Scientists Say The Asteroid That Killed The Dinosaurs Almost Wiped Us Out Too (theweek.com)
HughPickens.com writes: Conventional wisdom states that mammalian diversity emerged from the ashes of the Cretaceous/Tertiary mass extinction event, ultimately giving rise to our own humble species. But Joshua A. Krisch writes at This Week that the asteroid that decimated the dinosaurs also wiped out roughly 93 percent of all mammalian species. "Because mammals did so well after the extinction, we have tended to assume that it didn't hit them as hard," says Nick Longrich. "However our analysis shows that the mammals were hit harder than most groups of animals, such as lizards, turtles, crocodilians, but they proved to be far more adaptable in the aftermath." Mammals survived, multiplied, and ultimately gave rise to human beings. So what was the great secret that our possum-like ancestors knew that dinosaurs did not? One answer is that early mammals were small enough to survive on insects and dying plants, while large dinosaurs and reptiles required a vast diet of leafy greens and healthy prey that simply weren't available in the lean years, post-impact. So brontosauruses starved to death while prehistoric possums filled their far smaller and less discerning bellies. "Even if large herbivorous dinosaurs had managed to survive the initial meteor strike, they would have had nothing to eat," says Russ Graham, "because most of the earth's above-ground plant material had been destroyed." Other studies have suggested that mammals survived by burrowing underground or living near the water, where they would have been somewhat shielded from the intense heatwaves, post-impact. Studies also suggest that mammals may have been better spread-out around the globe, and so had the freedom to recover independently and evolve with greater diversity. "After this extinction event, there was an explosion of diversity, and it was driven by having different evolutionary experiments going on simultaneously in different locations," Longrich says. "This may have helped drive the recovery. With so many different species evolving in different directions in different parts of the world, evolution was more likely to stumble across new evolutionary paths." -

70% of U.S. Government Spending Is Writing Checks To Individuals

In effect, the government has become primarily a massive money-transfer machine, taking $2.6 trillion from some and handing it back out to others. These government transfers now account for 15% of GDP, another all-time high. In 1991, direct payments accounted for less than half the budget and 10% of GDP. What's more, the cost of these direct payments is exploding. Even after adjusting for inflation, they've shot up 29% under Obama." It's very hard to lay blame on only one part of the U.S. government, though; as the two largest parties are often fond of pointing out when it suits them, all spending bills originate in the House. -

An Instructo-Geek Reviews The 4-Hour Chef
Bennett Haselton writes "Recently I wrote an article about what I considered to be the sorry state of cooking instructions on the web (and how-to instructions in general), using as a jumping-off point a passage from Evgeny Morozov's new book To Save Everything, Click Here. My point was that most "newbie" instructions never seemed to get judged by the basic criteria by which all instructions should be judged: If you give these instructions to a group of beginners, and have them attempt to follow the instructions without any additional help from the author, what kind of results do they get? The original title of my article was "Better Cooking Through Algorithms," but due to some confusion in the submission process the title got changed to "Book Review: To Save Everything, Click Here" even though, as multiple commenters pointed out, it didn't make much sense as a "book review" since it only mentioned a short passage from the actual book. This article, on the other hand, really is intended as a review of The 4-Hour Chef, even though the article only covers a similarly tiny fraction of the book's 671-page length. That's because even before buying the book, I was determined to review it according to a simple process: Try three recipes from the book. Follow the directions step by step. (If any direction is ambiguous, then follow what could be a plausible interpretation of the directions.) My estimation of the quality of the book, as an instructional cooking guide for beginners, is then determined by the quality of the food produced by my attempt to follow the directions. (I've done this so many times for so many "beginner cookbooks," that I've probably lost my true "beginner" cook status in the process — which means that the results obtained by a real beginner using The 4-Hour Chef, would probably be a little worse than what I achieved.)" Read on for the rest of Bennett's ThoughtsI bought the book with tempered high hopes. Watching Tim Ferriss in his TV interviews and reading the enthusiasm that leaps off of every page (each recipe even comes with a "song pairing," music to jam out to while making the dish), it's hard not to take a quick liking to him. He comes across as a man who who really does want to share his passion and not just sell books. He's goofily handsome in that way that women and some men often confuse with "confidence", although he does seem to possess a lot of actual confidence. But enthusiasm is the enemy of objectivity, and I was determined to review the book according to the criterion of how well the directions actually work, not based on how much fun it would be to hang out with Tim. Even though it would probably be fun.
In his interview on Jimmy Fallon, for example, they looked like they were having a great time, but Jimmy told Tim that he read the book and tried following the directions for making bacon-infused bourbon, then proceeded to show some "action shots" of the result that he achieved: a jar of what looked like solid bacon fat, which Jimmy said he did not drink. OK, I thought, that means that whatever comes next, in that case the directions failed. Tim proceeded to explain that you have to be careful not to overblend it, and to leave it in the freezer long enough to be able to scrape more of the fat off, so that if you get a result that looks like Fallon's jar of goo, then that's probably what you did wrong. Great advice, but, not in the book. "Bacon-infused bourbon" sounds like precisely the kind of recipe that will sell a lot of books (not surprisingly, it's listed on the back cover of the book jacket), but which is hard to write good directions for.
In the same interview, Ferriss showed how he cooked sea bass sous vide in a hotel kitchen sink and then finished it by searing it with the hotel's travel iron, which he cheerfully admitted the hotel was not too happy about. I'm all for re-purposing common household items to find a new way to achieve something, but only if it's an improvement over the more mundane way of doing things; otherwise, it's just doing things inefficiently for the sake of being weird as an end in itself. (When I posted a photo of my bookshelf with a hollow-core wooden plank C-clamped to it at one end, with the other end used as an anchor for my XOOM tablet so I could watch movies while lying flat in bed, it was because that was the easiest way I could find to do that.) To be fair, Tim's suggestion of searing fish with a travel iron was probably intended to get the reader into the adventurous spirit, not as literal advice -- but then, my mission remains to evaluate the actual cooking advice, according to the results it produces.
The short answer: Of the three recipes I tried, one came out barely edible, and the other two were palatable mostly to the degree that the raw ingredients themselves were tasty, so I might as well have just snacked on the ingredients separately instead of combining them. All recipes definitely showed signs that they could have been greatly improved by being worked over by the process I described in my last article — i.e., show the recipes to a group of genuine newbies, listen to their feedback about all the points where they get stuck, then keep revising according to that feedback until you reach the point where the latest round of newbie testers is able to get through the directions with no problem. (You may notice that this sounds like a very obvious idea, but most how-to directions show very little sign of having been put through this kind of scrutiny.)
The first recipe in the book was for "Osso Buko", Ferriss's "knock-off" version of ossobuco, using lamb shanks instead of veal shanks. With $60 for a new porcelain Dutch oven, $20 for the lamb shanks, and other miscellaneous expenses, it cost me about $100 just to try the recipe to see if it worked (although Fred Meyer let me return the Dutch oven after I realized I was never going to try this again, and yes, I know you can find cheaper ones). A few times in the recipe, the directions used an unfamiliar term that I would have expected to be defined in a text for true beginners (for example, I didn't know what a "dry wine" was, and even the Wikipedia article wasn't much help, but the grocery store stockboy helped me out). The bigger problem was that at multiple points in the recipe, the instructions were too ambiguous to know if I was following them correctly, or I was unable to follow them exactly and didn't know how big of an adjustment I needed to make (e.g. what to do if the smallest shanks I could find were bigger than the recommended size). I still have no idea if the mediocre results were caused by one big screwup at one particular step, or the accumulation of many small deviations from what a real chef would have done.
Specifically: (1) The recipe calls for a Dutch oven. Ferriss has a brand he recommends, but can I use one from the local Fred Meyer? How big? The recipe doesn't say. I picked a five-quart since it was big enough to hold the lamb shanks. (2) The recipe calls for "lamb shanks." Fore shanks or hind shanks? Does it matter? My grocery store only has "lamb foreshanks" anyway. (3) The recipe says each shank should be 12 oz, but the smallest ones I could find were all 16 oz. What adjustments do I make? I have no idea. (4) The recipe called for "1/3 of a bottle" of wine, but later said to pour in enough "to cover 1/2-3/4 of the meat," and I couldn't do that without pouring in the whole bottle. I assumed the "cover 1/2 of the meat" direction took precedence over the "use 1/3 of the bottle" direction, but at that point I was sure that I'd deviated so far from the intent of the directions that the dish wasn't going to work. I put the whole thing into the oven at 350 degrees for two hours, which is about the only part of the recipe that I was sure that I followed correctly.
The results came out barely edible (I said "barely" — I still ate them, but I would never serve them or bring them to a party). Mostly it was a lot of work to cut through the tendons and small bones to get to the meat; if the Dutch oven was supposed to soften the meat so that everything fell off the bone, it didn't work.
The second recipe I tried was for crab cakes with harissa sauce. Right away I ran into a problem, since even in my fairly cosmopolitan city with multiple ethnic and specialty grocery stores, none of the ones I visited had ever heard of "harissa sauce." Now for directions that have been thoroughly beta-tested, this is where they would typically say, "Harissa sauce can be difficult to find, so here's where to look; otherwise, you can use this as a substitute." I found some forums saying you could use hot sauce, so I went with that. The crab cakes came out fine, but probably mostly due to the expensive crab ingredient, and I didn't like them enough to make them again.
The third recipe that I tried was for coconut cauliflower curry mash. The directions called for "crushed cashews," and said "If they're uncrushed, you can then crush them in your hands directly into the bowl. This is how Chuck Norris does it." By this time I was getting a little tired of the book being cute at the expense of being helpful — roasted cashews are physically impossible for most people to crush in their hands — but I flattened some under a rolling pin and followed the rest of the recipe. The result tasted OK, but probably only about as good as if I'd just mixed up the nuts and cauliflower and other ingredients and cooked them in a pot.
And that was the end of the ride for me. Three recipes and three results that I never thought about making again (one that was barely edible, and two that tasted only slightly better than the component ingredients mixed together, neither one all that good). Based on those sample results, my estimation is that for a true beginner going through the recipes in the book, the "success rate" would not be high enough to justify the time and money that they'd spend.
Full disclosure compels me to report that I did successfully prepare and "serve" one recipe in the book: bacon roses, which turned out about as well in my own kitchen as the ones he showed off on Jimmy Fallon. Most artificial roses have removable heads, and if you bake a couple of rolled-up slices of raw bacon, they come out resembling roses that can be threaded on the artificial-rose stems. But even then, the instructions in the book were overkill, requiring the reader to take a cupcake baking pan and drill holes in the bottom of each cupcake holder, so that you can cook the bacon in the cupcake holders while draining the fat out (but which also ruins the cupcake pan for the purpose of making actual cupcakes). For one thing, you can use silicone cupcake molds and just poke a hole in the bottom rather than drilling through aluminum; these can also be stacked when you're done, so that they take up much less storage space than a 12-muffin baking pan. But in any case I found that you could get perfectly good results just by rolling up the pieces of bacon and baking them sideways on a broiler rack; they hold their shape just as well as if you had baked them in the cupcake holders, since the rolled-up bacon hardly expands anyway. (This is the kind of thing that you also find if you have people beta-testing your recipes.)
To be fair, I'm only narrowly reviewing the book as an instructional guide to cooking. The book claims that the principles taught in its pages can be used to transform your life in a wide range of ways, including becoming world-class in "any skill" in about six months, which Ferriss says he has used to learn kickboxing, Spanish, shooting basketball 3-pointers, and Japanese horseback archery. Next on his list: writing cooking directions!
But now I'm being a smartass, and the truth is that there is potential for the recipes in these book to be transformed into something that could produce fantastic results in the hands of a beginner. Normally when I try out a "beginner's cookbook" — usually by using Amazon's "Look Inside" feature to sample a few recipes from the cookbook and print them out for free — if the first three recipes produce inedible results, I throw them out and never give the cookbook a second thought. But I'm more optimistic about re-working Ferriss's recipes in accordance with the beta-testing process above, for two reasons. First, he really does seem to have a passion for helping people and not just selling books (that's important, because it's hardly going to drive book sales to take recipes from the book and beta-test them and improve them as a free web-based project). Second, he has legions of fans who would probably volunteer as beta testers. I myself would be happy to volunteer, since the commitment of a beta tester is minimal, by design, because you're supposed to simulate the experience of a real user without overthinking it: go through the instructions one time, and record the quality of the result you get at the end. (Optionally, make a note of any ambiguous directions you encountered along the way, which might affect the quality of the end result.)
As they're written now, I don't think the recipes in the book would pass the definitional test of good directions: Give them to beginners, have them try to follow the steps, and record the results. I had essentially the same thought about the business-launching advice in Tim Ferriss's first book, The 4-Hour Workweek, which I only bought as a companion to the new book. Now I think The 4-Hour Workweek does contain a lot of useful self-help advice — for example, to get over your fear of the worst-case outcome by visualizing it entirely and realizing that it's not that bad. (Although I cracked up at the part about "outsourcing your work," thinking of a certain Verizon employee who took the advice too literally.) But for a book whose key premise is that you can liberate yourself from a 40-hour workweek, the advice about how to start a successful business to do this, occupies a surprisingly small portion of the book (pp. 150-200, if you leave out the subsequent chapter about how to automate your business once it's successful). Well, I've been a part of various entrepreneur communities since before I graduated college, and over the years I've seen many people follow some variation of the steps in those chapters, and the reality is that even if the founder does everything right, most new businesses still fizzle out just like my mediocre "osso buko."
The key difference, I think, is that any formula on how to start your own wildly successful business and shrink your workweek down to 4 hours, cannot work without a lot of luck — if it could, angel investors would just start hiring "entrepreneurs" to follow the formula exactly, if every one of those entrepreneurs (or even 25% of them) hit it out of the park with their new business venture, the investors would make out like gangbusters. Most methodical research suggests that actually only about 5% of VC-backed businesses hit their projected break-even on cash flow -- suggesting that even the best VCs can't find any combination of personal attributes, or action steps, that leads to entrepreneurial success without a big dose of luck. (Ferriss himself says that The 4-Hour Workweek was turned down by 28 out of 29 publishers, which sounds like a testament to the importance of persistence; but most authors whose work is turned down by the first 28 publishers, will usually get turned down by the 29th one too, and there was obviously a certain amount of luck in the fact that that didn't happen to him.)
On the other hand, following a recipe and producing a delicious dish, ought to be possible without luck. What you need, though, are precise directions that have been picked apart by beginner beta testers to remove any ambiguities, until you reach the point where the latest wave of beta testers was able to get through the directions with no confusion, and produce great results in nearly every case. The recipes in The 4-Hour Chef aren't at that point, but Tim Ferriss has the fan-based manpower at his disposal to test and transform those recipes into truly idiot-proof directions for delicious food, if he wants to.

The arguments in the book didn't always change my mind, but they made me reformulate many of my own arguments in the other direction.
In most sections of the book, Morozov attacks the beliefs of "solutionists" who believe that a particular program or algorithm can solve a social program. Usually, I thought his criticisms of a given algorithmic "solution" were spot-on. But I often found myself thinking of a different algorithm that I thought would solve the problem much more effectively than the one Morozov was critiquing. This, naturally, could be construed as missing the point of the book. However, I'm prepared to defend any of the alternative algorithms that I came up with, or bet money on how it would fare in the real world. I'll have a full review of the book when it's released, but I think many of Morozov's argument are interesting enough to deserve an article in their own right.
For example, Morozov describes a new kitchen technology that guides would-be chefs through the process of preparing a meal, by illuminating pathways on the kitchen floor to show the cook where they're supposed to walk next, and then using laser pointers and visual aids to guide them through what they're supposed to do when they get there. If you want to know how to expertly carve a fish, for example, the ceiling-mounted lasers will trace out the exact cuts that you're supposed to make on the fish's skin. The description sounds like a parody of what people think the Big Bang Theory geeks would like their kitchen to do for them.
Morozov argues, not unreasonably, that "[t]o subject [cooking] fully to the debilitating logic of efficiency is to deprive humans of the ability to achieve mastery in this activity, to make human flourishing impossible and to impoverish our lives," and that "deviating from recipes is what creates culinary innovations." Well that's one of the 1/3 of his arguments that I agree with. Besides, if you can afford the cost of a laser-guided kitchen just to cook meals for yourself, you could probably use the same amount of money to take a professional cooking class, order takeout every day to tide you over until you know how to make decent stuff on your own, and still have money left over. If you're using it instead to try and cook to impress party guests, how's that going to work? If you're making the food where your guests can see you being guided around by lasers, they're going to think (correctly) that you don't know how to cook, and if you're making the food in a back room where you're out of sight of the guests, you might as well order takeout and have it smuggled in through the back door.
On the other hand, Morozov says in his next paragraph: "In a world where only a select few could master the tricks of the trade, such 'augmented' kitchens would probably be welcome, if only for their promise to democratize access to this art. But this is not the world we inhabit: detailed recipes and instructional videos on how to cook the most exquisite dish have never been easier to find on Google."
That's where he lost me. I have vastly different views on this, which can be summed up in three points:

The qualify of most "how-to" instructions aimed at beginners, judged by the results they produce in the hands of actual beginners, is far worse than most people believe.

Moreover, for reasons I'll describe later, the incentives created by the free market in general (and Google in particular) more or less guarantee this result: How-to directions exist that cover nearly every human activity, but most of the directions are not particularly good.

I have an idea for a different algorithm (surprise!) that Google, or any other similarly positioned web titan, could use to change the incentives of web publishers, leading them to write how-to instructions that would produce much better results when followed by actual beginners.
The morass of cooking how-tos on the web are a good example. Partly from always having other things that I'd rather learn, and partly from being perfectly happy eating lots of plain fruits and vegetables (good for your health, but not for your cooking skills), I had survived to early adulthood hardly knowing anything about real cooking. Being a decently smart person, I figured that made me well suited to judge the effectiveness of the countless cookbooks written "for people who don't know how to cook". Because I firmly believe that if you follow a set of directions precisely (or, if the directions are written ambiguously, then if you follow some plausible interpretation of each step in the directions), and the result doesn't come out as predicted, then it's the directions that failed, not you. If another set of instructions would have produced better results, then those directions are better. This is not rocket science, but many cooking directions in cookbooks and on the Internet are glaringly missing key pieces of information that would have made the directions better, by the above definition.
Now, I understand the importance of experimenting and deviating from recipes and tailoring things to your own tastes, but I think that has to come after you've produced an edible dish that you can use as a baseline. I make scrambled eggs a little bit differently every time -- curry powder, mussels, capers, tabasco sauce, blue cheese (just not all in the same pan, please) -- but the only reason that's possible is because the simple directions for plain scrambled eggs actually work. When I say that most cooking directions don't work, I mean that if you follow them precisely (but without any prior cooking knowledge), they don't even get you to the baseline of an edible result that you can then use as a jumping-off point to try your own variations.
The odd thing about cooking is that of all the people whose cooking I liked so much that I asked them where they learned how to cook, all of them said that they learned from an in-person instructor (usually a family member); I have yet to meet any really good cooks who learned their skills from written recipes or web videos. This suggests that the learning materials on the Internet are falling short. (By contrast, I know plenty of people who have learned PHP programming or similar skills out of a book.)
And from my experiences helping out friends in the kitchen who had more cooking experience but who were trying to follow a particular recipe, it seemed that their most valuable skill was knowing the crucial parts of the recipe that were missing, or wrong. And then they would use their non-beginner knowledge fill in the missing steps or make the necessary corrections as we went along. With the current mediocre state of most cooking directions out there, that's surely a useful skill. However, it does mean that you could make most recipes produce much better results in the hands of a beginner, if you simply fixed all those parts that were missing, or wrong.
Take, for example, my misadventures making jalapeno poppers. Going to a friend's Super Bowl party, I figured that jalapeno poppers would be an easy thing to make, with just under 200 how-to videos on Youtube and about 600 matching recipe pages on Google, most of them calling for only four ingredients. How hard could it be?
Well, there are two important things that should be in every jalapeno popper recipe, or the recipe is doing more harm than good just by being out there on the web. One is that when you're slicing and handling the raw jalapenos, you have to wear gloves, or the capsaicin in the jalapeno -- which is also the active ingredient in pepper spray -- will leave a burning feeling on your fingers that lasts for about the next 24 hours. (If you touch your eye with your finger, you might even have to go to the emergency room.)
The other indispensable piece of information is that to make the jalapeno poppers edible, you have to remove the seeds and the white ribs from the inside -- not just the white center of the jalapeno (which slides out easily), but the white part of the ribs, which have to be scraped off of the outer wall (a grapefruit spoon works great, otherwise a paring knife or a regular sharp knife will do). Most recipes do tell you to remove the seeds. But the white ribs left inside the jalapeno are just as hot, and if you don't cut them out, the finished product will have a hotness that's too overpowering to taste anything else. So what's the problem? Here's a table listing the first 10 Google matches for "jalapeno popper recipes", rated according to whether they contain those two must-have pieces of information that a beginner would need. (If the directions said to "devein" the jalapeno or "remove the membranes", I gave it an "Almost" in the second column -- because a first-timer is likely to think that this refers to removing the white center of the jalapeno, and not realize that you also have to remove the ribs attached to the edges. I'm being strict here, because it would have taken almost no effort for the recipe writers to be clear about this, and if you don't do that step correctly, you will have to throw out the finished product.)

eHow.com does have a helpful page about how to treat capsaicin burns from handling jalapenos. Perhaps that's their penance for the fact that half of their 'jalapeno poppers' recipes don't tell you to put gloves on.
If you could have made poppers based on these incomplete instructions, because you knew to put gloves on or to scrape the ribs out, good for you -- you possess the background knowledge to fill in the parts of the directions that were missing, or wrong. But that doesn't do the real newbies any good.
I went to this trouble because I want to beat you over the head with the crucial fact here: Most directions suck. They suck not just in absolute terms (burning your hands, or the mouths of people who eat the jalapenos with the ribs still in them) but they especially suck relative to how easily they could have been fixed. There is no excuse for putting up a recipe for jalapeno poppers that doesn't tell the reader to put gloves on, or that only tells the reader to "remove the seeds". And I've run into the same phenomenon over and over -- whether looking for directions on how to lower memory consumption of a web server, or how to get stains out of a carpet, or how to replace a 12V direct-current power supply with a cartridge of 8 AA batteries in series -- where not only did the directions not work, but I later found out that they could have worked if the author had simply added one or two key pieces of information.
However it seems that almost everyone believes that the quality of directions on the web is much higher than it actually is -- where, by "quality", I'm talking about the results that would be achieved by a beginner following the directions. (If I had asked you, "Where can I find a good recipe for jalapeno poppers?", is there about a 100% chance you would have said, "Google"?) I assume people overestimate the usefulness of all the how-tos out there, for two reasons: (a) they glance at the directions but don't try them themselves, so they just assume the directions work; or (b) they already know how to do the task being described, so when they read the directions, their brain automatically fills in the missing steps or makes the necessary corrections. That doesn't mean the directions would work in the hands of a true beginner.
Unfortunately, the quality of the directions on the web, is perfectly explained by the incentives created by Google. If there's any niche in the how-to space that is not already filled by some article on the web, an author can easily grab some extra web traffic by writing the first page about that topic. For a popular topic like how to make jalapeno poppers, there's enough traffic going around that dozens or hundreds of authors can put up their own how-to pages and each collect just enough web traffic to make it worthwhile. Thus, every "directional" niche will be filled, and some will be filled to overflowing.
Within a particular niche, however, there's not much incentives to make the directions particularly good -- where "good" means "produces good results when followed by someone with no prior knowledge in this area". Whether your directions work or not, they'll attract about the same level of traffic from Google. Even if the author later realizes that the insertion of a few key steps would make their instructions better, there's no incentive for them to do it -- that's not going to make your how-to page rise up in the Google rankings above the other pages on the same topic.
Which brings me to my proposed solution. It would take a company with a giant pre-existing web presence to pull it off (not quite on the level of Google, but at least an eHow or a Food.com). But it would take almost no maintenance on the part of the company themselves, once the process was put in place.
To incentivize people to create instructions that actually work, a given how-to guide would go through three phases:

After the directions are written, genuine newbies (recruited from the web site's usual visitors -- people who just want to learn something new in an area where they have no prior expertise) attempt to follow the directions and tell the author about any problems they ran into, or steps in the directions that seemed ambiguous. If the author thinks some reader is just being an overly nit-picky moron, they're free to ignore their questions and suggestions, but they would do so at the risk of their directions faring poorly in the next phase.

Once the initial wave of corrections and clarifications is finished, the directions are put into a pool marked "Ready to be rated!", where they are rated by the next group of genuine newbies who attempt to follow them. Each reader rates the directions simply: If they followed the directions and got the result they expected, then thumbs up, otherwise, thumbs down. If multiple readers spot a mistake or an omission that somehow got missed in the first phase, then the author can make the necessary changes and start the second phase over. (To prevent the author of the directions from "gaming the system" at this stage, the volunteer newbies should be selected at random from a large pool of people who sign up saying "I'm game for learning how to do anything new." If you let people self-select to go to the directions and rate them, then this enables the author to stack the deck by having all of their friends go to the page and give their directions a high rating.)

Finally, once the directions have reached some acceptably high percentage of positive ratings, they get released into the general pool of directions/how-tos/recipes of which the site can promise, "80% of newbies were able to follow these directions successfully." If the system works -- and if the volunteer readers in step #2 are representative of the skill level of the site's general readership -- it should be expected that most readers should be able to follow the directions and get good results at that point.
Almost all of the "how-to" directions that I've read, on any topic, could have benefited from being put through the wringer as described by the steps above. It's not merely that I think this algorithm would produce good directions; it's that my definition of good directions is precisely those directions that would pass the test in step #2.
As for what incentivizes the authors to produce directions that make it through this process, perhaps the hosting site could split the ad revenue with them from the pages containing the author's directions. Perhaps the hosting site could just reward them with a link from the article to the author's professional home page. Or maybe people would happily submit the instructions for free if it went towards a non-profit repository of helpful information, a la Wikipedia. (The huge difference from Wikipedia though, is that if you're an expert on George Washington, it's easy to write a good article about George Washington; but if you're an expert on cooking, that makes it hard to write a set of cooking directions that would fill in all the blanks needed by a beginner. Hence the multi-step vetting process above.)
It's tempting to think this is process would be "overkill" for a simple recipe, but that fails to consider the magnitude of the time savings when multiplied across the hundreds or thousands of people who will read the information over the course of its lifetime on the web. If the author spends an extra 10 minutes on the instructions to clarify things in such a way that saves just 1 minute of reading time for the average reader, when that 1 minute of time savings is multiplied by hundreds of readers, it's clearly an overall time-saver. (What disgusts me about the jalapeno popper recipes is that the authors could have saved me a whole day of painful burning on my fingers, if they had just taken 10 seconds to include the step about putting on gloves -- that would have been an overall time-saver even if only one person had read the recipe.)
So Morozov was right that we don't need laser-guided kitchens guiding us through the algorithm of carving a fish, but we should consider that an entirely different kind of algorithm could change everything for a beginning cook, or a person trying to learn any other skill from scratch. The Star Trek kitchen in To Save Everything, Click Here makes for an easy target for Morozov's argument, but that kitchen technology is hardly making enough inroads to threaten cooking as we know it -- I'll bet you'd never heard of it until this article. Bad directions, on the other hand, are so ubiquitous that we've accepted them as a part of our way of life, and we've all but forgotten to think how they could be made better. Like Robert Kennedy, I see people looking at their capsaicin-burned hands and their inedible jalapeno poppers with the ribs still attached and asking, "Why?", and I imagine eHow.com lining up newbies to critique their recipes until each recipe achieves a high rating from beginners based on the actual results that they got, and ask, "Why not?"

Book Review: Sams Teach Yourself HTML5 Mobile Application Development
Michael J. Ross writes "The last few years have seen the emergence of several significant advances in web technologies, including HTML5 and CSS3 — all impacting the development of traditional and mobile-centric web sites. In turn, various technical book publishers have released titles addressing one or more of these technologies. While one book may focus on HTML5 and the new JavaScript APIs, another might include extensive coverage of CSS3, with little mention of JavaScript. A recent title, Sams Teach Yourself HTML5 Mobile Application Development in 24 Hours, focuses on some of the more commonly employed elements introduced with HTML5, and how they can be used for creating mobile sites and applications." Read below for the rest of Michael's review. Sams Teach Yourself HTML5 Mobile Application Development in 24 Hours author Jennifer Kyrnin pages 496 pages publisher Sams Publishing rating 8/10 reviewer Michael J. Ross ISBN 978-0672334405 summary A tutorial on building web sites and apps with HTML5. This book was authored by Jennifer Kyrnin, who has plenty of experience in using as well as teaching web design techniques, and who curates the Web Design / HTML section of About.com. The book was put out by Sams Publishing (an imprint of Pearson Education) on 25 November 2011, under the ISBN 978-0672334405. On the publisher's page, visitors will find the book's description and table of contents, and some sample content in a PDF document, including the first chapter, "Improving Mobile Web Application Development with HTML5." The page appears to not list any reported errata. This book is available in both print and electronic formats (EPUB and PDF), but prospective buyers should be warned that the e-book is less than seven dollars cheaper than the print version ($25.59 versus $31.99), despite the huge disparity in production and distribution costs. The author's web site offers additional information, primarily in the form of a newsletter devoted to HTML5. The preface claims that this second web site has the example source code from the book, as well as ways to ask questions and report errata; but if so, they are well hidden, as of this writing.
Spanning 496 pages in total, the book's material is organized into two dozen chapters, as is usual with any of the books in the "Sams Teach Yourself X in 24 Hours" series. Readers may well wonder if this artificial constraint causes the various authors to structure their books in a way that does not always make sense. In the case of this title, there does appear to be some forced splitting of material between two chapters, namely, "Building a Mobile Web Application" and "Converting Web Apps to Mobile." Conversely, three topics that may deserve their own chapters are lumped together, in "WebSockets, Web Workers, and Files." Moreover, it is arguably unrealistic to expect that the typical reader will be able — or would even attempt — to read and comprehend a technical book of such length and subject matter in only 24 hours — to say nothing of the time required to type in the sample code (in order to test it and reinforce the information learned). This "teach yourself in 24 hours" format borders on "brain surgery in three easy steps." Lastly, it leads to silly phrasing such as: "a result of reading the hour" (page xvii).
The chapters and appendices are grouped into four parts, the first of which is titled "Building Web Pages and Applications with the Open Web Standard." The structure of the first chapter is replicated in all of the other chapters: The author briefly lists what the reader will learn, and then begins explicating the concepts, illustrated with example code wherever appropriate. Each chapter concludes with a summary (which is of no value), several FAQs (whose material should instead be folded into the main chapter content), and a workshop section comprising quiz questions and exercises for the reader to tackle. Part I's eight chapters introduce HTML5, web applications, the W3C Open Web Standard, the new HTML5 elements and their attributes, CSS3 (with justifiably limited coverage), mobile browser detection, JavaScript, and jQuery. Then the author presents the basics of how to build mobile web apps, both from scratch and from using a non-mobile web site as a starting point.
Part II, "Learning the HTML5 Essentials," goes into greater detail of numerous basic aspects of HTML5: the new HTML5 sectioning, heading, and semantic elements; the semantic repurposing of some HTML 4 elements; the new canvas element (with limited coverage of this extensive topic); new typography support; audio and video elements; new form capabilities; HTML editable content, spell checking, and other user interactivity; microformats, microdata, and RDFa; in-page drag and drop; and new functionality for linking (the <a>, <area>, and <link> elements). Readers should note that the discussion in the ninth chapter on the new sectioning elements starts off rather confusingly, but soon improves, making it well worth reading.
The third part of the book, "HTML5 for Mobile and Web Applications," begins with an introduction to web apps, as well as the HTML5 application programming interfaces (APIs) and data sets upon which they may rely. The author then discusses specific APIs that can be of great use in web apps — specifically, the WebSockets, Web Workers, and File APIs, which allow one to make asynchronous connections between the app and a remote host, perform scripted background processing, and access local files. The remaining chapters show how to: make a web app usable even when it is disconnected from the Internet; save data on the client side (using local storage, session storage, Web SQL, and IndexedDB); control the browser history; geolocate the client; and convert an HTML5 application into a native mobile app, with detailed information on using PhoneGap. Aside from the index, the book concludes with three appendices that cover: answers to the end-of-chapter quizzes; a list of the HTML5 elements and their more commonly-employed attributes; and a list of other books and web sites that address HTML5 and mobile design and development.
The average programming book — particularly one of this size, and in a first edition — will contain some errata, and this one is no exception: "shortcut style" should read "shorthand style" (page 37); "Specific[,] Measurable" (87); "complimentary" should read "complementary" (93); the "By the Way" section on page 131 is missing a close parenthesis; "html5elmeents" (136); "will [be] eventually" (184); "a straight line [] they" (184); "makes build[ing] forms" (223); "method[s] exist" (362); "the page [it] is on" (383); and "()creates" (390).
There are some other parts of the text where either the author or the editorial team may have been careless — for instance, the figcaption and figure tags repeated on pages 16 and 18. Fortunately, such cases are few and far between. The HTML, CSS, and JavaScript code is generally of decent quality, except much of the HTML markup is not indented properly. In the JavaScript code, most if not all of the string concatenation is jammed together, making the elements difficult to distinguish (e.g., page 72). Also, some of the HTML does not utilize the more streamlined attributes of HTML5, such as <script type="text/javascript"> (e.g., page 20), or is not well formed, such as </li> tags missing (e.g., pages 236 and 250).
The author occasionally uses terminology that would be comprehensible only to someone who already has the knowledge that the narrative presents for the first time, without providing at least a quick explanation, e.g.: the !"!" JavaScript operator (page 55); the terms "rollover" and "user agent" (page 69 for both); and "the manifest comes up 404 or 410" (page 342). Some of the advice may be true, but is rather outdated, such as the admonitions in the first chapter to not use frames, nor to use tables or spacer images for layout. Those principles were validated and disseminated many years ago. Some statements could easily be misinterpreted by beginners, e.g., "As long as your HTML file is in the same folder as your style sheet file, it will load your styles when your page is loaded" (page 36). Other statements are not explained in detail or substantiated, and consequently the reader will probably not understand the reasoning behind it, e.g., "using the min- and max- extensions is more effective" (page 61), and "a separate mobile domain [] makes your mobile site easier to find" (page 10). Readers may disagree completely with some of the claims, e.g., "XHTML [is] very difficult to write" (page 2).
There are only two discernible problems with the production of the book: In some of the HTML code, curly quotes are used (e.g., page 303). Secondly and more importantly, the san-serif font used to indicate keywords looks much too similar to the serif font of the regular text, causing the keywords to blend into the surrounding material.
Yet the main problem with the narrative is the somewhat erratic manner in which the author skips from one topic to the next, often providing just a few paragraphs or even sentences for each topic — giving the impression that critical information may have been neglected as a result of the less-than-methodical organization of the material. Most of those topics are discussed again, in varying levels of detail, in later chapters. This is not optimal, because technical readers generally hope to find full coverage of any given topic in one place; hence, it can be frustrating if the information is scattered throughout a book. This is especially true if the reader has already read the book in full, and is now returning to it in order to utilize it as a reference source. For instance, in many cases, attributes are presented, but without detailed explanation or examples. Fortunately, the worst of it seems to be confined to Part I of the book, which contains most of the introductory material. Most if not all of the key concepts appear to be addressed to at least some extent. Lastly, some of the information that should have been presented right up front, is not, e.g., the definitions of HTML5 on pages xiv, 1, and 52.
Unlike most programming books nowadays, this one has few instances of phrasing that would baffle the reader for long, and there are no goofy attempts at humor. For most of the topics, the information provided is the minimum to achieve the bulk of the desired results. The advantage to this is that the narrative is generally concise and quick to read, and the author is able to cover a lot of ground without having to package such a broad topic in a (more expensive) tome. Some of the narrative is quite good, such as the explanations of the various browser exceptions involved in the HTML5 drag-and-drop functionality.
Despite the aforementioned blemishes, this book is definitely worth a look, because it is currently one of the most complete tutorials for learning how to use HTML5 for creating mobile apps and web sites.

Why So Many Crashes of Bee-Carrying Trucks?
Hugh Pickens writes "Interstate 15 in southern Utah has been reopened and officials say 25 million bees that closed the road have been accounted for after a flatbed truck heading for California carrying 460 beehives overturned near a construction zone. The bees were on their way to Bakersfield, California for almond pollination next spring. 'The driver lost control, hit the concrete barrier and rolled over,' says Corporal Todd Johnson with the Utah Highway Patrol. 'Of course we then had bees everywhere.' But a similar incident happened in July, when 14 million bees, as well as a river of honey, flowed out of a wrecked semi in Idaho; and 17 million bees escaped a fatal truck crash in Minnesota last year. Why so many highway accidents involving bees? The uptick results from more and more honey bee colonies being transported around the country via highways in recent years. Local bee populations are rapidly dying off from a little-understood disease called 'colony collapse disorder': 'The number of managed honey bee colonies [in the U.S.] has dropped from 5 million in the 1940s to only 2.5 million today,' says the U.S. Department of Agriculture. Unfortunately, some honey bee scientists suspect that the rise of migratory beekeeping may be contributing to the species' decline as transporting hives from farm to farm spreads pathogens to local bee populations." -
Court on Video Games: Less Cleavage, More Carnage
On Monday we discussed news of a Supreme Court ruling which held that violent video games deserved free speech protection under the First Amendment. Now, frequent Slashdot contributor Bennett Haselton writes with this followup that questions the Court's consistency in such matters. "I'm glad the Supreme Court struck down the California law against selling violent video games to minors, but reading over the decision, I had the odd feeling that the arguments by the dissenters made more sense than the majority — mainly because of the hypocrisy of continuing to ban sexuality while giving violence a pass." Read on for the rest of Bennett's thoughts.John Landis said, "R is when you bare a woman's breast, PG is when you cut it off." That is apparently now also the law of the land regarding video games, according to the Supreme Court's June 27th decision (PDF) overturning a California law that banned sales of violent video games to minors. I'm glad the Supreme Court struck down the law, but reading over the decision, I had the odd feeling that even though I agreed with the majority's conclusion, the actual arguments made by the dissenters made more sense, primarily because of the hypocrisy of the majority in treating sex as more taboo than violence.
The majority opinion, written by Scalia, has already been widely quoted as a ringing defense of free speech:
"Reading Dante is unquestionably more cultured and intellectually edifying than playing Mortal Kombat. But these cultural and intellectual differences are not constitutional ones. Crudely violent video games, tawdry TV shows, and cheap novels and magazines are no less forms of speech than The Divine Comedy, and restrictions upon them must survive strict scrutiny..."
But Scalia continues to believe that the government does have the right to ban the sale of nudity and sexuality to minors (as decided in the Supreme Court's 1968 Ginsberg v. New York decision), just not violence. So he kept qualifying statements like the one above by adding "except for pornography", like a judicial version of the fortune cookie "in bed" game:
"[A]s a general matter, . . . government has no power to restrict expression because of its message, its ideas, its subject matter, or its content... There are of course exceptions. These limited areas, such as obscenity... represent well-defined and narrowly limited classes of speech, the prevention and punishment of which have never been thought to raise any Constitutional problem."
...
"Speech that is neither obscene as to youths nor subject to some other legitimate proscription cannot be suppressed solely to protect the young from ideas or images that a legislative body thinks unsuitable for them."So he's continuing the Supreme Court's tradition of carving out of a First Amendment exception for sex, but won't make one for gratuitous violence. I would be against banning either type of content, but if I were forced to ban one of the two, I would definitely pick violence. Wouldn't you?
As Steven Breyer wrote in his dissent:
"But what sense does it make to forbid selling to a 13-year-old boy a magazine with an image of a nude woman, while protecting a sale to that 13-year-old of an interactive video game in which he actively, but virtually, binds and gags the woman, then tortures and kills her? What kind of First Amendment would permit the government to protect children by restricting sales of that extremely violent video game only when the woman -- bound, gagged, tortured, and killed -- is also topless?"
Well, he's right, isn't he? Except he misses the point that perhaps the remedy is not to ban violent video games, but to overturn the precedent that photos of topless women are harmful.
Alito seemed to agree with Breyer, when he wrote in a decision joined by Roberts:
"Victims by the dozens are killed with every imaginable implement, including machine guns, shotguns, clubs, hammers, axes, swords, and chainsaws. Victims are dismembered, decapitated, disemboweled, set on fire, and chopped into little pieces. They cry out in agony and beg for mercy... The objective of one game is to rape a mother and her daughters; in another, the goal is to rape Native American women."
(Alito was technically not dissenting, because he agreed that the current law was impermissibly vague, but filed a separate opinion because he was at pains to emphasize that he thought some future law against violent video games might be constitutional.) The implication seems clear: "If we can ban some things for minors — like pornography — then good God, can't we ban this stuff too?"
Scalia, in his majority opinion, responds to Alito's description of game violence: "Justice Alito recounts all these disgusting video games in order to disgust us — but disgust is not a valid basis for restricting expression." But this is just hypocritical — because Scalia, throughout his own decision, kept deferring to the Ginsberg Supreme Court ruling, which said that the government could ban porn sales to minors if it depicted sex acts in way that the "average person" would consider "patently offensive with respect to what is suitable for minors" (along with some other criteria). In other words, if it causes disgust.
Breyer and Alito also made similar arguments to each other on another reasonable-sounding point — that industry self-regulation might not last long, now that the law has been struck down. As Alito wrote:
"The Court does not mention the fact that the industry adopted this system in response to the threat of federal regulation, Brief for Activision Blizzard, Inc., as Amicus Curiae 7-10, a threat that the Court's opinion may now be seen as largely eliminating. Nor does the Court acknowledge that compliance with this system at the time of the enactment of the California law left much to be desired — or that future enforcement may decline if the video-game industry perceives that any threat of government regulation has vanished."
Breyer agreed:
"And the industry could easily revert back to the substantial noncompliance that existed in 2004, particularly after today's broad ruling reduces the industry's incentive to police itself."
This sounds more realistic than Scalia's recitation of the video game industry party line:
"The video-game industry has in place a voluntary rating system designed to inform consumers about the content of games... This system does much to ensure that minors cannot purchase seriously violent games on their own, and that parents who care about the matter can readily evaluate the games their children bring home."
What do you want to bet that Breyer and Alito are right, and enforcement of the rating system will decline now?
Compare this with another case, when Communications Decency Act of 1996 (essentially banning the "seven dirty words" on the Internet) was struck down in 1997 at least in part because a "less restrictive means" existed for censoring content in the home — parental blocking software. I didn't like blocking software much, but as a statement of fact, it existed, and was a less restrictive means than the law. The crucial difference there was that parents who used blocking software, weren't using it in response to a government threat of legislation, they were using it because they wanted to, and didn't stop using it after the law was struck down. There's no reason to think the same is true for industry self-applied video game ratings.
Finally, Breyer (but not Alito) rejected the argument that the California law should be struck down for vagueness, arguing that it was no more vague than laws against selling pornography minors, which the court had upheld:
"Comparing the language of California's statute (set forth supra, at 1-2) with the language of New York's statute (set forth immediately above), it is difficult to find any vagueness-related difference. Why are the words "kill," "maim," and "dismember" any more difficult to understand than the word "nudity?" ... California only departed from the Miller formulation [the Supreme Court case that defined obscenity] in two significant respects: It substituted the word "deviant" for the words "prurient" and "shameful," and it three times added the words "for minors." The word "deviant" differs from "prurient" and "shameful," but it would seem no less suited to defining and narrowing the reach of the statute."
Well, I think he's right. They're all just words, and they don't have crystal clear boundaries, but you pretty much know what they mean, and there's no reason why one group of words is more vague than the other. (In fact, in a 2008 article I argued that you could measure scientifically the vagueness of a law — just show the law to different test subjects, along with some made-up scenarios, and ask whether those scenarios violated the law or not. I'm quite confident that if you applied that test to these two different laws, you would measure about the same level of "vagueness".)
Again, I don't accept the justices' premise that the government has any business banning the sale of either sexual or violent content. But if you're going to grant the premise that they can and should, then Alito and/or Breyer seem to have made better arguments than the majority on at least those three points: That violence probably deserves less constitutional protection than sex, that the industry isn't likely to keep regulating itself if they no longer think they have to, and there's no reason that "kill" and "maim" are any more vague than "nudity".
(By the way, when I say the "dissenters sounded more reasonable", I am not including Clarence Thomas, whose entire solo dissent was devoted to research showing that the Founding Fathers did not believe people under 18 had First Amendment rights at all. If Clarence Thomas thought really hard, could he think of any other category of people who were denied full civil rights in the 1700s, and hence why we wouldn't want to apply that standard today?)
Fortunately, the majority did get the most important point right, which is that studies do not show a causal relationship between video game playing and real-life acts of violence. As Scalia wrote:
"The State's evidence is not compelling. California relies primarily on the research of Dr. Craig Anderson and a few other research psychologists whose studies purport to show a connection between exposure to violent video games and harmful effects on children. These studies have been rejected by every court to consider them, and with good reason: They do not prove that violent video games cause minors to act aggressively (which would at least be a beginning). Instead, "[n]early all of the research is based on correlation, not evidence of causation, and most of the studies suffer from significant, admitted flaws in methodology." Video Software Dealers Assn. 556 F. 3d, at 964. They show at best some correlation between exposure to violent entertainment and minuscule real-world effects, such as children's feeling more aggressive or making louder noises in the few minutes after playing a violent game than after playing a nonviolent game."
Unfortunately, Scalia lacked the nerve to say that this point should have been the only point that mattered, in a society where freedom is the default unless there's a good reason to the contrary. Because the logical consequence of that, would have been that since the "evidence" for the harmful effects of pornography is even weaker, then the government has no business banning that, either.
The problem constraining all nine justices is that they felt bound by the prior Ginsberg ruling making it permissible to ban sales of pornography to minors, so their options were limited to (a) striking down the video game law while ignoring the hypocrisy of continuing to ban pornography, or (b) pointing out that violent video games are probably at least as distasteful. This ignores the possibility that they could have just (c) overturned their prior ruling, as they have done many times before.
If I were a justice writing for the majority, my whole opinion would be:
Well, we can only make an exception to the First Amendment if there's solid evidence of real harm, and there is no scientifically valid evidence of harm here, so the law violates the First Amendment and is struck down. Oh, and that goes for Ginsberg too, next time it comes up. How much did you guys pay for law school again?
Unfortunately, Obama has said that he's looking for Supreme Court candidates that display "empathy", and what I said would probably hurt the other justices' feelings, so don't hold your breath for my being nominated.

Twitter As Realtime Sports Reporter

Sports reporting via Twitter makes me think of the stories about Ronald Reagan's broadcasting exploits creating "live" play-by-play based on telegraphed updates — and sometimes the wire went dead. I wonder whether the control-happy local franchises will do anything to prevent in-person fans creating and sharing such instant play-by-play accounts. -

Student Loan Interest Rankles College Grads

Judge Rules That I Own Slashdot

I say: What about the entertainment value? Recently I received an e-mail with the subject line: 'Reminder: Link exchange with your site http://slashdot.org' Finally, I thought, someone else who agrees that I'm carrying the site's entire success on my shoulders. I even hurried off to check the registration of the slashdot.org domain to see if they had made the transfer official in honor of my contributions, but apparently the domain is still being squatted by some outfit calling itself "SourceForge"." I'm shocked that a legitimate businessman would make such an error. Read on to see what Bennett does about it.So I returned to the e-mail, which began, "Dear Webmaster". Scrolling through it, I found the part that I was looking for (I munged the sender's URL slightly, to avoid crashing the poor guy's server from all the traffic I'm sure he's already getting):

OK, technically at this point suing spammers in Small Claims is really more of a hobby. I still think that the real future of spammer-suing is in federal court, if you can amass enough damages against a particular company to reach the threshold of $75,000 to bring a federal lawsuit. The idea is not to go after the bottom-feeders who are sending the actual spams from their Mom's basement, but to follow the money and see who is ultimately buying the leads. You can respond to mortgage spams by entering a drop-box phone number and a made-up name, waiting to see who calls you, and then telling them that the person who sold them that lead is generating them illegally and that they shouldn't buy leads from them any more. Next I'll probably try responding to some ads for pills or other shady products by using a temporary one-time-use credit card number that's only authorized up to the amount of the purchase, to see which companies are doing the sales on the back end. (The checkout forms for those pill-hawking pages rarely say the name of the company that will end up on your statement, but the charge on your card has to be from someone.) The only types of spam I can think of where "following the money" wouldn't work, would be pump-and-dump stock spams -- in that case, the beneficiary could be anyone holding stock in the company. The SEC can freeze trading in stocks that are promoted in pump-and-dump but it's still no guarantee of catching the guilty party -- even someone who buys a lot of the company might just be an "innocent" third party who knows it's a scam but hopes to cash in on the price spike (although FAQs suggest that this strategy doesn't work). But for other types of spam, it's already been well documented how you can track it to the financiers without even trying to identify the actual person who pressed "Send".
Of course there's another reason why you'd rather be in federal court. Small Claims anti-spammer cases may not shed a lot of light on the economics behind spam, but they are instructive for what to expect if you ever appear before a District Court judge for any other reason. In this trial, heard by Judge Judith Eiler on November 5, 2007, the defendant telephoned in to the court hearing and said several times that this was a "personal e-mail from me to him" and should be exempt from the anti-spam laws. I said that I didn't think an e-mail with the subject "Link exchange with your site http://slashdot.org" could be considered "personal" since nobody who knew me would think that was my website, and in any case, personal e-mails tend not to start with "Dear Webmaster". But Judge Eiler ruled that this was a personal e-mail after all:
"Um, spam, these are anti-spam laws, which imply that they are mail just sent out in huge bulks, which would be the antithesis of a personal e-mail. And here he puts his name, in fact this is the person that you directly sued rather than somebody that's in a corporation or a company. The court does think that there's some indication that this is a personal-type e-mail. While it may have gone out to a number of people, it doesn't have quite the earmarks."

Every time I write about a spam case, I swear it's the last time. I wonder if judges read that and say to each other, "I'll bet we can get him to do it again." With this ruling, if the subject line "Link exchange with your site http://slashdot.org" is not "false or misleading", does that mean I can claim slashdot.org as my site after all?
So I don't think that suing spammers in Small Claims will make much difference in the long run. But the odds are that you might have a case come before a Distict Court judge at some point in your life. Consider that the same type of judge who thought the message above was a "personal e-mail", might someday be deciding whether you're responsible for $10,000 in damage to someone's car, or whether there is proof beyond a reasonable doubt that you were guilty of rape, or whether you get to keep custody of your child. There's no joke here, just something I thought you should keep in mind.
So I'm hardly a victim, but it could have been worse; I could have gotten a spam -- excuse me, a personal e-mail -- with a subject like "Your g1rl says you n3ed a b1gger m3mber". I would have been pissed if the judge had ruled that subject line was not misleading.

Wal-Mart's Terrible Nintendo Wii Knock-Offs

Will Low Lamp Lifetime Spell Trouble for DLP TVs?
Techno-Canuck asks: "Now that the DLP TVs have been in customers' hands for the last few years, there are problem histories that are begining to unfold. According to Toshiba's DLP TV User Manual: 'The average useful service life for the lamp is approximately 8,000 hours in LOW POWER or 6,000 hours in HI BRIGHT MODE.' However there were problems with certain 2005 Toshiba models that saw the lamp lifetime at only a few hundred hours or less. Toshiba replaced the lamps in these models at no cost and extended the lamp warranty to 2 years. According to an FAQ on About.com the lamps currently last an average of 1500 hours. Whether or not Toshiba has resolved the problem remains to be seen, as only time will give the real indication. There also seems to be lamp issues with some 2004 models as well, but Toshiba does not seem to be stepping forward to resolve the issues in this case. The customer ire is starting to rise, however. Will there be similar problems for the 2006 models once enough time has elapsed?" Most people probably would use the information provided by Toshiba to make a decision about what the lamp maintenance costs would be for DLP ownership. However if lamps only last for 1500 hours, then that's a 400% increase in costs over what Toshiba is presenting to customers. The cost of a lamp is $200 or more, and for a family household that averages 6 to 8 hours of TV viewing per day, this translates to a new lamp every 187 to 250 days. Strangely enough the Toshiba warranty on a replacement lamp not covered by the original TV warranty is 180 days.
It's possible that the death blow has already been struck. It appears that no longer carries DLP TVs in its product line." -

Nintendo To Be the Hero of the Adventure Genre?

Prognosticating Sony's Downfall

Halo 3, combined with the price reduction, effectively undercuts the momentum of the PS3 launch. IBM Develops New 3D TV Technology
neutron_p writes "IBM has recently announced a new and affordable 3D video system that works with normal DLP (Digital Light Processing) televisions. IBM demonstrated the new system on a 50-inch, flat-screen Texas Instruments rear-projection digital television at the 22nd annual Flat Information Displays conference held in San Francisco this month. This "black box" device can be connected to any DLP projector or television via the common VESA 3 pin stereo connector. Exact details concerning the 3D technology - still unnamed - were not forthcoming, but the company spokesperson said it was compatible with OpenGL and Direct Draw, which is definitely aimed at software developers who make 3D games." -
PDA Security, the Next Big Hurdle for IT?

'General Dynamics inked an $18 million contract with the secretive National Security Agency to design and develop a secure mobile personal assistant for defense workers. The PDA will integrate all types of communications including voice, data and web.'" His summary of PDA attacks states: 'These devices are easy to smuggle into a business and can be used to propagate an attack against network devices. House To Enact Anti-Spyware Law
Stephen Samuel wrote to mention that the U.S. House of Representatives has readied the aptly acronymed Securely Protect Yourself Against Cyber Trespass Act (SPY ACT) for law. MS-BS has an article claiming that the bill allows a loophole for the makers of proprietary software. The issue at hand concerns Section 5, paragraph b, subsection 2, under the heading of limitations. The law does not apply to: "(2) a discrete interaction with a protected computer by a provider of computer software solely to determine whether the user of the computer is authorized to use such software, that occurs upon (A) initialization of the software; or (B) an affirmative request by the owner or authorized user for an update of, addition to, or technical service for, the software." The law, then, would disallow Gator and their ilk but would not hamper Microsoft's Genuine Advantage Program. More complete commentary is available at TechReview and About.com. -

Whether you're working a cushy corporate job, are self-employed, or are still in college, what makes you feel frustrated and stressed? Unless you have had some major disasters in life, the answer will probably rotate around having too much to do and too little time to accomplish all the tasks. Moreover, people around you don't seem to realize how pressed for time you are as they keep coming up with every possible way to interrupt you.
Business people like to talk about multi-tasking. It fills one with feeling of self-importance, since it's obvious that if one multi-tasks, then he or she is involved in multiple projects, failure on most of which would probably result in the end of human civilization. But as Allen points out (his site contains a promotional WMV/QuickTime video), multi-tasking requires you to persist a bunch of projects (most of them unfinished) in your head.
If you count the time you spend on each actual project, and the time you spend switching between the projects, you'd be surprised how much time is spent on the overhead of going from one project to another. Basically (although Allen doesn't express it in these terms) we all would like to be Knoppix, with everything kept in RAM (our brains), nothing relegated to the hard drive (paper or information-management software), multi-tasking at its best. But as anyone would tell you, Knoppix can be quite resource-intensive, and you do not exactly get screaming speeds with it. We're all wired up like early DOS - single-tasking with everything else assigned to external storage, best at doing one thing at a time, if we're to do it well.
Allen develops a system to deal with projects and everyday interruptions accompanying them. Does the issue that came up require less than 2-3 minutes to respond to? Is it returning a call to confirm the dental appointment or e-mail to another developer saying you agree with his suggestion and would approve of it? If it takes you less than 2-3 minutes, do it right away. Do not file it under "Later," do not postpone it until lunch, because your brain keeps track of this stuff, and this unfinished while loop will be running in your brain, even if consciously you do not think about it every minute. In other words, keep the RAM clean.
Allen advocates the 3-D model, where the Ds stand for "Do it," "Delegate it," "Defer it" and advises all projects and small tasks to be processed in that order. The "Do it" part was described above for the tasks that take just a few minutes. The author promises you'd be surprised how much can be achieved by following this simple rule. At the same time, if the project just requires your approval, and you'd pass it to someone else after that, delegate it. But get it off your mind right away, because it's not yours and thus cannot occupy the precious RAM space. Delegate it -- send the e-mail, fax it away, or transfer it to another person in your organization. And if it's definitely a long task and it needs to be done by you, then defer it to the time slot when you're sure you can sit down and do it (by the time you get rid of all the doable and delegable, you will find yourself with plenty of time left to important projects).
Allen is pretty good at pointing out the various excuses that we come up with to excuse our lack of productivity. The rules sound simple, even simplistic, but that's the key to the efficiency of his system. I liked the author's approach, and adhering to his system seemed to bring a relaxed attitude into my daily schedule, since now I don't have a guilt trip over concentrating on a single task and refusing to multi-task. I would recommend this book to anyone who feels stress after work or someone who feels they are not at the top of their productivity and spend too much time doing inessential things.

Cutting Through a Wi-Fi Traffic Jam?
eric3xxx asks: "A week or so after Christmas, I tried to connect to my home wireless network and while I could see my access point I could not connect. After scanning the network, it turned out that there were at least twenty new access points in my apartment building (and in the surrounding buildings). Most of them had names such as 'linksys' and were all set on their respective vendors default channel (apparently a lot of people received 802.11b/g WAPs as presents). I tried changing the channel on my access point, starting at 1 and continuing through all of the channels, and none of them worked (probably since the channels overlap). In any case, I have no clear solution to this problem. I suppose I could boost the signal, however, that also increases noise. Perhaps I could convince my neighbors to put together a shared wireless network. I may just switch to 802.11a since it isn't as widely used." Has anyone else had success in configuring their APs to work in an areas of heavy wireless traffic? -
Stable Linux Kernel 2.6.10 Released

Genetic Savings & Clone now not only offers genebanking for your pet (alive or recently dead), but a full service cloning shop. Although they started by producing two clones of the CEO's cat, they have now produced their first commercial clone for a woman from Texas. GSC has modified their cloning procedure to overcome the resemblance issues demonstrated when the College of Veterinary Medicine, Texas A&M, created CopyCat. The technology looks promising but the $50,000 price tag will prove to place the service out of the reach of most pet owners."
