An anonymous reader writes "Microsoft is planning on giving away $1000/hr randomly to users of the new MSN messenger. They are going to send instant messages to the winners. I can just see it now, 'You've won $1000 in the MSN Messenger giveaway, just go this website and enter your SS# and credit card info for verification.'" Where's Ed McMahon with the big check when you need him?

      But think of what you save from not using it:

      You have to give SS# and Credit Card, so those could possible be submitted for a nice spam. Or better yet they will take 1000 from your credit card to give it back to you.

      If you are going to be given a prize you should not have to give vital informaiton (SS#) or financial informaiton (Credit Card).

      I think the submitter was suggesting that it's quite possible that someone could trick messenger users into giving away their personal info by claiming that the user won the $1000.

      That seems odd. Aside from the obvious correlations of suing MSN Messenger and gambling. I believe the federal law on gambling winnings is $5000 (or at least that is what the roulette lady told me) before IRS notification is required. It seems odd there would be such a distinction between gambling winnings and a contest give-away. Especially an internet based one where the winning user may not live in the US.

      You don't - Microsoft don't write applications for Linux. Or maybe you didn't notice that? You could try it using Wine or CrossoverOffice or something.. but i'd be surprised if it worked.

      And with reference to the lottery ticket analogy.. it should now go like "I want to enter the lottery, but I only want to enter using this ticket from a competing lottery company machine.. but it doesn't fit into the lottery machine of the one I want to play! No fair!"

      *sigh*

      You know I really hate being the guy who defends Linux at work, only to have to come on here and actually defend Microsoft from time to time. This bullshit naive Linux zealot attitude drives me up the wall.

      Yeah, but companies in the U.S. are prohibited from operating lotteries. That's why you always have the option of sending in a "ballot" by email "no purchase necessary." Just as now purchase is necessary I doubt MSN Messenger is required--but if you don't have MSN Messenger you might have to resort to snail mailing in your opportunity to win.

      That probably makes the offer void in some states.
      You cannot have product purchase or license attachments to lotteries. You cannot require a product purchase for a sweepstakes.

      Unfortunately, it's not "illegal" enough to put BillG in prison, but it is probably illegal enough to void the offer in a whole lot of places.

      My question is, can they tell which version you are using, (I assume yes) and if so, how do the other clients like trillian, jabber, gaim, etc., handle this?

      What versions would they show up as to Microsoft?

      It was revealed today that Microsoft has been secretly bundling MS Ass Pounding in all versions of it's Windows software beginning with Windows 95. The Ass Pounding software, dormant until recently, was remotely activated when obscure clauses in both the XP SP1 and MS Licensing V6.0 went into effect. Tell-tale signs of the software are empty wallets and a very sore anal sphincter, primarily because the software does not come with the foreplay feature by default. The foreplay feature is only available to those who inform their MS reps that they are considering switching to Linux.

      I'm more worried about the opposite effect -- someone out there is going to start IMing random users, telling them to visit a Microsoft-looking web page and enter their login and passwords (along with some other identifying information) to receive their prize. Odds are they'll hit just enough suckers who've actually entered the contest (and a few who haven't) to get a $@!%load of stolen accounts.

      Of course, people have been doing this anyways without Microsoft's help -- or AOL's, or Yahoo's. So maybe I'm making something out of nothing here.

      In an earlier version of the Messenger EULA, they had language had Microsoft claiming ownership of any information and communications sent via Messenger.

      I don't recall the exact wording at the moment, but it was pretty disturbing. That section is no longer in the current EULA, so it appears that the outrage had them change their mind.

      However, everything entered into *any* chat service is totally unprotected, and can be snooped. In fact, in the current EULA, they explicity state that they will give archives of the messages (which they store, BTW) away to officials upon prompting.

      Microsoft reserves the right at all times to disclose any information as Microsoft deems necessary to satisfy any applicable law, regulation, legal process or governmental request, ...

They also must be logged in to the service and agree to use only Microsoft's Quality products for the rest of their natural lifetime.       If you win and you aren't running windows, I don't think they could keep you from claiming your prize. The "you must run msn messenger" isn't a rule, it's a suggestion.

      I think that particular phrase means you don't have to purchase a product in order to enter to win (because then it can be construed as gambling).

      However, I would compare this more to when Mastercard offers to pay the credit card bill of whoever's bill clocks in at 11:17am on 23 December, 2003.

      An informational column in a local newsweekly recently mentioned these laws. It stated that the purpose of these laws is to prevent illegal lotteries. Any contest in which you must buy a gamepiece to participate is considered a lottery. Thus the "no purchase necessary" and "for a free gamepiece, write..." on soda giveaways and the like are designed to comply with that law.

      Restricting your giveaway to users of a certain product is probably not covered by such laws. If this giveaway were only for MSN subscribers, for example, that would hardly be illegal, would it? (IANAL, of course)

      Besides, you could just as easily argue that they have to have a way for people to enter without purchasing a computer, couldn't you? If MS does have to comply with any lottery laws, they'll probably implement a mail-in method ("please send a self-addressed stamped envelope to...").

      Quite true. I see this in rules all the time, working for a promotions agency and all. The curious thing would be to see if MS will send these instant messages to anybody logged on to MSN Messenger, including those who use GAIM or Trillian as the client, but according to the article you have to enter on a website and upgrade to MSN Messenger 6. Sounds like Gaim and trillian users are out of luck, as are people who aren't logged in during the day. Oh well.

      Yes, the law requires a free entry, but this kind of giveaway makes it real easy to drown it out.

      We haven't seen the official rules yet, but what I expect the free entry method to be will be to send a 3x5 inch card with your name and mailing and indicating which hour's drawing you want to be entered for to an address in Redmond. There will likely be a limit one mail-in card per hourly drawing, which will equate to the one entry that online users will get for showing up on the service during that hour. Cards must be handwritten, no printed cards accepted.

      But, the catch is that if you want to enter all 24 drawings in a day, you'll need to seperately mail 24 envelopes with single cards in them. Afterall, 37 cent stamps are paid to the United States Postal Service and not Microsoft.

      Still, spending $62.16 to enter all of the drawings in a week seems a bit unwise, because you'll only be allowed to win one $1,000 if you win at all. Lottery tickets would be a better use of that money.

      But doesn't everyone get a copy of Windows when they buy their computer? After all, only evil vendors catering to software pirates would sell computers without Windows.

      Or at least that's what I learned from Microsoft's OEM section a couple of years ago when they talked about the evils of "Naked PCs".

      (For those who don't remember the "Naked PC" campaign, you'll have to go to the Wayback Machine to find a copy of Microsoft's page -- Microsoft removed it from their OEM area after this PR campaign failed.)

      Practically, though, the cost will be zero money, but mucho of your privacy. Love those radio boxes where I get to pick a gender, DOB, ZIP code and household income range.

      No, you dont have to purchase anything, you just need to download and run the MSN Messenger software.

      You could run the software on your friends computer, a computer given to you freely, or the unlocked down PC at your internet cafe, etc etc.

      The contest may be limited to the people that run Windows already on their computer, but no judge is going to accept some argument that this messenger contest is out there causing people to buy a copy of Windows so they can run MSN Messenger and thus its gambling.

      MSFT has plenty of lawyers, and I'm sure they've already considered this issue.

      Sure, why not?

      Consider this: to enter by mail, you need to buy envelopes and some kind of writing implement. To enter by calling a toll-free number you need a phone (or to pay for a pay phone). To enter this MS contest, you have to own a computer. My point is that you can't enter any contest of this type without buying something "once-removed". The only thing that the law prohibits is making people buy a _gamepiece_, because that turns the contest into a lottery, and there are laws prohibiting most lotteries (they're a form of gambling).

      MS Windows (and MacOS) are not gamepieces. They are part of the system for notifying winners. Requiring the winner to use MSN Messenger is more akin to requiring the winner of a drawing to be present at the time of the drawing even if they registered in advance, or requiring that the winner be contactable by phone (which requires them to own a phone and have phone service). There's nothing illegal about that.

      But, the catch is that if you want to enter all 24 drawings in a day, you'll need to seperately mail 24 envelopes with single cards in them. Afterall, 37 cent stamps are paid to the United States Postal Service and not Microsoft.
      Here is a possible solution: Put all of your cards in a box. Find a person in Redmond (or whatever city where the index cards need to be mailed), and have everyone mail all their card boxes to this person. Then, this person could go to the post office or wherever the address is located, open the boxes up, and either a) stuff the mailbox with them or b) have the postal employee put them in the post office box as a delivery. I have no idea if this would work, but it would sure save lots of time and money for everyone involved (except for the poor guy who has to deliver the index cards)...

      That would seem an exploitable distinction: Make a low-cost product (a trivial piece of software -- say an applet that pulls publicly available weather info and displays it in the user's taskbar); sell the product for some fairly low amount of money (but more than its actual value), and have a running contest for users of the software.

      In that case, the software *is* in effect the gamepiece -- but the ability to reasonably contend that its purchasers pay their cash not for its value as a gamepiece but for whatever small intrinsic value it actually posesses could keep the persons running this out of court.

      My point was that the law doesn't say that you can't be forced to buy _something_ to participate in a contest. Every contest requires you to buy something, even if just an envelope, yet they're still legal. Rather the law says that you can't be forced to buy a _gamepiece_, and neither MSN Messenger nor MS Windows is a gamepiece. For that matter, neither is the required computer, or the required network connection, or any other requirement for participating. If anything these are contest restrictions along the lines of "The winner must be present at the time of the drawing to be eligible," which are also perfectly legal.

      It's funny really. Linux has come a long way in the last two years alone. Yet, with all this wonderful progress that they've made, the pro-Linux/anti-MS Zealots can't fathom the idea that MS has been improving Windows as well.

      Since I first installed Windows XP Pro, which was before it was released to consumers (got the OEM version a week before everyone else), the OS has NEVER crashed. And I run it 24/7/365, minus a reboot every few weeks (by my own preference, not because it needed it). The worst that's happened is that maybe an APP crashed a total of 3 times. But XP shrugged it off and kept running. Again, if you have bad drivers or cheap hardware, I'm sure XP will turn into a nightmare (one of my friends has bad luck with it, but bought the cheapest motherboard he could).

      I belive you, but my experience is quite different. I've already seen BSOD on almost every Microsoft OS, despite the fact that I don't even work with Windows on my own. Most (but not all) of the Windows computers I've seen (i.e. at work) had crashed for some reasons (don't ask me why). And I've seen quite a lot of them. That includes Widows NT, 2000 and XP (professional edition) with various service pack installed. And the hardware was not always the cheapest sort available. And if all the problems were related to the hardware and/or the drivers than Windows is really a bit too picky about it.

      I heard the same thing years ago about GNU/Linux, how it must be the hardware or alpha development drivers. Not much anymore though I use standard stuff. My nvidia card works in Linux flawlessly, and NOT so well on my XP Home edition [XP-lite] Desktop. I got the re-run-around when looking for answers and one install attempt did make it work, for a while anyway. It was later said to be 'bad' hardware [But shhhh! Don't tell my Linux install that. It doesn't seem to know how bad the hardware is...]

      Welcome to the Twilight Zone [spooky music playing in the background]. Ironic isn't it? ;-)

      I am impressed on the uptime though. Sounds like a genuine improvement.

    I've always claimed that I wouldn't use Microsoft products if you paid me. This changes nothing.

    But seriously, wouldn't this normally set off red flags in the antitrust department (if it wasn't gutted)? Paying people to use your product as a method of moving into a new market sounds a little dicey coming from someone like Microsoft. Normally I'd have nothing against this kind of gimmick, but it seems rather sleazy compared to Microsoft's normal tactic of assaulting me with MSN ads and breaking competing products.

      Certainly it qualifies. MSN Messenger 6 is available for anyone to use, without requiring you to purchase a copy of MSN Messenger at any version. MSN Messenger itself is free, so there is no purchase required.

      Granted you have to have an operating system that MSN Messenger will run on to actually win, which I believe restricts you to Windows and possibly OS X, but that is no fault of the promotions people.

      actually, there's a reason they say "no purchase necessary" there are different laws depending on if purchase is necessary or not, and it's much easier to have a public offer like this. if purchase is necessary, it's counted as gambling (like the lottery) and a whole ton of taxes and laws then apply. companies just choose to make it "no purchase necessary" because of that. just a loophole they all exploit.

      I know you're being funnny, and I've never seen a dealer on a street corner giving out drugs, but most dealers you're gonna establish any sort of relationship with will let you sample the product before buying.       It's not necessarily like HTTP's User-agent: field. MSN Messenger 6 could be using some sort of strong encryption to keep unauthorized clients from entering the contest. In order to send a message that looks like it's from MSN Messenger 6, you may pretty much have to run the MSN Messenger 6 binary in emulation.

    So did they fix the bug where it insists on popping up an alert when you get hotmail even if you have that turned off? I can't stand it when I'm playing Battlefield 1942 and it sends my fps to 10 by doing so.

    In Germany a company cannot hold up a lottery where only users of it's product can participate.

    So if for example Coca-Cola puts some random numbers on the inside of their bottles and makes some kind of lottery of it, it must provide the same winnning chance to people who just call in though they haven't bougth the product (and not obtained a number).

    So Microsoft would need to provide the same chance for getting the bucks to everyone who's using another IM as well.

    Don't know how it's handled in other countries, but I think it's like that in many European countries.

      Similar in the UK. If you have to purchase a product / use a service to enter, it's classed as a lottery and so is taxed, illegal to provide to under 16s and must be registered. Hence the 'no purchase necessary' clause on most things.

Whenever you make a purchase on your Mastercard, you had a 1 in N chance of winning a million dollars or something.       Well, I'm working for a company that has traditionally rewarded its employees with stock options that vest in four years. Due to the recent market, past options are underwater and likely to stay there, and employees don't have any feeling of "reward". Granting stock instead of stock options is an admission that there is no short-term hope of stock price increase IMHO.

      You can look at it in a different way. A stock option only has value if the stock goes up. Right now, the economy is in the shitter (but starting to look up), and stocks are at low prices. Giving options now will cost more money later when the economy picks up full-swing and stock prices improve.

      From that point of view, a company giving stock rather than stock options probably believes that their stock will at least double. If the stock price does not double, then option is worth less than the stock grant. But if the stock price at least doubles, then the option is worth more than the grant.

      Giving away stock options in lieu of salary is a terrible thing for existing investors. These options don't come out of thin air. They come from newly issued stock, diluting current ownership. MS spends billions every year buying back their own shares to keep investors happy just because of this practice. If a company I hold lots of shares in stopped giving away options, I'd be fucking ecstatic.

    Sounds like a trial run of a marketing/publicity stunt. Next thing you know, they're selling IM "pop-up ads" to companies in blocks. It'll be the next "feature" of IM. When rolled out, everyone's permission setting, buried somewhere deep in the settings, will be "I want IM ads." Then, when enough people get completely annoyed by it and complain, Microsoft will "apologize" but only after seeing how long they can stretch it out...all the while raking in cash.

    IM "spam" is going to be the next big headache...and of course, the knee-jerk reaction will be to pass more laws.

      Conversion by the masses from Napster should teach people something. IM programs can EASILY be changed. There are some competing services and though Yahoo!, AOL and MS aren't the best of companies, if they try something stupid, people will jump ship fast because there are already millions of users on something else. If they ALL do this, then we might have a problem. But noticing how Trillian is spreading, you can bet they'd take advantage of the foolishness.

    I downloaded an early version of the MSN Messenger client years ago and archived it. I still use that version, which is now four years or more old. I get nagged once a week to 'upgrade' it but I always refuse. It's a fine basic Messenger and it does everything I want. I'm not interested in running anything .NET on my machine unless absolutely necessary.

    So I'm probably not eligible for the contest, huh?

      I am interested in running .NET on my machine. The first time I saw it on windows update, I installed it and it killed explorer (and you know how deeply embeded in the OS that is) so I had to reinstall. On the clean install, I tried again. The installer crashed every time. Then I gave up.

      Oh well, I only really use Windows to run an X server anyway...

    After the best buy MSN computer giveaways, and the whole thing with the pricing on the x-box, i was cynically oberving that it wasn't enough to just develop the product for free like with MSIE, Microsoft had to actually essentially pay people to continue using their product.

    Now Microsoft is literally paying people to continue using their product.

    Well.. it's a good solution to the chicken and egg problem, and I guess that's been MS's mindset all along. Users are something you can buy; you spend money to get users, and then once you have them locked in, you can charge whatever you like from them.

      Not really. A network externality is where there's an advantage caused by a larger quantity of people using a particular service. For instance, if someone buys a bag of flour, that doesn't benefit me in any way. If there's only one flour-maker in town, that's not a net benefit.

      With some things, types of communication especially, a new user benefits the current users. In the case of communications (telephones, chat networks, et cetera), another member benefits the current members, since that's another person to talk with. Slashdot, though not a monopoly, gains benefit from network externalities. How boring would this site be if there were no comments?

    Apparently similar schemes do work for some phony mortgage counsellers, so I'm afraid they are likely to spread even worse if any such lottery really ever comes into existence.

      You need to purchase a stamp to enter most 'no purchase necessary' contests. You can run msn messenger on MAC, IIRC, so you are not required to purchase something that 90% of people who own computers don't already have - windows or mac.

    The SSN and CC# number comment was meant as a joke. You know, Joe Luser enters the contest (or is told he was automaticly entered), gets an IM from a scammer telling him "just this information please and we'll send you the money". Later he realizes all he got was the wrong end of a plunger.

    However, everything entered into *any* chat service is totally unprotected, and can be snooped. In fact, in the current EULA, they explicity state that they will give archives of the messages (which they store, BTW) away to officials upon prompting.

    You can always try Miranda IM with the SecureIM plugin activated. The only problem is that the ones recieving your messages needs to have Miranda and SecureIM activated.

    I think some Jabber clients and servers support encryption too.

      Most Jabber servers support SSL, which gives client-server protection, and is fine if you are talking to people on the same server and trust the server admin (the 1.5 and 2.x series servers should support server to server encryption as well).

      In addition, a number of clients support OpenPGP (often using GPG), for which there is an official Jabber specification and so can use end-to-end encryption, which is interoperable between clients (although there are a few theoretical issues with the spec which should be fixed in the next version).

      On a side note, I use the MSNM transport for Jabber, and would be highly entertained if someone won this prize for using a competing network...

      Then you really haven't gotten around the restrictions at all, have you? The whole point behind VMWare is that you can run more than one operating system at a time, however, running linux, then running Windows on top of it in VMWare doesn't negate the obvious fact that you're indeed running Windows. By running Windows, you're already adhering to part of the regulations. So really we've just discovered that you can get the same outcome in more than one way. Just because you do something _your_ way instead of _my_ way, doesn't mean that the something wasn't done to begin with.
