPs are getting away with banning heavy users because they presume it's for illegitimate purposes (and I suppose that, for the most part, they're correct at this point.)
The major content producers may shift their business models from distribution via traditional broadcast, satellite or cable technologies to an Internet-based approach. If that truly happens, there will be heavy pressure applied from the big boys to make the Comcasts and Verizons and AT&Ts of the country get with the program and beef up their networks. What we as consumers can't do (because we aren't the cable company's customer, content producers and their attendant advertisers are) big media can. And that'll benefit all of us indirectly, because when Internet capacity reaches the point where it can provide video delivery as easily as local cable networks currently do, the concept of "bandwidth hog" will go the way of the Dodo. -

No dilemma. No dilemma at all. The only reason there isn't more downloading going on is because there aren't more people that know how to do it. I mean, my goodness, if everyone that had a broadband connection knew how to install a BitTorrent client, head over to TorrentSpy or Mininova or The Pirate Bay and download stuff and knew about codecguide.com's Codec Packs so they could play all that media without any problems on their Windows boxes, why, I think we'd see a lot more people watching crap-free entertainment.
You see, these are people that have long been accustomed to selling whatever they please, because they knew we had no choice but to accept it no matter how they chose to present it. If we wanted a movie, we took whatever they threw at us. That's changed, for now, and lawsuits, the DMCA and the rest aside, I don't think they've fully come to grips with that.

I've bought a lot of DVDs over the past eight or nine years. Lots of them. I like movies, I do. But I have to say, watching purchased DVDs has become similar to the experience I get at the local movie house: i.e., disappointing and not what it used to be. And both groups complain that sales are down. Cripes, what does it take to give these people a clue? The media companies dis their customers when those customers have alternate means of receiving their products (in this case, means that provide no revenue) and they expect sales to increase? Give me a break.
It would surprise me if Sony executives ever got down from their ivory towers (or whatever the obviously isolated spot where they store their upper management) and spoke directly with typical consumers of their products to see what, if anything, said people like about Sony products. Oh, I'm sure Sony's marketing drones have plenty of "focus groups" and "surveys" and all the rest of the trappings of modern marketeering ... but they don't seem to be paying much attention upstairs.
Media Marketing Rule #1 should be "if the customer BUYS THE DISC it should PLAY."
This is not rocket science. This is about good business. It's about continuing to have a business. -

The MPAA has done everything possible in order to NOT get any of my dollars. Nearly every film out is some formulaic droll foisted on a demographic that I am generally not a part of. Nor are any of my friends or family! So not only do they not generally OFFER things for which I can throw hard earned money away, the things they do offer that hold some interest are generally of such low quality acting (Keanu Reeves can NOT act), awful script (The last major blockbuster movie with decent dialog I can't even remember), and then they are charging way too much for it. I know a DVD costs like twenty five cents to make, including the box it comes in. I'm not spending $17.99 on some movie with no plot, no acting, no dialog, and no continuity, even on the rare occasion it IS about something I'm even remotely interested in, which is INCREDIBLY uncommon.
I'm also definitely not going to a theater to watch it once, get way over charged for soda and popcorn, and probably sit by somebody who doesn't turn off their phone, smells bad, is partying loudly with a six pack of beer (which I myself have done at some of these movies, in an attempt to improve their observed quality), or is making out with another teenager in ways that are not only illegal to be watching, but so badly done as to be more embarrassing than erotic.
I generally enjoy documentaries and WELL MADE films. They are almost NEVER available at the theater, and are also extraordinarily rare at Blockbuster, Hollywood, or any of the other cookie cutter corporate rental chains that do not offer any services for individuals like me whatsoever.
If movie makers want to make money again, they are going to have to start making decent movies. It's unbelievable to me that crappy sequels like X-men 3 make as much money as they do, but when the alternative is crappy sequels to "Bridget Jones' Diary", I can't actually say I'm even mildly surprised.
This entire rant can also be copied nearly verbatim for the RIAA and why I don't purchase many albums from corporate labels anymore, either. Just substitute the words movie and album, and swap theater with concert venue, most of which are also shitty corporate owned parks that also over charge for shitty unhealthy beverages.

Lots of p2p sites do not offer adult
I don't generally see porn movies on the p2p sites.
There are a few which have general keywords coming up in the search clouds, but on the whole its tv shows and general movies which are big (and on some its languages, like "French").
Take a look at one such cloud which does include adult keywords, but they are dwarfed by big budget tv. -

Not that clean
I see it in the same light as arresting automobile manufacturers for the hit-and-run death of an innocent pedestrian. Sure, the car was used as the lethal weapon of choice, and it was productive in doing its task, but it's not Chevrolet's fault that their Silverado 1500 was used to kill someone.
It isn't that clean cut though. Chevrolet aren't making their offering as a "pedestrian killer 1500", they are offering something which clearly has a legitimate purpose and are offering it for that purpose.
If someone is running a bittorrent site and they have set up categories such as "TV Shows" or specific show names then I can't see how anyone can claim that they are offering something neutral.
Bittorrent as a tool is neutral. However if you expend effort designing a site in a way which specifically assists illegal use then I don't think it's surprising to be included as part of a "conspiracy". You have specifically assisted people to use the tool for illegal means.
I've not seen Elite Torrents so I don't know how much this applies to it specifically. Having said that from what (little) I have seen "subtlety" isn't a word I'd associate with that sort of site.
Search engines and so forth may contain similar information. However they have not expended effort to specifically help people find that type information, it is just there because it happens to be part of all the information out there. -

isoHunt / Mininova
In my opinion the best site for new releases is isoHunt. There are no fake files on isoHunt and isoHunt torrents usually have many reliable trackers cross-referenced from BitTorrent sites across the internet.
For older files Mininova is the best. It has almost 150000 files. Everyone can upload, but there are good moderators who remove fake files. The site has a very fast, CSS-based layout without HTML tables.
I don't use private sites, because it's very hard to have a high ratio on those sites if you don't download 0-day releases. On public sites I have a 1.0-1.1 ratio after 3 hours of seeding. It's impossible on private sites because there are 8 times more seeders than leechers.
