Well, you could make that argument from multiple angles, but again you're dealing with straw men.
The problem is not the relative moral culpability of the acts so much as the accuracy of the analogy. Stealing a CD from a record store is far more like not paying the RIAA for a download -- especially since downloaded music easily substitutes for a store purchase. Breaking into someone's home is totally inaccurate. When you download a song from someone else, you aren't stealing the song from them, you're just not paying the rights owner for it.

Here's a few pulled-from-my-ass tests for the real world, as opposed to their real-world tests for an ad-revenue-driven world.
- Fill the disk with data, then write random bytes to random sectors of the disk (using a repeatable PRNG). See what percentage of the filesystem is still recoverable afterwards, and how long it takes to do a fsck on it.
- Time this.
- Count the number of times each FS's developers have murdered someone (hey, it's no less meaningless than measuring a FPS timedemo in terms of seconds per filesystem).

I think someone has thought of the same basic concept before. Personally I wouldn't want to have a bomb ready to go off at any time on my lap, the C4 is relatively stable but the detonator really isn't and would have to be in place. A spark, a battery on fire and boom goes you. The collateral damage could be pretty nasty too, even if the charge is small. If you want the James Bond solution, I'd go with poisonous darts on the front, open it up and you get a nasty surprise. That way you can carry an antidote in case of malfunction, plus the laptop is unharmed and can be returned to you. Well maybe, after a friendly chat with the local police.
