Bungie Speaks On Halo 2 Leak

BlueMoon writes "A moderator on the official Halo 2 forums posted some speculations and warnings about the Halo 2 leak. To the question where the leak originated he answered "is almost positively the work of some jerk in the manufacturing plant who pocketed the game". They also send out a warning that posting any kind of information about leak will result in "having your XBox Live account's ability to play Halo 2 crippled as we can and we will ban your gamertags from access to vital parts of Halo 2's online experience"." TalkXbox has a repost of an official statement asking community members to assist in the capture of the folks who leaked the game.

    Bungie, I'm ashamed! Look, I LOVE the Halo series. I bought the first Halo game when XBox came out. In fact, I BOUGHT the Xbox just to play it!

    BUT, and it's a big but, I have TWO friends who work at Bungie... and no, I'm not naming names here, but they have HUNDREDS of gigabytes of illegal movies, mp3 audio files, and PC software on their home computers. Trust me, we were watching Spiderman 2 with beers and popcorn three days before it was in theatres!

    Where is the JUSTICE here? I know others of you are the same way. You write software, so you value software but not movies or music. I bet music industry employees steal movies and software but don't download illegal mp3s. It's just the NATURE of how things work.

    Bungie is over-stepping their bounds here. Piracy is as natural as BREATHING. If you have a computer, disk space, and a connection to the Internets, it's not hard work to hunt and find exactly what you want for free!

    Look, I plan on buying Halo 2. I love the first one and still play it with my boyfriend and my family when they come to visit me because it's easy to learn but FUN as heck. I just want Bungie to be honest here -- they'll do fine financially... no one wants French subtitles anyway!

      The threat of banning your gamertag is for those who post leak information (where to get it, H2 spoilers, etc.) in the Bungie.net forums. You have the ability to link your gamertag to your Bungie.net account.

      While your passport may not be linked directly to your XBL account, we would not know if MS has other way of keeping a tab on you. It's Microsoft we're talking about here, you know?

      For all you know, they may have their IP on you. That would be good enough for them to contact your ISP and come after you.

      Well, if someone stupid enough to try to play H2 on XBoxLive with a pirated copy, I imagine it'll be pretty easy to find out who they are. I assume each factory-stamped copy is tagged. When suspicious activity associated with a single tag start showing up (simultaneous log-ons, etc.), I'm sure flags will be raised, and the MS ninja legal team will be deployed, Tuttle-like, to take out the perpetrators.

      And anyone stupid enough to play H2 on XBL before the official release is sure to get some scrutiny.

      I'm not quite sure... I believe that when I logged on to xsn sports site I was asked my XBL tag, so I guess it is now linked to my passport account.

      In order to play the Halo 2 release, you'd need a mod chip. If you go on Xbox Live using any game with a mod chip enabled, you're automatically banned anyway. So you'd have to be doubly stupid in order to do it with a game you're not even supposed to have.

      You can opt to link your Passport with your gamertag. You can do it at www.xbox.com and probably other MS sites as well. This basically enables you to see who's online from a web site, and possible a few other features.

      No, but it's linked to your medical data. So if you've used a leaked copy of Halo 2, and you have a medical emergency, you'll be turned away at every ER and left to die in the street.

      Actually you can use one of the free software exploits to mod your Xbox without spending a dime. It is a common misconception that playing pirated games requires a mod chip. However, you will still get banned from Xbox Live if you connect with a game burned to CDR, DVDR, etc, or if you have a modified C-drive, or if you have a modified BIOS.

      Now what I don't understand is why the Xbox mod community hasn't found a way to lie to Xbox Live about the contents of its C drive, BIOS, and the media on which the game is recorded. If they ever do get that capability, then you can play on Live with pirated games.

      Because the Mod community does not want to get involved with legal hassles.

      MS is letting these mod folks get away with what they are doing because in effect they are helping MS develop a more secure computing platform (palladium anyone?). MS figures they develop games that have massive XBox Live appeal, keep the system setup to keep the games secure, and then you end up with a revenue stream and research in how to develop a physically secure box to deliver content and services to users also.

      The ONLY thing Live checks is a hash of your bios in ram. You're free to modify your C: as much as you like, as well as switching to a larger harddrive, changing your videooutput mode (yes, the one used when the modchip is turned off as well), region etc.

      Some people know how to play on Live with a modified bios - it's actually not that hard. There's no point in releasing an easy way for everyone to do it though - Microsoft would just update the code that checks for modifications.

      Not according to all the customers whose XBOXes I've modded that have attempted to play online with their chip disabled (I tell them not to, but they have to find it out for themselves, don't they?)

      They also check if the Hard Drive is locked. Possibly some other checks too, but mainly the hard drive lock and BIOS check. You can, I believe, get away with using a modded XBOX on Live if you disable your modchip, and ensure your drive is locked, with an MS dashboard installed on C: (your modchip would have a boot from F: BIOS instead).

      All that being said, I don't even care that much , since I refuse to sell chips with anything but Cromwell FlashBIOS preloaded, anyways.

      Likely with an MS dashboard exploit, I would imagine. However, new games nowadays are coming out with dashboard auto-patches, invalidating known exploits. BUMMER! That'll teach you, nasty pirate, for buying an original instead of a cracked copy!

      Personally, online play with anyone but people I know has never interested me. You end up battling people who know the game inside and out and quickly tire of it. Well, that's me, anyways. Instead, I phone up a friend and use XBConnect.

      You can link your XBL gamertag with your MSN account, that way, you can msg your in game buddies, and see what they may be playing now.

      Most people who play XBL and uses MSN messenger do this.

      To participate on Bungie forum, you login with your MSN account (passport). Most people do this as well, as it's easier than filling in your email, and then fill in some registration form, and then wait for the auth. email.

      Good point. There is no Bungie. Once Microsoft bought the outfit all semblence of an ethic game company disappeared. Microsoft made Halo as released and Microsoft is the one threatening game players for posting public information about Halo 2.

      Congratulation, by that single post the size of the leak has been amplified by several orders of magnitudes. That torrent will be burning soon. A post at the front site of thepiratebay.org already says that their ISP's been asked to take the file down and they denied the request.

      It does, but you need to have a modded xbox to play, and modded xbox's are banned from xbox live. That aside, what are you talking about? They said they would ban the gamertags of the bungie.net forum posters. When you sign up for an account, you can put in your gamertag, and most users do, and lol most even have it in their sig.

      It's to be expected with the American doctrine. The willingness, and preperation, for American forces to bring in the big ordinace in close support of the little guys on the ground is a MASSIVE force multiplyer. If someone forgets to cross a t, or transposes some numbers, the results are predictably catastrophic. But when it works, which is the vast majority of the time, it dominates.

    There's no doubt in my mind that Microsoft has people tracking down whoever was responsible for this. I hope whoever it was thought that leaking the game was worth his job, I hear the Microsoft legal team employ some very effective ninja.

    When will companies realize that piracy is just an unfortunate part of doing business. Did they honestly think it wasn't going to be posted up on the internet? I've talked to a variety of friends and strangers. Those that are familar with Halo and Halo 2 all said that they knew of the leak, but they were still going to buy it when it comes out in a few weeks. Those that steal it now...probably wouldn't have bought it anyways.

      Im so going to get screwed by the "copyright infringement isnt theft" brigade (I understand that - but I personally believe that copyright infringement decreases the value of the item) but:

      When will people realize that lack of privacy is just an unfortunate part of an extensively connected internet. Did they honestly think their private details werent going to be posted up on the internet? I've talked to a variety of friends and strangers. Those that are familar with myself and my life all said that they knew of the leak, but they were still going to talk to me. It would have gotten out somehow.

      Come on guys, piracy isnt a fact of doing business, any more than physical theft from Walmart, or defrauding your favourite bank. These people should deserve everything they get, they took what wasnt theirs and placed it outside the control of the copyright owners. However you feel on the subject of copyright law, the law still stands and it should be respected UNTIL CHANGED. These guys have every right to have Halo2 premier in the stores or otherwise as they see fit and not on the internet in the form of a ripoff.

      (the way to 'fight' this kind of very early leaks is simple: don't think that you can sit on them and wait for the right release window, because if you've spent _any_ time in the industry you know it _will_ be leaked).

      they don't need any help, and whats the problem anyways.. doesn't really matter if they guys who would copy it copy it couple of weeks earlier or on the release day. you can't get on live on a modded xbox so isn't the whole fucking threat a moot anyways, and everyone playing online owning a legit copy, so they're only possibly going to fuck up a _legit_ customer? way to cow, bungee!

      You've never read a Bungie post before, have you? They've always been just barely serious, dating back to the Marathon days.

      Their post is more about keeping information about the leak off of their OWN BOARDS. In fact, if you actually read the post they almost come off more concerned about screenshot spoilers. Not that they aren't concerned about piracy, etc., but that is always a problem. They just didn't expect the spoiler problem since normally for software the leak doesn't happen until everyone who wants to could purchase it.

      I doubt companies really think they will be able to stop it but if they did not try that as good as them endorsing stealing their software. At least the remote possibility of punishment keeps most law abiding people in line. Granted many idividuals sometimes even myself (though I have gotten better lately with academic licensed software and OSS) will have pirated copies of software, notably overpriced commodity software (IE MS windows and Office). I believe MS makes most of their money from business where the potential of loss to due to infractions on EULAs is much greater than to a home user. Also it easier for a business to get caught, just takes one unhappy employee who just lost their job to give the BSA a call. Most Video game makers have solved the problem of pirated software with online play where each cd or copy of the game uniquely identifies itself and only one copy can play online at once. As a result downloading the game with net play functionality stripped from it is not as good and you will shell out the $40 or so for the game.

      Actually, my guess is that lots people want to download it because it's cool and they can. Many will still buy it when it's available so they can do the online stuff. It's funny that they hype it so hard and are then surprised when people want to get it ASAP.

      I can remember downloading the 1993 Rush album (Counterparts) in 8KHz Sun .au format, just so I could hear it early. I still bought the album when it came out. This was before Napster or mp3s were around.

      You have never run a business have you?

      Accountants make allowances for uncollectable accounts (people who promise to pay for goods and services but never do and who would cost too much to track down and make pay), and I am sure that retail outlets make an allowance for physical theft. Do you really think that banks don't assume that some portion of their transactions are going to be fraudulant?

      Just because these things are are illegal, fraudulant, or theft doesn't mean that they are not a fact of doing business.

      Now copyright infringement is not considered to be theft by the current interpretation of the courts. IANAL, though. These are separate laws. Copyright theft is more like tresspassing on land leased from the public (for a hundred years) to a private party. Doesn;t make it right, but it is not theft.

      The parent poster chided Microsoft for even making an effort to go after the pirates. Sales lost due to piracy are undoubtedly part of their profit equation, but it's still in their best interest to limit it as much as possible, rather than simply giving up.

      This is how you, I, and most people reading this operate, too. To do almost anything in the real world is to invoke the chance of somebody else doing something mean or unpleasant to you. When this happens, you and I do not simply roll over and take it; if somebody messes with me; I'll kick their ass right proper. So why the chiding when Microsoft does the same to protect their own interests?

      The software market is far more complex than a simple retail shoplifting operation.

      Personally I think we would all better if Microsoft and other really went after copyright infringement with everything they have. Note that copyright infringement is not equated with theft in copyright law.

      Here is my viewpoint: each pirated copy of commercial software reduces the available market for open source software during the initial stage of adoption. Therefore the more that Microsoft enforces their EULA restriction's the more people will potentailly use Linux, OpenOffice, etc.

If you work at a cd fab and you leak a copy of something on the internet, let alone your biggest client's huge upcoming game, you deserve to be at least fired if not prosecuted. The manufacturer would be lucky not to lose their contract with MS for this, I think the least they could do for MS is to fire the person responsible. Whats unfortunate is that their immediate supervisors may also be fired.

      If you're trying to sell software, and someone at the CD manufacturer puts it on the internet a month before you release it, are you just going to say, oh well shit happens?

      It does take a little bit of time to go from start of producing the discs, packaging and to go through the distribution channels such that all the stores have all the copies they need for release week. One month isn't that long of a time.

      So, what, that whole purchasing the company, moving everyone who wanted to go to Redmond (and laying off everyone who didn't), integrating them with Microsoft's game development unit - that was all just a big smokescreen?

      Bungie = Microsoft. They are as much a part of Microsoft as the Office development group, the Windows development group, etc. They're just another group.

      And, frankly, given how many people from the original Bungie (pre-acquisition) are left, it's not a very good group at that. By and large everyone who left did so because it was impossible to get crap done properly at MS.

      BTW, enjoy whatever re-warmed crap that group puts out. It won't hold a candle to what it could've been before Bill & Co. destroyed Bungie.

      I think you're missing the point - is the theft of the CD justifiable in any way, shape, or form, that doesn't translate out to some stupid, selfish reason? Is there some overriding social good, an overall benefit to humanity that justifies the taking of this property?

      I sure can't think of one.

      This is not feeding a starving family or doing any one of a number of other acts that could be reasonably argued to be justifiable. This was theft for entertainment purposes, or if you prefer, copyright infringement for entertainment purposes, which either way, is still wrong.

      So, in answer to your question, if you were the one who did it and I knew you did it or had anything to do with it in any way, shape, or form, I'd turn you in a second, without remorse or guilt of any kind. I might even possibly generate some glee.

    You'd think Halo 2 contains the codes to remotely launch nuclear missiles or something. Yeah, a lot of work and money went into making this, but in the end, it's just one other piece of art/entertainment.       I could not believe the arrogance of this statement. I've never audited a company without at least a few major security holes. Then again, I could not believe the arrogance of their entire release. Do they really believe they need to threaten people?       Have you ever seen the kind of security the manufacturing and distribution plants have? The major CD distributor for Walmart and Best Buy and others hires TEMPS, and has a large security firm on the premises to make sure no one is walking off with items.

      While it is possible it could have been anyone within Bungie that leaked it, it is more likely that it is a temp at the distribution plant with no loyalty at all to the company that did it.

    I love reading the debates on Slashdot on whether piracy is theft, I really do. They have given lots of insight into the true meaning of the word theft.

    I don't think making copies available is theft, but Microsoft does:

    "We consider downloading this code, or making it available for others to download, as theft," the company says in a statement.

    Actually the "jerk" who lifted the original copy is guilty of theft, not the pirates. Slashdot posters have convinced me of that time and time again. Microsoft still has all the copies except the one lifted from the plant. Piracy is piracy, theft is theft. (Or is it? he he)

    The more people that know its actually been leaked, the more that will go out on the net seeking it. However, I don't feel that this leak will have a big impact on the games sales. It would be interesting to find out how many people actually have modded xboxes, and then on top of that... how many people would be happy with a 'french' version of the game.     His logic sounds pretty solid to me. He considers any illegal copying or physical theft of Intellectual/Copywritted material wrong. Downloading a binary has no "victim". Either way. Microsoft/Bungies stance appears to be toward talking about the leak. Things like "I got a copy and this game Rulez!!!" or "You can go snag a copy HERE WWW.XXX.com!!!!" Either way it will not reflect the public. The players who want to OWN the software will buy it. The people who want Warez will download the english version after release anyway.

      I am a proud centrist here, and I don't think I'm alone. I respect the devs and publishers enough to not pirate it (happily running 100% legit softwares and media in my life), but I'm also certainly not going to turn someone in to the supplier (!) for doing so. At least not for free; I want a real perk. They get my $50 for a copy of the game (or a limited license to use if you prefer...) and that's it - they don't get my services as a private-law enforcer.

    It seems to be that way, yes. It would seem that the french PAL version of the game has surfaced on the internet.

    Did Bungie get hacked or something?

    Of course not. This is almost positively the work of some jerk in the manufacturing plant who pocketed the game is it is being printed in mass for world release on the 9th of November.

    What can I do about it?

    For starters:

    STOP POSTING LINKS TO LEAKED INFORMATION WHERE THE PUBLIC HAS EASY ACCESS TO IT.

    The rules have not changed from what we said about leaked magazine shots. Clearly, this leak is highly illegal. By posting links to where it can be downloaded, or even by posting links to screens of the leaked game, you're contributing to the problem by spreading the leaked information. Further, you may spoil the game for people who have worked hard to keep their first experience of Halo 2 pure.

    As such, expect harsh reprimand for the posting of leaked information. A link or offer to give out a link via private media on the forums will get you banned permanently. The same goes for any kind of leak-related spoiler information. Further, you risk having your XBox Live account's ability to play Halo 2 crippled as we can and will ban gamertags from access to vital parts of Halo 2's online experience. We are NOT kidding around here. There will be no warning, no appeal, you'll just be gone.

    If you come across a link to the leaked game, do not reply to it, do not post about it in other forums, do not in any way spread the problem. Message me, SketchFactor, Frankie, or Achronos immediately upon discovering the leak, and then leave it alone. Even telling your friends can result in the spread of the leak, which does us as a company harm.

    What is Microsoft going to do about this?

    There's no doubt in my mind that Microsoft has people tracking down whoever was responsible for this. I hope whoever it was thought that leaking the game was worth his job, I hear the Microsoft legal team employ some very effective ninja.

    What do I do to avoid spoilers now?

    I'm not sure what to tell you. This post makes it quite clear that spoilers from the leaked game will get people seriously banned, but we all know that won't stop some idiot from running in here with a screen of some huge spoiler. My suggestion? Avoid Halo 2 forums if you want to make 100% sure that you don't see any major spoilers. If you must visit forums, make sure you're very choosy about which threads you read. Avoiding spoilers is up to you, now.

    That covers it. From here on out, any threads related to the piracy of the game will be deleted on sight.

    First of all you can't play these copies of the game on xboxlive. You can't play any backups on xboxlive because your modchip has to be on and nobody, I mean nobody has a way of playing backups on xboxlive.

      As far as damages are concerned, yes, the principal theft isn't even a fraction of a drop in the bucket. What? $49.99 at Best Buy? Compared to the loss of marketability, dilution of brand, interference in the performance of contractual obligations, etc. that can be argued as a source of damages, that $50 pocket discount just doesn't register.

They aren't banning accounts for talking about it - they are banning for people who link to info on how to get it, whats in it, spoilers obtained from the leak, etcetera. Basically they're trying to keep the bungie forums a safe place to enjoy discussing the game, for those who want to retain the surprise at the storyline when the game is legally released, and of course cut down on at least a few people finding out where to get the game.

While it's true that the microsoft approach to software piracy in general is sometimes pretty outlandish, it's nothing new. The piracy website has been around a long time. Microsoft has been asking people to squeal on their buddies for a long time. Hell, I've seen advertisements telling you to turn in people who pirate M$ software. This is nothing new, and pretty much standard Microsoft fare, so don't act like it's so ridiculous that they are doing it for a game - It is the de facto corporate response to any piracy.

      k...you must not play very many online games, as most, if not all, withold the right to pull the plug on you on whatever whim they wish.

      I don't really understand what you're getting so pissy about, many games now actively monitor the activity of the players for suspicious behavior, although this is usually to find cheaters, not pirates.

      Take Counter Strike for example, which is probably the game most associated with anti-cheating. They'll happily ban you from playing multiplayer if they catch you cheating.

      Many other games, especially MMORPGs, have some sort of Code of Ethics that will get you banned if you break. Getting caught exploiting some type of nasty bug, especially one that acts as a DoS, will get you banned/shit listed. Most companies are up front about this and it's widely accepted in the MMORPG world as SOP.

      So...why exactly are you so pissed? I'd call piracy a worse offense than cheating, and certainly more deserving of a ban, than giving yourself ub3r l33t h4ckz.

      Even with the security, someone in the chain will find a way around it.

      When I was working on console games, we had someone do a last second change to the ROM we submitted, which broke a later level. (Yes, he got his ass kicked for changing something that had just been approved by QA.) So the next day, we submitted the correct ROM for approval. Soon after, our game was on sale in Hong Kong. Interestingly, it was the wrong ROM. We tracked it down, and one of the console company execs had grabbed that ROM, but not been given the update. It turned out, he was the guy in charge of security, and he'd been selling ROMs while sacking his workers for leaking ROMs. He was only found out because of our mistake.

      So what happened? He was allowed to find a job with another console company, and we were loudly blamed for our poor security, and ended up being sued for breaching clauses in our NDA. The suit fizzled out eventually, because we hadn't done anything wrong, but it served it's purpose of making sure that the console company weren't blamed for what their execs were doing.

    Bungie is not some monolithic corporation.

    Yes, they are owned my Microsoft -- but they themselves are totally great guys (and gals) who hang out with their fans (for instance, i regularly talk with one of the animators, Anim8rJB on the TeamXbox.com forums), drop clues and hints, update us every single week with the progress on the game, and just totally act like a bunch of fools in general.

    Bungie isn't some MNC with faceless lawyers, Hummer H2's, ties to Bush/Cheney, and lawsuit after lawsuit laying the smack down on all their fans. Quite the opposite -- they allow Nightmare Armor to sell their armor, they allow Red VS. Blue to sell T-shirts, DVDs, and Hats, with no royalties. They're just a bunch of dorks like you or me.

    Yea and a copywright violation has stiffer penalties than a petty CD theft. What is it now like 5 years 250 thousand dollars or something. (No one ever reads that annoying black screen at the beginning of movies) Plenty of kids get caught stealing stuff from stores. It's usually a slap on the wrist. Even an adult will pay some measly fine and maybe spend at most a few months in jail.

      You know, there ARE people who DO have modded XBoxes that DON'T pirate games.

      Why would you do that?
      1) Xbox linux- to have a machine that's useful for other stuff when you arn't playing the games. I know several people who run File/Media Servers off their XBoxes when not playing games. In fact, this was one of the reasons I was looking at getting one- using it as a Video/Music/Fileserver PC. I also know of people who used them to build cheap compile clusters for writing software.

      2) Playing imports- this is less of a draw with XBox than with PS/PS2 because most games are released in multiple regions, but I can see people not in the USA Region modding their XBoxes to play games

      3) Region Free DVD-
      despite what they'd like you to think, there is a legitimate use for region free players. If you travel, you can get DVDs in other languages (yes, many dvds are released with multiple language tracks/subs, but usually only spanish or french here in the USA- I've yet to see an American DVD of an American movie with German or Italian Dubs

      So lay off the "All modders are Pirates" crap. I've pirated significantly less stuff (including Movies/Music/Games/Apps since I started modding & became a member of the Opensource Community. IIRC I've only downloaded 1 illegal MP3 in my life- and that was deleted 5 min after downloading it.

      My reply said nothing about all modders being pirates. I stated that if they pirated the game then they must have a modded xbox. If the console is not modded then could they still play the game? I am not sure but I don't think they would be able to. I was just stating that it should not be such a big deal if the game was released in the wild because it IS going to happen. They(Bungie) will receive enough money to continue to produce games.

      Erm...

      There are quite a few game companies who have written their own software without licensing it out as a basis for the games of others.

      Ignoring the fact that Bungie already has one licensee for the Halo engine, there's probably one little secret, one little flaw in your theory...

      The Halo (1) engine actually isn't that great, and has many peculiar limitations. It's difficult to extend it (Halo PC is somewhat limited in modding potential - there's no chance of adding extra code without hacking the main Halo executable). Its design isn't really suited for online play, and isn't client-server like Quake, Half-Life, Unreal etc. (Gearbox did a pretty good job of retrofitting some modern netcode, but it's still not perfect).

      There are a bunch of weird physics bugs involving moving objects (lifts, etc) and non-player entities - persuade a vehicle or monster on to a lift, and it'll fall straight through.

      It's perfectly tuned for the game it was written for and works extremely well for that, but it's not some cross-platform, ultra-versatile thing like a Quake or Unreal engine. Anyone wanting to add to it will have to dig deep down into its innards.

      As for the Halo 2 leak, probably the biggest problem isn't so much the hand-wringing about copyright theft, more the fact that Bungie has kept the full story of the single-player game a complete secret. There are most likely whole races of creatures you're not supposed to know about yet, like in the original Halo. And the pricks pirating the game are likely to be just the sort who will jump into some online forum to describe all the plot twists and characters.

      Halo.Bungie.org has already closed its forums to new posting. Bungie.net are threatening people with permanent bans. Vicious, yes, but for a Bungie game, where the sotory is incredibly important, revealing the plot is wrong...

      Bungie's made a few other games actually. Myth, Marathon, and Oni to name a few. Halo's obviously the big money-maker out of all of them.

      Bungie is technically one of the studios in the Microsoft Game Studios. So yes, they are all MS employees. However, I can tell you that they're allowed to be very independent-minded, since are one of the few studios to bring profit to the whole MGS group.

      The Norwegian police's economic crime division ("Økokrim") has a nifty program that (I'm not kidding) can monitor P2P traffic everywhere, to see which IP is downloading what. They used it with great success in a recent international kiddie pr0n raid ("Operation Enea"). There was a documentary about the sting on Norwegian television, showing how it worked. I was baffled, they monitored all P2P traffic over the course of a weekend, looking for certain known filenames and general keywords, storing all the info in a database. They caught a great number of kiddie pr0n peddlers in the sting.

      OK, They won't use this to find you when you download Halo 2, and they don't have the resources to monitor constantly. However, if you live in Europe and download that file called 'ILLEGAL PR0N LOL FORBIDDEN' don't feel too safe :)

      Anyone know if the cutscenes are in real time?

      I ask this because from the screens shots I have seen people are of people playing them back using "Bink Video Player." Could it be that the game's cutscenes are not in-game, and they are showing pre-rendered FMV?

      The bink site mentions that Halo 2 uses their codec, but not for what. Besides that, I haven't found out much else.

    Actually, I believe bittorrent prevents people from doing this very thing. It uses checksums for each segment transferred, so you can't just insert any old data in. You would have to insert data that matched the checksum. Needless to say, this is not generally an easy thing to do.

      I've downloaded it and started playing it. Its pretty fun. The french is a bit annoying but there are subtitles during the cinimatics so i am not completly lost. Also, you get to play as the covanent part of the time. Haven't played multiplayer yet (not xbox live, splt screen) but I think i will this weekend.

    They aren't banning accounts for talking about it - they are banning for people who link to info on how to get it, whats in it, spoilers obtained from the leak, etcetera. Basically they're trying to keep the bungie forums a safe place to enjoy discussing the game


    Sure, they have a right to control their forums, but the statement Bungie made isn't limited to just their forum. Here's a clip of the rather draconian announcement:
    If you come across a link to the leaked game, do not reply to it, do not post about it in other forums, do not in any way spread the problem. Message me, SketchFactor, Frankie, or Achronos immediately upon discovering the leak, and then leave it alone.Even telling your friends can result in the spread of the leak, which does us as a company harm.

    It really sounds like Bungie is trying to control the spread of free speech. It's a rather poor statement if all they want to do is provide a leak-talk free forum on the bungie forums. A good way to actually GET people to talk about something is to tell them very loudly to NOT talk about it. Get real Bungie, this is a game not a military secret. Sadly I think this is just a poorly thought out statement from one guy at Bungie, but since it's the only thing that's been said it's taken on large-scale meaning.

    Bungie needs to realize that the cat is out of the bag and they can't do anything to put it back in. Anyone that wants to know will know. They should have just been as quite as possible, announce they're looking for the source of the leak, and remove any posts on their forums posting links to the game or spoilers.

    The thing is, the torrent-linker above could have been the initial seed, in which case he very easily could've made a 4GB file of goatse, and just called it "Halo 2 Xbox DVD" or some such.

    Not true. I wanted to get a leaked copy, but I didn't know how until I saw that slashdot post. I'm downloading it right now.     What has gotten into Bungie? Reading their comments on the leak is just like listening to a child throwing a tantrum. Here are a few pointers for them :

    1- There is no point in acting as if the world has ended. Games get pirated all the time. In fact, ALL of them get pirated. What made you think yours would be exempt?

    2- Repeatedly pointing out that this is "highly" illegal (is there a lowly illegal?) bores me. EVERYBODY knows it's illegal. Next, please point out that the sky is HIGHLY blue...

    3- Pirate copies are available before your game was officially released, so what? Again, it happens all the time, especially with high profile games like yours.

    4-Is this going to harm you more than if the game had been pirated one or two days before official release? No, to play a copy, one needs to have a modchip installed. People who have a modchip installed and are playing the leaked game were going to pirate it anyways once it was released.

    5- Microsoft is investigating this and will prosecute to the full extent of bla bla bla.

    Again, you're boring me. Most of these investigations get nowhere. If you do happen to catch the leaker, I hope that makes you happy because no one else will give a shit. The guy who leaked the HL2 source code was arrested. This didn't dissuade the guy who just leaked Halo 2. What makes you think this time will be any different?

    To sum it up: It's no surprise that your game was leaked, it's no surprise that it will be pirated, and we all know it will still sell like hot cakes and that you will all make lots of money. Hell, you're already making lots of money, you work for Microsoft right?

    So stop your whining. Thank you.

      I don't think it's so much that it was pirated; rather because it was pirated almost a month ahead of time. The majority of pirated games nowadays are usually at most a week ahead of time, if not the day of.

      A mod chip is NOT needed. You can use a free software exploit to mod your Xbox without spending a dime. Furthermore, you can use a modded Xbox for things other than pirating Xbox games. I use my modded Xbox with Xbox Media Center, which turns it into a super DVD player capable of playing almost any digital media format: DVD, CD, divx, xvid, mp3, etc.

      I personally don't care for most Xbox games. I only own around 4 games.

    They have denied that request, since the file in question is not illegal in sweden. The file only contains information on how HALO2 can be obtained - not HALO2 in itself - therefore the file in question is not at all illegal, according to swedish law (and The Piratebays lawyers views on the matter).

    Also, according to previous court rulings - the owner / maintainer of The Piratebay cannot be held liable for how its users uses the service offered.

    However, in the end, the seeders / downloaders that upload data, can be held liable - if microsoft can track them down AND get the court to force the ISPs to reviel who they are.

    I find it more than a little amusing that Bungie would call on the community for support considering what they did to their (predominantly Mac - based) community in 2000.

    Some of us have far longer memories than that company would probably like. Rather ironically, "bungie" is still a synonym for "stabbing somebody in the back" in my mind.

    Okay, yes, I'm still bitter, but the thing that has seemed to give games longevity is when the game has an active community - Marathon, Myth I and II had some fantastic mods come out for it. The people who created these mods were fiercely loyal to Bungie, in the way you'd expect that almost oxymoron the "Mac gamer" to be. When Bungie sold out to MS, it was not just another company take-over. Many publications carried editorials specifically on the issue.

      Actually, there are a couple of softmods that will allow you to run unsigned code without owning a modchip. You need a Action Replay thingy that allows you to download savegames off the 'net, and then you use a copy of 007: Agent Under Fire to exploit a loadgame hack. After that, you're pretty much to go.

      It's actually really easy to do, it's just not well known.

They used it with great success in a recent international kiddie pr0n raid ("Operation Enea"). There was a documentary about the sting on Norwegian television, showing how it worked. I was baffled, they monitored all P2P traffic over the course of a weekend, looking for certain known filenames and general keywords, storing all the info in a database. They caught a great number of kiddie pr0n peddlers in the sting."
    I'm sorry, but I believe that you have misunderstood completely.

    They have no way to monitor all P2P traffic, obviously.

    What they did was simple. They knew some common search term for child porn, and they searched the FastTrack network for hits. They then downloaded files, and registered the IP addresses of the people they had received kiddie porn from. They may also have checked the user's file list to see if he was sharing anything else.

    It's that simple. There is nothing baffling about this. You can do it yourself! Fire up Kazaa (beware of spyware), and search for kiddie porn (use your imagination). Now you can download it and check the IP address of the person you downloaded from.

    Actually, they used a customized FastTrack client which made all this easier.

    Where are the ethics of that? The above quote is from a company who is threatening to destroy something of value that belongs to one of their customers if they suspect said customer of POSTING A URL, regardless of whether there is any evidence that said customer pirated the game or gave a copy of the game to anyone else. I don't own an xbox. I don't own halo1 or halo2, and based on the ethics of the companies that developed those products, I never will.

    It's Microsoft that gave you the GamerTag under certain terms. You are not allowed to encourage piracy of Microsoft products (posting a URL is encouraging).

    I'd agree that it is a cost... but not a loss, nor a physical loss.

    A persons downloading of shareware app from a web site is little different than a person taking a car for a test drive.

    Both are free for the customer to do and that help them decide if spending money on the given product is worth while. In both cases, the cost to the seller is a cost of doing business and a smart company will write off such expenses as 'business expenses', not as a 'loss'.

I know a guy who has a modchip, and he has pre-ordered a copy of the game, just to support the company in what they feel will be a great game. They use their modchip to stream video (of recorded tv shows) and purchased music across their network to the TV mainly, what's the problem with this?

      As one of the people you are speaking of, I would have to say "Nothing at all".

      I have spent the better part of a couple of years converting all of my and my wife's albums, cd's, out of print tapes, VHS collection, DVD collection, etc... to a (IMO) very nice file server based system.

      We use our Xbox as a system to access this information and play it over our entertainment system.

      I also have a 160 GB drive in the Xbox itself where I back up every game I buy -- I never need to touch the disc after that. While my chip (like most on the market) does allow itself to be turned off for Live use, I've never turned it off... because I don't do multiplayer on my Xbox.

      I have tested games before buying. I don't rent and copy them, however. I have downloaded games before buying (if my local video store doesn't carry the title) and tested them. If I like a game, I'll buy it (as I get older, I'm realizing there aren't many games I care enough about to buy... much less actually play). However, unlike the PC, the Xbox doesn't often have demos (outside of specific gaming rags which I don't purchase).

      As long as that is the case -- I will continue to try a game out before I purchase it. Especially when it is something as overlyhyped as Halo 2. I've already been disappointed this year (Doom 3 for PC, Second Sight & Ninja Gaiden for the Xbox) -- and unlike going to the theatre, nobody's going to refund my bread if I turn it off half way through and never touch it again.

      So, Bungie, the way I look at it I've already spent a load on you guys (as many ex-Mac gamers have): Abuse, Pathways into Darkness, Marathon 1-3, Halo 1, Oni, Myth 1 and Myth 2... and you usualy did me right. Regardless, I will still be testing Halo 2 out before I buy it -- whether you like it or not. And if Halo 2 is up to snuff, I'll break out my mastercard and stand right in line. If not, after a couple of hours, I'll know it, delete it and probably never think about it again.

    The swedish ones are in the same style as the others. The best i think is the one with "Uppsala universitet", is from a university that is very upset over some leaked scientific papers or something, and is going to sue. However, after some discussion (and discussion on their part with their lawyer) they realize that there is nothing anyone can do, and the site "The Piratebay" is fully legal.

    However, as I said in my previous post, the endusers can be held viable IF they can make the ISPs give out IP adresses - which they wont here in sweden, afaik. However the ISPs will send out letters to their customers on request (letters with no threats that is, just warnings).

    Ummm, I would have thought that would be applied to the pirates, not the people buying a game to support a CORPORATION that, by law, MUST be motivated by money (or, in more general terms, wealth) ONLY.

    I'd suggest it's much more likely that pirates are motivated by a love of many other things, law breaking, general piracy, hoarding, collecting, and some other things I can't think of right now, but the last thing on my list would be a love of money. More appropriately, I don't think it makes it *to* my list...

    Besides, I would expect a pirate motivated by money not to be using BitTorrent to give copies of the software to others for free, but to use something like FTP and then sell copies to kids at high school.

    As a HALO fan, I certainly downloaded HALO 2. The french in the cut-scenes are ok as there are english subtitles, but all the ingame talk's not subtitled... So, I got pretty bored after half an hour. Anyways, in that half an hour I'm sad to say it behaved and looked like the same old Halo with new levels. It didn't feel the same though, I had severe trouble getting used to the "feeling" of the controls. So... well, my first intention was to buy it when released, but I'm not so sure anymore. I can't say it lived up to any of my expectations. Maybe HL2 will?
