Jack Thompson Sues Microsoft

An anonymous reader writes to mention that Jack Thompson, in his latest bout of zealotry, has set his sights on Microsoft for their recent release of Halo 3. GameAlmighty has posted the letter to Bill Gates. "Here's the deal, Mr. Gates: Either Microsoft undertakes dramatic, real steps, through its marketing, wholesale, and retail operations to assure that Halo 3 is not sold, via the Internet and in stores, directly to anyone under 17, or I shall proceed to make sure that Microsoft is held to that standard by appropriate legal means. I have done that before successfully as to Best Buy, and I shall do so again as to Microsoft and all retailers of Halo 3."

      I envy someone who can get so singularly focused on one topic. I think the guy's going batshit -- or should I say overreacting -- but I envy that quality nonetheless. How much meaningful work could get accomplished with such focused energy. You know he might just accomplish an end to his means because of it.

      But his energy isn't focused. He attacks the wrong targets. He's not starting a PR compaign to make parents aware of ratings. He isn't threatening retailers with boycotts for selling mature games to children. He's suing a company who has no control over the situation, and no legal responsibility. That's not focused energy. It's the kind of random misdirected energy I expect from a crack addict.

      Eh ... I dunno man. Isn't there a medical term for when someone gets so fixated on something that their perception of it becomes completely warped to the point of being detrimental to everyone around them? Sounds like a plausible mental condition. And that he can [attempt?] to wield the power of the courts to enforce his warped perception is slightly scary.

      I suspect the point is coming when Thompson is going to start feeling some very real consequences of constantly wasting the time of the court. Either he is indeed a complete lunatic, or he's an addicted publicity hound. In either case, the least that should start happening is that he needs to have all the legal costs bounced back on him.

      he's already been run out of one court for his antics... so yes, the courts are tired of this.

      on a side note, I don't think he'd have a chance in hell against Microsoft's lawyers. Halo is the wrong game to attack anyway. Sure it's violent, but it's fantasy violence a la Aliens or Starship Troopers against not to scary monsters. It's not even the horror genre like Doom with people turned to zombies and demonic undertones... it's strictly man versus alien. And occasionally alien versus people. It's not violence depicted against PEOPLE for sport like GTA. otherwise he ought to be out there protesting Forest Gump or Pearl Harbor for depictions of people really getting shot at and loosing limbs. Personally what I've seen of Halo 2 makes it barely PG-13.. mostly for the language and occasional gratituious monster kills or foul language to bump up the ESRP so tweens will want it for being "grown up".

      I agree with your general idea, but Microsoft has more control over Halo 3 than any company on the planet. Microsoft *could* decide not to release Halo 3. Likely? Of course not. Could Microsoft ensure Halo 3 never hit the stores? They're the ones to go after if you honestly believe the courts would side in his favour.

      But lets be frank. Hes not trying to stop the sale of Halo 3. Hes generating 'awareness'. Hes not trying to prevent violent games from reaching children. Hes trying to rid the world of violent games. Period. When he suggests that GTA is a 'murder simulator', I dont think hes saying that the ratings system doesn't work, I think hes saying that nobody would suffer from alcohol abuse if the world stopped creating alcohol. Hes a modern day prohibitionist; considering that prohibition really did exist at some point in time, its not all that nuts to suggest that he probably has more than a few financial backers. Hes just pretty shameless with his opportunism. You really ought to give more credance to your enemy; he may be really misguided, but you have to have at least some reluctant admiration for his tenacity.

      The only difference is the fruitcake ramming his head into a brick wall has a slightly higher chance of surviving than the fruitcake trying to sue Microsoft.

      Needless to say, if the best they can do for lawyers is a jackass like Jack Thompson, when they do start their attack, we'll slaughter by the dozens and stack their bodies like cord wood.

      It's not that he has a chance against Microsoft (or against any other company for that matter), it's that these really are amounting to nothing more than nuisance lawsuits, which cost companies time and money, not to mention the taxpayer, who gets to foot the court's bill for Thompson's theatrics. The real crime here is that the guy isn't give an itemized bill for everything from the judge to the bailiff to the goddamn toilet paper in the bathroom. Let him exercise his right to annoy on his own dime, and not on the public's.

      I think it was Richard Hell Richard Hell who once said he preferred addiction to non-addiction, explaining that at least he knew what he depended on and was important go him, while non-addicts were caught in an invisible net of dependencies that ruled their life without them ever noticing.

      The point the GP makes though is still valid. He is trying to rid the world of violent games. He is just doing it in the least effective way possible. This would be the rough equivalent of me suing someone for driving through a green light while kids were crossing with the walk sign in their direction...because I think that cars should wait for all pedestrians to cross all directions before proceeding.

      He is suing MS for doing something legal. There is no law preventing the sale of violent games to kids. The suit will be thrown out.

      I personally envy everyone who is able to focus on one particular topic and do something constructive with it. 2006 and 2007 is for me a turning point in that case, because I have always had many ideas, but not the focus to follow them up.

      I am now busy on a project that I chose myself (developing a tool set for simulating digital components, building a small computer system with it, and in the mean time learn Common Lisp, because it is all implemented in that language), and for that I needed to dump a whole lot of other activities and projects that I also want to do. Since I have a job, a wife, a kid, a house, a garden and a family, I have also to spend time on these things, and time over is spent on my project.

      The worst you can do is say that someone is maybe a monomaniac, but I think that you then need to be able to do a real diagnosis, i.e. you must be a doctor with the relevant knowledge.

      I believe it's called Obsessive Compulsive Disorder. Some people clean things. Some people count. Jack Thompson sues game manufacturers.

      Also, the fact that he can attempt to wield the power of the courts to enforce his warped perception is not scary in the least. The fact that you feel some people should not have access to the courts as arbiters is very scary, and if you were someone with even a modicum of power over the courts, it would immediately upgrade to scary as hell. The courts are the perfect place for this. Let Jack Thompson sue Microsoft. Microsoft will eat him. I would love to see them just skip to the third 'E' here. He should be able to do everything in his power under the law to force his views on the world at large, because now the world at large gets to apply massive backlash.

      He's a poor lawyer, an even poorer communicator (which is odd for a lawyer), and he's backing the wrong horse. He is, in effect, working FOR the game companies. Now _EVERY_ kid will crave this title for Chrimmus. Jack's guaranteed a million seller for Microsoft simply by opening his mouth and calling it "evil".

      Pressure? My ass. The people and companies he's "going after" couldn't care less. Their answers have been simply "if you'll go away, we'll agree to it." Any sort of half-intelligent individual can see he's the internet age's equivalent of an ambulance chaser.

      No, prohibitionists were way more rational. Theoretically, if you could stop any alcohol production, people COULDN'T drink the stuff. There really would be no alcohol abuse. Yeah, I know, theoretically. However, there isn't an equivalent with murder. Look, computer games were created AFTER world wars I and II, for god's sake. In the very same century, over 100 million people were killed during war!!! Then there's the THOUSANDS of years of violence in the human race that has happened ever since humans have EXISTED.

      Violence would exist, pretty much the same as it does now, with or without violent media. To suggest otherwise literally means that you are insane, and incapable of realizing facts and logic. I don't know what's wrong with Jack Thompson or people who listen to him.

      Initially I thought this was April Fools because it's actually snowing here in Calgary today, but I digress.

      You have to admire his tenacity, but his target is questionable. They create SAW movies with far greater frequency than Halo games, and SAW movies are I think just as (if not more-so just because more people sell them) accessible as Halo games. The violence in the SAW movies is also I'd argue far worse than anything you'd see in a video game just because it's real actors portraying it. (Yes, I'm ignoring the interactivity argument, but still...)

      We'd be paying for the courts anyway. Jack Thompson is hardly a man of poverty, and Microsoft can drain him without taxpayers sending money their way too. I actually appreciate him, he actually helps my case for video games. It's easy to polarize the issue to 'video games are good' and 'video games are bad.' I just set him up on the 'video games are bad' side, and let his comments about Burger King sponsoring murder because they made a few crappy X-box games drive most people who don't see shades of gray over to my side of the fence.

      I believe it was Nietzsche who said that there is no more perfidious way to harm a cause than to argue poorly on its behalf.

      I agree. I haven't liked anything he's said in the past - but I can't fault the guy for not wanting a game rated Mature not to be sold to kids 17 and under. He's within the letter of the law, and I can't see anything wrong with not enabling kids to participate in violent-themed activities.

      Whos to say hes against murder? I was saying hes against people using video games to 'learn' how to do it. Surely, alcohol prohibitionists didn't think all the negative behaviour that came from drinking would stop - they just figured, if you prevented the sale of alcohol, you wouldn't have people abusing it as a technology. Similarly, Jack Thompson thinks that if violent video games were illegal, nobody would become more likely or more proficient at killing people thanks to a video game.

      Thats where people get confused; hes not saying that banning video games will save humanity. Hes saying that he doesn't play video games, and why not ban violent games because they dont do anything for him and from his viewpoint they can encourage real life violence.

      I don't agree with him, and obviously, given his previous 'success' in the legal system, most others don't as well, but he's a pretty successful demogogue given that there are thousands of other people who share his beliefs that have never generated large slashdot threads or cnn coverage or launched legal actions against video game companies.

      I got attacked for saying that we should reluctantly admire his tenacity. I'm not sympathizing with him, I'm only pointing out that he knows his role in life; hes a protestor. We all know he'll be insignificant in the larger scheme of things. Should he 'die in a hole' like others have countlessly suggested in threads like these? I dont care who it is, nobody should die in a hole. I think hes an entertaining ankle biter for hire. Hes destined to a two paragraph article when he passes away. Hes wasted public time and money, but hey, thats science; its still a valid experience for society when he is proven to be in the tiny minority. Those who feel the same way will be able to know by the history of attempts against the distribution of violent video games that its not really worth trying to clog the system. The larger they are, the harder they fall.

      hmm. I guess when you go all reducto ad absurdism (or however it's spelt) it sounds wrong. However I don't think the world's really as black and white as you're trying to imply. Most mercenaries wouldn't just side with the enemy if they offered them more $$$ - this implies a moralistic component. Conversely, I think it would be possible to argue that some totalitarian states encourage amoralism (new word), under the guise of "just following orders" or whatever.

      An amoral person can do anything, as they look out for themself (also known as psychopathic) - at least a moral person behaves consistently.

      Well, hes actually trying, in this case, to get the manufacturers of video games to abide by their own rating systems. Every now and then congress threatens to take over the job of rating video games, movies, or music if the industries don't do a better job. I think the only defense Microsoft would have would be to remove the mature content warning altogether. Either they think it the rating on the box isn't accurate, doesn't matter, or they simply don't care. Its like Al Gore being a big environmentalist, but spending thousands on electricity every month.

      There is a limit to which any corporation will care about enforcing a label that hurts its own sales.

      or perhaps one could also argue that Microsoft job is only to inform others to make their own minds. Radical concept. I guess they could have ads saying that Halo contains mature content.

      Seeing as we also have problems keeping guns, tobbaco, drugs,alcohol out of the hands of minors. It shouldn't really come to anyones suprise that we also have problems with video games. In light of that one would have to question the sanity of anyone actually spending any time on the problem.

      The thing is the manufacturers really don't have much say in the enforcing of the rating systems, do they? I mean, once the game's all produced, packaged and shipped out it's really out of their hands. If he'd directed his ire at the stores that sell games (who *are* the ones who ought to be enforcing those ratings) then maybe I'd concede that this is possibly the most sane thing the guy's said since I first heard of him.       Please, for the love of God, don't classify him as a Christian. I'm offended that he tries to use christianity as a platform to push his agenda. If he wanted to be a good christian, I think he would sympathize with the families of the victims in cases like the VTech shootings and try to help them overcome their grief, instead of lying to build up his podium and attempting to use it to further his misguided causes.

      Sadly, like a terrorist, Thompson has tainted whatever legitimacy his complaints may have had through gross excesses.       Actually it's not just Republicans who want to talk about this kind of gaming regulation. A lot of butt-kissing Democrats have made suggestions that way, including the rather liberal Hillary Clinton. This is not a Republican/Democrat issue. They both suck on this issue for the most part.       The way I see it, she's trying to pander to the center-right more than actually being center-right. Much like John Kerry pandering to whatever audience he was talking to, or Bush pandering to evangelicals. Her healthcare ideas are most certainly not center-right. She's taken a drastic centrist turn since about 2003 or so. Giuliani is also trying to more appeal to what he considers the mainstream.

      Much like the Democrats who were staunchly anti-war until after they got elected, and have since done nothing more than publicity stunts on the war, were Hillary to get elected, I think she would do an about face on a lot of her "center-right" attitudes.

    How is Microsoft supposed to take drastic measures to ensure retailers don't sell its games to people under 17? I wouldn't be upset if Microsoft started a "17 means 17" program, where if they received proof of a retaler selling "M for Mature" games to people under 17, they would cut off that retailer from all shipments of Microsoft products for 6 months. But is it practical?

    If it was Wal-mart, would Microsoft cut them off or give them a stern warning? When I was young and working temp gigs at Disney, I spent a few days calling video stores that had broken street date on video releases, getting a store manager on the line, then handing them over to a Disney manager to chew them out and threaten them with not getting future releases.

    But one thing that was interesting was one of my co-workers told me how Costco got away with it all the time. They were such a huge retail channel for Disney videos, Disney couldn't afford to threaten Costco, so they just had to take a "grin and bear it" posture in those cases, filing a protest but unable to make threats.

    I'm sure Microsoft doesn't want to see young kids getting their hands on violent games and they're not doing tobacco industry style strategy sessions on how to sell "Halo 3" to 10-year-olds. OTOH, how much can they actually do when they're not the ones actually controlling the point of sale?

      You have to remember that places like Costco and Wal-Mart are *huge*. Movie releases by Disney mean relatively little to them on a yearly basis because their product range is so diverse. Delaying the movies only delays the time until Disney makes money on the movies which these places are going to sell regardless.

      So while that response might be fair, it is ultimately pointless and ends up hurting Disney more than those particular retailers.

      Thats what I was thinking initially. Their Lawyers can't just come out and rip him a new one because it looks bad. Forcing a 'solution' on all their distributors is just impractical. I imagine the first response will be a nice spokesman coming out and making all the right noises about how MS are concerned about kids being exposed to violence and all the measures they take to prevent this and that because they are concerned members of society their games are not really 'violent' its just a tiny part of the gameplay and while they respect and share Mr Thompson's concerns they are currently doing everything in their power to prevent improper sales etc.

      However after all the public bs I and considering that gaming and the XBox is going to make them quite a bit of money over the next few years I expect Thompson will find MS much more abrasive and confrontational should he do anything they feel is going to threaten their margins.

      Nah, I don't really see this is much of an issues for Walmart because items such as beer, tobacco, some spray paints & paint thinner (and other solvents that you can get high from), and various over the counter drugs all require a DL and for the purchaser to be over a certain age. It should be almost trival to have M rated games treated like those other items. The requireing a DL alone is sort of an age limit for 15-18+. If they actually check the DL, most have something like a red border around the picture or something if the person is under age for either beer products or tobacco. I don't see how this is a big deal for major chains to enforce. If anything the ATF could be expanded to incould expanded to include all age monitored sales and have that body incharge of enforcing the rules. I doubt it would be that simple though.

      It doesn't hurt that Live enforces certain age restrictions. Hell, minors can't even use Messenger. And offline, parental controls on the 360 can be configured to block games like Halo 3. It's obvious to anyone who gives it serious thought - you can't learn essential things about breathing, handling the trigger, recoil, and good postures for sniping by playing video games. I've been taught sharp shooting so experience tells me that it's extremely unlikely you'd learn anything useful from those games. Lee Boyd Malvo may have liked playing Halo, perhaps even because sniping was an element of the game, but I'm pretty damn sure he learned the techniques elsewhere.

      It's pointless to tell these things to people like Jack Thompson though, because it's not in his interest to listen. Thompson doesn't realize that there simply might just be something wrong with Lee Boyd Malvo and not in the games.

    Right, where to begin, first, This guy is clearly a media whore looking for the next journalist to blow, using sensationalist terms like "hyperviolent", someone get this guy a dictionary. He's probably threatening microsoft because they're big and thhey don't wnat bad press, they haven't done anything yet! It's a threat based on what may or may not happen a few months from now.

    Secondly he apparently did this to bestbuy, guess what, NOT THE SAME THING! Bestbuy is a shop, microsoft is a programming company, they will not get sued for selling to under 17s cos they only sell to businesses, they don't actually retail anywhere near a decent %age of the games. It's not up to them to enforce the law on the retailers, it is the retailer's obligation, no one elses and certainly not this random lawyer.

    Thirdly, why is this relevant to the public? It doesn't concern us, we should not be sent a copy of this, why has he done this? May I suggest he is advertising this n order to further his reputations and to try and pre-empt microsoft in anything they do in their media campaign?

    Finally, who is he to be sueing anyone, it doesn't affect him remotely, the nearest he's got to violence from video gmaes is videos of video games played in order to illustrate how just his cause is not giving the full picture at all.

    I feel i could have written this better, but I'm in a rush (as all 16 year olds are), just illegaly downloaded Halo from the pirate bay and can't wait to see that cool real gore!

      Under an extension of the logic that holds tobacco companies liable for marketing to minors.

      Jack would have to show a few things that he hasn't been able to show before though (that violent games harm minors), and he would have to get a law passed first (preventing the sale of harmful games to minors). But if he can do that, the precedent is well established.

      He can't do that though, so he is jumping the gun.

      They aren't. Well, I am convinced the law and any judge on such a case would think so.

      But remember, this is the US. Where anyone can sue anyone (including himself!) for any reason whatsoever, with no penalty to the plaintiff. They call that "justice", not realizing it's actually more like "enriching the lawyers".

      If he DOES sure (which I understand hasn't been done yet) he'll be thrown out pretty easily. And regarding who you should root for, in such a fight, the answer is simple: the side you think should win. That it's Microsoft is irrelevant: nothing is ever so evil that it can do no right.

    ... because really, they're just distributing a video game. This attack on gaming is stupid, just like many other laws trying to prevent social activities. It's a futuristic combat game, there is nothing REAL about any of it. The supposedly realistic world the game takes place in is a complete fictional fabrication. Unless Jack thinks Microsoft has a fucking time machine and knows that this is the true future. :-)

    Why doesn't he focus his effort on banning violence from news reports ... cause that's like real. Or how about violence in film? That is a depiction of real people, handling pseudo-weapons that are designed to look like real weapons, and through the use of special effects, depict the actual killing of people in as much graphic detail as possible (cause it looks cooler). He really needs to stop acting like a fucking crusader for the war on video games. I am under the impression that there is no "moral majority" backing any of his actions, and the generation of adults who grew up playing video games will just want Mr. Thompson to shut up.

    And if he brings up the recent VT shootings, from what I understand of Cho's background, that he didn't play video games.

    Can someone please throw a cream pie at Thompson, like ASAP? Someone already nailed BillyG with a pie, someone needs to get Jack.

I am tired of hearing people bash on games and saying that they are, and I quote from the article a "health hazard" because they think games are the ONLY cause for violence in America. Because their peers made fun of them constantly, they were in an area of low economic opportunity, and their teachers said they were failures.       What will likely happen is that Microsoft will tell retailers not to sell the game (which will be rated M I imagine) to anyone under 17 or they won't get anymore games from Microsoft. Most major retailers will probably comply at the corporate level (and introduce it as policy). (since, like Microsoft, they probably don't really want kids getting hold of M rated games)

      Then, if any copies of Halo 3 are sold to people under 17, Microsoft and the retailers can point the finger at individual stores for not following corporate policy.

      Microsoft has nothing to gain from doing anything against Jack Thompson unless he actually sues them (in which case they need to fight hard). If Microsoft goes after Jack Thompson right now, Jack will paint Microsoft as "being ok with the sale of violent video games to minors".

The problem I have is someone will freak out over a missed comma(my biggest problem) or apostrophe. I think its crazy in a forum that people go way off topic and spaz out over a missed period.

      I agree that if you go and make really bad mistakes people will most likely opt not to listen to you. But if your going to ignore someone because they used an apostrophe incorrectly and then yell about it. Thats just overkill. Contribute something to the conversation and then say "hey grammer mistakes bug me so I would like to point out that the way you did that is incorrect". I guess it's just that people are so rude about grammer, they get angry about it like it's the end of the world.

      I haven't read a newspaper that hasn't had a typo or grammer error. Why should the people on slashdot be burned at the stake for bad grammer/spelling.

    Not that I would be against a law to state that it is illegal for someone to sell mature video games to kids, but come on a violent video game is way less dangerous then drugs, cigarettes, and alcohol. 99.9% of kids can play violent video games and not be any way affected by them. And those that are affect usually have other contributing factors that make it so. There is no way Microsoft could assure that there game is never sold to children. Look at all the before mentioned products, they still get sold to kids all the time even though its illegal by law. Jack Thompson is fighting the wrong people. He needs to be helping parents learn how to be parents. Most young kids don't have the money to buy a 50 - 60 dollar game. Let alone a several hundred dollar console.

      Don't be an idiot. Did you every do something your parents didn't know about? If so, I hope the shot themselves...preferably in front of you. If not, no wonder you seem to have issues.       A parent can not know everything there teenagers does down to that specific. Am I supposed to follow them around the mall when they're 17?       Try this one. True story but I can't find the link at the moment.
      A couple run a home-based child-care centre. Husband mows the lawn on a ride on mower and a child gets out and is accidentally run over by the mower. Who gets sued? The lawnmower manufacturer. They were found to be negligent because the mower went over the kid backwards and didn't have a device to prevent it from going backwards. Never mind the fact that no ride-on mower has one, or that one doesn't even exist. Never mind the fact that the couple were negligent in letting a child out unattended (I think it was a 2 year-old) or that he was mowing the lawns while the children were there. The couple didn't even get sued. So if you live in the US, then maybe you would sue BMW because, hey, they have deep pockets.

      IIRC it's enforced by cutting off shipments from member game developers if stores don't cooperate. And if member game developers break the cartel then they're punished by not getting their games rated by ESRB. Which I believe then won't pass the first party.

    it deserves, which is none. Apparently, it's now up to publishers and developers to police their own games and make sure that stores don't sell their inventory to kids. How many stores are going to carry Halo 3? Sounds like M$ needs to get some hiring done to get every Wal-Mart stocked with an employee who's sole job is to check ID's. Seriously, WTF is this crap? It's up to the stores who sell the game to police it (If such a thing was required by law), not publishers.     Being a parent has always been hard, but I think it is getting harder. There is growing social and peer pressure for kids to start doing things they are really not equipped to handle. Society is treating kids like mini-adults which they are not.

    Teenagers (13..18) were once considered kids in their emerging years. Now they are treated like adults. The new emerging group are the "tweenagers", a term that started out refering to 10 to 12 year olds, but now extends as low as 8 or even 6.

    So now instead of parents having to deal with 14 year olds asking for adult treatment, they're now dealing with 8 year olds asking for padded bras "because everyone else has them".

    Marketers will do everything they can legally do to create revenue. They have advertising and other forces on their side. Parents have no more tools than they have ever had. Marketing has got more agressive and will continue to do so.

    Added to that, most parents are willing to just go with the flow. Typically these days most parents work (as opposed to 40 or 50 years ago when many many mothers did not). Most parents don't have the time or inclination to spend with their children to give them the guidance that they need.

    So if the parents don't give the guidance, and soceity increasingly tolerates aggressive marketing, where is the control going to come from?

    The most powerful propaganda technique is to selectively not report. The media already does this with entirely too many things that they want put over on the population. (Ever notice how they don't tell you about a lot of tyrannical laws until they day they go into effect, rather than warning you when they're in the legislature (when you could do something about it), or up for executive signature (when you might have a slight chance to abort it)?)

    For once we've got a petty tyrant who's knotting THEIR shorts, too. So let's not play into his hands by trying to get the media to shut up and let him perpetrate his evil unimpeded.

    What really amazes me is the man hasn't gone after the Wii(at least to my knowledge). Come on, a game like Red Steel should be a big fat target for this guy. Not to mention Metroid Prime 3, which is a game that is making some buzz. You would think the controls used in these games would seriously disturb him, those Wiimotes are more like guns than any 360 or PS controller could ever be!

      My mod points literally expired minutes before I loaded this, but I'm giving you a virtual +1 Interesting.

      The thing that always seems really stupid to me about these claims is that with the exception of joysticks for (combat) flight sims, the controls used in (violent) videogames are nothing at all like the ones used in real life. I'm a half-decent shot with a pistol and much better with a rifle, but I absolutely suck at FPS games... and I bet the reverse is usually true as well. FPSs just don't account for things like the weight or length of the weapon, the affect recoil has on aim (I mean, see above comment on FPS games, but even I know how to tip the sight control stick slightly down in Halo 2 so my SMGs don't climb from recoil... whereas real full automatics are far harder to control and vast amounts of R&D has gone into the invention of 'governers' that limit the number of shot fired in a burst, because otherwise people tend to shoot most of their ammo into the sky. The grips are also different, and even the triggers don't feel the same at all.

      The real difference, however, is the aiming. Mouse, keyboard, analog stick, joystick, control pad... it doesn't matter, not a single one is anything like actually trying to hit a target with a real weapon. I don't shoot at people, obviously, and usually not at terribly mobile targets, but even lining up on a stationary target is a major difference. This is especially true if shooting 'from the hip' (which is WAY harder than movies make it look) where you don't have any kind of crosshairs, zoom, or direct LoS along the barrel. Until now, no videogame* I've ever seen has even approached what real-life aiming is like.

      Now, along comes the Wii. You aim by... aiming. Your hand is on a object not terribly unlike any firearm without a pistol grip. You are shooting in a way that's pretty much 'from the hip' with perhaps the equivalent of a laser sight added (crosshairs on screen). I haven't played Red Steel or any other Wii game involving shooting with a Wiimote, and I'm sure the best of them still isn't terribly realistic, but it's a hell of a lot closer than any other mainstream control scheme I know of* and if JT actually gives a damn about the supposed reason behind his crusade (keeping people safe) and has an IQ of better than 40 (not sure about this either, but he did supposedly make it through law school) he should be terrified/outraged by this!

      *Ok, duckhunt. But seriously, the aim in that game was a joke; it was more about learning how to game the system than about how to target accurately. There may have been others - I wasn't much into console games at all until recently - but by and large what I've said above holds true.

      Well, there is one game that does realistically simulate firing a weapon. Unfortunately it is so exclusive it makes halo 3 alpha testing pale in comparison. It would be the M.A.C.S. or the Multipurpose Arcade Combat Simulator, a marksmanship training aid developed for the Super Nintendo for use by the US Army. It is part of the M16 marksmanship training program and is specifically used for proper sighting and target acquisition (more info). Personally I didn't find it as useful as the dime and washer exercise, but then again my problem was trigger squeeze not sighting.

      Yea, it is terribly unrealistic. I think your grasp of how the control works though is pretty good. The amazing thing to think about also is how much buzz Red Steel got. Sure it was a horrible game but before the Wii was released I couldn't go to a game site without seeing something about it. Why didn't he go after it? Does the lack of blood in the game make it a non-issue, cause talking with my media violence professor it the violence is still there whether we see the blood or not. I would seriously love to see his take on the Wii. Has he not gone after it for the web imposed "kiddiness" of Nintendo?

      It refers to an optional System Preferences pane that can be downloaded for OS X Tiger (link) called DashOnOff which lets you disable Dashboard - it's not the only way to do this, but it's been a while since I updated my sig. You may also want to Google "MainMenu" which probably enables you to do the same thing, as well as having quick recourse to utility scripts and other stuff (I don't recommend it wholesale, AFAIK, you need to sudo su to run /etc/weekly from the Terminal, so this menu might retain more privileges than needed).

Budweiser doesn't need to police its own product, and there are actual LAWS regarding the sale of liquor.     How is Microsoft supposed to take drastic measures to ensure retailers don't sell its games to people under 17? I wouldn't be upset if Microsoft started a "17 means 17" program, where if they received proof of a retaler selling "M for Mature" games to people under 17, they would cut off that retailer from all shipments of Microsoft products for 6 months. That might be an antitrust violation if it's construed as Microsoft leveraging Windows (a common item at game-selling stores) to enforce their distribution policies for another product.

    Actually, MS's games division are really nice guys. At some point, MS basically decided to open a console division, and did so by throwing money at the most passionate game dorks they could find, then giving them space to do what they wanted to do. Because the division is reasonably young, and the older executives largely keep their hands off of it, it's not plagued by the infighting that the rest of MS is.

    I originally wanted the Xbox to fail miserably in the market, lest the beast from redmond do to consoles what they did to operating systems. But, by and large, the games division has been run by a bunch of stand-up guys doing good stuff. And I'm not just saying that because I've met them, but also from what they've done. You have to admit, the Xbox 360 is no MSN.

Hell, if history has shown us anything, it's that nobody can hold onto a monopoly there for more than ten years at a stretch. Atari, Nintendo, and now Sony all rose and fell, and if Microsoft ever reaches the top, the same will happen to them.

      It does seem that way, doesn't it? Just remember, there was no OS monopoly before Windows, and no office monopoly before MS Office. Microsoft are experts at generating self-propagating monopolies (yes, they failed at many things - MSN, Zune - but a few big successes are all they need). Just watch, they are already leveraging their Windows monopoly to help the XBOX (multiplayer games with Windows and XBOX, shared credit system, etc.), they are consolidating their development tools so that developing for Windows and XBOX can be done simultaneously, and I am sure they have more tricks up their sleeve (look at the XBOX media store, I am sure we will see tight integration with Windows).

      So yes, people buy a new console every 5 years. But only the Microsoft console will integrate especially well with their Windows machine, both for the end-user and the developer. We may very well see a console monopoly in the next decade. Sadly, Sony and Nintendo seem to have no clue (if they did, we would see them standardizing their development tools, integrating with iPods, etc.).

      I don't think Microsoft will ever effectively leverage their windows monopoly into the game console world. I don't ever see them getting a chance to monopolize the console reason. For a number or reasons.

      The first being that whatever integrations they did with X-Box and Windows could be done with third party apps by Nintendo and Sony. They just wouldn't get to use the super-secret backdoor windows code to do it.

      Second off what seems to drive the game console world is not integration but innovation. NES had it's new 8 bit graphics and games with actual stories. PS1 ruled because it recognized that not all video games need to be kids games. And the Wii is knocking the snot out of the PS3 and X-Box 360 with their innovative controller despite having graphics hardware well behind it's competition. And if there is one thing Microsoft is bad at, it's innovative technology.

      Third consoles are rooted more in hardware than software. So, when the hardware gets replaced with the next generation of consoles their development tools will need to be re-evaluated. It'll be one more thing to slow the next console out the door.

      No, the console market is open season. Probably always will be.

      To add to this:

      MS IS managing to do a few things to leverage Windows in the console space, but they're primarily small, value-added items that extend the functionality of the XBox 360 into the realm of Windows Media Center. They can basically put the 360 up as a media extender or possibly a DVR and extend the installed base if people see it as competetive in these areas. This will allow them, eventually, to get more games developed for their console, and possibly sell more games (where they'll make some money from the whole thing).

      This follows along with the idea that people bought PS2s as cheap DVD players, and that people might buy PS3s and XBox 360s as mid- to low- range Blu-Ray and HD-DVD players, and then might pick up a game once in a while. In the console world your game sales make the money, but your installed base ensures that people make the games that your customers might want to buy for YOUR console, and hopefully not the other guy's console.

      However, once someone has an XBox 360, what do you do to get them to buy the next-generation hardware? Basically they end up having to cut the 360 short of its full potential to give people a reason to buy the new one if they are primarily using it for the secondary features, much like they have with the original XBox. I think in the end the 360 wins on this angle over the PS3 anyway, because the market for HD-DVD and Blu-Ray movies isn't going to be there until one of them fails, if ever.

      I found that the idiocy was illustrated most by the quote As you also know, Lee Boyd Malvo trained on Microsoft's Halo to further enable him to become the remarkably efficient "DC Beltway Sniper." That was reported by NBC News at the time and was noted in Malvo's criminal trial.

      No, neither of them were trained snipers. John Allen Muhammad qualified as expert in the M-16, but was NOT a trained sniper. Lee Boyd Malvo, being only 17 at the time, was too young to have served.

      On the other hand, John's military experience may have led to their choosing of the AR-15 for the attacks, as it was what he was familiar with(except for missing the full-auto option).

      Finally, from what I've read most of the shootings occured from ranges that anybody who can PASS qualification shouldn't be missing at.

    I am tired of Mr. Thompson's flawed argument that anyone effectively "trained" on any violent video game anywhere. Firing a rifle/pistol/whatever in a video game is nothing like firing its real-life equivalent. For starters, breathing comes into play, as well as the weight of the weapon and the motion of the trigger finger. A video game controller allows you to separate all these things from the motion of the crosshairs. Your thumb and pinky move separately rather nicely, the controller itself is fairly light weight, and when you breathe, the joystick doesn't move. Nobody can train for firing a real, live gun by shooting at elites and grunts with illuminated pixels!

    Most states do not recognize private rating systems under a legal jurisdiction. What can the state deem viewing appropriate to people under the age of 18 is pretty much only absolute when visual depictions of sex are involved.

    Stores wanting to look like responsible businesses will have their own policy of id'ing anyone if its rated mature. Much in the same vein as the comic book authority or the mpaa rating system, the private ownership of ratings means that at the very least, legal responsiblity for a minor seeing an r rated movie, or playing an m rated video game is no where except on the parent themselves.

    There is however precident that Thompson wants, he did lobby for Louisiana to make the M-rating half equivalent to the Nc-17. Again the problem can be broken down to the very simple fact that no private rating system is transparent enough to the point where every reasoning for the system is agreed upon. I don't see this court case actually going anywhere but at a settlement. If Jack thinks this is some kind of indiciation that he is in the right, he would have to be very insane to think so.

    If there was a government rating system, then at least we can see the documents for ourselves and see how they rate media. It also gives an opportunity for the consumers to adjust the system by means of voting power. But as it stands a private rating system doesn't allow us that luxury, so for example movies that would be passable for Pg-13 standards will be rated R or NC-17, while ones that could be NC-17 would be rated R.

    Every time I come up with a new idea, I think it'll be the one that I can focus all my effort on and enjoy, but after thinking about it a while, I realize that it doesn't do it for me.

      I really had to concentrate.

      I still have to concentrate. Keeping a journal helps (I use TiddlyWiki). By creating regularly a journal, you can do a summary of what you have accomplished, and you can map out what you want to do.

      It comes down to planning. Start with a plan, then concentrate on the separate steps of the plan.

      It is a little bit like repeating a mantra. Sometimes working on a project gets boring, or you desperately need to understand something, or design something, repeat to yourself the end goal of your target.

      Also, try to stop thinking about the mountain of work that lies ahead of you. If you have a large project, thinking about the amount of work that needs to be done can very easy demotivate you. When that happens, concentrate on the small thing that you need to accomplish NOW.

      I started my project in August last year. I started with a kind of plan. I had the following goals :

      • Create a library for simulating digital components (MSI).
      • Use this library to implement a simulated computer architecture.
      • Design my own computer architecture.
      • Use Common Lisp, in order to learn Common Lisp.
      • Get experience with open source VC (Subversion) and CM (trac) systems.

      By creating a plan, and always concentrate on my end goal, I was able to start this project, and write pages of upfront documentation before implementing each part of the digital library.

      By the end of November, most of this library was complete, in December I started designing my architecture, and the ISA was ready by Januari.

      Do not get distracted by possible optimisations. Once I got together my ISA and implementation architecture, I had to go ahead with building a real system from the libraries I designed, even when there where some small, non-critical errors in it. Keeping a journal can help here, too. Write about your possible changes in it, so that you have a reference, but let them alone until your system works.

      One has to keep oneself in line with the desired goal. For some people this comes natural (although I tend to assign to such people a lack of imagination), for others, especially with a vivid imagination, this is not so easy. I presume it comes down to conditioning.

      I was also tired of myself, of not being able to do something that I really wanted, or at least start something and really go through with it, until it was finished, and note merely barely working.

      Do not forget to take rest, but take a rest which clears your head. For that I have my garden, and I like to read, but not difficult things (this should only be done in the context of your project). It should relax your brain from the concentration that you need to focus on your project.

      The above list is just a summary of the things that I have done. I think it comes down to : concentrate on your plans, concentrate on your goals, file away things that are not relevant to what you want to do.

      And I think one more important aspect : be prepared from the onset to say to yourself that you will not be sorry dumping all the rest of your ideas, at the advantage of the one thing that you would like to work on.

    This guy is a lawyer, how can he get away with threatening legal action if they allow a sale to "anyone" that is under 17. I am pretty sure there are a few places that Microsoft sells software that does not have a law restricting the sale of a game in that age group. I could understand if it was just a nutcase without legal training, but this is a nutcase that has passed the bar. You think he would understand that as a lawyer he is not allowed to threaten the wrath of law for retribution against legal acts that he personally disagrees with.

    I am not sure if Jack Thompson was home-schooled or not. However, he does exhibit some tell-tale signs of it. He seems to be somewhat oblivious to how the real world works, and thinks that what he was taught as a kid is the whole truth.     I've got several friends who are instructors in the US Marines and they train grunts to shoot guns and kill people. From talking to them, it doesn't matter how "Bad ass" you are, how violent people think you are, how many games you've played....the human pshyche is normally averse to taking another human life. You can argue all you want about violence, insensitivity, etc.. but the simple matter is this: When it comes right down to it....and you've got a living person within your site/crosshairs...most people will not shoot.

    Once you get out of the fairy tale world of the movies and realize this simple part of the human mind, Jack's futility and silliness becomes very apparent (if it didn't already). Following his logic, we'd do away with ANY virtual realism because some crackhead could say, "I trained for *insert heinous crime* by playing *insert ANY game here*". Idiots were saying this about Dungeons and Dragons in the mid to late 1980s. We don't ban board games and dice because of a few retards.

    Is the fact Microsoft has no responsibility over who buys this game. Much like the producer of a movie has no responsibility over who watches his movies. It's up to the PARENTS and retailers to enforce the 17 and over rule. I emphasize PARENTS because the ESRB was not made so retailers could babysit ignorant parents kids. That and what is acceptable to some may not be to others. (I have run across a lot of parents who refuse to let their teens plat Teen rated games) It's out of Microsoft's hands once its for sale. The rating is on it, and if retailers let kids buy it, it's certainly not Microsoft's fault.

    Oh, and lol @ stopping production of Halo 3. That made me giggle.

    Remember back in the day when pro wrestling was king? That shit is marketed to kids like crazy, and I remember how shocked I was when I learned that it wasn't real. I know tons of kids who hurt themselves or others trying to do shit like that, not realizing it was staged. Jack really missed out on a great opportunity to save the children...

    I do target shooting for fun, and I play video games for fun. There is NO relation between firing a handgun and shooting stuff in games, aside from hand-eye coordination. A lot of activities strengthen that so he can't say that improvement of hand-eye coordination leads to murder.
