Why shouldn't they oppose it? The Democrats aren't interested in meeting in the middle. They are interested in pushing their own agenda. The fact that they can't even convince the moderates in their own party to go along with some of the stuff they've tried to pass ought to tell you something. Mind you, this is exactly how the GOP operated when they had control, but the silence coming from the man who promised us a new kind of politics is deafening, isn't it?

The Democrats have made concession after concession to the Republicans on every major bill they've tried to get through Congress, and the Republicans just move the goalposts. This is why we ended up with a watered-down, crap stimulus bill. This is why we're ending up with a watered-down, crap health reform bill. The Republicans are taking obstructionist tactics to new extremes, like "accidentally" losing their voting cards, and filibustering a defense slash war-funding bill in the hopes that the Senate won't even be able to debate the health insurance reform bill. Meanwhile, the Democrats refuse to use the options at their disposal, like reconciliation, to pass the health care bill without bipartisan support or a supermajority. Senator Baucus worked with Republicans for ages on his version of the health care bill, only for them to oppose it anyway. Republican Senators gleefully announce that they intend to break Obama and make health care his waterloo. Republicans previously for health care reform suddenly oppose it for nebulous reasons.

100% party unity is unrealistic for the Democrats on any issue, and the Democrats have 60 members in their caucus in the Senate, not 60 Democrats. Senator Lieberman lost his Democratic primary and garnered more Republican votes than his Democratic opponent, and also more than his Republican opponent. He opposes pretty much every big-ticket Democratic agenda item. That's hardly a party-line Democrat to begin with. Other Democrats are suggesting they will vote against the bill because of a lack of cost-control options like the public option (removed to appease Republicans, despite it's 60%+ support among the public), or because of compromises made to the Republicans, which have garnered no Republican votes and only weakened the bill.

The Republicans don't want to meet in the middle, and the Democrats are fools for trying to act bipartisan. All they get for it is Republicans shrilly insisting that the Democrats are bullying them around any time they want to pass any of the legislation they were elected to pass. The Republicans don't oppose the health care bill on ideological grounds. Plenty of Republicans have supported health care legislation more liberal than what's in the Senate today, such as, say, Richard Nixon. Mitt Romney imposed a very similar plan to the one in the Senate now while he was governor. And so on and so on and so on. It wasn't until the current cycle that Republicans became opposed to plans such as the one now before the Senate. The ideology behind conservatism didn't suddenly change. No, the Republicans made a political decision that it was in their best interest to do their best to attack and bring down any initiatives Obama came up with.

The Republicans aren't opposed to the health care reform bill for any other reason than they were determined to make the Democrats failures. And they're doing an excellent job of it.

That's a loser's lament. Votes are still cast by people, and people still make decisions. Yes, money definitely helps, but there are multiple examples of where the candidate that spent the most money lost. Even today, the major party candidates have lost. Witness Joe Lieberman losing the Democratic primary, and then going on to winning statewide. Witness the rise of Conservative Party nominee Doug Hoffman in the NY-23 race. Witness Reform Party, turned independent, governor Jesse "The Body" Ventura.

The problem is that those boundaries are not defined. Which is why we get rejections on artistic grounds and other such stupidities.

Aside from the fact that adequate grounds exist for military jurisdiction based on the Pentagon portion of the attack - and the fact that the act KSM is most likely to be charged with conspiracy, which certainly occurred outside of the U.S. - the analysis is far more complex if one has a basic understanding of criminal procedure. The very high standard of proof required to convict in a criminal court, and the complexity of the rules of evidence - particularly when considering the difficulty of trying a conspiracy charge. Hell, as a law student, I spent untold hours just looking at hearsay and its numerous exceptions. Not to mention the issue of evidence extracted during and after water boarding sessions and other interrogation

I obviously haven't seen the prosecution's evidence in full, but if this were a more traditional criminal charge, I'd wager that they would have one hell of a tough row to hoe. Keep in mind that, if the law is applied as it should be, a jury may only consider evidence that has been admitted before the Court. If vital bits of evidence are excluded--a scenario that is certainly feasible--can the prosecutors successfully prove the elements of the crime KSM is charged with? If not, in a real trial, he would have to be let free.

Of course, this isn't going to be a real trial.

Assume that KSM is acquitted. There is obviously no chance he'll ever be released, nor could he be released onto U.S. territory at all, of course, under the Immigration and Naturalization Act. A real criminal trial would carry with it the vagaries and risks associated with any criminal trial, no matter how "air tight" a case is (e.g., O.J. Simpson), and the possibility of an acquittal and release.

I fear what we have here with the upcoming KSM trial is more of a show trial. The conviction, execution, and virtually pre-determined, or at least that is how Obama is treating it in statements to the press (as a lawyer and former law professor, he should know better, as he acknowledged with his subsequent ass covering).

Aside from some of the more obvious questions (Why a criminal trial for only this handful? Why are military tribunals "good enough" for the rest? Why has Obama shifted support from the military tribunals he once supported specifically for KSM to the civilian courts? How will classified evidence be handled? Will KSM truly be given full access to all the evidence against him, including names of informants?) are the more larger concerns. Why a show trial for this person? Why now? Will show trials become the norm for the particularly loathsome among us? For those it is more politically convenient for the president to try via show trial? Is this the direction we would like to go in?

If this were to be a real trial, it would be a demonstration of the Obama administration's willingness to take unacceptable risks on national security, particularly since a much friendlier venue is allowed under law and some of the trickier, thornier aspects of the law can be avoided. Instead, it may prove to be a perversion of the criminal justice system, which has rules that are much better established and protect every single American citizen. Why open the door to show trials?

The article you're quoting is outdated: here's the rest of the story:
The Treasury didn't have Fox Entertainment News listed on the original list of networks requesting an interview, this was claimed to be a Treasury staffer error by one source I read.
Subsequently, Fox News was not in the orig pooling of networks for the interview.
Fox Entertaiment News got a separate interview of the same length as the other networks.

Becuase this story is a month old, I guess the other news networks attributed the omission to error rather than malice.

After the White House tried keeping got involved with Treasury's decision whether or not to allow Fox News in a round robin of interviews with "pay czar" Kenneth Feinberg, the five networks bureau chiefs banded together until Fox was permitted in. The joint action shows one of the difficulties if the administration tries to marginalize Fox, especially when that disrupts the network pool. (Fox's own report via Johnny Dollar). UPDATE: From what I hear, the situation was more between Treasury and Fox after the networks decided to pool interviews with Feinberg that had been requested by some, but not all of the networks. The bureau chiefs agreed that all networks should be included in the pool, including Fox, which had been missing from Treasury's list of networks involved in the interviews. The White House was contacted by Treasury, but as a spokesperson points out, they did not keep Fox from interviewing Feinberg. “The fact that Major Garrett conducted an interview with Ken Feinberg at a time when all the other networks did speaks for itself," deputy White House press secretary Josh Earnest told POLITICO. “This White House has demonstrated our willingness to do a round of interviews with a range of networks but not Fox," Earnest added. "Clearly, that didn’t happen yesterday.” Indeed, the White House conducted interviews recently between Obama and five Sunday show hosts without including Fox's Chris Wallace. UPDATE 2: A Treasury official tells Mediaite: "There was no plot to exclude Fox News, and they had the same interview that their competitors did. Much ado about absolutely nothing."

So either Fox didn't request the interview or the Treasury didn't add it to the list and consequently they weren't in the orig pool.

Something to watch out for if it happens again, but I'm not going to attribute to malice what can easily be explained by error. However it looks like you're misrepresenting or unaware of the facts. It was the Treasury, not the WH, who didn't have Fox Entertainment News in the orig pool and the WH approved the additional interview for Fox Entertainment News.

Fox & Friends, something that I am forced to watch nearly every morning by my companions, spits that out maybe once every two weeks, O'Reilly mentions it in a huff on occasion, Beck flies through it when he's on one of his crazy speeches, and I'm pretty sure the actual news side of Fox News pulled the whole "some sources say..." routine at some point over it. If you want, I can go digging for some video proof...

Fox and Friends comes across as the program that just couldn't say anything insightful if it weren't for the teleprompter (and they struggle even with that). It isn't exactly on my list of high quality programs as is, say, Special Report or NPR reporting in general.

I would like to see O'Reilly say that, from what I have seen it wouldn't surprise me, but I have never heard anything about him on that subject, and I mean beyond a possible implication from a question such as "How bad can the Obama administration vetting process get?" Beck has absolutely not said anything of the sort, at least while on Fox.

My point I was trying to make is this isn't something that Fox is guilty of, or at least not alone - other organizations are just as bad with facts if not worse.

This is really nothing new. The prizes in physics, chemistry, medicine, even literature are often given long after a discovery has been made (or late in one's career in the case of literature). Those awards are generally given for things that have stood the test of time.

The peace prize, on the other hand, requires no such scrutiny. Mahatma Gandhi never actually won a prize despite multiple nominations, yet Obama wins despite the fact that his nomination occurred before he even had time to do anything? There is something fundamentally wrong with this picture. Then again I suppose that just makes me a terrorist sympathizer, and therefore unable to form a completely impartial view on the matter.

It is intended to create an environment where equal opportunity exists for all; it does not guarantee equal outcomes for all, nor should it. Right, because we all know the Republican party stands for "Republicanism in its purist sense." Regardless of what a few members of the party may think, the party itself promises to keep the rich, rich, and uses their ultra-religious members to pull in the poor that have nothing left other than God.

Either a) Obama has so much free time on his hands that he can meddle in local matters, or b) he was hoping to distract his audience from his appalling lack of substance in his appeal for government takeover of the health care sector. Since Obama is famed for his lack of substantive arguments (what we call "all hat and no cattle" in this part of the country), my vote is "B."

Here's a thought, Obama: health care is not a right. A person has a responsibility to take care of themselves. Nowhere in the Constitution is it mentioned that the federal government has the power to create a nationalized health care system. That means that this power belongs to the states. You would think that a former Constitutional law professor would know this, but I guess this is what we have come to expect from affirmative action products. Instead of wasting all of your energy on yet another government power/rights grab, creating another unfunded entitlement, and creating another huge avenue for fraud and waste (or what we like to call MedicAid and MediCare), why don't you incentivize the states to come up with creative solutions to the health care problem and see what works best? Isn't it better to have more brains working on the problem than fewer? Obama, you seem to have forgotten that the states are not a collection of regional subjects of the federal government, but are separate entities of which YOU are the servant.

It's much simpler than that. The Republican Party has demonstrated for at least the last 30 years, and especially in the last 8 years, that they have absolutely no respect for science in particular, or education general. Is it really hard to see why a group of well educated scientists would want little to do with a party that despises them?

Party labels have less to do with who you vote for than the GP seems to assume. Just because someone calls themselves a Democrat doesn't mean that they will never vote for a Republican. It's stating a preference, nothing more. Most people tend to lean to one side of the aisle or the other. Even most people who call themselves independents will usually self-identify with one party or the other if pressed.

That's not to say that there aren't party ideologues on each side who will vote the party line regardless of the candidate, but historically they have been a relatively small number, and well outnumbered by the people who will vote for the candidate with the better TV ads or similar ridiculous reasons. After the 2008 presidential campaign, that seems to be changing on the Republican side as they appear to be actively trying to drive out anyone who is NOT a party ideologue. Take Dick Cheney's comments about Colin Powell as just one bit of evidence of this. Another example was the smear campaign ran against any right-wing pundits who had dared to question the credentials of Sarah Palin as VP. We'll have to wait and see what happens there, but the irony is that those party ideologues are killing there party. The base, no matter how well organized, cannot carry a national election on their own. If they ever want to win the white house again, they'll need a lot more than the Republican base.

• Unlike other new england/midatlantic states, Pennsylvania's Primary system is restricted by party registration. Democrats voting in the primary can only select who the democrat nominee is, and Republican can only select the republican, and third party selects third party, etc.
• Last year, the big contest was Obama versus Clinton for Democrat presidential nominee. By the time PA came around in the primaries, late, only McCain remained, so a Republican vote meant nothing; only 26% of registered Republicans voted.
• There was a huge drive by radio personalities last year to have Republicans switch their party status to Democrat to vote in the election. Additionally, many people felt abandoned by spend-happy double-talking Republicans. Many ended up leaving the party, 200,000 is the reported number. PA had a record turnout for Clinton, but that's besides the point.
• Forward to 2009, the registered Republicans who are left are pretty much hard-core conservatives: stop the spending, get government out of business, etc etc
• Over the last couple of years, Sen. Specter has behaved in a manner that is against the core of the party, voting in favor of dozens of high-priced spending bills, in favor of the bailouts, etc
• Sen. Specter is up for re-election this year, and his advanced polling is showing his Republican support at about 20% for / 80% against. It is almost certain that he will not be the Republican nominee next spring, since he is running against the same challenger who almost unseated him 6 years ago when Specter had huge party support.
• Sen. Specter has now switched his party to Democrat to take advantage of PA demographics, and possibly extend his political career an additional term instead of being voted out by his constituents in disgrace: "On this state of the record, I am unwilling to have my twenty-nine year Senate record judged by the Pennsylvania Republican primary electorate" - Specter

A lot of people are talking about "how bad it is getting" and yeah, I'd say in some instances, sure, the economy seems bad. Hmm. . . rouge countries with nuclear weapons -- yeah, bad. GOP congressmen saying there are 17 socialists in the House. The humanity!

Majorities come and go, and they tend to say the same exact things. It's really kind of exhausting. Maybe it will get out of hand. . . at least that would be less predictable and more exciting.
