Blade Runner 2 Script Done, Harrison Ford Says "the Best Ever"

Harrison Ford apparently thinks the script is "the best thing (he's) ever read." Although Scott is debating whether or not he'll direct the sequel, it looks like Ford will most certainly be reprising his role as Rick Deckard." -
Crowdsourced Remake "The Empire Strikes Back Uncut" Now Complete
Two and a half years ago, we posted news of the completion of the Star Wars Uncut project. Now, reader kdataman writes that another fan-made Star Wars movie remake is ready to watch; this time it's Empire: 480 fan-created 15-second clips have been assembled to remake the entire movie, scene for scene (but not always word for word). The variations swing from professional production values to cardboard cutouts, but they are all creative and many are hilarious. Hard to pick a favorite scene but the guys at MTV selected a few highlights. -
Could Maroney Be Prosecuted For Her Own Hacked Pictures?
Contributor Bennett Haselton writes with a interesting take on the recent release of racy celebrity photos: "Lawyers for Olympic gymnast McKayla Maroney succeeded in getting porn sites to take down her stolen nude photos, on the grounds that she was under 18 in the pictures, which meant they constituted child pornography. If true, that means that under current laws, Maroney could in theory be prosecuted for taking the original pictures. Maybe the laws should be changed?" Read on for the rest.Online warnings about the dangers of teen sexting, from sources ranging from the FBI to MTV, frequently warn that even a minor who takes a sexually explicit picture of themselves can be prosecuted for violating child pornography laws.
And these prosecutions really do happen. One Pennsylvania district attorney threatened child pornography charges against two teen girls who posed for a photo in their bras making peace signs, and tried to force them to write a report on why their actions were wrong and "what it means to be a girl in today's society." (With the ACLU's help, the girls' parents sued to stop the D.A. from following through.) A study from the American Academy of Pediatrics found that in teen "sexting" incidents reported to the police, even in cases where the sexting was between two minors and there were no "aggravating" circumstances (abuse or lack of clear consent), police made arrests in 18% of those cases. (The arrest rate was higher in cases involving "aggravating" circumstances or where an adult was involved in the sexting.)
Meanwhile, hundreds of articles have been written about Porn.com being forced to take down the nude pictures of McKayla Maroney, after receiving word from her lawyers that she was underage when the pictures were taken. As far as I can tell, none of the articles about the incident mentioned that, if her lawyers are correct, then Maroney could be theoretically prosecuted for creating, possessing, and distributing child pornography. Of course nobody wants to see that happen, but the elephant in the living room is that before Maroney's photo leak scandal, many teens were arrested for doing essentially the same thing, and more of them will continue to be arrested after the celebrity nude hacking scandal is old news.
That's not to say that Maroney's photos necessarily did constitute child pornography. Nude or topless photos of minors are not necessarily illegal, if they're not sexually explicit; Thora Birch was under 18 for her topless scene in American Beauty. I haven't seen the Maroney photos (honest -- although I'd like to think that whatever she was doing, she was making her not impressed face). Maybe they really were explicit enough to qualify as child pornography. Maybe they weren't, and Maroney's lawyers misunderstood the law and thought that any of her underage nude or topless selfies were automatically child porn. Or maybe her lawyers knew the pictures were not really child porn, but they were bluffing when they demanded that Porn.com take the pictures down. Whatever the case, Maroney's lawyers claimed the pictures were child pornography, and if they're right, the lawyers just criminally implicated their client as well.
If the pictures really were explicit and she sent them to any of her same-age friends, she could also be charged with disseminating obscene material to a minor. Iowa teenager Jorge Canal was convicted on this charge, and his conviction upheld by the Iowa Supreme Court, after his 14-year-old female friend asked him to send him a picture of his erect penis, and he obliged. (Although since he was 18 at the time of sending the picture, there was no child porn charge.) If his defense attorneys tried a defense along the lines of, "My clients actions harmed absolutely no one, and it's the prosecutors who have ruined the lives of not only my client but also his supposed 'victim', by putting them both through a trauma that will hang over them for the rest of their lives," it didn't work.
Many states have attempted to pass laws specifically addressing sexting by and/or to teenagers by reducing the penalty from a felony child pornography charge to something less severe. What all of these laws still have in common, though, is that they retain the option to impose some criminal penalties on teens for sexting even among themselves. The ACLU has opposed such a bill in Pennsylvania on the grounds that even a misdemeanor charge for teen sexting would be too draconian of a punishment.
"The Need for Sexting Law Reform: Appropriate Punishments for Teenage Behaviors", written by Alexandra Kushner, a legal associate at Winston & Strawn LLP, and published in the University of Pennsylvania Journal of Law and Social Change, argues for de-criminalizing consensual sexting among teens. (The paper argues for retaining the option to prosecute cases involving abuse or malicious forwarding of a sexted picture.) Much of the paper is refreshing for the plain language not often found in legal argumentation; discussing the case of a 16-year-old and 17-year-old who faced child pornography charges for taking sexy pictures of each other, Kushner writes, "They should not have been charged at all because they were not harming each other or anyone else by taking and keeping these pictures." This is exactly the right way to frame the issue, but to most legal scholars, sentences like these are considered simply adorable.
For the other side, you can read "A Legal Response Is Necessary for Self-Produced Child Pornography", by law professor Susan Hanley Duncan. I found it less than convincing because much of the paper stresses that sexting can have serious unforeseen consequences for teens, including public humiliation if the pictures are forwarded to their friends. Well, we know that. But that just raises the obvious question: Isn't that punishment enough, and why do we need criminal charges on top of that? Even buying into the stereotype that teens are focused only on the present -- if a teen is not deterred by the humiliating prospect of having her photo forwarded around the entire school, then why would they be deterred by the threat of prosecution, which is less likely, further out in the future, and a potential risk that they might not even be aware of?
(Note that this logic does not apply to students who forwarded sexted images to harass the person appearing in them -- the person forwarding the image usually does not face the short-term threat of public humiliation, which means a legal penalty might be the only deterrent they would care about. That's one argument for retaining the option to prosecute people who forward sexted pictures maliciously.)
Even the FBI, in their "Advice for Young People" regarding sexting, betrays a certain embarrassment over the hypocritical nature of the laws. To a person forwarding an image of someone else, they warn: "You could face child pornography charges, go to jail, and have to register as a sex offender;" but to the person taking the original picture, they say only vaguely that you could "even get in trouble with the law" -- while leaving out the fact that all of the draconian penalties in their list, also apply to the person who takes the picture, under the laws that the FBI enforces.
But unless or until sexting laws are changed, Maroney probably did violate them according to the statements from her own lawyers, which might lead cynics to think that she escaped being charged because of her celebrity status. I think that's unlikely. Recall that "only" 18% of teens who sexted each other were arrested in cases where the incidents were reported to police, so if she had been a non-celebrity, she probably would have gotten off scot-free as well. Whether a teen gets arrested or charged for "sexting," probably depends less on what they actually did, than the luck of the draw as far as which police officer hears the report of the incident, and which prosecutor ultimately has the discretion to decide whether to file charges. (Of course that makes me a cynic too, but I'm the kind who thinks that people see patterns and non-existent reasons for outcomes that are far more random than we'd like to believe.)
Public reaction is another matter. When District Attorney George Skumanick prosecuted those two girls for posing in their bras making peace signs, he may not have had all of the public on his side, but there would have been an absolute tsunami of outrage if he had tried the same thing against a celebrity like Maroney, trying to get her to write an essay about "what it means to be a girl in today's society." I'm sure she would have been not impressed.

Game of Thrones: Bush's Head Gets a Makeover

Bush's head in the season finale of the first season of 'Game of Thrones,' HBO has digitally altered the offending scene. After releasing an formal apology, HBO proceeded to yank the episode off all digital platforms, as well as halt distribution of the Season 1 box sets. The episode is now back with an altered head; more hair, less chin. Show creators David Benioff and D.B. Weiss later clarified, 'We use a lot of prosthetic body parts on the show: heads, arms, etc. We can't afford to have these all made from scratch, especially in scenes where we need a lot of them, so we rent them in bulk. After the scene was already shot, someone pointed out that one of the heads looked like George W. Bush.'" -
Reaction To Diablo 3's Always-Online Requirement
Last week we discussed news that Diablo 3 will include a real-money auction house for items and require a permanent connection to the internet even for single-player games. Fan reaction has been loud and varied, with many decrying the restrictive DRM. Blizzard exec Robert Bridenbecker said he was surprised by the outrage at the online requirement, saying, "it really is just the nature of how things are going, the nature of the industry. When you look at everything you get by having that persistent connection on the servers, you cannot ignore the power and the draw of that." Some other developers came out in support of the scheme; id Software's Tim Willits said always-on would be "better for everybody" in the end. Max Schaefer, one of the makers of Diablo 3 competitor Torchlight 2, said he understands why they did it, even though Torchlight 2 is not doing the same: "... it seems that most of what they are doing is related to trying to keep a truly secure, cheat-free economy in Diablo III. Whatever you do, you have to make sacrifices. We sacrifice a cheat-free environment to give players the most options, they are sacrificing options and flexibility for security of the economy like you would in an MMO. I understand their approach and sympathize with the technical difficulties of what they are trying to do." -
EA's Origin Service To Go Mobile
Electronic Arts recently launched their own digital distribution platform named Origin, a merging of various similar services they've operated in the past and a direct competitor to Steam. The two rivals have already butted heads over DLC distribution, with Valve's business terms forcing Crysis 2 off Steam. (And this may be just the first shot in the upcoming content distribution wars, though EA says it will continue to allow downloads through other outlets, and that Origin could support games from other publishers in the future.) Now, EA has announced that Origin will include some degree of cross-platform support, and will try to battle Apple's Game Center on iOS devices. -
Nintendo Trying To Win Back Core Gamers With Wii U
Speaking at a shareholder meeting yesterday, Nintendo president Satoru Iwata discussed the company's goals for the Wii's successor, which aims to pick up the subset of gamers turned off by imprecise motion control. He said, "Wii was not accepted by core gamers because they did not want to abandon their preferred control approach. Additionally, Wii did not use HD because HD cost/performance at the time was low. Wii U makes it easier to use conventional controls. Also, the Wii U controller is not as big or heavy as it looks." Earlier comments from Shigeru Miyamoto indicate the new console will have more to offer in terms of online capabilities, but Nintendo isn't going to focus too heavily on that. -
Blizzard Aiming For Q3 Diablo 3 Beta, 2011 Release
During an earnings call this afternoon, Blizzard CEO Mike Morhaime revealed the company's goals for testing and releasing the much-anticipated new chapter in the Diablo series. "[Morhaime said], 'On the Diablo 3 front, I'm pleased to report that we began internal, company-wide testing last week. The game is looking great and we are currently targeting a Q3 launch for external beta testing. The development team is working hard to try to launch Diablo 3 this year, but I want to be clear. We do not have an official release date or window yet.' Details on the external beta are currently extremely limited, so we don't know the scope of how many testers will be involved or what the beta will include. It's hard to imagine that anything could match the gargantuan beta for StarCraft 2, but Blizzard has said that Diablo 3 will have plenty of online functionality, and that sort of functionality needs plenty of testers to succeed." -
DHS Seized Domains Based On Bad Evidence
An anonymous reader writes "Back over Thanksgiving, the Department of Homeland Security's Immigration and Customs Enforcement unit (ICE) made a lot of news by seizing over 80 domain names. While many of these involved sites that sold counterfeit products, five of the domains involved copyright issues. Four of them involved hiphop-related blogs — including ones that hiphop stars like Kanye West and others used to promote their own works, and the last one was a meta search engine that simply aggregated other search engines. Weeks went by without the owners of those sites even being told why their domains were seized, but the affidavit for the seizure of those five sites has recently come out, and it's full of all sorts of problems. Not only was it put together by a recent college graduate, who claimed that merely linking to news and blog posts about file sharing constituted evidence of copyright infringement, it listed as evidence of infringement songs that labels specifically sent these blogs to promote. Also, what becomes clear is that the MPAA was instrumental in 'guiding' ICE's rookie agent in going after these sites, as that appeared to be the only outside expertise relied on in determining if these sites should be seized." -
Killzone 3 Announced
Sony has officially taken the wraps off of Killzone 3, providing a ton of information about the third installment in the popular FPS franchise. The game will pick up where Killzone 2 left off, the levels will be much larger than in the past, and it will contain support for 3-D mode. Eurogamer has a detailed hands-on report about the game. Quoting: "Encounters have lost much of their predictability. More open design gives the AI more options, as well as freeing the player from the necessity of hide and peek. This means that it's now a much more viable option to get up close and personal with the Higs, unleashing the multi-stage and context-sensitive CQC kills with rifle butts and the trusty knife. ... For stage three of the hands-on we're introduced to perhaps the most exciting piece of new hardware — the jetpack. Initially only coming attached to a Helghan shock trooper, this insectoid assault platform is a four-winged, one-man affair, complete with a unlimited supply of ammunition for the attached large-calibre machine gun. Fighting them from the ground puts you in a precarious situation, putting you on the backfoot as you balance the necessity of looking upwards with the dangers of the sheer ice-cliffs around you. ... From the ground the pack will propel you upwards to around 15 feet, with the glide period afterward giving you the freedom to traverse sizable gaps. There's a booster, too — squirting you forward in short bursts if you're falling just short of an edge. Controls are light and agile, with the disconcerting verticality soon becoming second nature. " -
Halo 2 Online Preservation Effort Ends
A couple weeks ago, we discussed news that some dedicated Halo 2 fans were keeping the game's multiplayer alive after support for online play was dropped. Now, a few days shy of a month after support ended, the last users have been knocked off the server. "[A user named] Apache N4SIR outlasted everyone. 'May 11th @ 0158hrs I was FORCEFULLY REMOVED!!' he wrote on the forums at Bungie.net. 'I thought I'd be the one turning off the lights but that was done for me. Good night everyone, my Elite needs a rest.' His last comrade in arms, Agent Windex, was still signed on, as spotted by Kotaku at 4 p.m. US Pacific Time on May 10, but their adventure, which began on April 15, ended after Windex announced 21 minutes later that he had been removed from play and Apache N4SIR suffered a similar fate hours later, as he described in his post." -

Suspension of Disbelief
Frequent Slashdot Contributor Bennett Haselton writes in "A federal judge rules that a student can seek attorney's fees against a high school principal who suspended her for a Facebook page she made at home. Good news, but how could the school have thought they had the right to punish her for that in the first place? Posing the question not rhetorically but seriously. What is the source of society's attitudes toward the free-speech rights of 17-year-olds?"Well, you knew this post was coming when you read the news. A federal judge has ruled that Katie Evans, who had been suspended from high school for creating a Facebook group calling one of her teachers "the worst teacher I've ever met," can proceed with her suit seeking attorney's fees from her principal for violating her First Amendment rights. Evans, now a journalism student at the University of Florida, is represented in her suit by the ACLU of Florida.
If any of the recent student online free-speech cases should have been adjudicated in the student's favor, this would most clearly be the one. As Judge Barry Garber wrote in his ruling, Evans's page did not contain threats of violence (if it had, it would have been a matter for the police, not for a school punishment), and the principal didn't even find out about the page until two months after she took it down. It's hard to believe that the principal's lawyers, if he consulted with them, would have gone along with a recommendation to suspend the student. And once the Florida ACLU contacted the principal, wouldn't he have realized that the longer he fought the case, the more legal bills the ACLU would amass, along with the possibility that the principal could be ordered to pay them? Even if he had estimated that there would only be a 5% chance that he could end up being ordered to pay legal fees, was it worth the risk, if the fees could come to thousands or tens of thousands of dollars? Well, now he knows.
When a different judge ruled that a student had no right to challenge his suspension for making a vulgar Myspace page about his principal, I said that there was no more objective basis for saying that the ruling was legally "right" than it was "wrong," because if you put 10 judges in separate rooms and ask them how they would rule on the case, you could get 10 different, mutually contradictory answers. Well, fair is fair — even though I support Judge Garber's ruling 100%, I have to concede that it did not necessarily follow inevitably from the facts and the law, and there's no objective basis for calling it "the" right ruling. Judges are not like doctors who look at a mammogram, and draw on experience that the general public does not have, in order to see something that would be hidden from the rest of us. In cases like these, judges simply have multiple plausible interpretations in front of them, and they pick one. As such they're acting more like referees (who make a decision so that the game — or, in this case, society — can move on) than true "experts."
There is a temptation to think that there is some consistent reasoning behind the different courts' rulings — say, that the student who created a vulgar page mocking his principal (the student was identified in papers only as "J.S.") went too far and crossed a line, while Katie Evans's page complaining about her teacher was clean enough to stay on the safe side of the line, and make her eligible for damages in a First Amendment suit. This, I think, is nonsense, an attempt to put a consistent theory on top of a legal system that does not follow consistent rules from one court ruling to the next. If different judges had been randomly assigned to J.S.'s case and Evans's case, then it might have been J.S. who won and Evans who lost. After all, it was a federal judge who once ruled that a Utah high school had the right to suspend a student for wearing sweatshirts emblazoned with "Vegan" and "Vegans Have First Amendment Rights." (The judge and the principal had apparently confused veganism with eco-terrorism.) How do you reconcile that with any of the recent rulings? (No prizes for guessing how that judge would have ruled if the shirts had said "Christian.")
But even if it's still a roll of the dice how a court would rule in a particular student free-speech case, what matters from the point of view of a principal in a future case, are the potential payoffs. What if you're thinking about suspending a student for a non-threatening, non-libelous Facebook page? If the case ends up in court and you win, then you get the satisfaction of being "vindicated." But if you lose, you could be ordered to pay tens of thousands of dollars to the student's attorneys. So even a small number of victories for students in free-speech cases, even if mixed in with an equal or greater number of victories for the schools, still create an enormous incentive for a principal not to risk the case at all, when the potential gain is so small and the potential loss so huge. Even if you think there's only a 5% chance of being ordered to pay the student's $10,000 legal bill, that means you'd still have to decide if it's worth (on average) about $500 to get the satisfaction of suspending them.
(On the other hand, if a student created a page that was so threatening or libelous towards a staff member, that the school would run the risk of being sued if the principal didn't suspend the student, then the school and the principal are taking some legal risk either way, but the risk involved in suspending the student is much smaller. Fine — there's nothing wrong with suspending a student for threats of violence.)
So the ruling is a much more significant victory for student speech than many of the parties involved probably realize. Even though Judge Garber didn't actually award Evans her attorney's fees (yet?) — he only said that she could proceed to seek them against the principal — just the fact that it's coming dangerously close to that, means that principals in future cases now know what the risks are.
But why was all this necessary? How did the legal and societal climate of attitudes toward people under 18, lead to a principal thinking that he could punish a 17-year-old for comments that she made about a teacher, on her own time, to a third-party audience? If the students in the school had been comprised, not of minors, but of adults from some other minority group — African Americans, immigrant women, native Spanish speakers — there's no question that the principal never would have thought he could get away with suspending the student for criticizing a teacher.
Similarly, students at Harriton High School in Rosemont, Pennsylvania just discovered that school officials had given laptops to students to take home with remotely-activated webcams, that could be used to take photos in student's homes and transmit them back to school officials. Incredibly, this was discovered not by students or their parents examining the laptops, but because school officials used the feature to take a photo of a student in his bedroom, and then confronted him about "inappropriate" behavior, not considering that the students and their parents might consider it "inappropriate" that the school snuck spy cams into their bedrooms. (The school has issued a denial claiming, "At no time did any high school administrator have the ability or actually access the security-tracking software" — which doesn't seem to make sense, since the lawsuit was filed in the first place because the student was told by the assistant principal that the webcam had caught him engaging in "inappropriate behavior.") What was the school thinking? Probably, they were thinking, "These are minors, we can do what we want." If their student clientele had been comprised of adults, they never would have dreamed that they could confront a student about behavior in their room that they captured with a hidden camera. (Ironically, the school may end up in more trouble for spying on minors, as this editorial argues, since the school officials may now be guilty of recording and possessing child porn, depending on what the cameras "captured" in the students' rooms!)
So no matter how much ink is spilled analyzing the legal technicalities of suspending a 17-year-old student for off-campus speech, that's not what the case is really about. The case is really about attitudes. Change society's attitudes to think of 17-year-olds the way we currently think of 25-year-olds, and no judge is going to deny them their right to criticize their school on their own time, any more than a judge in today's society would deny that right to a 25-year-old.
And where does this attitude towards minors come from? I suspect that most people who believe that we have to draw the line somewhere around age 18, believe it for no better reason than because they were raised in a society where most other people believe it too. If you think that setting the cutoff age at 18 is just "common sense," then I would bet my house that if you had been raised in a society where the cutoff age was set at 13, that would seem like "just common sense" to you as well, and similarly if you had been raised in a society where the cutoff had been set at 22. This may seem like an unremarkable observation, but my belief in minors' rights has always been motivated by a more fundamental belief that you should not believe things merely because most people in your society believe them. If that sounds like a trite platitude, consider how few people in the US seem to question the rule that you can show a man's chest on television but not a woman's chest. In more liberal Denmark, supermarkets can stock tabloids at toddler-eye-level with photos of topless women on the cover, while in Saudi Arabia, adult women can't leave the house without covering their faces, and in all three societies, the majority thinks these regulations are just plain "common sense." Is the age of majority just another arbitrary illusion caused by the power of consensus?
When I said this on The David Lawrence Show, the host made the thoughtful observation that most countries all over the world set the age of majority for most purposes at 18. Close, I said, but it doesn't quite prove what it seems to prove, because those globally diverse societies did not reach that conclusion independently — they move in similar directions because of cross-cultural influences. (The voting age was set at 21 in many democracies before many of them lowered it to 18 in the 1970's within a few years of each other.) To get a better sense of whether there is any merit to the idea, we'd have to do something like the "putting the 10 judges in 10 separate rooms" test — put 10 different societies in mutual isolation from each other, let them develop and debate things on their own, and see if all or most of them reach the conclusion that 18 us a good cutoff age for adulthood.
The idea that actual children — under the age of, say, 11 — are qualitatively different from adults, has in fact been re-discovered by civilizations that developed independently at different points in history, all over the world. So there's probably something to it. The idea that teenagers are qualitatively different from adults, is something particular to recent history, and a wise person transported forward in time from the 1500's to the present day might scratch their heads and wonder why we think that 18-year-olds should be allowed to criticize their teachers but 17-year-olds cannot. I suspect the artificial extension of childhood grew out of the fact that because modern jobs are more complicated than they used to be, we need more years of schooling before we can go out and compete in the workforce. The fallacy there, though, is that just because we need more years of schooling, doesn't mean that the natural age of "human maturity" has gone up. So we end up with 17-year-olds having to go to court to establish their right to criticize their teachers on their own time.
Judge Garber wouldn't have been in a position to make this argument in his ruling even if he agreed with it. But even if his ruling was based on logic that has nothing to do with the underlying case for minors' rights, it was still a step in the right direction.

Emmerich Plans Foundation As a 3D Epic

The plans include using technology developed for Avatar including 3D and motion capture technology. When asked about using this technology Emmerich responded: 'It has to be done all CG because I would not know how to shoot this thing in real.'" -
BioWare Targeting Spring 2011 For Star Wars: The Old Republic Launch
MTV's Multiplayer blog reports on comments from BioWare employee Sean Dahlberg, which indicate that they are aiming to release the game in spring 2011. He said, "While we have not announced a specific date, we can confirm that we are targeting a spring 2011 release for Star Wars: The Old Republic. We've got a lot of exciting updates and reveals planned throughout 2010, including the first-ever hands-on testing for the game. ... We can't wait to share more about the game with you as we progress through the year, so make sure you stay tuned to the official website for details." Recent posts to the game's developer blog provide details on the Imperial Agent and the Jedi Knight. They also released a video which gives insight into their design process for the Dark Side. -
Dragon Age: Origins Expansion Coming In March
ishanjain tipped news that BioWare has announced an expansion for Dragon Age: Origins, called Awakening, that is due out on March 16th. Awakening "is supposed to run about 15 hours and will allow for players to import and edit characters they've broken in from the core game," and it will take place "in the in the role of a Grey Warden Commander who's been tasked with rebuilding the order of Grey Wardens and finding out how the darkspawn survived following the death of the Archdemon dragon." A trailer is available at the official site, as well as some information on a new bit of DLC that will be out shortly, entitled Return to Ostagar. Infinity Ward Fights Against Modern Warfare 2 Cheaters

The news comes as the war between IW and MW2's fans rages over the decision to go with IWnet hosting instead of dedicated servers. Mac, Linux Support For Quake Live, Preview of Rage

Support for both is being implemented with next Tuesday's update, according to project lead Marty Stratton, who gave the release date during a press conference held at QuakeCon 2009. A video of the press conference is up at QuakeUnity." John Carmack revealed that they're working on a "premium" subscription service for Quake Live, which will allow players to configure and run their own private servers. Also at QuakeCon, a new trailer was released for id's upcoming shooter, Rage. Kotaku posted an extensive preview of Rage, saying, "I've seen no game that, in this realistic style, looks so good and has a landscape so rich with visual splendor." GTA Chinatown Wars May Pave the Way for M-Rated Content On the DS
The recently released Grand Theft Auto: Chinatown Wars is one of only a handful of mature-rated titles for the Nintendo DS, so the industry is watching closely to see if the traditionally family-friendly market can support such titles. While sales have not been stellar, they haven't been terrible either, easily outperforming previous M-rated titles. If they continue to improve, it's possible we'll start seeing a more consistent effort for "serious" games on Nintendo's portable console. "In the end, Singer said Nintendo hopes that the sales story of Grand Theft Auto: Chinatown Wars will be an encouraging one for game publishers. 'I think strategically, this is a very important game because it helps send the message that great M-rated content can come to the platform and will find a home.'" -
Wii System Menu 4.0 Released

Max Payne 3 Announced For Next Winter
tordavis writes with news that Rockstar Games has announced Max Payne 3 is in the works for the PS3, Xbox 360, and PC. It's currently planned for this coming winter. Quoting the news release: "'We're starting a new chapter of Max's life with this game,' said Sam Houser, Founder of Rockstar Games. 'This is Max as we've never seen him before, a few years older, more world-weary and cynical than ever. We experience the downward spiral of his life after the events of Max Payne 2 and witness his last chance for salvation.' Sony Charges Publishers For DLC Bandwidth Usage
tlhIngan writes "Since October 1, 2008, Sony has been billing game publishers for DLC bandwidth usage. The game companies are forced to pay 16 cents per gigabyte downloaded by users (the 'Playstation Network Fee') regardless of whether the content is free or paid. The good news is that free content will only be billed during the initial 60 days it's up, but paid content will require fees forever. (No word on whether free content will mysteriously disappear after 60 days, though.) Given that some popular game demos run over a gigabyte by themselves, it could easily start costing publishers serious money (16 cents each for a few million downloads adds up). So far, it hasn't cut down the content available (or few publishers have started pulling content), but it's too soon to tell. It should be noted that Microsoft isn't charging publishers any money for content on Xbox Live, though some may argue that the 'gold premium content' is the same thing." Perhaps this is one of the reasons various publishers are pressuring Sony for a PS3 price cut. -
Review: Resident Evil 5
The Resident Evil series has been a pillar of the survivor-horror genre for over a decade, with over 40 million copies sold and several books and movies to show for it. Resident Evil 4 was one of the most highly acclaimed games of 2005, and the lengthy development period given to its successor shows how important it was to Capcom to maintain that level of quality. More than that, the gameplay changes made to Resident Evil 5 make it clear that they're not simply trying to replicate success, but to really establish what they want the series to be. For better or for worse, the series is being pushed toward a bit more action, and the co-op element is almost a necessity. Read on for the rest of my thoughts.- Title: Resident Evil 5

Resident Evil 5 starts you off as Chris Redfield, a familiar face from earlier in the series, as he chases down a bio-terrorism threat in Africa. As you soon find out, there is a New and Improved Las Plagas parasite, which sends its unwitting hosts into a zombified and suggestible state. The new breed is, on the whole, smarter, faster and more dexterous. While some zombies are content to swing their fists or throw an empty bottle at you, others will fight complex gun battles, using cover, deadly accuracy, and aspects of the environment to try and take you out. You'll still meet the shambling, growling hordes you're used to, but there's a much greater range of bad guys than before. They essentially fill any role an uninfected human might in a traditional action game. Newcomers to the series probably won't give this a second thought, but long-time fans may be bothered by it.
Accompanying you on your journey is Sheva Alomar, a young African woman in the Bio-terrorism Security Assessment Alliance (BSAA) who quickly becomes Chris' loyal partner. This is the foundation of the game's focus on co-op play, since a second player can take control of Sheva and work in tandem with you, either locally or over Xbox Live. For solo players, Sheva is controlled by the game's AI, to generally favorable results. Chris and Sheva each have their own inventory space, and you can shuffle items, guns, and ammunition between them as necessary. They back each other up in fights; when a zombie grabs and holds you, your partner can come to your aid and knock the zombie away. If you are close to death, your partner can resuscitate you.
The AI does a pretty good job at being where you want it, coming to your aid when you need it, and doing a respectable amount of damage to your enemies. It has no qualms about running itself out of ammo, but you can give it more or tell it to pick up more off the ground. The one major problem is that you can't really set up a plan with your AI partner. You can't tell them to stay here and cover you while you advance to a different spot, and you can't direct them toward a particular threat. The enemy AI is by turns intelligent and quite stupid. They'll chase you anywhere, scaling ladders quickly or jumping between rooftops, and they'll duck behind walls for cover. Unfortunately, they also have a habit of running up to you and standing still for five seconds before deciding to attack. You can also just run through big groups of some enemies without a scratch. It's probably necessary for the sake of letting the player have a chance to survive, but it's not believable stupidity, and makes it feel like they're just giving you something at which to throw your extra ammunition. Boss AI is almost nonexistent; they usually play out more like scripted encounters. For some of them, this works well.
The difficulty in fighting any of the game's enemies is strictly tied to how you control your character. Capcom made the decision to forbid movement while using your weapon in Resident Evil 5. If you don't like the idea of being unable to "run and gun," you should definitely try the demo first to see how it plays. The effect it has on gameplay is to make shooting your guns something that takes more thought and planning. Firing for extended periods becomes a dangerous proposition because zombies tend to come from all directions. If you stand still long enough, one will eventually come up behind you and attack. It makes situations where you're frantically firing into a group of onrushing enemies all the more tense, knowing that death may be creeping up on you unseen. Oh, and for whatever reason, Capcom decided to prevent you from moving while brandishing your knife as well. I can understand stopping to aim a gun, and maybe having your feet stop moving while actually swinging a blade, but why can't you walk and hold a knife at the same time? Perhaps they just didn't feel it was worth the time to code the changes for an infrequently used weapon. Either way, trying to hit things with your knife is annoying and often useless.
That said, Capcom didn't balance the stationary firing restriction with more responsive aiming. Even at the highest level of sensitivity, the controls are quite clunky to use when enemies are surrounding you. They did implement a button combo that flips you 180 degrees, and this helps to some extent. However, it's still fairly slow, and you almost always need to spend extra time finding your target after spinning around. Worse is when there are zombies to your right or left; button combos that flip you 90 degrees to one side or the other would have been quite welcome, but you're not given that option. Many similar games have implemented a tracking system for nearby enemies, either as dots on a mini-map or arrows on a HUD. Not so in Resident Evil 5; you're often forced into simply panning slowly around the room to see if anything is heading toward you.
You'll also get to deal with a several types of enemies — such as dogs, spiders, and some bosses — who sometimes move more quickly than you can track them. They don't pose a huge threat to your character by themselves, but they often grab and hold you, allowing other, more dangerous enemies to get close. Those have their own associated problems — for one, a few of the more difficult enemies will just outright kill you if they get within melee range. While this makes sense from a realism perspective, it can be frustrating given the slowness of the movement system, and the requirement that you stop to deal damage. Add to this the huge amount of damage some of them can take, and you end up with regular enemies that feel tougher than the end-of-level bosses.
The boss encounters themselves are hit and miss. Resident Evil 5 makes gratuitous use of Quick-Time Events both during fights and in cut scenes. As the boss prepares to smash you with some tentacled appendage, you'll have a window of a second or so to press a button or get killed. This works decently when you're actually able to control your character, and it's used as part of a normal fight. In one of the later chapters, you get to fight a giant spider that's hanging onto a big, circular platform. As you attack the legs holding it in place, you dodge the ones that are free to swipe at you. It's a lot of fun. Unfortunately, many of the other QTEs are simply distracting. It's used continually in cut scenes to, presumably, keep the player engaged as the game characters are forced into decisions about fighting or dodging. But there's no real consequence to those actions; it's either linearly continue the scene or die (and start again very close to where you died).
One thing you'll notice is that many of the boss fights are just variations on a theme: chase bad guy, catch bad guy, watch bad guy turn into nigh-invulnerable, many-tentacled super zombie. But he has a weak spot! Some of these fights work better than others, and there are more original battles scattered throughout the game as well. For example, a battle with a hulking monstrosity that looks like a troll from Lord of the Rings is unique, but quite simple. The fight scenes with the mastermind who's orchestrating all these events (or, as I call him, "Neo") are more complex and interesting, but tend to suffer from QTEs that rely on fast movement, which is not the game's strong point.
The game ships with over 50 cut scenes of varying length. They're quite impressive to watch, and fans of the Resident Evil story won't be disappointed. They do an amazing job of developing the plot and tying the various levels together in a logical way. The scenes are framed and rendered in such a way that they look like movie footage shot by an actual camera, and it's done well. Monsters, characters, and explosions all look amazing. The story itself isn't high drama, but it's entertaining and serviceable — it's what you'd probably expect from a high-budget zombie flick. The big plot twist is depressingly predictable, but it sets up a cool fight. The settings and scenery during actual gameplay are excellent as well. You're taken through modern slums, primitive villages, underground labs, and a variety of other locales. There's quite a lot of detail, and Capcom took care to make everything colorful and interesting to look at.
Resident Evil 5 is a game that gets much better when you have somebody to play with. As I mentioned earlier, the AI is reasonable, but it doesn't compare to having another human to watch your back or help you kill something. The movement and aiming issues become much less problematic when playing with a friend, since you can stand back to back and limit the area one person has to cover. Once you've defeated the main campaign, you also open up Mercenaries mode, which can be played solo or with a friend. Much like in the previous games, you're dropped into a level with plenty of ammo and plenty of zombies to fight. You have a time limit, but glowing pillars scattered around the map will add time to the clock, and enemies will get stronger as the round goes on. The primary campaign forces you to manage your ammunition fairly strictly — if your accuracy isn't great you can expect to run out of bullets frequently — so being able to just fight without worrying about it makes Mercenaries even more entertaining.
The inventory and weapon selection systems are dominated by ammunition limits. Since you aren't given much of any one type of bullet, you're forced to carry around several different guns. These guns and their associated ammo don't leave much room for healing items, grenades, or proximity bombs, so those are used sparingly. You get the standard shooter-game implements — pistols, shotguns, machine guns, rifles — and the lack of ammo will force you to switch between them fairly often. It can be annoying, especially when you're restricted to a pistol or machine gun when you want to use something more powerful. They also give you a few more impressive weapons as the game goes on, but those are used less frequently. Regardless of the ammunition situation, the weapons themselves are nicely designed. You'll have a broad array of tools for the situations you're given, and each gun has a distinct feel.
It wouldn't be a Resident Evil 5 review without mentioning the concerns of racism that were raised when it was revealed that the game would be set in Africa. To put it bluntly: it's a non-issue. The plot is a natural development of moving the Resident Evil story to a new continent. They make it clear that the zombified people are victims, and that the real evil is the corporation behind the experiments.
Whether or not you enjoy Resident Evil 5 is likely to be dependent on how much you like the controls and whether or not you have a buddy you can play with. The plot is cheesy, but in an entertaining way, and it's basically shown to you as a movie interspersed with gameplay. Fans of the story will be pleased — there are tons of unlockable visuals and bits of information. If you were hoping for a more traditional survival game, you may be disappointed. The action is definitely ramped up, and there aren't really any scary moments. However, it's definitely a worthy addition to the Resident Evil franchise, and the amount of care and effort Capcom put into this game is quite evident.

He left the door open to using smartphones for "augmenting" gameplay. Ward also mentioned that upcoming space MMOs Jumpgate: Evolution and Star Trek Online are so different from EVE that they're not really worried about direct competition; EVE thrives in part because of the player-generated drama and scandals, which few games pull off as well. Massively has gathered a variety of details about the Apocrypha expansion, which includes the game's first epic mission arc, and they've also posted some screenshots. CCP Games launched a website for the expansion containing concept art and interviews with some of the developers. -

Mobile Gaming Market Heats Up
A few days ago, we discussed Sony's announcement of a slew of new titles for the PSP, part of their plan to reinvigorate the platform. Unfortunately, according to analyst Nicholas Lovell, it may be too late for the PSP to achieve what Sony had hoped. He says gaming on the iPhone and iPod Touch are rapidly expanding to fill that section of the market. Despite this, rumors have been swirling once more that the PSP2 is under development, and while Sony wouldn't confirm or deny, they were at least willing to talk about the rumors. Meanwhile, the App Store is dealing with a flood of titles that shows no sign of slowing, making it somewhat difficult to keep tabs on the higher-quality games. An Apple spokesperson discussed this in an interview with Pocket Gamer, and also mentioned that they'd be OK with a community gaming service similar to Xbox Live, should somebody decide to make one. It's likely that Apple will soon see more serious competition from Android Market; now that a pricing system is going online, the major publishers have more of an incentive to bring games to the platform. The Guardian's games blog recently went over some of the top games available on Android. -

Lego MMO Delayed
LEGO Universe, the MMOG currently under development by NetDevil, will not be coming out this year, as was previously expected. Mark Hansen, a LEGO Group exec, would not specify a new time frame, and attributed the delay to avoiding competition between some of their other upcoming products. Hansen did comment on the possibility of a console version of the game, claiming that they're just waiting for the right time. IGN did a related piece on the past and future of console MMOGs, exploring where early attempts failed and what needs to be done for them to succeed. Many game developers and publishers are still hesitant due to the massive financial investment required to get such a game up and running in a market that has yet to prove itself. -
What Spoils a Game For You?
MTV's Multiplayer Blog is running an interesting piece about what constitutes a spoiler in video games. The interactivity of a video games, argues the author, often makes it necessary to spoil or reveal at least general characteristics of a game during a review or other informative article. He says, "I believe that writing about games is overly careful. I believe that game scripts, game plots and game endings have been given a pass because critics tend to avoid them or address them with the most ginger touch. I'd at least like the discussion about spoilers to cease being so binary. There is room between avoiding mentioning a plot event and reporting its main details. There is value to addressing anything and everything that is most interesting in a game, and value in doing it with words that express meaning rather than those designed to mask it." Warhammer Team Hit By Layoffs
Zonk notes that Mythic Entertainment, developer of Warhammer Online, is being hit by another round of layoffs. The report estimates that between 60 and 130 staff were let go as part of Electronic Arts' reduction of its workforce. This comes alongside news that the number of Warhammer subscribers has settled to around 300,000. Mythic's Mark Jacobs was quick to affirm that while they were "resizing the team," their plans and schedule are unchanged, citing lower demands on QA now that the launch period has passed. Hopefully this means that their upcoming "live expansion," A Call to Arms, will not be affected by the layoffs. -
Console Download Speeds Tested
MTV's Multiplayer blog tested and compared the download speeds of games on the Wii, the Xbox 360, and the PS3. They tested a variety of scenarios, with the PS3 most often coming out on top. The Xbox 360 took first in one test, but in that situation it was using a wired connection while the other two were not. The Wii consistently came in on the slower side, taking last place in all but one test. The PS3 ranged from .44 to .79 MB/sec, the Xbox 360 from .26 to .86 MB/sec, and the Wii from .30 to .55 MB/sec. Fallout 3 DLC and Games For Windows Live Woes
A reader writes with news that the Operation Anchorage downloadable content for Fallout 3 has been released. Rock, Paper, Shotgun details the extensive difficulties encountered by users of Games for Windows Live while trying to locate and install the new content. This is the first in a series of three DLC releases, and they are exclusive to the PC and Xbox 360. The last, Broken Steel, will allow players to continue within the game once the main story is finished. Unfortunately, Bethesda apparently doesn't plan to patch that ability into the PS3 version. -
Second GTA IV Patch Released, Early Look At DLC
IllusionMPN notes that a new patch has been issued for the PC version of Grand Theft Auto IV. It primarily contains bug fixes and optimization changes, though it's created an issue with some input devices. We're also starting to get hands-on previews of the upcoming downloadable "episodic content," The Lost and the Damned. Trailers and an achievement list are available as well. The original game's Niko Bellic won't have much of a role in the new content. -
EGM Magazine Shutting Down
Gamasutra reports that Ziff Davis Media has sold a number of gaming websites, including 1Up.com, and will be shutting down their popular magazine, Electronic Gaming Monthly. Some of 1Up's staff was laid off as well, though the new owners want to keep the rest of it intact. The sale was motivated by an unprofitable business model made worse by the recent downturn in the economy. 1Up's James Mielke has made a post about the final hours of EGM, and a glimpse at the final issue, saying, "...the final, secret, unpublished issue of EGM will show up here on 1UP shortly in the near future. You will be able to read every hi-res page, ads and all (last time I checked at least) on 1UP, to see the beautiful job that crew did, even with the guillotine hanging over our heads every minute of the day." -

God of War 3 Gameplay Unveiled
Over the weekend, Sony used Spike's Video Game Awards to release new information and a trailer for God of War 3, the final installment of the God of War series that is planned for sometime in 2009. The press release described a new game engine which brings "significant strides in giving players the realistic feel of actually being on the battlegrounds. With texture resolutions being quadrupled since God of War 2, God of War 3 will feature fluid, life-like characters, as well as dynamic lighting effects, a robust weapon system, and world-changing scenarios that will truly bring unmistakable realism to Kratos' fateful quest. Players will have a chance to join battles on a grand scale with many more enemies on-screen and be able to interact with levels like never before." Gamecyte notes that the news contradicts early rumors that the game might be an MMO. -
Publishers Detail Specific In-Game Ad Plans For Future Games
MTV's Multiplayer Blog recaps a recent event held by Massive Inc., a subsidiary of Microsoft, during which game publishers put forth specific ideas on what types of in-game advertising players will and won't be seeing in the near future. The examples varied in how interactive and intrusive they were, from name-brand bottled water power-ups to destructible virtual billboards to taking advantage of sports game locker rooms for product placement. They did claim they would restrain themselves from blatant advertisements that would ruin immersion in fantasy games. Blizzard partnered with Massive to bring ads to Battle.net, but don't expect to see ads in the associated games. -
PlayStation Home Beta Opens to the Public
Yesterday Sony launched the open beta for PlayStation Home, the virtual world designed for PlayStation Network community members. Eurogamer has an in-depth look at the features of Home. Activision Wants To Bring Guitar Hero To Arcades
dlapikin writes "Activision is preparing a deal with Konami and Raw Thrills to bring Guitar Hero to arcades worldwide as soon as 2009. It looks to be a great fusion of their current Guitar Hero III axe and World Tour. 'Some features have been streamlined, however, like character customization. Raw Thrills doesn't want people obsessing over the hair color of their on-screen rock star. But one important feature that has remained is downloadable content. Raw Thrills has the ability to push new songs to "Guitar Hero Arcade" through the Internet. Owners of the machines can pick and choose which of the new songs to add to the cabinet.'" -
Activision Blizzard Announces Guitar Hero 5, New Call of Duty
MTV's Multiplayer Blog reports on recent announcements from Activision Blizzard which confirm that sequels to several popular franchises are on the way. The games include a new Guitar Hero, Call of Duty: Modern Warfare 2, and a new Tony Hawk, which will use some kind of non-standard controller. "At the meeting, Activision Blizzard showcased new games that would make sense for in-game ads, including the vaguely titled "Guitar Hero 5," which included a screen shot of gameplay with a Burger King ad to the right of the note highway." -
Age of Conan Servers To Merge, Funcom Sees Layoffs
Two ominous signs have come recently for Age of Conan fans; developer Funcom went through a round of layoffs, and they announced plans to merge some of the game's servers in order to maintain a "healthy" population. Despite this, Funcom has maintained that development will continue for both the PC version and the upcoming Xbox 360 version of the game, confident that Age of Conan won't follow Tabula Rasa into oblivion. A writer at Vox ex Machina doesn't share that view, pointing to several of the game's flaws as reasons why it didn't maintain the popularity it enjoyed at launch. -

Bethesda has announced that an editor for the Windows version of Fallout 3 will be coming in December. They also said the first additional downloadable content for the Windows and XBox 360 versions will follow in January. Guitar Hero: World Tour's recent launch saw boxes of plastic instruments flying off store shelves, quickly selling out in many areas. Unfortunately, many players reported problems with the bundled drums sets, prompting Activision to release a drum "tuning" application and a free midi-USB cable to connect the instruments to a PC. Otherwise, reviews for the game have been largely positive, and MTV's Multiplayer Blog did an analysis of using Rock Band drums in GH:WT, and vice-versa. Kotaku looked at which set was louder, coming to the conclusion that while they sound different, decibel levels are very similar. The early success in sales for GH:WT caused Activision to say holiday demand may not be met, and that they're examining two methods in particular to develop the franchise: instrument upgrades (hopefully less ludicrous than Logitech's $250 axe) and the possibility of a subscription-based model for user-generated content. "[Activision Blizzard CEO Bobby] Kotick says that there are now 25,000 user generated tunes that have been created for the game, and projected 'up to 100,000 songs' by the end of this year." -

Miyamoto Scrutinizes Mario, Zelda, Hails Portal
eldavojohn writes "Nintendo icon Shigeru Miyamoto stated in an interview that 'What I've been saying to our development teams recently is that The Legend of Zelda: Twilight Princess was not a bad game, by any means. But, still, it felt like there was something missing. And while, personally, I feel like Super Mario Galaxy was able to do some things that were very unique, at the same time, from another perspective, certain elements of it do feel somewhat conservative. This is something I've been talking to both of those teams about ... hopefully [the next Mario and Zelda] will feel newer and fresher than their most recent versions.' MTV Multiplayer also commented on Portal's mechanics and gameplay, to which Miyamoto responded, 'I think Portal was an amazing game, too.' Music Game Competition Heats Up
With Guitar Hero: World Tour set to launch on October 26th, Activision has released a list of downloadable content that will be immediately available. Activision has also apparently included a trailer for Guitar Hero: Metallica (which will arrive sometime next year), and they recently trademarked the name 'Guitar Hero Modern Hits,' which may be part of their plan to increase the amount of Guitar Hero content they produce. Meanwhile, new Rock Band 2 DLC tracks are coming as well, and the release dates for the PS2, PS3, and Wii versions have been set. Early reports say the Wii version made the platform jump better than the original Rock Band, and that all currently existing DLC will be available for Rock Band 2. MTV's Multiplayer blog took a look at Wii Music, which creator Shigeru Miyamoto calls, "Not quite a game and not quite an instrument."
