I don't know how widely this ruling will apply. IANAL, but my understanding is that this would only definitely apply within that specific jurisdiction, but that other jurisdictions would be very likely to accept the same argument when it is presented to them.

The decision will also likely affect the some 500 other individuals living outside of California who were sued along with Pavlovich for posting the code, said Allonn Levy, Pavlovich's lawyer said.

He said the decision to limit such lawsuits on the issue of jurisdiction sets a precedent that would be followed by courts in other states.

"This is such a cutting edge issue," Levy said. "Now that it is the law of the land in California I would expect that other states will do the same."

This guy is a lawyer, making the same point: the California movie industry cannot bring every DMCA related case to its local court. It will have to determine where the alledged crime occurred and file suit there.

That's too bad about Snape. He was absolutley perfect in the first film. I loved the scene where he introduces the students to his potions class. The uncut version from the special features of the dvd is even better!

but Richard Harris's Dumbledore gets a lot of scenes.

Ahh, but good news about Dumbledore! His is probably the most interesting character in the first book, but some of his best lines got truncated.

Honestly, I don't know what the series will do without Richard Harris (he died recently). David Heyman, the producer of Harry Potter has already admitted that Harris is "irreplaceable". He's not just giving a polite eulogy either. Harris was spot on as Dumbledore. In fact his calm, reasoned, lilting interpretation added to my appreciation of the old wizard.

Richard Harris will be sorely missed.

P.S. Not to dismiss Harris's other roles in a varied and interesting career, but I don't want to stray off topic.

It's not OSS at all. Symbian is still a proprietary, closed-source OS. Here's an announcement from April about their "opening" of code.

What the Reuters article says is that MS wouldn't release the SmartPhone OS code to Sendo but Symbian would.

IMO, this is a terrible mistake on MS' part. They refused to release code to one of the first licensees of a brand new, untried OS for a market segment that demands vendor differentiation more than any other.

The EU courts don't always agree with the courts of the member countries, which is fortunate since it is far from unanimous amongst voters that the EU should take precedence over national sovereignty. And EU member countries freely ignore the EU courts.

So what will probably happen is MS will rightly be found guilty, they will ignore the remedy

More likely is that MS will ignore the EU court, as most EU members do, and nothing will happen until national governments (most likely the Germans or Spanish, who seem to be the most unfriendly to MS) take an interest.

Actually, I saw this on google news yesterday: A British company is working on delivering porn on demand to your phone, to keep you entertained as you ride the bus home from work. :) Personally, although I know the camera/phone combo has proven popular in Japan, I think adding cameras to cellphones is rather overrated. One is bound to be sacrificing features on the camera (here, it appears to be resolution) and creating an unholy clutter in the process, although I have to admit the image in the article looks pretty good...

I see an Indian national or someone from Signapore resign from their position at a large company like Veritas, I won't believe that they are as skilled at lying as their American counterparts.

Colombia Rebels Kill 11 Civilians -Rights Group Marxist Colombian rebels allegedly killed 11 civilians, abducting them from a pool-hall, tying them up and methodically shooting them execution-style days later, Colombia's top human rights official, Ombudsman Eduardo Cifuentes, said on Thursday.

According to Reuters Simonyi has rights to patents he developed at Microsoft and Microsoft is entitled to be first to negotiate for rights to Intentional Software's developments.

According the the Wall Street Journal the new company will be based in Bellvue, Washington, which is home to almost as much Microsoft real estate as Redmond.

By all accounts the split was friendly.

The article also speculates that it could cause a enviromental hazard if the water temperature rises and the methanes rises to the athmosphere thereby contributing to global warming.

There's an SF novel about this: Mother of Storms by John Barnes. It's a terrible book in many ways, but the premise - a massive release of methane from one of these undersea methane beds altering the global climate in sudden and completely unexpected ways - is interesting. It's also perhaps something to keep in mind when considering plans to liquefy carbon dioxide and dump it in the sea (as opposed to underground)

Well spoken, but ultimately you must remember that there is no (reasonable) limit to the number of websites and/or sources of information out there... I personally do not feel that US culture or values are Good or Bad neccessarily - I read some "big corporate" websites everyday, but avoid other popular ones altogether. This is simply a decision that I have made for myself. Fortunately, everyone else on the Internet is entitled to an opinion and choice of their own. Some common rants:

Think CNN is a tool of the government to brain-wash the masses?
Solution: Read Reuters or the BBC-News or any other news site you find suitable. Better yet - read from several/many different sources.

Think Hollywood is controlling what the masses see and hear?
Solution: Check out IMDB... Read reviews from hundreds of individuals like yourself, and formulate your own opinions.... See and watch only what you choose to.

I can certainly understand why the author feels as he does - It must be frustrating for other cultures to see what must be an obviously American influence on so much of what they read and watch... but no one is forcing them to do so day after day. Everytime they type in "www.abcnews.com" or tune into the Sopranos, I think its only fair for them to take responsibility for the fact that they are about to get information/entertainment from an American source - and should keep that in mind before their fragile minds are corrupted by the big conglomerates lurked inside those sources.

... Sorry, didn't mean to get sarcastic at the end there... I just think this whole "seperate european internet" idea is kind of silly, and the very definition of "unneccessary."

I realize that you took a very objective viewpoint in your post, so not all of this is aimed at you ;)

Most U.S. newspapers are affiliated with the AP and Reuters, though a smaller number use the Agence France-Presse, which is more popular internationally. Then there's United Press International, which is practically dead, so few papers use it.

Knight Ridder and Gannett are different animals altogether. They are huge corporations which own dozens of tiny newspapers you've never heard of and a few larger papers (USA Today is Gannett's flagship paper, while the San Jose Mercury News is KR's, though KR's Miami Herald is a better paper). One of the "advantages" of these giant corporations is that they share stories with other papers in the corporation, which enables a paper in Fargo to cover an event in San Francisco without having to put up the money for a regional bureau.

Better papers (New York Times, Washington Post, Wall Street Journal, Los Angeles Times, etc.) maintain their own bureaus outside their hometowns (for instance, the Washington Post has about 10 bureaus in U.S. cities outside DC [Chicago, New York, Los Angeles, etc.], and about 12 bureaus in international cities [London, Tokyo, Moscow, etc.]), so they use a far higher percentage of their own content, but they still use the AP, Reuters and AFP for stories they can't afford to cover themselves or don't have the time to reach. However, you won't see a Knight Ridder story in a paper like the New York Times.

The big difference here is that aggregators/metabrowsers are computers that display headlines without discretion. Newspapers employ editors who have been trained in the art/science of news judgment. For this reason, a metabrowser will quickly become exceptionally boring and irrelevant.

I believe the next corporation to go under will be AOLTimeWarner. There is no doubt that they are already cooking their books. The management is dumping their shares like crazy and some are even resigning. This is definitely the sign of a company in trouble.

Do you know how the scientists test for the carcinogenic effects of products like this? They take lab rats and either force-feed or directly inject them in a matter of hours or days with a large multiple of the amount of the substance a normal human would consume in a lifetime. Hell, you can even overdose on water.

I've thought a bit about cancer lately and I've had two ideas so far. First, look at the process of human aging. Basically, the body slows down it's reproduction and replinishment of cells in the body--it slows down maintaining itself. I tend to think of cancer as likely a side-effect of this slowing-down process (misplacing the resources used in the replinishment?). The second idea is what if it's a (momentarily detrimental) part of our evolutionary process? Perhaps we're in line evolutionarily for enhanced abilities to heal and slower aging--which would require greater regenerative abilities of the cells of the body.

... or for corporations to adopt the independent methods as a matter of convenience.

This could start the ball rolling towards a standard, leading more and more big corporations towards M$'s standard.

Given that some security features are introduced to keep the security of the larger companies internal messages, this might induce private users to join the network, and the ball is rolling.

I've heard the Reuters initiative is struggling to get acceptance amongst its clients, anyone who knows how far Bloomberg is getting along this route?

Just to speak about Open Source, it has gained media coverage in France in two of the main newspapers (Libération and Le Monde - the latter raising the subject again today).

Europe is also lucky enough that the vast majority of press agencies/newspapers/etc are not owned by big greedy conglomerates and are therefore marketing independent. Economy biased media exist, but they are the minority here. The Diana hype has occured here too (hey, it happened in Paris, how could this be ignored), but the death of Mother Theresa, OTOH, hasn't gone unnoticed.

Marketing disease in the media is of particular worry because medias are a political force today. See the pedophilia "trend" (again in Europe), for example, which all started with the case of Marc Dutrou, in Belgium, several years ago. Raising this case led to 1. politicians looking at the problem and 2. people, aware or victims, starting to speak on public whereas they would remain silent prior to that. The media can influence people in the good way, like in this case, but the other way around is also true.

I just hope that this disease doesn't infect us, honestly. I just don't want to see presidential campaigns turning into commercials just like they are in the US.

Speaking of news, I hope you US citizens know that Mr Bush refuses to adhere to the Global Court because he doesn't want his soldiers to be subject to its juridiction. Crimes are crimes, period. FYI the two other countries refusing to adhere are Russia and China. Nice refereces. This is a blatant insult to the rest of the world, as was his rebuttal of the Kyoto Treaty (need I say which country emits the more pollution in the world?). If not, then the rot in your media is not only about marketing.

I don't know about you, but that "a Microsoft certificate which is so advanced that some U.S. universities require that their students earn it to graduate" line sures makes me shudder.
